The Organizational Meeting of the Dryden Town Board was called to order at
8 : 00 A . M . at the Dryden Town Hall . Present were Supervisor McCord , Council -
men Gridley , Cotterill , Tarr and Webb .
RESOLUTION # 1 ZONING ENFORCEMENT OFFICER
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED that this Board renew the appointment of Sibley Stewart as Zoning
Enforcement Officer for the year 1971 at the salary of $ 8 , 000 . 00 .

Supervisor McCord •, made the following appointment : Joan Wallenbeik as
Secretary - Bookkeeper to the Supervisor at a annual salary of $ 3 800 . 00 .
SNOWMOBILE ORDINANCE
Supervisor McCord opened the meeting to discussion regard the Sn . wmobile
Ordinance . He said that if the Board decided to pass the ordinan e at this
time , it would have to be as presented at the Public Hearing Dec - tuber 22 ,
1970 . He said if the Board decided to make any drastic changes oi amend -
ments , it would have to go back to another public hearing and de ay it
that much longer . Supervisor McCord said one thing that bothered him
greatly was the insurance question that is still much in the air He said
t hat Bill Bailey is checking into whether the Town has to buy extra
liability insurance and , if so , how much it is going to cost . He . lso said
another thing that bothered him was the fact that we had to designate the
✓ oads as being " safe " for snowmobile travel . Councilman Tarr relied
411 that in his opinion there is not such a thing as a " safe " road and he
recommended that by keeping the speed at 10 mph , it would make it safer
than having the speed at 20 - 25 mph . Councilman Gridley replied hat he
felt the speedishould stay at 10 mph . The other members of the board were
all in agreement with this issue . Councilman Gridley said that pe haps
it would be a good idea to table acting on this ordinance until t e next
✓ egular board meeting and by that time we might know about the insurance .
There was considerable discussion on the insurance question . Councilman
Cotterill said that he did not see why we would need extra insura ce just
f or snowmobiles . He urged the passage of the ordinance and said the
town did have to pay liability , the board could always rescind the ordinance .
He did not see the necessity of going to another public hearing a d causing
more delays . Councilman Webb was of the opinion that we owed it t . the
people to get something on the books , we could always make amendments and
d esignate other roads at a later date . Supervisor McCord called a tention
to the fact that we were not budgeted for the cost of signs or
ill
insurance or anything pertaining to this ordinance . The councilmen said
that since that was brought up at the hearing and the snowmobilers agreed
to erect signs , we should let this duty to these people for this year .
Also there was discussion regarding the Ceracche Television Antenna
Corporation . Supervisor McCord said he received a letter from Mr . Ceracche '
attorney . They have requested that no snowmobile operate within 1000
feet of the antenna unless the machines are equipped with suppressors . Mr .
Ceracche said they cost about 50ch each and he would be willing to buy them
for the machines . It was noted that the ordinance would not be in effect
until the signs were all up and this too would take time . It was decided
that Highway Superintendent Case. could stipulate where signs should be
and snowmobilers make, erect and maintain signs for this year .
RESOLUTION # 35 SNOWMOBILE ORDINANCE
Councilman Webb offered the following resolution and asked its adoption .
WHEREAS at a Public Hearing duly called and held on the 22nd day of
• December , 1970 , in the Dryden High School , Dryden , New York , for the
purpose of considering the enactment of an ordinance to regulate the
operation of snowmobiles on public highways , and places of the Town of
Dryden , Tompkins County , therefore , be it
RESOLVED that this Town Board of the Town of Dryden enact the proposed
Snowmobile Ordinance with the following addition to No . 9 Section 4 : " No
person shall operate a snowmobile on public or private property within
a 1000 foot radius of the Ceracche . Television Antenna Corporation located
off Snyder Hill , unless such snowmobile is equipped with suppressor " ; and

FURTHER RESOLVED that this ordinance will not go into effect until such
signs as designated by Highway Superintendent Case has been erected on
said highways by various snowmobile groups and verification by Highway
Superintendent Case that the signs have been erected .

he Public Hearing was called to order at the Town Hall by Acting Supervisor
ridley at 7 :. 10 P . M . Present were Councilmen Gridley , Cotterill , Tarr and
debb , Zoning Officer Stewart and Attorney Amdur . Absent Supervisor McCord .
-Acting Supervisor Gridley reported that the purpose of this Hearing was
she application of Walter Blodgett of Webster Cleaners located at 2006
bryden Road , Dryden , N . Y . , to obtain a Special Permit to include snowmobile
gales and service . The notice of the Public Hearing was duly advertised
in the newspapers . .
----n r . Blodgett reported that it will be an addition to their business . They
will use the present building .
Acting Supervisor Gridley asked if there were any questions , being none III
----ft was decided to close the hearing and make a decision at this time .

RESOLUTION # 36A SPECIAL PERMIT - WEBSTER CLEAN : RS

Councilman Tarr offered the following resolution and asked its adoption .
RESOLVED that this Board grant the Special Permit to Webster C eaners
to start a new business of snowmobile sales and service at 2006 Dryden Rd .

. PUBLIC HEARING
The Public Hearing was called to order by Acting Supervisor Gridley at
7 : 30 P . M . at the Town Hall on January 12 , 1971 .
Acting Supervisor Gridley reported that the purpose of this Healing was
the application of Cecil Shulman of 523 Cayuga Heights Road , Itiaca , New
York , to obtain a Special Permit to erect a billboard on his property
located on Route 13 and Etna Lane . This is required by Section 1502 of the -
Zoning Ordinance .
Mrs . Margaret Anagnost was present representing Mr . Shulman who was out III
o f town . She reported that the sign is a Collegetown Motor Lodg = sign that
has been up about six years along Route 13 on Mrs . Hardesty ' s p operty
( Love In ) but the Christian Broadcasting Network wants to put U '• their
sign there so Mrs . Anagnost moved her Collegetown sign about 400 - 500 feet .
She estimated they get 42 % of their business from that road sign . She is
set back further than is required . She also submitted pictures t • lthe Board .
At this time , the meeting was opened to questions or comments from area
✓ esidents . Mrs . Jean Tate read a petition signed by 19 of the property
owners along the stretch of highway that is adjacent to the sign They
objected on the grounds that billboards are detrimental to highway safety
and detract from the senic quality of the natural enviroment . It was also
n oted that this section of Route 13 , particularly at the interse ' tion of
Route 13 and Etna Lane , has a higher rate of accidents than any other part
of Route 13 . Mrs . Ellen Bonn presented a petition signed by 70 residents
o f the Etna area and another petition from the Etna Community As - ociation
signed by 10 members of said association . This petition requested that Mr .
Shulman be denied a permit because of the increased traffic haza ds and
✓ isual pollution . The third petition was presented by Mrs . Selma Nielsen
of 1639 Dryden Road from the Etna Women ' s Community Club which a so
ID
expressed the denial of a permit to Mr : Shulman . Mr . Harrington felt that
the reason there are so many accidents on this road is because t e bill -
boards attract the motorist attention . He said they have tried to get
three signboards out at the end of Etna Lane and it seems no one can do
anything about it . He claimed that is where some of the worst acc dents
have happened . Mrs . Nielsen reported that the first sign that crest up
there was the Kenyon Plaza Motel and it was erected November 11 , 969 and
she reported it to the town office on November 12th and talked to Mr .
Wells . Mr . Wells followed it up and called her and read the lett - r from
them claiming that this was a former billboard . She has lived the e since
1964 and all that has been there until this billboard was erected in 1969
w as two rotted posts in the ground . According to her , this is th ° third
sign erected since zoning went into effect .
Being no other questions or comments , the hearing was declared closed .

JANUARY 12 , 1971
Minutes of the Regular Monthly Meeting of the Town Board of the Town of
Dryden held January 12 , 1971 , at the Town Hall , commencing at 7 : 50 P . M .
Present were Councilmen Gridley , Cotterill , Tarr and Webb , Zoning Officer
Stewart , Attorney Amdur and County Representative Schickel . Absent was
Supervisor McCord . •
The Meeting was called to order by Lewis H . Gridley , Acting Supervisor .
The Meeting was opened with the Pledge Allegiance to the Flag .
Roll Call was by the Town Clerk .
Approval of the Minutes was , held off until the next regular meeting .
COUNTY BRIEFING
Illmrs . Schickel reported that Harris Dates had been elected Chairman of the
Board of Representatives of Tompkins County . Community College : Plans are
progressing . The Architect from the firm that is designing the building
presented the drawings in form of a slide presentation to the County Board
and the building will be one large building but it is to be a " village
type " . The bids for the entrance road has been planned and should be let
very soon . The Community College Planning Board Officials are planning to
meet with the Town of Dryden Town Board and Planning Board and the
Village officials on February 2nd , at that time the plans will be presented .
Dog Warden : Have different proposals on the SPCA , sheriff ' s department and
perhaps the present system will be retained . Dog Quarantine : A 24 hour dog
quarantine is going to be in effect January 15 to May 1st throughout the
county excluding the City of Ithaca . This is at the suggestion of the
Conservation Department because of the harassment of the deer by the dogs .
County Water & Sewer District : Has been suggested by one of the members of
. the board that such a district by formed by the county . Mohawk Strike : This
strike has not been settled and its really affecting the revenue in the
county . TC3 Entrance : Councilman Gridley wanted to know what location
the entrance road is going to be . Mrs . Schickel replied it is to come off
oute 13 abdut where the sign ' is . She is not sure that Livermore Road is
oing to be used for construction . ;
LETTER FROM SUPERVISOR McCORD
Acting Supervisor Gridley read a letter from Supervisor McCord setting
forth a few recommendations for the board to consider , as follows : Designate
one evening a month for public hearings ; preferably the 3rd or 4th Tuesday .
Reconsider the snowmobile ordinance in view of information that will be
presented by Bill Bailey . Establish a firm line of communication with the
officials of Tompkins Cortland Community College . Set a Public Hearing for
February 1st to consider recommended amendments to the zoning ordinance ,
the mobile home park ordinance and amendments to the snowmobile ordinance
if necessary . Lastly , he stated he would like Councilman Gridley and
Councilman Webb to review the 1970 standing committees and make recommendations ;
at the February meeting . .
WILLIAM G . BAILEY - SNOWMOBILE INSURANCE
Mr . Bailey reported that the question is whether or not the town is covered
for liability as a result of the snowmobile ordinance . Attorney Amdur said
there is a question of liability of the town involving snowmobile accidents
o n the highways which we declare safe for snowmobile use . She said even
though we don ' t use the language safe , it ' s there by implication and by
Sreference in the conservation law . She said there will be a bill submitted
to the legislature to limit the liability of the towns . Attorney Amdur had
two questions for Mr . Bailey ( 1 ) are we covered under our general liability ,
1 nd ( 2 ) if not , what liability can we get if any . Mr . Bailey said that under
unicipal Law that no civil action for damages or injuries to persons or
roperties sustained by reason of any highway bridge or culvert being
defective , out of repair , dangerous , unsafe or obstructed unless written
notice was actually given to the Town Clerk or Town Superintendent of
Highways ; and that there was a failure or neglect within a reasonable time
after the giving such notice to repair or remove the defect , danger or
o bstruction complained of . But no such action shall be maintained for
damages or injuries to persons or properties sustained solely and consequently
o f the existance of snow or ice on any highway , bridge or culvert unless
written notice was actually given to the Town Clerk or Highway Superintendent .
Mr . Bailey read the endorsement on the Town ' s policy , as follows : the insurance
does not apply to bodily injury or property damage arising out of the ownershir

maintainance , supervision , operation , use or control of streets including
sidewalks , highways or other public thoroughfare , traffic signs , signals
or parking meters . This exclusion does not apply to bodily injury or
property damage which arises out of and occurs . during the performance of
construction , street cleaning or repair operations . Mr . Bailey said he
did not think there was anyone that could say there is coverage or there
is not coverage for a particular accident involving snowmobiles . Councilman
Cotterill replied that all we want to know if somebody sues , you' re going
to give us the protection . Bailey replied : we are not . Councilman Jotterill
wanted to know what we have liability for . Mr . Bailey replied " Not for the
existance of the streets " . Mr . Bailey said because in Town Law no civil
action shall be maintained against the town , by reason of any highway
accident . Mr . Bailey said we are covered for a road under construction , and .
operation of highway equipment . Councilman Cotterill wanted to know what
we are alarmed about . Attorney Amdur replied that there are two kinds of
liability - one is for a defect in the road and the other is the liability
that may be placed upon the town for taking the positive step declaring a road
open , uncongested and safe for snowmobile travel . According to Attorney 411
Amdur we are taking a positive step . At this point Mr . Bailey said if such
a policy was available he is not sure he would write it and he expects the
cost would be very high .
CITIZENS PRIVILEGE OF THE FLOOR
Harold Case from Varna was present to complain about the rate for the water .
He said when the district was formed , the rate was to go down rather than
up . He said this was not explained by Mr . McCord when they got together last
fall . He said it increased from $ 71 in 1969 to $ 95inow .
Snowmobilers from the Snyder Hill area were present to criticize the Board
for enacting the restriction of snowmobiles within 1000 feet of the r2eracche
Television Antenna without suppressors . They claimed they are unable to
purchase suppressors as no one knows what they are . They said Mr . Morse
failed to show up when tests were being made . They also felt that a member
of the town board should have been present to observe the test . Attorney
Amdur read the results of the tests and said that the radius had been
reduced from 1 / 2 mile to 1000 feet . Councilman Webb explained to citizens
that the Board did not pass the ordinance very easily . He said there was
a lot of discussion and the vote was only three in favor , 1 abstaining
and 1 against . The reason it was passed at all was to give the snowmobilers
a chance to ride on the roads this winter , which sounded feasible at that
time . He further reported that they thought it best to get something on the
books and then put it to a hearing for changes . He said he wanted to make
it clear that this was not a five to nothing vote and that it is not fair
to the other two who did not vote for it to have people say the Town Board
unanimously voted the ordinance in . He felt that we should see what }mappens
this winter and study it next summer and make changes . Mrs . Underwocd from
Snyder Hill submitted a list of roads they would like opened to snowrrobile
traffic if and when there are changes made in the ordinance , as follows :
Besemer Road , Gehung Road , Landon Road , Whitted Road and Snyder Hill Road .
Attorney Amdur reported as it stands right now , we have an ordiance passed
but it does not take effect until all the signs are up which we haven ' t
begun to do .
COUNCILMEN PRIVILEGE OF THE FLOOR
Councilman Cotterill suggested that the Zoning Officer take the present book
and try to bring it up to date , get houses numbered , etc .
RESOLUTION # 37 DIRECTORY •
Councilman Cotterill offered the following resolution and asked its adoption .
RESOLVED that thid4Board authorize the Zoning Officer to take the present
directory with him during his travels about the town and try to cover
these roads and bring it up to date and all future permits number them
as they are issued . .

Village Board and Village Planning Board will be working with Tompkins
Cortland Community College officials at a informational meeting to discuss
primarily the road entrance off Route 13 and other things . The meeting is
to take place on the 2nd of February at 7 : 30 P . M . at the High School Library
Room .

ATTORNEY
Attorney Amdur said she would like to reverse something she said earlier .
Re the effective date , she was going under the impression that the ordinance
w as not in effect until the signs were up and that is not correct . The
o rdinance shall take effect immediately upon publication and filed with
the Conservation office . She further reported that it does not say that
it is not effective until the signs are up . It says " no snowmobile shall
be operated under the provisions hereof until the signs and markers are
installed " . The suppressor part would be in effect . She was under the
impression that the ordinance itself did not take effect until the signs
are up . '
Attorney Amdur reported that there are two hearings that must be set . One
is the Mobile Home Park Ordinance . The draft has been completed by the
Planning Board after numerous hearings and the other hearing for amendments
to the zoning ordinance . She reported that the Planning Board has requested
• some definitions be put into the zoning ordinance . She suggested that they
hold a meeting to discuss this before they hold the public hearing . Council -
man Tarr suggested that the Town Board meet with the Planning Board on
this issue . Attorney Amdur thought that perhaps the snowmobile ordinance
could also be discussed at that meeting . It was finally decided to set a
informational meeting with the Planning Board on the 19th of January at
7 : 00 at the Town Hall . It was decided to set the public hearings on the
1st of February .

He reported there were 15 public hearings conducted by the Town Board and
11 conducted by the Zoning Board of Appeals . Twenty - five violation letters
were sent out , ten had to be turned over to Justice Court . Zoning Officer
Stewart further reported that his hours for 1971 will be 9 : 00 A . M . - 1 : 00 P . M .
on Tuesdays , Thursdays• and every Saturday from 9 : 00 A . M . - 12 : 00 Noon .
Mondays , Wednesdays and Fridays by appointment . He also reported that he has

Zoning Officer Stewart reported that he has heard from Mr . Dixon from the
State , Building Code . Mr . Dixon strongly recommends that the town adopt
the State Building Code . He suggested amendment to 1801 , to require
a building permit before they could change use of a building . As it is now ,
if they don ' t add to or extend or enlarge , they don ' t need a permit .
Attorney Amdur asked Mr . Stewart what was he going to inspect because we
h ave nothing in the ordinance that says they have to have certain fireproofing
and walls , etc . She said the question is whether we are going to request
a building permit everytime we change the use .
LETTERS
A letter from the Department of Transportation was received in which they -
h ave allowed the speed to be reduced to 35 mph on Lower Creek Road . They
d id not find that the speed should be reduced on Upper Creek Road . One
copy of the completion notice must - be returned to their office stating
the date the speed limit was posted .

D iscussion centered on the application of Cecil Shulman to erect a bill -
board on Route 13 . Councilman Cotterill said he came to the conclusion
that a lot of people would be happy if we got rid of some billboards , not
add . Councilman Webb felt that the Zoning Officer should check into the
other two signs that were reported as illegal , particularly the one they
claim just went up . Councilman Gridley suggested that Mr . Stewart look
into this and report back at the next regular meeting . Councilman Cotterill
said that he was not for allowing the billboard to be erected 0n - the - grounds
of the public opinion in that it causes traffic hazards and is determintal
to public safety and welfare .

The recessed Town Board Meeting was called to order by Acting Supervisor
Gridley at 7 : 10 P . M . at the Dryden Town Hall on January 19 , 1971 . Present
were Councilmen Gridley , Cotterill , Tarr & Webb . Absent Supervisor McCord .
Acting Supervisor Gridley inquired as to what was on the agenda other than
snowmobile business .
Councilman Webb reported that he talked with Supervisor McCord on the
phone . Supervisor McCord requested that a meeting be held with members
of the board on the following Tuesday or sometime during next week . It
was decided that a meeting would be held on the 26th day of January at
the Town Hall at 7 : 30 to go over information on the forthcoming public
h earing . Councilman Webb said that at that time Supervisor McCord will
probably discuss setting a date for a public hearing re snowmobile ordinance .
c • Councilman Webb reported that we can not rescind the ordinance without a
h earing first . Supervisor McCord requested that the board take no action
on the snowmobile ordinance tonight .
William Underwood from 361 Snyder Hill Road said they have the suppressors
on their machines and it has not changed the television reception one bit . '
He gave ah example : one Sunday his set was just as clear as could be during
the day and that evening he could not even see the people on the screen
and he positively stated that there was not one snowmobile in operation
that evening because it was so cold . Mr . Underwood expressed dissatisfaction
with the test that were made at the antenna site . He claimed he watched
the television set up in the shanty by Ceracche and said there was a lot
of distortion in the set whether the machines were running or not - the
picture was still the same according to Mr . Underwood .
Councilman Gridley reported that Superintendent Case said they had to go
up an additional two feet on the building and he got in touch with the
contractor and was quoted a price of $ 300 extra . .. ' . .
Zoning Officer Stewart had some estimates from other printers for

Councilman Webb wanted to know when the Collegetown billboard would be down .
Zoning Officer Stewart reported that Mrs . Anagnost had called him and wanted
to know if she could leave it up until she talked to her attorney . The Town
Clerk reported that she had called Monday and said it would take about a
week to get the billboard down . Councilman Webb suggested that Mr . Stewart
f ollow this up . Zoning Officer Stewart reported that the other sign had hot ;:
been followed up . He found a letter in the file to Mr . Wells claiming that
the sign had been there since 1963 . He called D . B . Harrington about the
Hillside Inn sign and it was up before zoning because he recalled trying
• to get rid of it . It seems it is on state property and the state does not
h ave money to follow it up . Councilman Gridley expressed hope that Mr .
Stewart would be able to take pictures of various spots where in doubt
' and keep watch . .

February 1 , 1971
Supervisor McCord called the Public Hearing to order at 7 : 35 P . M . . t the
Dryden High School Lecture Room on the 1st day of February , 1971 . ' resent
w ere Supervisor McCord , Councilmen Cotterill , Tarr , Webb and Gridl : y ,
Zoning Officer Stewart , Joseph Clancy - attorney from Helen Amdur ' -
o ffice ; also present approximately 15 citizens of the Town of Dryd : n .
Supervisor McCord reported that the purpose of this hearing was ( 1 to '
present the suggested amendments to the Town Zoning Ordinance and 12 )
to present the proposed Mobile Home Park Ordinance .
Supervisor McCord reported the first change would be in Section 18 . 1 ,
page 10 of the Zoning Ordinance . He reported that there will be essentially
two additions . The first addition after the phrase : enlarged or exuended

"or any work commenced that will change the present use of any building "
w ithout a Building Permit , etc . The second addition will become the last
sentence in Section 1801 , as follows : ' Said permit shall be posted . r
displayed in a conspicuous place and shall be visible from the nea ( est
public road . " No questions or comments followed regarding these clanges .
Supervisor McCord reported that the next change would be in Sectio 1502 ,
No . 7 , page 8 of the Zoning Ordinance . He reported that the follow ng
w ill be added after deleting the end period : " if located upon the and
and 50 square feet if located on the building " . The next suggestion
✓ egarding this same section is to delete No . 9 entirely and No . 10 will
become No . 9 . Supervisor McCord reported that No . 9 presently statrs :
Temporary sign for advertising the sale or rental of services or goods : one
sign , 4 square feet . This is what will be deleted from the Zoning ordinance .
Mr . Relyea from Varna said he was wondering if people are computinr the
size of that sign . He said in considering this in signs that adver ise a
large farm for sale , commercial buildings , or whatever it might be , he felt
hat the Town is talking about a sign which is relatively smaller han
robably 50 % of the signs advertising commercial real estate in thr Town
f Dryden at the present time . Supervisor McCord replied that wouls come
ender billboards . Supervisor McCord further explained that we are r nlarging
` It to 50 square feet if the sign is located on the building . He reported
---=that this is to allow a little more flexibility .
Supervisor McCord reported that the third change would be in Definitions ,
page 12 of the Zoning Ordinance . Addition , as follows : FACTORY - MAN FACTURED
STRUCTURE : A factory - manufactured structure or a pre - fabricated st ucture
u sed for year round human habitation , and having a floor area of n • t less
than 900 square feet and having a width or length of not less than 24 feet ,
shall be considered as dwelling or a dwelling unit for the purpose . of this
ordinance . This definition came under fire from Mr . Relyea . He said that
particular definition sounded like it was just dreamed up . Supervisor
McCord said that this definition was recommended by the Zoning Boaid of
Appeals . Mr . Relyea said they have definitions tb •_ bouer modular ho e that
are acceptable by the Federal Housing Administration and he urged ailing
it modular structures not factory -manufactured structures . He said a
factory - manufactured structure could be anything . Example : a buffer building
could be made into livable space . He did not think the definition onforms
in any of the existing acceptable definitions being used throughou the
whole industry . This was discussed at length . Mr . Relyea suggested that
definition be stricken and he expressed the desire that ordinances be of
the same type of ordinances acceptable throughout the financing . stiucture •
w ith commercial lending institutions and governmental agencies'.
At this time Supervisor McCord read the definition of a MOBILE HO 1 as
presently in the Zoning Ordinance , page 13 . The recommended definition :
MOBILE HOME : A . .vehicle either standing on wheels or with wheels re oved
and resting on cribbing , ties , blocks or a wall and used for year round
human habitation . A mobile home shall not be considered to be a d elling
o r dwelling unit for the purposes of this ordinance . Mr . Relyea o . jected
to this definition . He said it was not necessary to mention tires , etc .
He noted that mobile homes and modular structures are elgible for FHA and
VA loans and the definition becomes very important to this communi y and
to the people who live here .

Supervisor McCord reported that the final definition on the listIl was .
STRUCTURE . He read the definition as presently in the Zoning Ordinance ,
page 13 . The recommended change : STRUCTURE : Anything constructed or
erected with a fixed location on the ground or attached to something
having a fixed location on the ground . Structures include , but are not
limited to buildings, walls and fences over six feet in height , radio
towers , swimming pools , billboards , poster panels and signs . The
following shall not be classified ' as structures for the purposes of
this ordinance : fireplace chimneys , flagpoles and antennas . There were
no questions or comments on this change .
Supervisor McCord noted receipt of a letter from Mr . and Mrs . Thomas L .
Bond regarding their recommended changes in the zoning ordinance . It
was received to late to be taken into consideration at this hearing .
III PUBLIC HEARING
Supervisor McCord opened this hearing at 8 : 15 P . M . for the purpose of
reviewing the proposed Mobile Home Park Ordinance for the Town of
Dryden that was presented by the Planning Board to the Town Board .
Supervisor McCord said that perhaps . the best way to proceed would be
to assume that everyone . who is interested in this proposed • ordinance has
read it and move through it section by section and discuss any parts that
are questionable .
Section 3 - C . Mr . Schwan inquired , as to how do we define permanent . He
suggested that the following . be stricken : " there will be no permanent
structures on individual mobile home lots other than a storage building
and a carport " . Mr . Portzline and Mr . Relyea both commented on this
sentence and why it was in the proposed ordinance . They , too , suggested
it be stricken . Mr . Schwan did not think it was pertinent . He wanted to
know if they were going to take that sentence out and put it down under
H . Mr . Schwan said that under the definition of a mobile home , that is
a permanent structure and . he did not know what they mean by " permanent
structure " in C . Mr . Schwan said the point . he was making - is as the
definition says , your • not referring to the definition in H . Supervisor
McCord said he did not think the ! intent there was not to not permit
these kinds of additions . Alton Reed reported that they should refer •
to Mobile Home Stand E . Mr . Relyea said what we are talking about is
a parcel of land for the placement of a single mobile - home for exclusive
use of its occupants . According Ito him , that is what a mobile home lot is . . : ..
and suggested that the garbage be cut out of it .

1 . Internal Street : It was requested that after " Right of Way " it be
inserted : for renters in park .
Section 4 . Procedures for Application for Permit : Discussion centered
on the requirement of a 1 " : 100 ' scale . Mr . Relyea said that a scaled
drawing ibr '. a proposed mobile home park of 50 sites would cost on the
average of $ 150 per site . He agreed that a sketch would be very nice for
a preliminary layout , but he did not think they should require something
drawn to scale . He recommended that requirement be stricken from the
proposed ordinance . He said at the final hearing then engineer :' drawings
would be necessary . Mrs . Caldwell , member of the Planning Board , reported
that the Planning Board wanted a drawing that was acceptable . It was noted
that the preliminary application is for the Planning Board to review at a
411public meeting , after recommendations is presented to the Town Board for
a Public Hearing . The Planning Board can only recommend for or against a
park to the Town Board . The final decision rest with the Town Board . Mr .
Relyea felt that the Town Board should have a time limit to act on the
Planning Board ' s recommendation . Mr . Hardesty did not see the need for
the Planning Board to regulate him . Supervisor McCord explained that the
; . P. lanning Board is an aid to the Town Board to provide recommendations to
the Town Board . Someone in the audience recommended eliminating 1902 of
the Zoning Ordinance . No reason given .

5 . 01 . Mr . Schwan inquired as to the definition of a mobile home development
street - the paved area , the right - of-way area or what : He referred to
6 . 02 and inquired what difference . Mr . Relyea said it depends entirely
on the type of park that is designed . If the engineer designs in - street
parking , then there is going to be wider streets than if he designed to
have parking which is adjacent parallel to the mobile home site . He felt
that people are getting on pretty dangerous ground when they try to
design a mobile home park with this ordinance .

The question was asked why can ' t B , C and D be eliminated : nd make one
simple statement such as : the mobile home has to be so far from the
paved portion of the highway or the center of the highway or off- street
parking , recommended 15 or 20 feet from the edge of the pa ement .
5 . 02 Storage Buildings on Individual Lots . Mr . Schwann recommended taking
out the two words " is allowed " . Supervisor McCord said th s will be
studied . .
5 . 03 Skirts . Mr . Schwan recommended adding after withing 60 days , " weather
permitting " , after arrival in park .
5 . 04 Parking Areas . It was called to the Board ' s attention hat this
definition came from the Zoning Ordinance , page 13 .
5 . 05 Landscaping . Mr . Relyea felt that the PPlanning Board s ould not have
anything to do with this . He wanted to know on what do we b .: se . our right 0
to require landscaping . He said that it is required in one nstance and
n ot in another ( see Sec . 905 Zoning Ordinance ) . He said the. ' this was
d iscrimination .
6 . 01 Access . Mr . Schwan said the Town is confusing a mobile home park
✓ oad with a town road . He said that when you talk about a r ght of way ,
h e is lost . His recommendation for on- street parking : 9 fee on each
side and 18 foot road equals 36 feet .
6 . 03 Lighting . It was discussed and recommended that the following be
deleted : " mutual agreement with Planning Board and " - making it read , as
follows : Lighting shall be provided . by the park developer .
Section 7 - 7 . 01 Water - General Requirements . Mr . Schwan re : d the following
sentence : where public water is available , connection shall ' e used
e xclusively , unless the Tompkins County Health Department de ° m otherwise .
Mr . Schwan said : never ! They do not want to come out and tesi any more
samples than they have too . He said if he was building a ne mobile
h ome park and public water was available he would be tickled to death .
Mr . Portzline said he did not wantiany part of it , he said h ; has spent
h is hard earned money and that is the way he wants to remain .
Section 8 - 8 . 01 Electrical Distribution System and Individu - 1 Electrical
System - General Requirements . It was suggested that " Under riters " be
deleted and add " local electric power .
8 . 02 Specific Regulations . Mr . Schwan recommended deleting en ire provision
because it is going to be obsolete .
• Section 9 ' - 9 . 03 Gas Supply - Natural . It was recommended to , elete
I . " engineering practices " and add " utility company practices " .
9 . 04 Liquified Gas . It was recommended to delete " rear " of mobile home .
Section 10 - Recreational Area and Open Spaces . Mr . Relyea ano Mr . Portzline
objected to this section . They wanted to know what does this •' o for the
park , the people and the Town .
Section 14 - Effective Date . Mr . Schwan pointed out an error should
read : This Ordinance shall be in force and in effect immediately , etc .
Supervisor McCord thanked everyone for . comming and said that tiere _ ,will
be other hearings on the Mobile Home Park Ordinance before it s adopted . (11
