PUBLIC HEARING

September 8 , 1970
Supervisor McCord called the Public Hearin; to order at 7 : 35 P . M . Present
were Supervisor McCord , Councilmen Gridley , Cotterill , Tarr and Webb . Also
present , Attorney Amdur and Zoning Officer Stetaart .

_ Supervisor McCord reported that the purpose of this Public Hearing was a
request for a Special Permit to enlarge Mr . Cy Ortin ' s gas station . on the
corner of Mt . Pleasant Road and Route 13 in Varna . This is a requirement
of Sec . 102 and 1301 of the zoning ordinance . At this time Supervisor
McCord turned the floor over to Mr . Ortin . Mr . Ortin explained that he would
abbe adding on a . new bay on the existing two bays that are on the building .
It will be adjacent to it on the west end of the . building . The deminsions
are 15 ' 4 ' x28 ' : The. building will be of cinderblock and will have an over -
head door and two windows facing the west side . Supervisor McCord asked if
anyone had any questions . Mr . Ivan Clark was present and wanted to know
the set back requirement from the highway right of way . He was told that it
is 10 feet . It was also noted that Mr . Ortin ' s plans indicate that its 30
feet to the right of way . " .. . . _ - . . Mr . Clark expressed doubt that its •
that far from the right of way . Set back requirements were discussed at
length . Mr . Ortin further explained that Mr . Wells issued him a permit to
construct about lk years ago and he thought that was all he needed and
began construction after zoning went into effect . He claimed he was not
aware that he needed a permit to build . He was under the impression that the
report of new construction was his permit . Supervisor McCord said that Mr .
Wells did not issue permits to construct , but notices of new construction ;
these were primarily for assessment purposes . Councilman Gridley suggested
that the zoning officer check out the measurements . Being no other questions ,
Supervisor McCord suspended this hearing to open the next hearing .

PUBLIC HEARING - KEECH
Supervisor McCord called the Public Hearing to order for Mr . Robert Keech .
Mr . Keech appeared requesting a Special Permit for the purpose of leasing 42.: I
space for a new business in his present building on Route 13 . ' He said that �; i �ixs
he would like to lease to Travis Westbrook , an office equipment sales and A�i,r� a '.
service business , from the Ithaca area . He mentioned ' the possibility of a ,=. :, h�-
small food cart' out service but he was not certain about this as yet . The 4,: ..
space that Travis Westbrook would be using would be 800 sq . feet with optio ; ' y
for additional 800 sq . feet directly behind . Travis Westbrook will be
located in the extreme east part of the building . The carry out food service
• will be housed in 450 sq . feet in the west end . The laundromat is 24x65 and
there are apartments overhead, Supervisor McCord asked if there were any
questions or comments , being none the hearing was closed . !

that Bone Plain Road is posted 5 ton limit yet these trucks ar traveling
this road . Supervisor McCord said he will talk to Highway Supe intendent .
Case and County Highway Superintendent Howard Stevenson . She a so asked
the Roard if the West Dryden Association could dispose of the • ooks since
n o. one seems interested in getting the books out of their building . Super -
✓ isor McCord said it was all right to dispose of the books .

Mr . Edward DiGiacomo also complained to the board about the debris / strewn
along Bone Plain Road and Neimi Road .
• Mr . Francis Munch of Varna was present to complain about the in omplete
w ork during the sewer installation . He claimed he wrote a lette _ to the
Town Board last winter and never got any response from it . He want on to
e xplain that on Freese Rd . during the installation of the sewer line the
contractor filled a ditch in and this caused considerable hards . ip tohim .
H e claimed he got water in his basement from it . He reported th t he used
h is backhoe and spent some four hours uncovering the piece the ewer workers
had broken off and covered up . He said he did not feel the town should
✓ eimburse him , but felt that the sewer contractor should . He sa . ' d he talked O
to Gary Lee several times and Mr . Lee promised him that he woul have the •
✓ oad superintendent clean it out . Dick Case came down twice and looked at
it and told him that the machine was broken down . Supervisor. Mc ord said he
could not recall that particular letter and suggested that Mr . lunch send a
copy of the original letter to the Town Board . Supervisor McCori did mention
• that they held a meeting in Varna with the contractor , engineer , members of
the board and residents of the Varna area who had registered co plaints with
the Town regarding the sewer installation .
It was noted that the contractors have done nothing to rectify I erb Snow ' s
damages . Attorney Amdur said Miller was suppose to give a writ en report
and has not done so yet .
BUILDINGS AND GROUNDS : Nothing to report this month . Councilma Gridley mentiol
ed Sewer District in Varna forward recommendation to operate th • equipment .
SANITATION AND REFUSE : Nothing to report this month . Heard about problems
from the West Dryden residents as reported earlier .
PUBLIC RELATIONS : Nothing to report this month .
COUNCILMEN PRIVILEGE OF THE FLOOR : Councilman Cotterill reported that he
{ has not heard anything from the Dryden Jaycees regarding a town directory .
ATTORNEY : Attorney Amdur reported that she had two deeds ; Deer Haven Road
. from Alton and Jean Reed and South Knoll Drive from Clinton Cotterill .
RESOLUTION # 1246 DEER --HAVEN - ROAD / •
Councilman Cotterill offered the following resolution and asked its adoption .
RESOLVED that this Town Board approve Deer Haven Road subject to final approval
of Title by Attorney Amdur and final approval by Highway Superintendent Case .

RESOLUTION # 1256 SOUTH KNOLL DRIVE
Councilman Gridley offered the following resolution and asked is adoption .
. RESOLVED that this Town Board approve South Knoll Drive subject to final
approval of Title by Attorney Amdur and final approval by Highway Superintenden
Case . -

TOWN CLERK:: Mrs . Stelick reported that an Ordinance Book had b - en started 410
in 1963 but had not been brought up to date . It was advised tha • the Town
Clerk update the Ordinance Book .
ZONING OFFICER : Zoning Officer Stewart reported that he had is - ued 12
permits and 2 violations since the August Board Meeting . He ask - d the
Board if they want to stick to the numbering at every 50 feet o as the
ordinance calls for 125 feet . Supervisor McCord replied that the new
numbering system was based on a 50 foot numbering system and , th - refore ,
felt that we should stick to it .

LETTERS
Supervisor McCord read a letter from the Soil & Water Conservation District
regarding the possibility of Tompkins County joining the existing seven
counties . He requested that Councilman Cotterill represent the Town of
Dryden at a meeting to be held September 9th .

Supervisor McCord read a letter from the Mayor of the Village of H . mer
requesting the cooperation of the highway department while traveling
through the Village of Homer . This letter will be turned over to ighway
Superintendent Case .
Supervisor McCord read a letter from the Department of . Transporta ion to
Connie Cook regarding the status of the relocation of Route 13 . T e project
information report and map will be on file in the Town Clerk ' s Office and
is available for inspection . It was requested that the Town expre '. s their
✓ iews and comments within 30 days as a public hearing will be pub ished
in the near future .
O LD BUSINESS :
Mr . Hank Ross , Representative from the Xerox Corporation , did not appear .
Supervisor McCord turned this over to Buildings & Ground Committe - and •
requested that they check into prices for buying amalXor leasing a photo
copy machine for the town office and report their findings at th October
Board Meeting .

Supervisor McCord reported that the town incurred $ 500 worth of • amages in
Water District # 1 that were unrecoverable by insurance and this ecessitated
the District borrowing $ 1 , 000 to make the bond payment . The town expects a
check in the amount of $ 407 . 14 for the damages covered by insura ce . This
n ote is for a 6 month period .
Supervisor McCord reported that Tompkins - Cortland Community Coll ge has
announced that theybb e lan to start construction at the Dryden sit next spring
and hope to be in/ t fall of 1972 .
NEW BUSINESS :
RESOLUTION # 13049 PUBLIC HEARING - FIRE CONTRACTS
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED that a Public Hearing be scheduled for September 29 , 1170 , at
7 : 30 in the Town Hall for the discussion of Fire Contracts .

RESOLUTION # 1313 APPOINT DRUG COUNCIL
Councilman Cotterill offered the following resolution and asked its adoption .
RESOLVED that this Board appoint a Drug Council for the Town of Dryden , as
follows :

Supervisor McCord recessed the meeting at 9 : 40 P . M .
Supervisor McCord readjourned the meeting at 9 : 50 P . M .
Supervisor McCord called on Stephen Shulman regarding his app ication for •
a special permit to construct a trailer park on Hanshaw Road . Mr . Shulman
appeared asking approval of the special permit so that he cou d start
construction . Supervisor McCord remarked even though the Boar • does have
approval of the plans by the State , the Board does not have a ything from
the Tompkins County Health Department . Mr . Shulman explained hat the plans
w ent to the County first and they sent the plans to the State for approval
because it was over so many units . The State approved the pla s and sent it
back to the County and that is where Mr . Shulman got them . Th County gave
h im a copy of what the State had done . George Guest requested that Mr .
Shulman give him plans as to how the water and sewer trenches were going to
be laid and the clean- offs for the sewer . Supervisor McCord equested a
written statement that the Tompkins County Health Department approves of the
State plan ' that construction can start on these plans that ave been sub -
mitted .

RESOLUTION # 132e SPECIAL PERMIT - SHULMAN
Councilman Cotterill offered the following resolution and asked its adoption .
RESOLVED that this Board grant the Special Permit to Stephen Shulman to
construct a trailer park on Hanshaw Road subject to the approval of the
Tompkins County Health Department , and be it further RESOLVED that a
Special Permit be granted for the laundromat subject to being open only during
the hours the manager is on duty .

RESOLUTION # 13313 SPECIAL PERMIT - KEECH
Councilman Tarr offered the following resolution and asked its adoption .
RESOLVED that this Board grant the Special Permit to Robert Keech to lease
space to the commercial use limited to sales and services and excluding
manufacturing and heavy industry .
2nd Councilman Cotterill Roll call vote - all voting YES
Supervisor McCord suggested that the Board defer a decision on Cy Ortin
until the Zoning Officer can ascertain the set backs and that the drawing
that was submitted was accurate .
RESOLUTION # 13413 SPECIAL PERMIT FILE
Councilman Gridley offered the following resolution and asked its adoption .
RESOLVED that this Board authorize the Town Clerk to set up a " Special
Permit File " .

lirupervisor McCord asked if there were any additions or corrections to
the minutes of the August 11th Board Meeting . Being none the minutes were
approved as entered .
The next regular board meeting will be October 13 , 1970 at the Town Hall .

PUBLIC HEARING
FIRE CONTRACTS
September 29 , 1970 .
The Public Hearing was called to order by Supervisor McCord at 7 ; 35 P . M .
at the Dryden Town Hall . Present were Supervisor McCord , Councilmen
Gridley , Cotterill , Tarr and Webb .
Supervisor McCord read the terms and amounts of the contracts with the
designated fire companies to the 15 people present , as follows :
A . VARNA VOLUNTEER FIRE COMPANY , INC .
1971 - $ 6 , 000
1972 - 7 , 000

1975 - 9 , 000
B . NEPTUNE HOSE COMPANY NO . 1 , INC .
Annual sum of $ 10 , 000 for two years

2 . For such service the Town of Dryden shall pay to the Company the

3 . The district shall be responsible for any loss or damage to its
fire apparatus sustained in answering any such calls .
4 . The McLean Fire Department , Lansing Fire District and Brooktondale
Fire District shall be responsible for payment of all claims or injuries
to or death of firemen in connection with such calls .
5 . The contract shall continue for designated years, commencing January 1 ,
1971 .
6 . Such other incidental terms as may be necessary or proper with such
contracting .
At this time the Brooktondale Firemen reported that they were requesting
$ 161 ? : 50 annual payment and they would like the contract to run for two
years not five years as reported in the notice .
Being no other corrections or objections from the floor , Supervisor McCord
closed the Hearing at 8 : 15 P . M .
