HomeMy WebLinkAbout1970-06-02 32 June 2 , 1970 PUBLIC HEARING The Public Hearing was called to order at 7 : 10 P . M . at the Town Hall in Dryden , New York . Present were Supervisor McCord ; Councilmen Gridley , Cotterill and Tarr ; Zoning Officer Stewart ; Acting Zoning Officer Wells ; and Attorney Amdur . . Supervisor McCord stated that the purpose of the Public Hearing was to h ear a request of Mr . Clayton Cranmer for 2i' 2 the Town Board to grant a Special Permit to construct a trailer park on his land located off Mill Street in Freeville , New York . Requirement of Section 802 of the Town Zoning Ordinance . A notice of this hearing was duly advertised in the Ithaca Journal and Rural News . At this time , Supervisor McCord opened the hearing to questions concerning Mr . Cranmer ' s request . Mr . Cranmer ;; ! '! asked that it be called a mobile home park , not a trailer park . Councilman III � r1Vr' ' Cotterill asked to see the plans . Mr . Cranmer stated that he gave them to • `, „t:g ;. Mr . Wells . Supervisor McCord said that he hadt_ the plans and passed them to Councilman Cotterill . Councilman Cotterill questioned Mr . Cranmer if the Planning Board had been shown the plans or if he had discussed it at all w ith the Planning Board . Mr . Cranmer said he had only discussed it with Mr . Wells . Supervisor McCord said that we do have one letter that is a -fit ; ;: ;:,, copy of one that was sent to Mr . Cranmer by Richard J . Wilsen . The letters ,. _, reads as follows : " Dear Mr . Cranmer : Please be advised that I am against 314G your proposed trailer park project on Mill Street in Freeville , New York . A project of this type is not in character with the neighborhood and would tripu lower the values of existing properties . A more detailed letter will follow . Sincerely , Richard J . Wilsen " . Copies of the above letter was sent to the Town Planning Board and Town Zoning Commissioner . Supervisor McCord said that there is , at least in Mr . Wilsen ' s opinion , some objection to the mobile home park , but Mr . Wilsen did not appear at this hearing so j ' aia:ri '. he 'didn ' t know exactly what he means and another letter did not follow . RqN Mr . Cranmer did not receive any other letter either . Supervisor McCord =, . ,, asked Mr . Cranmer if Mr . Wilsen owned any land in the neighborhood . Mr . '�� ' . ; Cranmer replied that he owns a small piece of swamp and brush east of my land , therefore , he is an adjoining property owner . He further noted that T.' there is four houses in the area . The location of the property owned by Mr . Cranmer is north of the creek . Mr . Cranmer talked with Mr . Wilsen over the phone and at that time he did not object to the proposed mobile h ome park , then two days later he received a letter objecting to it . He h as not talked to the other neighbors , but said that they were aware of ' h is intention when he bought the property five years ago . His intention is to put in five trailers at this time . He has been approved by the Health D epartment for five trailers . Zoning Officer We 1 review the whole project w ith Mr . Cranmer on the basis of what we have / BY 0r£ eerbT eHome Park Ordinance . The ordinance is only proposed and the Planning Board is still w orking on it . In his opinion as the ordinance stands now , it pretty weld! complies with the proposed mobile home park ordinance . Mr . Wells was satisfied that it complies . Being no further questions , Supervisor McCord closed the Public Hearing for Mr . Clayton Cranmer . Supervisor Mc.C. ord told Mr . Cranmer that the Board will deliberate and make a decision and n otify Mr . Cranmer in writing . Mr . John Arnesen owner of Cycle City failed to appear for a Public Hearing ✓ egarding a request for a Special Permit to build a building on his property . Adjourned at 7 : 25 P . M . • SPECIAL MEETING Attorney Amdur had a deed ; in connection with a subdivision owned and d eveloped by Mr . Duane Hurlbutt ; to a road designated as Sunset West Circle . The Planning Board has approved the subdivision and Superintendent Case has approved the road . I •.r.„ RESOLUTION # 103 SUNSET WEST CIRCLE Councilman Tarr offered the following resolution and asked its adoption . RESOLVED that this Board accept the deed to Sunset West Circle as a town ✓ oad in Mr . Hurlbutt ' s development . 2nd Councilman Gridley Carried . , 1 1 33 11 RESOLUTION # 104 AUTHORIZATION FOR SEWER # 2 Councilman Gridley offered the following resolution and asked its adoption . RESOLVED , that Charles G . McCord , Supervisor of the Town of Dryden , be and h e hereby is designated as the authorized representative of the Town of D ryden , Sewer District No . 2 , and authorized to execute any necessary documents in connection with said sewer district . 2nd Councilman Cotterill Carried Attorney mdur reported that she had a meeting with Edward P . Holt , Community &E8a9 : 8n Representative of the New York State Narcotic Addiction Control Commission . He has conducted several programs in the last two days at the Dryden School . He is very interested in any group efforts or town "" councils being formed in areas and he will make himself available for coun5e.ltation at any time . It was suggested that the Town Board hold a • general meeting at which the presently formed committee .: 'iould be invited to attend and any other persons who are interested in the narcotic situation . Then possibly a council could be designated . Mr . Webster , who is on the Tompkins County Narcotics Council Committee , has worked with the Ithaca Narcotics Council and he has indicated that he would make himself available for any help that we might need . Supervisor McCord said that this is the d irection that the Town Board should take and stressed that a meeting be set . aIt " was decided that June 25th at the High School would be the designated meeting date . .. This date has been confirmed as being available for the Town to hold a meeting regarding forming a narcotic council . It will be an. informational meeting how the town should approach the drug situation . Supervisor McCord noted that Mr . John Arnesen , owner of Cycle City , was scheduled for a Public Hearing and has failed to appear . He spoke in favor of pbstphoning the Public Hearing until such time as he appears . Officer Wells tried to call him and there was no answer . Peter Levatich , Chairman of Zoning Board of Appeals , was present and ask if the building was already up . Supervisor McCord replied that is correct . Mr . Levatich said and he d oesn ' t have a permit yet ? Supervisor McCord replied yes , and the building - is done . Mr . Levatich feels that an injunction is in order . Supervisor McCord r replied that as far as the Public Hearing is concerned , we are here to get information . The Board can take that action , but not during the Public Hearing . The Public Hearing is to get reasons and rational`.wwhy this occured . Attorney Amdur said that this did not appear to be a willful act in that the owner thought the contractor got the permit and the contractor thought the owner got the permit . Mr . Levatich feels that the board should take a good look at this situation and set a good example . D . Councilman Cotterill offered the following resolution and asked its adoptioh RESOLVED that this Board dismiss the application of John Arnesen for failure of the owner to appear . 2nd Councilman Gridley Carried Supervisor McCord requested the Zoning Officer to draw up the necessary papers regarding the violation of John Arnesen . He may be punishable by a fine of $ 50 for the first offense . • Councilman Gridley nominated Merton Webb and Joseph Peterson for consideration for the Town Board . At this time Supervisor McCord read a letter from Harold Roberts , chairman of the Town of Dryden Democratic Party , regarding the resignation of Thomas Todd . Mr . Roberts noted that Mr . Todd had moved out of the Town some two months ago before it was announced that a vacancy existed on the Town Board . He further stated that June 2nd was to be an automatic election of a Republican farmer and that the Democratic Party would be submitting a qualified candidate in the November elections . RESOLUTION # 106 APPOINT MERTON WEBB Councilman Gridley offered the following resolution and asked its adoption . RESOLVED that this Board appoint Merton Webb to serve out the unexpired term of Thomas Todd to December 31 , 197 / .1 2nd Councilman Cotterill . Carried 3 4 . • Supervisor McCord expressed concern about Mr . Wilsen ' s objection to M . Cranmer ' s request for a Special Permit to construct a mobile home parr . Supervisor McCord said that he was not prepared to discuss it without further discussion with Mr . Wilsen and other neighbors , - since they ha . not been notified of the Public Hearing . He suggested that the Board refer decision until the next Board Meeting . Councilman Cotterill suggested that the Planning Board should review this and make comments for or agains . Supervisor McCord objected on the grounds that small mobile home park . are undesirable scattered throughout the town . RESOLUTION # 107 SPECIAL PERMIT - CRANMER Councilman Gridley offered the following resolution and asked its ad . ption . McCord , Supervisor Rosemary Stelick - Town C erk • fr • June 9 , 1970 Minutes of the Regular Monthly Meeting of the Dryden Town Board held June 9 , 1970 , at the West Dryden Community Center , commencing at 7 : 30 PM . Present : Charles G . McCord , Supervisor Clinton Cotterill , Councilman Henry Tarr , . Councilman . Merton Webb , Councilman • Sibley Stewart , Zoning Officer Helen Amdur , Attorney Marion Schickel , County Representative Absent : 4,e,e ) UED / ' • co Lewis Gridley , Councilman Recording Secretary : Rosemary Stelick , Town Clerk • The meeting was opened with the Pledge Allegiance to the Flag . Supervisor McCord introduced himself and thanked the Greater West Dryden Rural Cooperative Association for their hospitality for providing their building for the Town Meeting and particularly to the men ' s club , who had to reschedule their meeting . Supervisor McCord also introduced the members of the Board , Councilmen Tarr , Cotterill and Webb . Mr . Webb is the new council - man replacing Tom Todd . He further introduced Helen Amdur , Town Attorney and Rosemary Stelick , Town Clerk . Supervisor McCord asked the Town Board if there were any corrections or additions to the Minutes of the May ; l2th Board Meeting . Supervisor McCord noted to the Town Clerk that it was not necessary to have a resolution for approval of the minutes . Being no other additions or corrections , the minutes were approved as sent out . COUNTY BRIEFING - Mrs . Marion Schickel Narcotics Guidance Council : Mrs . Helen Amdur was appointed to this council to fill the vacancy of AlJier. t. Bedworth . Tompkins County Water Agency : The members to this agency were appointed and Harris Dates announced the members . They are as follows : William ,Sullivan and Michael Robinson , represent - ing the City of Ithaca ; Mayor Herbert Marcham for the Village of Cayuga Heights ; Walter Schwan , Town of Ithaca ; Edward LaVigne , Lansing ; Charles McCord , Town of Dryden ; Robert Dempsey , Groton ; Clifford Northrup , Ulysses ; Kenneth Georgia , Enfield and Newfield ; and Ernie Cole , Caroline & Danby . The Agency will have its first meeting on Tuesday , June 23rd at 10 AM . Southern Tier Planning . Board : The county has become a member of this board . It is comprised of seven counties of whch are mostly to the east and the south of us . A budget has been established at $ 3 , 125 . 00 . Fifty per cent of this may be reduced by the County ' Planning Board rendering services to the Regional Planning Board and Appalachiar Development District . By putting in this budget we will become a active member of this board and also part of the Appalachian Local Development District . This board and district helps us into looking into g grants that might be available to the county . . Youth Affairs : Chairman Dates asked Mr . Webster • I to head up a committee on youth affairs , and to come up with ideas for jobs for young people . Mr . Lee suggested that perhaps they be used in clearing . brush around the airport . Airport Clearance : The county is going to award a bid to a company that will come and cut about 98 acres of trees that are going to be cleared at two ends of the airport for clearance for runways . This bid just takes care of the cutting of the trees , not the clearance . Bulldozer Purchase : A bid was awarded for a bulldozer which will be utilized •Akin the sanitary landfill wheich we are in the process of setting up for this area . The county will own the bulldozer . Rat Control Program : Dr . Broad , spoke about the program that the, County might be elgible for . It would carry through to a lot of baiting of rats in the dumps . No action has been taken on this program yet . Federal FoodA . Stamp . Program : This program has gone into effect as of June 1st . The local distributor in this area is the First National Bank of. Dryden . People who are , elgible for this program should get in touch with the Dept . of Social Services in Ithaca . A family of four with a net income under $ 350 is elgible . It . enables people to purchase the stamps for about $ 75 and may be able to buy over $ 100 worth of food . CITIZENS PRIVILEGE OF THE FLOOR Mrs . Schickel reported that she came over the South George Rd . bridge tonight - to get to the board meeting and its in very poor repair . The traffic has been generated by the opening of the Holy Cross Church on that road . Super - visor McCord told her that we have written and have not heard anything from the railroad as yet . j Mr . Ray McGee from North Woods Road reported that he could not receive his mail as long as the road sign " CLOSED " is up . • NIMMENna 36 Mrs . Layaw .frawthe Upper Creek Road in Etna was present to protest the landfill site on Caswell Road . She is of the opinion that a du p is not n ecessary due to the fact that the road is not in good enough ondition to handle the increased traffic . Mrs . King from the Upper Creek Road in Etna was present to cal , the Board ' s attention to the poor condition of the Upper Creek Road . There is only one stop sign at the intersection of the Etna Road and Upper Creek Road . She feels that a stop sign is necessary on both roads , there is onl one stop sign and no speed limit . On her side of the Upper Creek Road th - dirt has kept . breaking away from the road until there is no shoulder and there is also a deep hole there . She cited an accident that happened the . e very ✓ ecently whereby a tractor wheel dropped in the hole and tipped over , both the driver and tractor landed at the bottom of the hill in the creek . There is no guardrails on either side . She talked. to Mr . Case a d he was u naware that it was in such condition , but she said that it had been this • w ay for years . The road was inspected just a week ago and she q estions the accuracy of the inspection . Supervisor McCord said that we depend on information like this from everybody , that is the only way we ca be aware of this kind of thing . He noted that he would pass this information on to Superintendent Case and he further noted that he did not have the power to dictate to Superintendent Case as to what he must do . He can tur the information over to Mr . Case and its up to him . Mrs . Jeanne Vanderbilt from West Dryden expressed concern about ' mpr. ovements to the road in the event the dump is operated on Caswell Road . She also inquired about the dirt road on South Woods Road being closed whel people live there . Supervisor McCord told her she would have to find thi . out from Superintendent Case . Mr . John Rowe from Schwann ' s Trailer Park inquired as to the stat s of h is request for a reduced speed limit on Schwann Drive which is a 50 mile • zone . He wrote a letter to Gary Lee , former Supervisor , about a y = ar ago . H e has compained several times to State Police and was told that ' t was open road . Supervisor McCord said he was not familiar with his situation , but would find out what happened to his request for a reduced spee • on Schwann Drive . Mrs . Sandra Fenner from Bone Plain Road was present to ask what procedure was required in order to change the name of a road . Supervisor McCord said that a petition signed by residents of the road was necessary and be presented to the Town Board . CASWELL ROAD - LANDFILL SITE Mr . Frank Ligouri from the County Planning Board was present and showed a film entitled " THE TROUBLE - WITH TRASH " . This film showed the variou . ways and means of present and future methods' of waste disposal . The sani ary landfill method is the method most communities are using at the pre . ent . This method involves excavation of holes and each day as the refuse is taken in , there will be a bulldozer on the site to compact the refine and will be covered with fill daily . According to Mr . Ligouri it is truly a sanitary method and the least expensive method for now . The futur = method being considered by some cities is the shredding method . Syracuse is currently using this method . Mr . Liguori said the Caswell. Road site is a good one and meets the requirements . There will be no operation wi hin 600 feet of the highway and there will be no odor . It will serve residents of the Towns of Dryden , Groton and Lansing . The cost of the operatio will be somewhere around $ 2 . 00 per ton . The cost of the operation will be • covered by the taxes levied on the taxpayer at a cost of about $ 2 - $ 2 25 per person per year . The life use of the dump is about five acres pe year . The dump will be open six days a week , time is not definite yet . The e w ill be no special charge except to Cornell University and Ithaca Co lege because they are tax exempt . He further stated that the dump should be o perating by the 15th of July . Councilman Cotterill asked what should w e do if the dump is filled to capacity before the 15th . He said the • ump o n Johnson Road is just about as full as it can get and definitly will be full by the 1st of July . Mr . Ligouri said in the event that this s ould happen , then the Town should contact Dr . Broad and perhaps he would allow the Collins dump to be reopened until the County opens the Caswell site . Mr . Ligouri noted that there will be a bulk site at the dump for the purpose of disposal of bulk items , such as cars , stumps & brush , refrigerator - , etc . Periodically a salvage company will come in and buy the bulk refuse f om the town . o) 4 At this point Supervisor McCord introduced the new zoning officer , ,Sibley Stewart . Robert Wells reported that he has been working with Mr . Stewart . Mr . Wells reported that he has been getting quite effective results and he is making people aware of a zoning ordinance . Mr . Blodgett has been taking truck loads of old cars out of Bone Plain , Midline Road and West Dryden area . Many people are not aware of how fast the town is growing . Speaking as a former tax assessor , he reported that the town has had a growth of about two million dollars of new construction a year over the past three years . Cooperation of the people has been excellent in most cases . Bob Keech from Etna wanted to know about zoning violators ; he is aware of two buildings and one fence being built without a permit . Mr . Wells said that he has been in contact with many violators and they are being dealt with . Supervisor McCord urged the people if they were aware • of any violators of the zoning ordinance they should turn them in to the Zoning Officer . PETITION - PROPOSED MOBILE HOME PARK ON MILL STREET Mr . Richard J . Wilsen of Mill Street , Freeville , was present to protest the Town Board ' s decision to grant a Special Permit to Clayton Cramner to construct a mobile home park on Mill Street . He showed the zoning map to the public in attendance and pointed out that this was an allowed use by Special Permit in an RC zone . He further pointed out that the biggest share of the Town of Dryden is zoned RC . Mr . Wilsen passed out a signed petition ( by some 30 people ) to the members of the Board whereby they were requesting the Town Board to revoke the Special Permit to Mr . Cramner . Prior to this hearing , the policy had been to send post cards to the n eighbors informing them of a public heartly .In this case , . no post cards w ere ever sent and none of the neighbors knew of the public hearing . Mr . Wilsen was aware of a trailer being on Mrf Cramner ' s property at one time , but as far as he could determine no utilities were serviced to the trailer and it was there for only a short time . The petitioners are against the trailer park for the following reasons : = - ; Mill Street is presently composed of single family homes . The proposed trailer park w ill lower the value of these homes and the trailer park will Create ' . fl an atmosphere of economic obsolesence . Mobile homes are not real estate . It would be introducing a commercial use into a residential neighbor - hood . Mr . Cramner ' s frontage on Mill Street ? appears to be extremely n arrow . The entrance to the trailer park is on a steep curve in the road creating a hazard to drivers . The Mill Street bridge over Fall Creek is a one lane bridge . The soil conditions of this land is very poor . The drainage from the septic system will end up in Fall Creek . - - - Mr . Dickenson wanted to know if there was any chance that the Board might ✓ econsider their decision . Attorney Amdur reported that the only notice I . required by law is a five day notice in the official newspaper , this also applies to the Zoning Board of Appeals . The Board can not revoke the permit . The only option that the Board would have is if there are any circumstances which have arisen since the first decision was made or some misstatement o f the fact at the first hearing . The legal notice was published in both the Ithaca Journal and the Rural News . Mr . Wells said that there are very few places in the State that send out post cards . This was his policy n ot a requirement of the law . This was discussed at length and Mrs . Amdur said if there wasn ' t zoning , Mr . Cramner could have put in his trailer park without answering to anyone . Mr . Wilsen questioned whether Mr . Cramner had met all the requirements for a special permit , sec . 1303 of the 0 ordinance . He said that Mr . Cramner called him on the 25th of May asking him if he could put in a large trailer and at that time he had no objection , then Mr . Cramner told him that he was going to put in four more trailers and that Mr . Wilsen object too . That is why he wrote the letter to the Town on the 28th of May and to Mr . Cramner . An unidentified man from Mill Street said that he was told by Mr . Cramner , when he bought the property , that he was thinking of a camp site . Mr . Cramner noted that a travel trailer park would create more noise and more traffic than a permanent mobile home park . And he further commented that it is not going to be a trailer park , but a mobile home park . Hugh Chaffin knows that area very well and said that the land is wet and saturated most of the time and in his opinion not a very good location for a mobile home park . RESOLUTION # 108 REHEAR CRAMNER APPLICATION Supervisor McCord offered the following resolution and asked its adoption . RESOLVED that this Board schedule a rehearing on Clayton Cramner ' s application for a special permit to construct a mobile home park to be held at the Town Hall , June 22 at 7 : 00 PM . 2nd Councilman Tarr Carried 38 Supervisor McCord announced that a Public Hearing would be held June 18th at 7 : 15 PM at the Town Hall for the proposed trailer park of Mr . George Van Epps , to be located on Hanshaw & Neimi Roads . Councilman Gridley arrived at about 11 : 00 PM . Residents of the West Dryden area wanted to know what parks had been approved and what parks are being proposed for the West Dryden area . Supervisor McCord reported that Rocco Lucente ' s Mobile Home Park had been given approval to be constructed on the Upper Creek Road ; Stephen Shulman is preparing his plans for a proposed park on Hanshaw Road and the pro - posed trailer park by Mr . Van Epps that is scheduled for a public hearing on the 18th of June , this to be located on Hanshaw and Neimi Rds . STANDING COMMITTEES Buildings & Grounds : Councilman Cotterill has talked to Superintendent III Case regarding additional parking at the Town Hall , also an addtt .ion to the town building . There is nothing concrete as yet as they are trying to get more information on costs . Councilman Gridley reported that the grounds need " to be taken care of , the grass needs mowing . Sanitation & Refuse : Councilman Cotterill has talked to Mr . Collins regarding the Johnson Road dump filling up ; he is willing to work with the town to solve any problems that may arise . Public Relations : Nothing to report this month . COUNCILMEN PRIVILEGE OF THE FLOOR Councilman Cotterill contacted the Jaycees about the directory . They will discuss it at their meeting so we should be hearing something in another month . He will follow this up . Councilman Tarr , ):uggested that perhaps the Civil Officers of the Town could have theirl'duties expanded to cover some of the duties of zoning . Attorney Amdur said that she would check and find out if there is any incompatibility of officers , but we might be able to appoint one part - time as assistant zoning officer . ATTORNEY Attorney Amdur reported that the insurance company has finally agreed to pay damages to the third person concerning; the water break in Varna . The cost of the repair to the pipe is not covered by the insurance company and is the Town ' s responsibility and expense . Councilman Cotterill inquired if it covers the cost of replacing the trailer and Attorney Amdur said she did not think we submitted a bill for that , she would check . Attorney Amdur reported that we do have a problem in the Town involving drugs . The will be an informational meeting held by the Town at the Dryden High School in the Small Lecture Room ( Room C13 ) on June 25 , 1970 at 7 : 30 P . M . for all persons and groups who are interested in this problem . Out of the larger group , which will include the already formed Dryden Committee , eventually there will be a Town Narcotic Council . The purpose is primarly education of the public , both children and adults . Mr. s . King suggested that Danny Taylor , a former addict , is going around and giving talks on drugs . He talks the language of the kids . He can be contacted at RD 2 , Freeville . TOWN CLERK • Mrs . Stelick announced that Grievance Day will be on June 16th from 3 - 7 at the Town Hall . It was also noted that on the 11th of June , 9 - 1 and 3 - 7 , there will be a question and answer session with representatives from the Assessment Department . Forms for review of property assessment are available at the Town Clerk ' s office and must be filled in for the Assessment Review Board . The Board is made up of a member from the Assessment Department , Town Supervisor Charles G . McCord and County Representative Mrs . , Marion Schickel . FINANCIAL REPORT Supervisor McCord passed out the financial report and offered a copy to anyone . 3 RESOLUTION # 109 HIGHWAY BILLS Councilman Gridley offered the following resolution and asked its adoption . RESOLVED that the Highway Bills be paid as audited . 2nd Councilman Tarr Roll call vote - all voting YES RESOLUTION # 110 GENERAL BILLS Councilman Cotterill offered the following resolution and asked its adoption . RESOLVED that the General Bills be paid as audited . 2nd. Councilman Webb Roll call vote - all voting YES COMMUNICATIONS Attorney Amdur received a call from Mrs . Monroe regarding a dog kennel of • a neighbor , Mrs . Dodge . It seems they have fenced in two dogs and she was inquiring if this was in violation of the zoning ordinance and if she has a kennel license . It is not a violation of the zoning ordinance . Mrs . Stelick reported that to secure a kennel license the dogs must be registered and it is at their option whether to have a kennel license or just an ordinary dog license . Present were Councilmen Gridley , Cotterill , Tarr and Webb ; Zoning Officer Stewart and Attorney Amdur . Absent , Supervisor McCord . D eputy Supervisor Gridley noted that this was a second public hearing for a special permit to construct a mobile home park on Mill Street in Freeville N ew York . At this time , Mr . Gridley opened the hearing to questions . Mr . Cranmer presented a letter to Mr . Gridley which he instructed the Town Clerk to read , as follows : " To : The Town Board of the Town of Dryden June 16 , 1970 • On June . 2 , 1970 , a Public Hearing was held at the Town Hall and discussion was had concerning the limited special permit tnat you were granting for five mobile homes on my property located off Mill Street , Freeville , New York . RESOLUTION NO . 107 was entered upon the minutes with reference to the granting of the special permit to me as follows : Councilman Gridley offered the following resolution and asked its adoption . RESOLVED , that this board grant the special permit to Clayton Cranmer to construct a five unit mobile hom e park . Seconded by Councilman Cotterill . The voting - Councilman Gridley - YES ; Councilman Cotterill - YES ; Councilman Tarr - YES ; Supervisor McCord - NO . I am at this meeting only for the reason that6the meeting has been called , but I feel that inasmuch as the special permit was granted to me that this meeting should not be held since the special permit had never been revoked or annulled and until such , the special permit granted June 2 , 1970 is still in force and effect and this meeting is not in order . For the record , I would like my objection noted and this letter submitted shall constitute my objection to such a meeting in view of the circumstances . I would like to state further that the petitioners who signed the petition presented by Mr . Wilsen are not proper parties to this proceeding . It is submitted that only about four of these people who signed the petition liveiin the immediate area and that the other people are not aggrieved by anything that happens in this area because to be aggrieved , a person must be specifically , personally and adversely affected as distinguished from one who is in the general class of a taxpayer and whose only interest is to have strict enforcement of zoning regulations , and there must be some special injury or damage to one ' s personal or property rights . I do not feel that with this limited number of mobile homes , there is anything which will materially affect properties in this area and I specifically request that the special permit be issued to me , since I would like to commence work as soon as possible . I will personally live in my own mobile home on one of these sites . In the future , if I apply for an additional permit to develop more mobile home sites on this land which ; incidentally , I purchased five years ago with the idea of constructing a mobile home park , then at that time I feel that anyone materially affected by my proposal will have the right to come in to object at that time . Signed. Clayton 0 . Cranmer . " • At this time , Mr . Cranmer stated his :dside of the story , as follows : H e plans to operate a park mainly for semi - retired and retired people . They are more permanent tenants and keep their mobile homes and lawns n eater . The retired tenant drives slower and leaves the park only once or twice a week and sometimese gone for weeks at a time . By having this park for retired people he will not be adding to the extra burden . of the school district . He has worked 11 years off and on for Taggin Wagon Park in Varna . rIn answer to objections that were heard at the Board Meeting on June 9 , 1970 ; The polluting of Fall Creek : The permit from the Health D epartment states that when there are three or more mobile homes , the e ffluent must be chlorinated after leaving the sand filter . The effluent w ill be more pure than that coming from a single residence ; Lowering the value of adjoinjng or nearby properties : The Shaeffers have an old barn and shed at the rear of their property . The barn has a hole in the roof and in a run down condition . They keep their property neater than any of the other three families surrounding Mr . Cranmer ' s property . The VanSykes 0 41 property is , tO.. _ . the ` eastrof : the pr. oposede park driveway and is barely visible through the tall grass and bushes . Mr . Cranmer doesn ' t think the lawn has been cut more than once or twice this summer if at all . Adjoining the Cranmer property to the east , and west of Mill Street is part of the Wilsen property . This parcel of land for the most part is brush lot and swamp . Mr . Wilsen lives across the street and at one time had a mobile home set up on his property near his house . Mr . Chafin lives north east of Cramner ' s property and the lawn is neglected , the grass gets quite high . West of his property is all farm land and woods . In Mr . Cranmer ' s opinion , a mobile home park would not lower the value on the surrounding properties . Mobile homes are assessed as real property ; The curve in the road : Mr . Cranmer ' s drive - way being on the curve allows one to see a safe distance up and down the road when leaving the park . The only difficulty is when one approaches from the south to enter the park driveway . Mr . Cranmer feels that the town could cut the bank a little farther back and allow better visibility . Mr . Cranmer "' allowed the Board to view pictures of the above properties . j Mr . Carl Tripp owns property between Mr . Cranmer and Mr . Shaffer , and is not opposed to Mr . Cranmer ' s application . He was not asked to sign the petition , nor was his daughter , Mrs . Maxwell , who lives on the same road . A letter from Joseph M . Borowitz dated June 22 , 1970 was read by the Town Clerk , as follows : " Some three years ago , or longer , Mr . Cranmer purchased the land for which he is seeking a special permit to install five or six trailers . The entire village population of Freeville was aware of the fact that he purchased this land ' :. arid for what reasons and intentions this purchase was made . Mr . Tripp , the previous owner , was quite aware of the intent as well as the residents on Mill Street , I firmly believe . Mr . Cranmer contacted my firm to construct a roadway into the project site which is where the contested entrance is presently situate . The road construction was performed at that time . I was of the opinion that Mr . Cranmer was going to do this work by himself and in his spare time , there - fore , the road was only constructed for a distance of approximately eighty feet . Since that time I believe that he has spent consider - able time and effort in the process of developing the property for the above purpose . Since that time , as we are all aware , the Town of Dryden Zoning Ordinance has come into being . I feel that the Board should consider the facts as above stated in rendering their decision for the issuance of a special permit for the proposed trailer park . If there has now been issued Health Department approval for these units , I cannot see why they would contribute any more pollution ' to Fall Creek than five or six single residences . I do , however , question - the feasibility of the added cost of site development for such individual home sites on this particular tract of land . Since most of the Town of Dryden is zoned " RC " I do feel that . the Board should exercise their perogative of issuance of special permits to trailer parks with discretion , and I am confident that this will be . done . Vacant land with no adjacent home sites should be given a higher consideration for trailer parks than areas in which homes have already been established . In the case of Mr . Cranmer , however , may I recommend that special consideration be given by the Board inasmuch as this project had been begun several years ago and , in my opinion , would be a hard - ., ship to this man in the event you chose to deny the issuance of the permit for the few units he has proposed . " Mr . Richard J . Wilsen was present to address the Town Board and fellow residents of the town as the representative of most of the residents on Mill Street in Freeville . They are against the proposed trailer park by Mr . Cranmer on Mill Street . This trailer park will change the character of the neighborhood which is agricultural and residents on large lots according to Mr . Wilsen . He further noted that this will be against the zoning ordinance which is to promote the health , safety and general welfare of the community . Mr . Wilsen said that a trailer park in a RC zone is not in agreement with the district regulations for an RC zone as set up in Article Eight , Page Six of the Town Zoning Ordinance , as follows : " The intent and purpose of the RC zone and the following regulations is to identify and establish areas where farming is one of the principal economic activities , where residential and other development should be compatible with farm use , and where rural residential development on large lots may be necessary to keep densities low in areas where public sewer facilities are unlikely , to limit development 42 in those areas having steep topography or a high water table which inter - feres with the proper operation of sub - soil sewage disposal facilities , and to establish uses compatible with existing development . " Mr . Nilsen also read the following " General Requirements " as set forth in the ' oning o rdinance , Article Thirteen , page eighteen : " Uses by Special Permit , where provided , shall be subject to the requirements of this section in audition to the requirements of the zoning district wherein located , to prevent conflict with or impairment of the principal uses thereof . Such use , shall be deemed to possess characteristics of such unique form to the district that each shall be considered as an individual case . The Town Board ✓ eserves to itself the right to consider and decide whether a Special Permit shall be issued in each individual case . " Mr . Wilsen said t at all the residents on Mill Street will be affected if the Special Pe . mit is granted . In his opinion the trailer park will impare the develop ent o f this area . Mr . Wilsen showed slides of. Mill Street and the curve in the ✓ oad . He further reported that the bridge on Mill Street is a one lase bridge and that the entrance to the trailer park will be just below he • curve . He also reported that the soil condition of that land accordi g to a soil survey of Tompkins County dated July 1965 indicated it to be ground wet silt loom which is a wet , poorly drained soil . He did not feel that Mr . Cranmer would stop at five trailers . He wanted to know if a y thought had been given to what would happen to the resale value of t surrounding properties . Mr . Wilsen , being a real estate broker , personally feels that the properties will decrease in value . The petition given to the board was signed by 28 people who will be directly affected by this trailer park and was a mistake and not in the best interest of the neighborhood . They thereby petition the Town Board to reverse its decision and rev ike the Special Permit immediately . Bob Keech of Etna was present and said that he was at the West Dryde board meeting and listened very carefully to Mr . Wilsen . He said that he c . uld n ot see a better entrance on that road than the one Mr . Cranmer. selected . A person coming out of that driveway will have to turn his head 40 degrees to the left or right to see directly up or down that road . It is a better e ntrance that if one was entering on a straight - a -way . Mr . Keech said that o n a straight - a - way , if it was on your side of the road , on the in - si e where you had to turn more than 90 degrees it would be much worse . He asked ) Mr . Wilsen how can you improve turning onto this road anymore on the land in that corner . Mr . Wilsen replied if you were to come down from West Dryden Road and if you are going to enter the site of this park , you 'gave to go over to the left . Mr . Keech replied that he hasn ' t seen a car m .: de yet that won ' t turn sharp enough ': so that you have to turn into anothei lan6 . He didn ' t think Mr . Wilsen had any argument there . Mr . Wilsen replied that if you were coming up from the village of Freeville , this curve is b1 nd and the entrance is just below the curve . Mrs . Wanda Wilsen reported hat in the winter the snow is high and the road is narrow and that its a ery bad corner . Mr . Relyea raised the question if there were five houses being built on this land to improve the whole neighborhood , would they use _ n ,y different driveway than will be used for this mobile home park . Mr . Wilsen said he didn ' t know . Mr . Relyea said that the mobile home park does n . t constitute any greater risk than if five new houses were there and ha the same amount of traffic using the road . Mr . Wilsen replied that if Mr . Cranmer was here this evening going for a sub - division , I would raise the same question . Mrs . Wilsen said that Mr . Cranmer has said that he wants to put in fifty trailers and he is not making that known tonight . Mr . Relyea said that the park if increased will improve the economic base of the community . nd broaden the tax base . Mrs . Wilsen said it would not help the school si uation and will add to the burden of overcrowding the school district . According to a national survey , there are 2 . 1 school children living in mobile h mes . 411 Mr . Relyea reported that Taggin Wagon has 21 school children out of 21 f' esidents . He said that most people who live in mobile homes are youn ; n ewlyweds and retired people .. There are five times more children coming o ut of the newly constructed sub - division than there are in a trailer ' ark w ith the same number of units . At this point Deputy Supervisor Gridley ✓ eminded the people that the present application is calling for five trailers . Mrs . Wilsen said that any tax advantage received from Mr . Cranmer will be more than taken up by the disadvantage of the school system . Mr . Relye : asked to comment on the tax structure . He said that it is a proven fact by a study group at Cornell University and by the Ithaca Journal that mobile home .: and mobile home parks in Tompkins County are paying more than their. fair s _ are in taxes . Mr . Wilsen , speaking as a real estate broker , is concerned wish ✓ alues of real estate and his opinion is that if you start putting in ' railer parks , no one is going to build a home . Trailers are not real estate , hey depreciate and they spoil the character of the whole neighborhood . 43 Tom Fox from Mill Street asked the Board what would . keep Mr . Cramner from increasing his park to 50 or more trailers . Attorney Amdur replied that if he is given the permit it would call for 5 trailers . He would have to make an additional application for a permit and go through the same pro - cedure . Attorney Amdur said that it is a allowed use in an RC zone subject to obtaining a special permit . At this point , Mr . Relyea commented that he would like to clear up a point of confusion in that there is a difference between a trailer park and a mobile home park . A trailer park is usually a travel trailer park . A mobile home park generally is specifically designated as a single family dwelling occupied on a year around basis . A modular home is a mobile home built in sections . He said that people that are so desperately in need of housing today are people with modest incomes in terms of low cost housing and that a majority of the people buying mobile homes are college people and elderly people on limited incomes . He also felt that any community that even suggests • the outlawing of mobile home parks or fails to property locate mobile home parks in the community is denying the very people that service the community . Hugh Chaffin lives across the road and objected to the fact that the trailer park will be located so close to Fall Creek . IIe said that the ground is wet and full of springs and that it is not a suitable place for trailers nor suitable for disposal of sewage . He did not feel that five trailers there would affect him seriously . Mr . Cramner said that he had drained the area where the trailers would be located and that the land there was dry and Mr . Chaffin was welcome to come and drive his car around in the area . Mr . Keech said that he did not think that the discussion on the sewage should be brought up at this meeting , that it was up to the Health Department . If there is effluent draining out , the Health Department will either close down the park or tell Mr . Cranmer to increase the chlorination .. Mr . Chaffin did not agree with Mr . Keech , he said that we can ' t depend on the Health Dept . or anyone else . Mr . Fox reported that there is effluent going into Fall Creek at the present time and the Health Department has ' done nothing to correct the situation . Mr . Cranmer said that with three units or more that it has to be chlorinated and its on the permit that he gave to the Town Board . Mr . Wilsen wanted to know if there is a zoning ordinance to regulate mobile home parks . Attorney Amdur replied that there was not such an ordinance as yet , but a proposed trailer ordinance had been submitted to the Town Board by the Planning Board but it is not yet complete and has not been submitted for action . The Board can not delay the : applicant a hearing if the mobile home park complies and Mr . Cranmer has arranged these mobile homes in the park to comply with the proposed trailer park ordinance . Mr . Keech said that he agreed with the thoughts and the way the majority of the Town Board voted . Mrs . Wilsen wanted to know if any thought had been given to the number of these parks that is being allowed . She felt that we are going to be wall to wall with trailer parks between Dryden and Ithaca . Mr . Gridley said that the zoning ordinance does not have any limitations . Mr . Keech said that the demand will give that answer . Mr . Wilsen called the Board ' s attention to the trailer park that is being constructed in Etna . This park has not helped the property values one bit . According to him , there are more homes listed for sale than he has ever seen there before . He questioned what is going to happen to these homes . He is afraid of this trend and people wanting to get out . __ Mr .. Cranmer said that the most common reason given by ' the people that ' move : . i ntc, mobile home is because they can ' t afford the burden of taxes on a house . 1 Mr . Relyea said that they have a large grou p of retirees in their park . They are people who planned their retirement yearLago and they reached the point where the tax burden and the burden of living in a urban community and maintaining a home is greater than their present income allows . For the most part people living in trailers are either young people just getting started or older people trying to preserve what income they have . Mr . Wilsen requested to summerize that he had a petition signed by 28 people living on Mill Street and they strongly feel that if this permit is granted it is definitely going to change the character of the neighborhood and they are very much against this . Mk i 44 Mr . Gridley reported that he received a phone call about 6 : 45 this evening from Mr . and Mrs . Glenn Stafford wishing to vouch for Mr . Cra mer ' s integrity and high ideals . Mr . Cranmer worked for them for se ' eral years and they were confident that he would operate a good mobile home park . Mr . Wilsen noted that in the zoning ordinance for a special permit there are seven requirements that an applicant must present to the zoning officer , sec . 1303 , page 19 , and he wanted to know if this had been don - . He was told that the zoning officer had all that information . Deputy Supervisor Gridley felt in the absence of Supervisor Mc ord that the Board should not arrive at a decision until all could get . ogether . Mr . Gridley requested Mrs . Gridley - Dep ty Supervisor Rosemary Stelick - Town Clerk 1 • 45 PUBLIC HEARING VAN EPPS ( RUMSEY - ITHACA ) June 18 , 1970 The Public Hearing was called to order by Supervisor McCord at 7 : 15 P . M . Present : Supervisor McCord , Councilmen Gridley , Cotterill , and Tarr ; Attorney Amdur ; Zoning Officer Stewart ; Absent : Councilman Webb . Supervisor McCord stated that the purpose of this Hearing was to hear from Mr . George Van Epps , president of Rumsey - Ithaca , for the application of a Special Permit to construct a mobile home park on Sheldon and Neimi "" tRoads . At this time , Supervisor McCord turned the floor over to Mr . Van Epps . • Mr . Van Epps called attention to the fact that Rumsey - Ithaca has been in business in the Ithaca area since 1922 and that they were not a fly - by - night outfit . They intend , if permission is granted , to construct 'a trailer park on Sheldon and Neimi Roads . Their intention is to build in sections of fifty units at a time . The sewer system was approved June 1st by the Health Department and will accomodate the whole park . The present water supply will only accomodate fifty units . There will be a grocery store , laundermat , sales store and proper landscape . Roads are going to be oil penatration and there will be concrete sidewalks . There will also be rules . The grounds will be kept clean and orderly and there will be no animals . There will be no garbage cans in view . Each unit will be on a concrete pad and tied down . There will be a 4x10 storage unit at the end of each trailer for garbage cans , lawn mower , etc . The main entrance will be on Neimi Road and two other entrances on Sheldon Road . Many of the trees presently on the property will be transplanted . The present tax yield is $ 155 school , $ 54 town and county . Assessment will be based on $ 550 per pad or $ 3500 per occupied pad . The tax yield will be $ 17 , 000 - $ 19 , 000 . The town will have no problem of garbage collection and no roads to maintain . Street lights will be provided , &Tie . . , . • - ' light for every two trailers . The average size trailer will be 12x65 . There w ill be a distance of 12 feet between trailers . Concrete carport will be provided . Lots will generally be 50x100 , with .5 foot taken off for the u tility section . There will be two trees on each property line . Shrubbery will be distributed between trailers . The roads will be 35 feet wide . Side - w alks will be 3 feet wide . There will be 12 feet between fronts of the trailers . Approximately 20 - 22 feet rear distance with a 10 foot corridor . A distance of 34 feet between the units . A recreation area will be provided 1300 feet down from the road . He said they had worked many months with the Health Department before final approval . He noted that they were very strict . He tacked the drawing of the sewage set -up to the bulletin board and and called attention to it . He told the members of the Board and neighboring ' ✓ esidents of the area that the sewage lagoon is located on 1 . 5 acres . The mainline is going to be 8 ft . pipe and have a 7500 gallon capacity for 50 trailers . At the run - off point of the lagoon is a chlorinator . The swing trap controls level of the water . There will be a chain link fence around the dike . There will be no odor from the septic tank . Larry Snow , occupant of a trailer in the area , asked how often the septic tank will be cleaned out . Truman Powers , Attorney for Rumsey - Ithaca , pointe � yy , out on the map a note to the effect that the septic tank is to be cleaned i' ?, � out once a year more often if necessary . He considered this a vital issue in that this detergent will bezFt flowing to Fall Creek and adding to the pollution problem . He had this checked out at Cornell and they claim there is nothing to cut detergent . He encouraged the Board to check the regulations of the Health Department . Mr . Van Epps reported that the effluent will flow through the Saroka lands to a small stream . The lagoon is down in the swamp . William Dilliger of Neimi Road questioned what is the use of all this water going to do to the water table . Residents of the area claim that they have had problems getting a sufficient supply of. water . Mr . Van Epps said that he could not answer at this time Jeanne Vanderbilt said that it all depends on what vein and at what level . Mr . Van Epps said that they have a very good supply of water , 1500 gallons per hour . John LoPinto said that the answers to these questions could ' be provided from the Water Resource Committee and T . G . Miller . 46 L arry Snow wanted to know how much odor will be errupted from the sewage systems not counting the prevailing winds from the west . Mr . Van Epps answered that information from the Engineers only calculates as to size , this only concludes that there will be noi , od. or . Ron Kelly asked about excess water run - off . Mr. Van Epps replied that it w ill be in the town ditch . Mr . Kelly said that some time ago the Town made a ditch 3 feet wide and ends at this property and he gets all the cans and trash that washes in . Mr . Van Epps assured him that there will be a maintainance man to take care of this . . Mrs . Wanda Wilsen voiced the opinion that this trailer park will mean more school children and will add to the burden of overcrowding in our school system ( which is presently experiencing an overcrowded situation ) and will increase teacher needs . She claimed that all the money raised in taxes will be used to pay for three new teachers . Mr . Van Epps replied that the trailer park will cater first to retired couples and then to n ew families . He also said that when the family enlarges they move out and II' buy a house . He hardly expects to have many children . Mrs . Wilsen replied o that the taxpayer should not - have to pay the brunt to educate these children . J eanne Vanderbilt had an article from the Ithaca Journal dated December 17 , 1969 , which states in part that Schwan trailer park is paying more than their share of taxes ( $ 7 , 732 ) per child ( total 33 ) , than it cost to educate them . . D on Bailey expressed concern what it is going to do to his taxes , he is surrounded by the whole level . He wasotold to contact Tom Payne and he could get the information from him . Mr . Bailey also wanted to know about the ditches for drainage . Mr . Van Epps replied just as it is on a city street , no more . L arry Snow expressed concern regarding a failure in their line and if the 0 possibility of contamination could occur . Mr . Van Epps replied that there w ill be manholes every 400 feet . The :sewer line is at different depths . Sewers will be interlocked and below the frost line . They will be using transit pressure pipe . Requirement is that the septic tank must be 100 feet away from any well . °John LoPinto said that he does not oppose this proposed trailer park provided that it iai11 not endanger any ones property . He felt that the questions asked by the people should be answered and that the meeting should be adjourned until ° such time that Mr . Van Epps can provide the answers to the questions asked by the people . Attorney Amdur reported that there is a separate definition of a mobile harrif ror b. ' + ,. e_ n the zoning ordinance . At this time there is no / rovlsion In i ' ep ng ordinance about the amount of land required for homes/. Mr . an Epps is having 5 . 3 trailers to an acre . The recommended density is 6 - 6 trailers per acre . Mr . Clayton Cranmer for a Special Permit to construct a mobile home park on his land located off Mill Street in Freeville , New York . IIIFindings of Fact and Decision were made at a Special Meeting of the Town Board on June 25th , 1970 , at which all members of the Town Board were present . The Public Hearing was duly advertised and in accordance with the policy established by the Town Board , individual notices of the hearing were mailed to adjacent property owners . REVIEW OF HEARING : Mr . Cranmer presented a letter stating his position of objecting to the action of. the Board in setting down a second hearing , which letter is fully set out in the minutes of the June 22nd hearing . He further stated that the mobile home park would be maintained primarily for the use by semi - retired and retired people- . He gave a statement as to his experience as a mobile home park manager , to wit : Assistant manager of Taggin Wagon Park , in Varna , for a period of ll years . He stated that he had Tompkins County Health Department approval for the septic system , and had complied with the present requirements of the proposed Mobile Home Park Ordinance . He presented photographs showing the surrounding properties to negate the statement that adjacent property values would be lowered and that the entrance driveway was unsafe . A letter. from Mr . ° Joseph M . Borowitz with respect to roadway work done by him some years ago was submitted and is set forth at length in the minutes of the June 22nd hearing . Others spoke in favor of the application , as is stated in the minutes . In opposition to the application , Mr . Richard J . • Wilsen appeared . A copy of a petition signed by 28 property owners in opposition had previously been submitted to the Town Board . The opposition was based primarily on the change of character of the neighborhood , the lowering of property values , and the allegedly hazardous traffic situation by reason Of. the park entrance . Slides were shown and photographs submitted . Other objections were based on the poor soil conditions , and possLble overcrowding of the school system . After a complete discussion of all of the above , the meeting was adjourned . FINDINGS OF FACT : U pon consideration of all the information supplied to the Town Board at • the June 22nd hearing and the previous hearing held on June 2nd , 1970 , and all members of the Town Board having inspected the site , the Board f inds that the applicant has complied with all the requirements to obtain a Special Permit , including Tompkins County Health Department ia3;, ' j ' requirements as to sewer and water . u'iY G In view of the above and the further fact that only five mobile homes a ' p is to be placed in said Park , the Board finds that the granting of the 7 �r,. application will have no detrimental affect on the adjacent properties in the area and will result in no increase in traffic and will create n o additional traffic hazards , the entry road itself permitting an un - o bstructed view ; and the Town Board further finds that the health , safety and general welfare of the community will not be adversely affected . 4 DECISION : - RESOLUTION # 114 On motion by Councilman Gridley , seconded by Councilman Tarr , and unanimously approved by all members of the Town Board , IT WAS RESOLVED that a special permit be issued to Clayton Cranmer to constrict a mobile home park on his land near Mill Street , Freeville , New York , upon the following terms and conditions : 1 . The mobile home park shall contain no more than five mobile homes , including the mobile home occupied by the owner . applicant . 2 . The lot size for and location of each mobile home shall be in accordance with the sketch map submitted with the application . 3 . All rules and regulations of the Tompkins County Health Department shall be fully complied with . 4 . The lots on the Mill Street side shall be screened by a landscaped 41) buffer strip within 90 days after the effective date of the Special Permit . 5 . The applicant shall cause the grounds of the mobile home nark to be maintained in a neat and orderly manner . 6 . Failure to comply with any or all of the terms and conditions of the Special Permit shall result in a revocation of the Special Permit . Charles G .
