The regular monthly Board Meeting was called to order by Supervisor Lee
at 7 P . M . Present were Supervisor Lee , Councilmen Todd , Ogden & Cotterill ,
and Assessor Wells . Absent - Councilman Gridley & Attorney Amdur .
The Meeting was opened with the Pledge Allegiance to the Flag .
Supervisor Lee asked the Town Board if they were prepared to approve the
January Minutes . There were no corrections or additions and the minutes
were approved as sent out .
Supervisor Lee then asked if there were any corrections or additions to
the February Minutes . They were approved as sent. out .
Supervisor Lee at this time introduced Mr . Rocco Lucente who was present
to find out if the Town Board was prepared to approve the roads , and take
them over in his proposed trailer park . Supervisor Lee informed him that
Attorney Amdur was absent from this meeting and she was checking into
the legal aspects as to whether or not the Town could accept roads in a
trailer park . He further stated that Mr . Case , Highway Superintendent had
looked at the proposed development butrad no comments at this time . He -
stated that the trailer park had been approved and recommended by the
Planning Board . Councilman Todd remarked that he was not ready to approve
it yet , and both Councilmen Ogden & Cotterill felt they would like to study
the situation more carefully , however , all Board Members felt they would
rather see a trailer park then have trailers scattered all over the Town
on separate lots . °
STANDING COMMITTEES
Sanitation - Councilman Todd stated he had nothing to report this month .
Building & Grounds . - Councilman Ogden had nothing to report at this time .
Planning - Councilman Ogden reported that Mr . Neiderkorn had turned the
701 project over to the 701 Commission . Everthing was in
the Board room and he went on to report that the large
booklets " The Dryden General Plan " had been placed in various
libraries and that it would to be signed out of the Town
Hall should anyone be interested in reading it , as only a
limited number had been printed . The small booklet " The Dryden General
P lan " Summary Report and Future Land Use Map could be
g iven to anyone requesting one .
He further reported that the Planning Board had two meetings
last week . Supervisor Lee reported he had received a
petition from residents on the Yellow Barn Road requesting
a change in the zoning , and that Mrs . Dedrick had called
h im and said she had a petition for him requesting a
change in the zoning in the area between Etna & Freeville .
Councilman Todd reported that he was a representative on the Egypt Creek
Watershed Project of which Dr . Crispell was Chairman and that the project
was presently at the State level where they would run a cost benefit
formula to see if this would be feasible and from there it would go to the
Federal Government . He asked the Town Board what they thought of the Town
making this a recreation area should it be approved , should the Community
College locate elsewhere . He went on to report that it would be relatively
inexpensive to put in gravel and sand to make a swimming area and clear
some brush to make a picnic area . He felt that perhaps the Highway Dept .
could do most of the work and save money should this possibility be
accepted . He futher reported that should the Egypt Creek Watershed Project
be approved it would serve three purposes , recreation area , flood control el
and water storage . The only question raised by the Board Members was
whether or not they would receive complaints from other areas of the Town
should this be done , and whether or not they would receive requests from
other areas to do the same type thing . As this project is still in the
planning stage no action was taken by the Town Board .
Supervisor Lee reported he had received a letter from Mr . & Mrs . William
Layton informing him they were in favor of the proposed zoning ordinance .
Supervisor Lee read a letter from Mr . William Deming , District Principal
of the Dryden Central School District expressing his approval and
appreciation of the Planning Guide completed by Egner & Neiderkorn , and
expressing his appreciation to the Supervisors of the Town of Dryden for
making this survey possible on behalf of the Board of Education .

Supervisor Lee reported he had a call from Mr . Jayne asking him to check
into the house numbering as both their house number . and the house across
the street owned by Spaulding ' s were using # 41 . A check of the records
✓ evealed that Mr . Jayne ' s new house number was 41 and that Mr . Spaulding ' s
o ld house number was 41 . This causes much confusion , but as the Town
Board does not have the authority to make people change to their new assigned
numbers this problem will go on indefinitely .
Supervisor Lee reported he had a copy of the letter to Mr . Dickinson from
Constance E . Cook informing Mr . Dickinson that she had submitted to the
Office of Local Government the question of whether the Town Board may
hold a permissive or advisory referendum on zoning . The Office of Local
Government had answered , stating that the general rule prevailing in this
State is that a referendum , whether advisory , binding or one of the other
possible types , cannot be held by a local government unless specifically
authorized by the State Legislature . This rule is founded on the concept
that we have a representative form of local government whereby the govern -
"l ing board thereof is empowered by the constitution and the Legislature
to govern and to provide the services and facilities required by the people
therein , within prescribed limitations . There is no general State statute
which authorizes municipalities to submit the question of whether or not
to adopt a zoning ordinance to a referendum , and to do so is invalidated
by the Courts , and in respect to an advisory referendum , this is merely
taking a poll of public opinion . A public hearing must be held prior
to final action , thus the public would have an opportunity to express
its opinion .

Supervisor Lee reported he had received a memorandum from Tom Miller on
the estimated unit costs for this district , based on construction bids
received February 27 , 1969 .

Supervisor Lee at this time stated that Audit & Control will not approve
a district when it goes over $ 10 . 00 per month and this is nearing the
panic area . However , this district is almost sure of an additional 136
units by various property owners due to enlargement of the trailer park ,
additional apartment houses and a plaza , in which case the cost would
drop to $ 47 . 80 per unit

Supervisor Lee at this time reported that Mrs . Amdur had the information
n ecessary and was ready to resubmit to Audit & Control . The bids are on
a sixty day limitation period and we would need fast action in order to
✓ eceive the okay and hold another Public Hearing .
Supervisor Lee reported that the Varna Fire Department had burned the
• house on the Ashton Property now owned by the Town of Dryden on March 8th
and he felt that the Town Board should make a donation to them from Sewer
District # 2 . He further stated that Freeville Fire Department had gone
to Varna to cover , and that the Dryden Fire Department had gone to
Freeville to cover . The question was then raised should a donation be
made to all three Fire Companies .
RESOLUTION # 52 DONATION VARNA FIRE DEPARTMENT
Councilman Todd offered the following resolution and asked its adoption .
RESOLVED that the Town Board of Dryden make a donation to the Varna
Fire Department in the amount of $ 50 . 00 and let the Varna Fire Department
decide whether or not to give to the Freeville & Dryden Fire Departments .

Supervisor Lee reported that the Compensation bill from Carey Insurance
Agency for the year 1966 had not been paid as yet , Mrs . Amdur was looking
into the legal aspects as to whether or not we were liable due to the
fact we were not billed , and the fact they used the wrong census figures .
Supervisor Lee reported that the Youth Application had been submitted
and okayed for the coming year .
NEW BUSINESS - None
COUNTY BRIEFING •
Supervisor Lee reported that the recommended site on Route 13 North of
the Village for the Community College had been rejected by the Tompkins
County Board of Supervisors , and that a three man committee would be
appointed by the Board of Supervisors to work with the College Trustees
to select and recommend sites for the College . He reported that the
Cortland County Board of Supervisors had also rejected the site due to
the fact they wanted less expensive land . The option on the present
three recommended sites expire September 1st and he stated he had heard
there were people interested in picking up the options on these sites .
He further stated that the State would have the final say so , and they
felt this was moving along at a more rapid pace then it needs to , and
that the College could stay on a temperary site from three to five years .
Supervisor Lee reported that there is presently a bill in the Senate
whereby a Supervisor to the Town could also be the County Representative
and it would be enacted in the next week .
Supervisor Lee reported that the 1970 census would be by Election Dist .
Supervisor Lee reported that the County was working on a County Land
Fill Dump and had appointed Mr . Frank Liguori to recommend one or
more sites .
Councilman Ogden asked the Town Board if they would approve April 16th
as the next Board Meeting date as he would be going on vacation and would
not be present on the regular meeting date .

Councilman Ogden offered the following resolution and asked its adoption .
RESOLVED that the regular Board Meeting for April be held on the 16th
instead of the 9th .
