HomeMy WebLinkAbout1967-11-09 NOVEMBER 9 , 1967 1 6 1 PUBLIC HEARING The Public Hearing was called to order by Supervisor Todd at 7 : P . M . Present were Supervisor Todd , Councilmen Lee , Ogden , Newhart & Jones and assessor Wells . Supervisor Todd opened the hearing by submitting to the ten people pre - sent a chart showing Tax Base , Rate and Levy for 1967. and 1968 . This showed figures for Whole Town , Town Outside , Dryden Fire , Lighting Districts and Dryden Sewer - District #1 , and Dryden Water District #1 . This chart is attached to Minutes . The Town -wide. assessment for 1968 is $ 2 . 96 per $ 1000 . 00 and the Town Outside is $ 2 . 54 per $ 1 , 000 . 00 and the County rate is $ 3 . 60 per $ ioocto0 . This along with the Dryden Fire rate of $ . 51 per $ 1 , 000 . 00 totals $ 9 . 61 for Town outside and $ 6 . 56 for Villages . • ` DRYDEN SEWER DISTRICT #1 Supervisor Todd reported that a correction needed to be made in this Special District changing the budgeted figure from $ 2613 . 67 to $ 1240 . 00 The figure for bookkeeping was changed from $ 125 . 00 to $ 25 . 00 giving a total appropriations figure of $ 2513 . 67 . Estimated Revenues was changed adding $ 260 . 00 for interest and penalties and the unexpended balance was changed from $ 13 . 67 to . $ 1013 . 67 giving . a balance to be raised by taxes of $ 1240 . 00 . Supervisor Todd reported that part of the reason for this lower amount of money was due to the exceptionally low bid received for this District . He further stated that although the district now has a low assessed valuation the potential is growing and some construction activity is already going on in that area . DRYDEN WATER DISTRICT #1 Supervisor Todd explained that $ 9 , 000 . 00 needed to be raised by taxes for this district to meet the Interest and Principle payments for the coming year . The figure was arrived at as follows : 60% Units - 204 Units © $ 26 . 07 per $ 5400 . 00 30% Assessed Valuation - $ 1 , 207 , 448 @ $ 2 . 24/ 1000 2700 . 00 10% Front Footage - 29 , 745 ® $ . 03 Ft . 900 . 00 $ 9 ; 000 . 00 Supervisor Todd further reported that this is ohly the operating budget and does not reflect money in the Account . FIRE DISTRICT Supervisor Todd reported that this amounted to $ . 51 on Village Outside to pay the Fire Contracts . A question was raised from the floor at this time as to why the budget had increased so much for this year , Supervisor Todd stated that most of the raise was in the Highway Budget and this was reflected in Items 1 , 3 . & 4 . Item #1 Repairs and Improvements , Item #3 Machinery and Item #4 Snow Removal . He further stated that the Town must maintain roads that are not all weather roads due to the fact that people have been building houses on these roads and the Town must get them in and out . Also the Town would now have to plow the South end of the Town which they have not been plowing and this added more miles , and inturn this was greater upkeep on machinery and added more labor . The question was asked if the raise in the General Fund was due to salaries alone : Mr . Todd reported that this was not the entire raise , 0 that money was added for a Special Census for 1968 and three new items had been added to the budget . These include money for a Zoning Officer should zoning go through , money / for rental of Mr . Collins Dump and money for a Recreation Budget . Having no further questions from the floor Supervisor Todd asked for a motion on the correction of Dryden Sewer District #1 . RESOLUTION #144 CORRECTION SEWER DISTRICT #1 Councilman Ogden offered the following resolution and asked its adoption . RESOLVED that Dryden Sewer District #1 corrections be made in appropriations and revenues changing the total for this district from $ 2613 . 67 to $ 1240 . 00 . 2nd Councilman Newhart Roll call vote - all voting YES 162 RESOLUTION #145 ADOPTION OF PRELIMINARY BUDGET Councilman Lee offered the following resolution and asked its adoption . WHEREAS , this Town Board has met at the time and place specified in the notice of public hearing on the preliminary budget and heard all persons desiring to be heard thereon now , therefore , be it RESOLVED that this :Town Board does hereby adopt such preliminary budget as originally compiled , as the annual budget of this Town for the fiscal year beginning ion the 1st day of January 1968 , and that such budget as so adopted be entered in detail in the minutes of the proceedings of this Town Board , and be it FURTHER RESOLVED , that the Town Clerk of this Town shall prepare and certify in duplicate , copies of said annual budget as adopted by this Town Board , together with the estimated if any , adopted pursuant to section 202 - a , Isubd . 2 , of the Town Law and deliver one copy thereof to ' the Supervisor of this Town to be presented by him to therBoard of Supervisors of this County . 2nd Councilman Jones Roll call vote - all voting YES Mr . Walter Schwann of Schwann ' s Trailer Park was present and asked why a Mobile Home Ordinance was needed for Trailer Parks as they were already ✓ estricted by the Health Department and the State as to what they could and could not do . He stated that he had attended one of the zoning meetings andhad learned that the trailer lots had to , be a certain size , so many trailers to the acre , the roads a certain width etc . Mr . Donald Portzline of Portzline Trailer Village was also . present and his feelings w ere the same as Mr . Schwann ' s . They had both talked with Mr . Neiderkorn who is conducting the 701 study and both felt that someone who knew nothing about running a trailer park should have a say in how they should run their business . Mr . Portzline further stated that he was told he could not have street parking and since his fuel lines , gas lines etc were run underground he could not and would not have off the street parking as if he did his park residents would be parking on top of these lines . Councilman Ogden reported that he had attended a 701 Meeting the previous evening and this very thing ( Trailer Parks ) had been dis - cussed and Mr . Neiderkorn had asked the 701 Committee and the Planning B oard what should be done and it had been unanimously agreed that he Mr . Neiderkorn should contact Trailer Park Owners , send them a draft of the Ordinance and ask for their suggestions and comments . Neither Mr , Schwann or Mr . Portzline felt an Ordinance was needed but both f inally agreed to going over a draft and making suggestions and seeing if an agreement could be reached . It was suggested that Councilman Ogden see about setting up a meeting between Park Owners , Planning B oard and the 701 Committee . Supervisor Todd pointed out to these two Gentlemen that at the present time the Town Board had nothing to say and would have no say until the Zoning Ordinance was handed over to them for approval . Councilman Ogden reported that Mr . Neiderkorn was writing a separate Junk Car Ordinance . He further stated that . the 701 meetings were well attended and that the State Department of Planning had given an extension to Mr . Neiderkorn into 1968 to complete his part of the program . He reported that the Secretary of the Planning Board had ✓ esigned and Mrs . Hardesty would be the new secretary and that Mrs . Steger secretary of the 701 Program had resigned and a replacement had not been found . Councilman Lee at this time brought up the subject of the Equalization Rate and felt that perhaps the Town of Dryden should have pursued this in Court as did the Town of Lansing . Supervisor Todd reported that he felt that the Town of Dryden had little to lose and it was not worth III it as it only amounted to $ . O1 per $ 1000 . 00 . He could see the Town of Lansing going to court as it involved around $ 21 , 000 . 00 but it only amounted to $ 3500 . 00 for the Town of Dryden . He explained that at the County this rate was set up in two methods . 1 . Use the State Equalization Rate . 2 . Use the ' rate as adopted by the Towns - some 80%0 - some 90% The County had voted for the State Rate , he had however ,/"not voted for it and neither had the Towns of Lansing and Ithaca . ' Supervisor Todd reported that since Mrs . Amdur was absent we would wait to discuss the lateral versus mains in the Dryden Sewer 'tistrict #2 u ntil the December Board Meeting . Supervisor Todd read a letter addressed to Mrs . Amdur from Thaler and Thaler whereby they had enclosed a Warranty Deed from Sharlene F . B elasco , Abstract of Title and Mortgage Release for the conveyance of Redwood Lane to the Town ofiDryden . RESOLUTION #146 REDWOOD LANE A ) Councilman Newhart offered the following resolution and asked its adoption . RESOLVED that the Town of Dryden accept this Road when approved by Attorney Amdur . 2nd Councilman Ogden Carried Supervisor Todd read a letter from Mr . Gerald D . Ryan who resigned from the George . Junior Republic Citizens Committee due to lack of available time . Mr . Ryan stated in his letter that a possible replacement for his position was Mr . Franz Pizilly of West Main St . , Dryden . Mrs . Luss had been instructed to write Mr . Pizilly and find out if he would accept this position . Mrs . Luss ' s letter was read and Mr . Pizilly ' s letter of acceptance was also read . RESOLUTION #147 GJRCC - MR . PIZILLY Councilman Jones offered the following resolution and asked its adoption . • RESOLVED that this Town Board appoint Mr . Franz Pizilly to replace Mr . Gerald Ryan on the George Junior Republic Citizens Committee . 2nd Councilman Newhart Carried Councilman Lee pointed out that no one had replaced Mrs . Elizabeth Crissey and he would like to suggest the name of Jack McFadden who would represent the same part of the Town as Mrs . Crissey . RESOLUTION #148 GJRCC - MR MCFADDEN Councilman Lee offered the following resolution and asked its adoption . RESOLVED that this Town Board appoint Mr . Jack McFadden ro replace Mrs . Elizabeth Crissey on the George Junior Republic Citizens Committee . 2nd Councilman Newhart Carried Clerk Luss was instructed to notify these people of their appointment and at the same time send them each a copy of the George Junior Republic Citizens Committee Resolution and the- names of the people serving on this Committee , and a copy of each letter be sent to Mr . Ryan , Mr . K irchgraber and Mr . Urquhart . :RESOLUTION #149 HIGHWAY BILLS . Councilman Ogden offered the following resolution and asked its adoption . RESOLVED that the Highway Bills be paid as audited . 2nd Councilman Newhart Roll call vote - all voting YES RESOLUTION #150 GENERAL BILLS Councilman Jones offered the following resolution and asked its adoption . RESOLVED that the General Bills be paid as audited . 2nd Councilman Lee Roll call vote - all voting YES Supervisor Todd asked for a motion on the minutes . Councilman Newhart said he felt that when the Town was making a motion on the purchase of machinery it would be a good idea if the Trade name was used . For instance in the motion for the purchase of the New Truck and Cinder S preader the motion only stated one New 4 -Wheel Drive Truck and did not mention that it was a FWD . The Board members felt this should be done . RESOLUTION #151 MINUTES 0 Councilman Ogden offered the following resolution and asked its adoption . RESOLVED - that the October Board Meeting Minutes be approved . - 2nd Councilman Jones Carried RESOLUTION #152 ELECTION INSPECTORS Councilman Jones offered the following resolution and asked its adoption . RESOLVED that this Town Board give Clerk Luss authorization- to pay the Election Inspectors when the bills have been prepared . 2nd Councilman Ogden Roll call vote - all voting YES Supervisor Todd brought up the subject of increasing the pay for the Custodians and reported that he had previously brought this up at a B oard Meeting and an additional $ 200 . 00 had been put into the 1968 budget for this purpose but nothing had been decided as to what should be done for this year . The Board Members felt that as long as it was a budget figure their was nothing that could be done this year , so the salaries would have to stay at $ 100 . 00 each . RESOLUTION #153 ELECTION CUSTODIANS Councilman Jones offered the following resolution and asked its adoption . RESOLVED that this Town Board give Clerk Luss authorization to pay the Election Custodians hwen the bills are prepared . 2nd Councilman Ogden Roll call vote - all voting YES Councilman Jones reported that he had gone over the letter from the Tompkins County Chamber of Commerce in regard to .Town solicitors and the control program . The letter further stated that this program had been successful in the City of Ithaca , and was now expanding to include all of Tompkins County, and if the Town did not have an ordinance they would be happy to prepare one for our consideration . Clerk Luss was instructed to write a letter and request an ordinance . . A letter was read from Assemblyman Constance E . Cook in regard to the . Joint Legislative Committee on Consumer Protection and the two days of Public -"Hearings Thursday November 30 , 1967 and Friday December 1 , 1967. . The Hearings will be held in New York City and any person wishing • to appear should mail a request and any person who wished to make a statement should contact Mrs . Cook . The Agenda includes proposed legislation relating to truth - in - lending , rights of third party holders and licensing of television repairmen and auto mechanics . Councilman Jones read a . letter from Mr . L . Werninck regarding land he owns on the East side of Main St . , Extension , Freeville , N . Y . He stated that he has approximately ten acres of undeveloped farm land , which is assessed at $ 6 ; 000 . 00 and as four acres is under water sereval times a year he feels that he is paying $ 1 , 000 . 00 per acre for the remaining six . He would like to build a bridge for access to this land and perhaps put up apartment houses or a trailer park and would like to know what his .taxes will be when the land is improved . Assessor Wells took out his tax maps at this time and told the Town Board that the assessment on this farm land was presently at $ 100 . 00 per acre. He stated that Mr , Werninck owned 24. acres - 1 acre where his store and apartment house is located is assessed at $ 1825 . 00 - 4 acres along the highway at $ 500 . 00 each and the remaining nineteen acres in the back at $ 100 . 00 per acre . Assessor Wells was instructed to answer Mr . Werninck letter and give hime the above facts and also to inform him of the Sub -Division Control Ordinance for future use . Councilman Lee suggested to the Town Board that he felt that they should communicate with the Trustees of the Community College and tell them of our interest in having the College located here . Supervisor Todd reported that he had talked with Ronald Space a member of this Committee and they would not have an idea on a site until they could see where the new Road would be going connecting Ithaca and Cortland . At the present time there are two possibilities . One layout is South of Freeville and the other is North of Freeville . Supervisor Todd read to the Town Board a letter from the U . S . Depart - ment of Commerce in answer to a letter from Mrs . Luss reporting that the Town of Dryden would like to have a special census and asking the procedure . . The letter from the Department of Commerce outlined the procedure for this special census . The cost will be about $ 2525 . 00 , and of this amount a check for $ 1 , 220 must be sent by January 15 , 1968 along with eleven ( 11 ) maps of the Town of Dryden scaled 1 " - 2 , 500 ' and five ( 5 ) maps of the two villages scaled 1 " - 1 , 000 ' . Assessor W ells was instructed to start getting the maps ready . Councilman Lee reported that he had a etition from residents of Varna asking for a reduced speed limit from 40 to 35 MPH , more active check - ing of the speed limit and a blinking red and amber light on the corner of 366 and Freese Road due to the many accidents that occur at this spot due to bushes , mail boxes and utility poles . Councilman Lee further reported that he had written a letter to Mr . William Hafermalz requesting that something be done and as yet he has had no answer . It was decided to place the petition on file in the Clerk ' s Office . Mr . Robert Watros was present and asked the Board if there was some way the Residents of the Village could get out of paying for Hwy Items 2 , 3 , 4 as these were duplications of what they were paying in Village Taxes . This was discussed in regard to work that has been done by the Town for the Village , the fact . that the Village could not perform some of the work due to lack of men and machinery , and the fact that the Town was always willing to do what they could for the Village and to the knowledge of the B oard the Village has never been refused on any request . It was suggested That Mr . Watros get an accounting from the Village of work done by the Town in the last two years and see if it is an advantage or disadvantage .
