HomeMy WebLinkAbout1965-12-14 6 December 14 , 1965 The regular monthly meeting of the Dryden Town Board was called to order by Supervisor Gridley at 8 P . M . December 14 , 1965 . Present were Supervisor Gridley , Councilmen Benson & Lee , Justice . H oagland , Highway Superintendent Case , Assessor Abrams and Attorney Amdur . Absent Justice Spaulding . The minutes of the last board meeting were approved as sent out . Supervisor Gridley asked the Town Clerk to open the bids for one new 1966 pickup truck . Opened and read and referred to the Highway Committee .. _ , f or their consideration . WATER DISTRICT - Hamlet of Varna Councilman Lee introduced Mr . Dennis Moran of O ' Brien & Gere . Mr . Moran reported that if everything went according to schedule they w ould be turning the water on in Varna October 25 , 1966 . He presented 41) . to the Town Board a tentative schedule for petitions , hearings , applications , approvals , final design , advertising for contractors , ✓ eceiving bids , starting construction and final turning on of water . ( Schedule attached ) . A discussion followed this in regards to petition ✓ ersus permissive referendum . RESOLUTION # 123 PETITION Councilman Benson offered the following resolution and asked its adoption . RESOLVED that Section 12 of the Town Law be followed and we use the petition method of forming a Water District for the Hamlet of Varna . 2nd Councilman Lee . Carried . Mrs . Amdur then reported that we could possibly get assistance with this d istrict through the F . H . A . Program , and that she had been in contact with Mr . Bruno in Senator Kennedy ' s Office , and also with Mr . Beach of Syracuse , New York who is with the Farmers Home Administration . She stated that an application had already been filed with them . Mr . Moran opened discussion as to the basis to be used for charging the cost of the district . Mr . Abrams recommended the application of 1 / 3 of the cost of the district be charged on ad - valoreum basis and 2 / 3 of the cost to be charged on unit basis . He stated that this would be advantages to the people and the district due to the large amount of vacant land within the district , and the indicated increase of land values due to the new appraisal . L IGHTING DISTRICT - Hamlet of Varna Mrs . Amdur reported that she had received a letter from the State Controllers Office in regards to the Lighting District and the Trailer Park . As the Trailer Park is a Corporation and the owner a .non - ✓ esident land owner the Corporation would be excluded in its entirety . H owever , in the case of a permissive referendum the Corporation would be allowed one vote . SAPSUCKER WOODS : Sewer District & Water District Mr . Lucente was present with his Engineer Mr . 4) nlop in regards to W ater and Sewerage for his development on the Sapsucker Woods Road . They presented a map of the area for those present to look over . Mr . Lucente stated that he would like a full sewer district and a part water district . smiscussio.n followed this in regards to forming a separate district or tying in with the Varna District . Mr . Lee at this time stated that Mr . Moran would be present on December 29 1965 and would at that time have a figure with and without the Sapsucker Woods area , and would Mr . Lucente being willing to wait until that time or was there some need to expedite this . Mr . Lucente agreed to wait for the figure from O ' Brien & Gere . Mr . Lucente then w as advised to authorize his firm of Lozier Engineers to get a final plan including petitions , preparations , district maps , district boundaries , financing and purposed bond schedule . Mr . Dunlop reported that the preparation of plans would cost $ 150 . 00 . RESOLUTION #124 Sewer District Councilman Benson offered the following resolution and asked its adoption . RESOLVED that the sum of $ 150 . 00 be and the same is hereby appropriated to pay the cost of preparing the general plans , maps , and estimatecs in 6 connection with the proposed district formation of the Sapsucker Woods S ewer District , as set forth in the proposed agreement for Engineering Services between the Town Board of the Town of Dryden , Tompkins County and Lozier Engineers , of 10 Gibb Street , Rochester , New York all in accordance with Section 191 - a of the Town Law of the State of New York and related sections and that the Town Board shall execute the proposed agreement with the aforesaid Engineers . 2nd Councilman Lee . Roll call vote - all voting YES . Mr . Amdur reported that everything was set with Mr . & Mrs . Ted Hulslander that the claim should be paid . She further reported that Mr . Hulslander would be in to see her on Saturday December 18 , 1965 . III RESOLUTION # 125 HULSLANDER CLAIM Councilman Benson offered the following resolution and asked its adoption . WHEREAS, it became necessary to widen a portion of the Southworth Road 0 of the Town of Dryden and the damage amounted to $ 325 . 00 , be it RESOLVED that $ 325 . 00 be paid to the property owners , Mr . & Mrs . Ted Hulslander . 2nd Councilman Lee . Roll call vote - all voting YES . Councilman Lee reported that Mr . Denman had concluded his outside work and is now doing his desk work , and he would like to have a portion of his money . This was discussed , and it was finally decided that Councilman Lee should tell Mr . Denman to make a Progress Report to the Town Board . VARNA TOWN HALL There was general discussion regarding the abandoning of the Varna Town . . Hall . Councilman Lee reported that the Voting Machines could be stored in the Varna Community Hall . It was then decided that if they were stored there the Town of Dryden would pay a fee for such storage . SEWER DISTRICT - Varna Councilman Lee reported that three meetings had been held in regards to the Varna Sewer tistrict . the first with Mr . Relyea , Mr . Miller and Mr . Desch . The second with Mr . Liguori , Mr . Miller , Mr . Relyea and Mr . Desch . The third meeting was held in the Dryden Town Hall with thirteen present , Mr . Miller , Mr . Liguori , Mr . Relyea , Mr . Kerr , Mr . Todd , Mr . Ogden , Mr . Jones , Mr . Lee , Mr . Lucente , Mr . Hannan , Mr . Desch and Dr . B enson . He said that the University is willing to set a public hearing f or the Dryden Sewer District , and this would go before the Board of ii. rectors of the University at their January Meeting . L IGHTING - Varna Councilman Lee reported that the lights will go in in the Hamlet of Varna in the near future . He then suggested that some of the lighting districts be examined to see who is paying for this service and who is not . PLANNING BOARD - Zoning Councilman Lee suggested that the Town Board appoint a representative ( well known ) in some of the different areas of Dryden to talk with people about zoning . He reported that the residents of the Town of Dryden do not seem to be aware of what zoning can do for them , and what it cannot d o for them . There was some discussion on this , but nothing was decided . RESOLUTION #126 ITEM #4 • Councilman Benson offered the following resolution and asked its adoption . WHEREAS there has been received in item ##4 the sum of $ 3 , 618 . 54 in excess IIof the budgeted amount for miscellaneous services rendered therefore , be it resolved that the sum of $ 3 , 618 . 54 and the same is hereby appropriated for use in item ##4 • 2nd Councilman Lee . Carried . RESOLUTION ##127 Transferred Items Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that the sum of $ 3000 be transferred from the General Fund to the following Highway Accounts . $ 1000 Item # 3 $ 2000 Item ##4 The same is hereby appropriated for use in the afore mentioned Highway items . The Superivsor is authorized and directed to make aaid transfer on his books . 2nd Councilman Lee . Carried . 0) RESOLUTION #128 Transfer Item #2 - #3 9 44 Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that the sum of $ 1060 . 00 be transferred from Highway Item #2 to Highway Item #3 . Said sum is hereby appropriated for use in Item # 3 . The Supervisor is authorized and directed to make said transfer on his books . 2nd Councilman Lee . Carried . RESOLUTION • #129 HIGHWAY BILLS a `� Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that the Highway Bills be paid as audited . 2nd Councilman Benson Roll call vote - all voting YES . ' RESOLUTION #130 GENERAL BILLS Councilman Lee offered the following resolution and asked its adoption . RESOLVED that the General Bills be paid as audited . 2nd Councilman Benson . Roll call vote - all voting YES .. RESOLUTION #131 ELECTION EXPENSE Councilman Lee offered the following resolution and asked its adoption . WHEREAS there is due and owMing the County of Tompkins for election expenses the sum of $ 730 . 53 be it RESOLVED that said sum be paid to the County Treasurer . 2nd Councilman Lee . Roll call vote - all voting YES . RESOLUTION #132 1965 ACCOUNTS Councilman Lee offered the following resolution and asked its adoption . WHEREAS there is due and owing the County of Tompkins the sum of $ 57 . 09 to balance the 1965 accounts with the Town be it RESOLVED that said amount be paid to the County Treasurer . 2nd Justice Hoagland . Roll call vote - all voting YES . RESOLUTION #133 COMPENSATION INSURANCE Justice Hoagland offered the following resolution and asked its adoption . WH IrEAS due and owing the County of Tompkins $ 1333 . 18 by the Town of Dryden being the Town ' s share of Compensation Insurance for the year 1965 therefore , be it RESOLVED that said amount be paid to the County Treasurer . 2nd Councilman Benson . Roll call vote - all voting YES . RESOLUTION #134 COMPENSATION INSURANCE Councilman Benson offered the following resolution and asked its adoption . WHEREAS it has been determined by the Insurance Commission of the Tompkins County Board , premiums for Compensation Insurance for the Town of Dryden will be in the sum of $ 3 , 429 . 00 therefore , be it RESOLVED that said amount be paid to the County Treasurer . 2nd Councilman Lee . Roll call vote - all voting YES . RESOLUTION #135 DESIGNATED BANK Councilman Benson offered the following resolution and asked its adoption . RESOLVED that the First National Bank of Dryden be designated as the official depository for the Town of Dryden for the year 1966 . 2nd Justice Hoagland . Carried . 411 RESOLUTION #136 SALARIES Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that all salaries for the appointed and elected officials be paid as of December 18 , 1965 . 2nd Councilman Benson . Carried . RESOLUTION #137 BONDING Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that the following people be bonded for the year 1966 as required by law . Supervisor Todd , Justices Hoagland & Spaulding , Town Clerk Luss , & Receiver of taxes Luss , Civil Officers , Harold Fitts , Raymond Sickmon & Edward Newhart , and Highway Superintendent Case . 2nd Councilman Lee . Carried . RESOLUTION #138 CIVIL OFFICERS Justice Hoagland offered the following resolution and asked its adoption . CERTIFIED CORPORATE RESOLUTION RESOLVED That 9 ;RtUoMtj : : be authorized " to sign and submit the bid or proposal of this corporation for the following project and to include in such bid or proposal the certificate as to non - collusion required by section one hundred three - d ( 103 - d ) of the general municipal law as to the act and deed of such corporation , and for any inaccuracies or mis - statements in such certificate this corporate bidder shall be liable under the penalties of perjury . Secretary ANTI - DISCRIMINATION CLAUSE The Contractor ( or bidder ) hereby agrees to the provisions of Sections 139 - a and 139 - b of the New York State Finance Law which require that upon the refusal of a person , when called before a grand jury to testify concerning any trans - action or contract had with the state , any political subdivision thereof , a public authority or with any public department , agency or official of the state or of any political subdivision thereof or of a public authority , to sign a waiver of immunity against subsequent criminal prosecution or to answer any relevant question concerning such transaction or contract , ( a ) such person , and any firm , partnership or corporation of which he is a member , partner , director or officer shall be disqualified from thereafter selling to or submitting bids to or receiving awards from or entering into any contracts with New York State or any public department , agency , or o fficial thereof , for goods , work or services , for a period of five years after such refusal , and During the performance of this contract , ( the contractor ) hereby agrees as follows : ( a ) The contractor will not discriminate against any employee or applicant for employment because of race , creed , color or national origin , and will take affirmative action to insure that they are afforded equal employment o pportunities without discrimination because of race , creed , color or national origin . Such action shall be taken with reference , but not be limited to : recruitment , employment , job assignment , promotion , upgrading , demotion , transfer , layoff or termination , rates of pay or other forms of compensation , and selection for training or retraining , including apprenticeship and on - the - job training . ( e ) The contractor will comply with the provisions of Sections 291 - 299 of the Executive Law and the Civil Rights Law , will furnish all information and reports deemed necessary by the State Commission for Human Rights under these non - dis - crimination clauses and such sections of the Executive Law , and will permit access to his books , records and accounts by the State Commission for Human Rights , the Attorney General and the Industrial Commissioner for purposes of investigation to ascertain compliance with these non - discrimination clauses and such sections of the Executive Law and Civil Rights Law . ( f ) This contract may be forthwith cancelled , terminated or suspended , in whole or in part , by the contracting agency upon the basis of a finding made by the State Commission for Human Rights that the contractor has not complied with these non - discrimination clauses , and the contractor may be declared ineligible for future contracts made by or on behalf of the State or a public authority or agency of the State , until he satisfies the State Commission for Human Rights that he has e stablished and is carrying out a program in conformity with the provisions of these non - discrimination clauses . Such finding shall be made by the State Commission for Human Rights after conciliation efforts by the Commission have failed to achieve compliance with these non - discrimination clauses and after a ✓ erified complaint has been filed with the Commission , notice thereof has been given to the Contractor and opportunity has been afforded him to be heard publicly before three members of the Commission . Such sanctions may be imposed and remedies invoked independently of or in addition to sanctions and remedies o therwise provided by law . The Contractor will include the provisions of clauses ( a ) through ( f ) in every subcontract or purchase order in such a manner t hat such provisions will be binding upon each subcontractor or vendor as to operations to be performed within the State of New York . The contractor will t ake such action in enforcing such provisions of such subcontract or purchase order as the contracting agency may direct , including sanctions or remedies for non - compliance . If the contractor becomes involved in or is threatened with litigation with a subcontractor or vendor as a result of such direction by the contracting agency , the contractor shall promptly so notify the Attorney General , ✓ equesting him to intervene and protect the interests of the State of New York . The contractor ( or bidder ) agrees that it will comply with Title VI of the Civil Rights Act of 1964 ( PL 88 - 352 ) and all requirements imposed by or pursuant to the Regulation of the Department of Health , Education , and Welfare ( 45 CFR Part 80 ) issued pursuant to that title , to the end that , in accordance with Title VI of that Act and the Regulation , no person in the United States shall , on the ground of race , color , or national origin , be excluded from participation in , be denied the benefits of , or be otherwise subjected to discrimination under any program or activity for which the Party of the Second Part received Federal financial assistance from the Department through the Party of the First Part ; and hereby gives assurance that it - 3 - • r 1 b' • Certified Corporate Resolution ANI' I - DISCRIMINATION CLAUSE ( continued ) will immediately take any measures necessary to effectuate this agreement . Carried . 7 December 29 , 1965 The adjourned Town Board Meeting was called to order at 9 : 20 on Wednesday December 29 , 1965 by Supervisor Gridley . Present were Supervisor Gridley , Councilmen Lee & Benson and Justices H oagland & Spaulding . Mr . Relyea was present in regards to a Sewer District for the Taggin W agon Park , Inc . A letter from Mr . Relyea to the Town Board was read . The letter was a formal request to the Town Board for assistance in the formation of the Sewer District . ( Letter attached ) A copy of a letter to Mr . Relyea from Jacob Y . Becker of Becker , Card & Scanlon , Attorneys at Law of Endicott , New York was given to the Town Board . It was in answer to a letter from Mr . Relyea in regards to a Corporation joining a petition for the formation of a Sewer D istrict when one is a non - resident owner . ( Letter attached ) After much discussion it was decided that this Sewer District would have to be in accordance with Article 12A and subject to a permissive referendum . RESOLUTION #142 SEWER DISTRICT Councilman Benson offered the following resolution and asked its adoption . RESOLVED that pursuant to a formal request from Taggin Wagon Park , Inc . that the sum of $ 900 . 00 be and the same is hereby appropriated to pay the cost of preparing the general plans , maps and estimates in connection with . a preliminary feasibility study of a Sewer District in the Taggin Wagon Park , Inc . , said study to be made by T . G . Miller , Consulting Engineers , of Ithaca , New York , all in accordance with Article 12A of the Town Law of the State of New York , and that the Town Board shall execute the necessary agreement with the aforesaid Engineers . 2nd Justice Hoagland . It was suggested at this time that a copy of this resolution be sent to John Burton , Assistant Vice President for Business , Cornell University and a copy to Noel Desch , Buildings & Properties , Cornell University . RESOLUTION #1L4 PUBLIC HEARING - SEWER DIST . Councilman Lee offered the following resolution and asked its adoption . WHEREAS , a Sewer District has been purposed for the Hamlet of Varna , • and WHEREAS , this information should be made available to the residents of Varna who may wish to join the District , be it RESOLVED that a Public Hearing be held February 1 , 1966 . 2nd Councilman Benson . Carried . At this time Mr . Thomas Parker presented to the Town Board a map for the Hunt Grove Sub -Division . He also presented a Deed and Abstract for a road adjacent to the Hunt Hill Road , and told Supervisor t Gridley this had been inspected and okayed by Highway Superinteddent Richard Case . This will be referred to the Planning Board . VARNA FIRE DEPARTMENT I It was reported that the- _ Varna Fire Department would like to have • the land that the Town of Dryden leases from Cornell University in 1 the Hamlet of Varna . This was discussed but a decision was not reached . RESOLUTION #145 VARNA FIRE DEPARTMENT Councilman Lee offered the following resolution and asked its adoption . RESOLVED that this be tabled untill after the first of the year . 2nd Councilman Benson . Carried . SPONSOR YOUTH PROJECT Supervisor Gridley asked the Board what they would like to do in 1966 about sponsoring Youth Projects . He pointed out to the Board members that the Towns were suppose to sponsor this sort of thing , and that it was financed by 2 State and 2 Municipility . He then suggested that prehaps the Town could charge for Building Permits to support this program . WHEREAS , Rocco Lucente has requested the formation of a Sapsucker Woods Water District comprising the Western part of parcel 19 , block one , Map 43 of the Town of Dryden Tax Maps and WHEREAS , cost figures have shown that there is no significant advantage to be gained from the formation of such special district when it can be included in the proposed Varna Water District , now therfore be it RESOLVED that the proposed Sapsucker Woods Water District be included in the Proposed Varna District and O ' Brien & Gere be authorized to proceed on that basis . 2nd Councilman Lee . Carried . The reorganization meeting was set up with the new Town Board for January 8 , 1966 at 9 A . M . RESOLUTION #148 TOWN TAX COLLECTOR Justice Hoagland offered the following resolution and asked its adoption . RESOLVED that Mrs . Luss be authorized and directed to collect taxes until the organization meeting of the next Town Board . 2nd Councilman Lee . Roll call vote - all voting YES . A statement was read by Councilman Lee and is as follows : "As the Freshman Member of this Board , I am certain I express the sentiments of my colleague Dr . Benson , my predecessor L . Saltonstall , Jr . and hundreds of citizens in our Town ; when I say : The Town of Dryden is deeply indebted to Supervisor Lew Gridley , Judge Harry Spaulding and Judge Millard Hoagland for their dedicated , loyal and unyielding service to this Town Board . In performace of their Public Duty , they have excelled and because of their high standards our Town has become a better place in which to reside .
