He also pointed out a wide carriage could be purchased for this typewriter if and when needed for $60 . 00 . The next meeting will be held Wed . evening , April 3 , 1957 . Nellie Rice , Town Clerk Lewis Gridley , Supervisor . April 3 , 1957 The regular mogthly meeting of the Dryden Town Board was held at the Town Office Building , on April 3 , at 7 : 30 P . M . Present were : Supervisor Gridley , Justices Shaw , Spaulding and Whitford , Councilman Baker , Assessor Abrams , and Hgy Supt . Beach . Former Supervisor Downey , Mr . Albert Hamnmond , Nationwide Insurance Representative , Mr . C . A . Randall and J . J . Harwood of the Varna Point) substation were present . Minttes of the March meeting were read for information and approval . Moved by Councilman Baker , seconded by Justice Shaw that these minutes be approved as read . Carried . Mr . Downey explained that the Grange takes up some community project each year , and he proposed that if the Town Hwy . Dept . would set the posts , the Grange woulddattach the signs designa$ing the Town Roads . He would talk it pver with the Grange at their next meetr. Mr . Hammond being the Nationwide Insurance agent living in the Town of Dryden , The board approved Mr . Hammond taking over the Town Insurance poliges now being handled by another representative „ of the same Company . ' Moved by Justice Shaw , segonded by Justice Spaulding that the General bills totaling $ 1 , 262 . 79 , Health bill of $ 5 . 00 , and the Youth Project bills totaling $ 190 . 56 , be paid as audited . Georg Construction Co . inviting the Town Board to their equipment display toybe held in Syracuse May 15 through the 19th . ° C 1 A communication was read from the County Attorney regard - ing the Town taking over any Hwy . or Street as Town Hwy . This letter to be a part oc these minutes . Moved by Justice Shaw , seconded by Justice Whitford that the particular street of the Werninck developement be posted that it is not a Town Hwy . ( subject to the approval of the State Engineer . ) . _ Carried . Moved by Councilman Baker , seconded by Justice Spaulding that Charles Newman be appointed Town Attorney for the current year . Carried . A communication was read from the village clerk of Freeville regarding moving the voting machine . Moved by Justice Spaulding , seconded by Councilman Baker that the voting machine in Freeville be moved to the new village hall , that new booths be made , and the new village hall be designated as the polling place for Dist . Carried . No . 6 . Mrs . Rose Reed submitted her resignation as Election Inspector for Dist . No . 3 . Moved by Justice Whitford , seconded by Justice Spaulding that Mrs .J Reeds resignation be accepted . Carried . Justice Shaw offered the following resolution : Resolved that : the Grievence Board should functions a Board of review for all claimants exemption . Rs Seconded by Justice Whitford . Roll call vote , All voting YES . Moved by Councilman Baker , se.eUnded by Justice Spaulding that the 2 Erwin reads to be built this year , be blacktopped next year . Dear Lou : In regard to your question concerning highways , please be advised . that Section 171 of the4Highway Law provides for highways by dedication . However, these highways may not be less than three rods in width unless certification in writing by the Superintendent of Public Works permits a lesser width . The owner must offer the lands to use by the public . This is done by the acts and intent : _of the owner . Another method of offering the land for use as a highway to be ' used by the public would be the recording and laying out of a map of the roads . The offer must be accepted , naturally, by the public authorities , showing' an intent to recognize it as • a : highway . Acceptance may be proved by long public use . Section 172 provides that any person assessable for highway taxes may make written application to the town superintendent to lay out a new highway. However , such application must be approved by the majority of the members of the town board . To avoid the difficulties which may confront you regarding this • present development , it would appear to this writer the town board should consider the establishment of a Planning Board pursuant to Section 271 of the Town Law. Under this section , you could appoint a Planning Board of five or seven members to serve without pay. These are appointive jobs and their terms are staggered from one to five years on their initial appoint- ment and thereafter' their term is for five years . • Under Section 272 , the Town Board designates one member of the Planning Board as Chairman or else the Planning Board can choose their own Chairman . The Planning Board adopts rules and regulations in respect to procedure and in respect to any subject matter over which it has any jurisdiction . The board has the authority to employ experts , clerks ,etc . , • which, ofcourse , you might not be interested in because of the expense . I The board would have jurisdiction outside the village and would aid in the growth of the township . The Town Board can authorize the Planning Board to approve or disapprove changes in highways or streets and the laying out and the abandoning of streets . The Planning Board also makes maps , investi- gations and reports ' in the planning and development of the town . Further , the Town Board can authorize the Planning Board to approve new subdivision - •, .r ', maps outside the village limits , etc . Before approving subdivision maps , the board would naturally look into all phases of the develop- ment to be sure roads , highways , fire control , etc . , were proper . A Planning Board is an advisory board and its recommenda- tions have to be adopted by the Town Board , but as a matter of practice , if the town board has confidence in the planning board it appoints , the recommendations are usually adopted . You cannot restrict the class of business in a particular neighborhood , the size of lots and spacing of buildings from the street without enacting a Zoning Ordinance and this is much more complicated as it requires the appointment of a zoning commission , publication of plans for the whole town and public hearings .
