Virgil Planning Board Meeting October 23, 2023 1 | Page TOWN OF VIRGIL PLANNING BOARD MEETING AND PUBLIC HEARING October 23, 2023, 7:00 PM BOARD MEMBERS PRESENT: Planning Board Chair Mark Baranello, Board Members, Karen Cushman, Dale Taylor, Sara Hollenbeck and Carole Lathrop OTHERS PRESENT: Alane Van Donsel Secretary, Attorney Dan Ellis APPLICANTS PRESENT: Applicant Richard and Sherri Beebe PUBLIC PRESENT: Matthew Simpson, Kelly Farinella 7:00 PM THE PLANNING BOARD CHAIR MARK BARANELLO OPENED THE PUBLIC HEARING: Planning Board secretary Alane Van Donsel read the legal notice that was posted in the Cortland Standard on October 17th and at the Virgil Town Hall on Oct. 12th. NOTICE IS HEREBY GIVEN that a meeting and a public hearing will be held before the Virgil Planning Board on October 23, 2023, at the Virgil Town Hall 1176 Church Street, Virgil NY 13045 at 7:00 PM. The meeting and public hearing is being held to consider the following application: The applicant and owner Richard Beebe owns land on West State Road tax Map #115.00-14-11.000 he is seeking a site plan review for a minor subdivision of a 37-acre lot. He would like to divide the lot into two lots, one with 408 ft of road frontage with 17 +/- acres and the second with 255 ft. of road frontage and 20 +/- acres. Mr. Beebe Spoke. He stated that he owns 37 acres with a barn and a well that he purchased several years ago. Matt Simpson would like to purchase the land. Mr. Beebe originally purchased the land to gain access to another parcel of land that he owns. He also thought that he might harvest the timber off that land. He would like to maintain a right of way to the back of his land. The subdivision will maintain 250’ of road frontage for both lots. The map he provided didn’t show the whole 37-acre parcel, only the subdivided lot. Mark Baranello asked three times if there were any other comments on this project. As there were none, Chairmen Baranello closed the public hearing at 7:06PM. 7:06 PM Planning Board Chair Mark Baranello opened the regular portion of the planning board meeting: Chairman Baranello discussed the requirements for the average lot with size. He stated that the average size needs to be at least 250’ feet, although the current law says 350’. Member Taylor stated that the average size of the back parcel is much wider. Discussion continued about the lot width size. There was a discussion on the method of calculation of the average lot size. Baranello stated that there is an error in the current Zoning law. The road frontage size was 350’ feet, but the minimum frontage was reduced to 250’, however the the average width size of a lot was not changed. The average remained at 350’ and the law still says 350’. Baranello stated that the Planning Board hopes that this is going to be corrected by the Town Board in November. Member Sara Hollenbeck pointed out that Mr. Bebee’s lots have an average lot width size of 375’. Baranello stated that Mr. Bebee will need a survey map that has the average width sizes calculated. Attorney Daniel Ellis-stated that the Town Board has a pending Local Law to correct the average width size to match the road frontage size. Member Taylor asked if this subdivision can be approved contingent upon the Town board passing the law on Nov. 9th. Zoning Officer Adam Brown stated there was no review from the county planning board. He said they can make it contingent on receiving County approval and that Mr. Beebe’s surveyor adds a second page with the remaining parcel showing the average width size. OLD BUSINESS: None NEW BUSINESS: RESOLUTION #23-24 APPROVAL OF A NEGATIVE DECLARATION ON PART II OF THE SHORT ENVIRONMENTAL ASSESSMENT FORM FOR THE MINOR SUBDIVISION OF TAX MAP #115.00-14-11.000: Member Dale Taylor made a motion to approve that the proposed action will not result in any significant adverse environmental impacts based on the information and analysis of the short Environmental Assessment Form and supporting documentation. Member Mark Baranello seconded the motion. Vote: Ayes Baranello, Cushman, Taylor, Hollenbeck and Lathrop. Nays: None Motion Carried RESOLUTION #23-25 APPROVAL OF THE MINOR SUBDIVISION FOR TAX MAP#115.00-14-11.000 FOR THE PROPERTY CURRENTLY OWNED BY RICHARD AND SHERRI BEEBE: Member Dale Taylor made a motion to approve the subdivision for tax map #115.00-14- Virgil Planning Board Meeting October 23, 2023 2 | Page 11.000, barring that there aren’t any negative recommendations from the Cortland County Planning board and that the presentation of a complete survey map is provided showing the average lot width size of the subdivided lots. Member Karen Cushman seconded the motion. Vote: Ayes Baranello, Cushman, Taylor, Hollenbeck and Lathrop. Nays: None Motion Carried RESOLUTION #23-26 PLANNING BOARD MINUTES FROM SEPTEMBER 25, 2023: Member Sara Hollenbeck made a motion to approve the Planning Board minutes from 09-25-2023. Member Mark Baranello seconded the motion. Vote: Ayes Baranello, Cushman, Hollenbeck and Lathrop. Abstain: Taylor Nays: None Motion Carried With no further business to discuss, Chairman Baranello asked for a motion to adjourn the meeting at 7:30 PM. Member Dale Taylor motioned to adjourn. Member Carole Lathrop seconded the motion. Vote: Ayes Baranello, Cushman, Taylor, Hollenbeck, and Lathrop.
