HomeMy WebLinkAbout09-25-2023 Planning Board Meeting Approved MinutesVirgil Planning Board Meeting September 25, 2023 1 | Page TOWN OF VIRGIL PLANNING BOARD MEETING AND PUBLIC HEARING September 25, 2023, 7:00 PM BOARD MEMBERS PRESENT: Planning Board Chair Mark Baranello, Co- Chair Sara Hollenbeck, Members: Karen Cushman, and Mike Carboine OTHERS PRESENT: Alane Van Donsel Secretary, Attorney Dan Ellis, APPLICANTS PRESENT: Applicant Matthew and Dave Denniston PUBLIC PRESENT: Gary Wood, Steve Kucerak CHAIRMAN RECUSED: Planning Board Chairman Mark Baranello recused himself from running the meeting due to a conflict of interest with the Denniston application. Co-Chair Sara Hollenbeck stepped in as chair. 7:03 PM THE PLANNING BOARD CO-CHAIR SARA HOLLENBECK OPENED THE PUBLIC HEARING: DAVID DENNISTON APPLICANT: Mr. Denniston stated that he and his son Matthew are the owners of Sugarbush Acres LLC. They inherited the property from his dad and Matthew’s grandfather who passed away. They now own a farmhouse that was built in 1873. They have looked at several options regarding what they would like to do with the house, most of the options would require variances. They have decided to sell the house and the hog house, chicken house and sap house with three acres of land. GARY WOOD VIRGIL RESIDENT ON SUGARBUSH LANE: Mr. Wood said he is in favor of this subdivision, and he would like the board to see fit to approve the application. STEVE KUCERAK VIRGIL RESIDENT ON SUGARBUSH LANE- Mr. Kucerak also doesn’t see any reason why this subdivision shouldn’t be approved. Sara Hollenbeck asked three times if there were any other comments on this project, as there were none, Co-Chairmen Sara Hollenbeck closed the Public Hearing at 7:07PM. Planning board co- chair Sara Hollenbeck opened the regular portion of the planning board meeting. OLD BUSINESS: RESOLUTION #23-21 APPROVAL OF A NEGATIVE DECLARATION ON PART II OF THE SHORT ENVIRONMENTAL ASSESSMENT FORM FOR THE MINOR SUBDIVISION OF TAX MAP #115.00-01-19.110: Member Michael Carboine made a motion to approve that the proposed action will not result in any significant adverse environmental impacts based on the information and analysis of the short Environmental Assessment Form and supporting documentations. Karen Cushman seconded the motion. Vote: Ayes Hollenbeck, Cushman and Carboine. Abstain: Baranello Nays: None Motion Carried RESOLUTION #23-22 APPROVAL OF THE MINOR SUBDIVISION FOR TAX MAP#115.00-01-19.110 FOR THE PROPERTY CURRENTLY OWNED BY SUGARBUSH FARMS LLC: Member Karen Cushman made a motion to approve the subdivision for tax map #115.00-01- 19.110 conditioned that a certified subdivision map is provided. Member Michael Carboine seconded the motion. Vote: Ayes Hollenbeck, Cushman and Carboine. Abstain: Baranello Nays: None Motion Carried CHAIRMAN MARK BARANELLO TOOK OVER AS CHAIRMAN OF THE MEETING NEW BUSINESS: None RESOLUTION #23-23 PLANNING BOARD MINUTES FROM AUGUST 28, 2023: Member Michael Carboine made a motion to approve the Planning Board minutes from 08-28-2023. Member Mark Barnello seconded the motion. Vote: Ayes Baranello, Cushman, & Carboine. Abstain-Hollenbeck Nays: None Motion Carried DISCUSSION ABOUT THE FORMER VIRGIL ELEMENTARY SCHOOL: Board members were interested in what was happening with the school building project. It was stated that the project is moving forward and there will be a public hearing on October 4th at 11AM for a County PILOT. With no further business to discuss, Chairman Baranello asked for a motion to adjourn the meeting at 7:20 PM. Member Michael Carboine motioned to adjourn. Member Karen Cushman seconded the motion. Vote: Ayes Baranello, Cushman, Hollenbeck, and Carboine.
