Adjornment | Agenda published on 03/23/2023 at 1:10 PM Planning Board Agenda Monday, March 27, 2023 at 5:00 pm NOTICE OF SPECIAL MEETING OF THE VIRGIL PLANNING BOARD NOTICE IS HEREBY GIVEN that a special meeting will be held on March 27, 2023, with the Town of Virgil Planning Board for the purpose of touring the former Virgil Elementary School Building. The board will meet at the Virgil Town Hall 1176 Church Street, Virgil NY 13045 at 5:00PM on Monday 3-27-23. This meeting will include a tour of the former Virgil Elementary School located at 1208 Church Street in the Town of Virgil with prospective property owner Kajen LLC. Following the tour, the meeting will return to the Virgil Town Hall to complete any remaining agenda items. Kajen LLC wishes to acquire the former Virgil Elementary School Building to convert into senior housing and a community center. Information on this proposed project is available at www.virgilny.org or contact the office of the Town Clerk at (607) 835-6174, Ext. 2. Any persons wishing to attend the tour may do so and may attend the planning board meeting. Individuals are invited to attend and may speak in person, by attorney, or by another representative. Communications in writing in relation thereto may be filed ahead of time with the Board or at such meeting. The location of the meeting is accessible to persons with disabilities. If special accommodations are needed for persons with disabilities, those with hearing impairments, or those in need of translation from English, those individuals should contact the Town of Virgil Dated: 03-09-2023 Alane Van Donsel Virgil Town Clerk on Behalf of The Virgil Planning Board Virgil Planning Board Meeting February 27, 2023 1 | Page TOWN OF VIRGIL PLANNING BOARD MEETING February 27, 2023, 7:00 PM BOARD MEMBERS PRESENT: Planning Board Chair Mark Baranello, Board Members, Sara Hollenbeck, Karen Cushman, Dale Taylor and Mike Carboine Absent: Carole Lathrop OTHERS PRESENT: Alane Van Donsel Secretary, Attorney Dan Ellis, Adam Brown Zoning Officer APPLICANTS & PUBLIC PRESENT: Applicant’s Steve & Yvonne Terwilliger, Danial Haynes, Al and Gayle Kryger, Jereme Stiles, Gary Wood, Sandy Price, 7:09 PM THE PLANNING BOARD CHAIR MARK BARANELLO CALLED THE MEETING TO ORDER OLD BUSINESS: REVIEW OF UPDATED SITE PLAN OF THE ICECREAM STORE: Mark Baranello said that he looked over the criteria that the planning Board members wanted to see added to the plans. Baranello stated that he felt that Hayne did add all the items, they were questioning the legibility of the items. They questioned Mr. Haynes on a few items that were added. Zoning Officer Adam said its up the planning board if they feel comfortable with the updated site plan. Sara Hollenbeck felt that certain elements weren’t legible. She was concerned with a crease in the paper that ran down the exit driveway. The board continued to question Haynes on the drawing. RESOLUTION 23-05 APPROVAL OF THE UPDATED SITE PLAN FOR THE ICE CREAM STORE: Member Sara Hollenbeck made a motion to approve the updated site plan for the Ice cream store. Member Baranello seconded the motion. Vote: Ayes Baranello, Hollenbeck, Cushman, Taylor and Carboine Nays: None Motion Carried NEW BUSINESS: PUBLIC NOTICE OF A PLANNING BOARD MEETING: NOTICE IS HEREBY GIVEN that a meeting will be held before the Town of Virgil Planning Board on February 27, 2023, 7 p.m. at the Virgil Town Hall 1176 Church Street, Virgil NY 13045. This meeting is being held to consider an application for a Site Plan Review to start the process for gaining approval for a senior housing floating zone approval for a proposed senior/disabled housing apartment building and community center. Tax Map# 126.14-02-21.000 and 126.14-0220.110. The applicant Kajen LLC wishes to purchase the former Virgil Elementary School Building to turn it into senior housing and a community center. KAJEN LLC SENIOR HOUSING & COMMUNITY CENTER TAX MAP# 126.00-14-02-21.00 & 126.14-02-20.110: Steve Terwilliger from KAJEN LLC is proposing to purchase the former Virgil Elementary School. Terwilliger is planning to put in roughly 19 apartments for senior housing and or disabled housing. The second part of the plan is to partner with the Homer Preforming Arts center. They have a whole array to things that they’d like to do, such as plays, lessons for children and adults, pottery and music lessons. He said that Ty Marshall was here and spoke to the Town Board regarding the community center. Terwilliger said he’d like to allow the Virgil senior’s to host luncheons and maybe have a drop off center for children. Perhaps there will be a medical facility for the people of the apartments as well as the community. The third part of the plan is he’d like to bring back sports to the fields. Terwilliger isn’t sure if there is interest in this, perhaps there are less children, but he would like to revive the sports programs. Mark Baranello stated that the board just received the county review, and he noticed that the property is designated as an independent living facility and or congregate housing, meaning a boarding house. Terwilliger stated that they will be all self-sufficient apartments with kitchens and bathrooms. Dale Taylor asked about disabled housing. Terwilliger stated that it’s going to be senior housing, but if say a disabled veteran needs an apartment, he’d like to be able to rent to them, but 55 and older is the focus. This is all going to be achieved with private funds. There was discussion between the applicant and the board regarding the parameters on 55 and older and the accessibility of the apartments. The applicant wanted to make it clear that the budling is accessible because it has an elevator and a wheelchair lift. Sara Hollenbeck read a couple lines from the county’s recommendations. There was some discussion on the senior housing district floating district and disabled persons. Attorney Dan Ellis stated that the only limiting criteria is that those renting the apartment need to be 55 and over. The discussion continued for quite a while. RESOLUTION 23-06 SPECIAL MEETING TO YOU’RE THE SCHOOL: The Virgil Planning Board decided that they would like to tour the school in order to get a better understanding of the site plan. Member Dale Taylor made a motion to set a meeting for March 27th at 5:00PM to tour the school. The Planning Board will meet at the Town Hall at 5:00 PM and walk over to the school. The regularly scheduled Planning Board meeting will start at 7:00 PM at the Virgil Town Hall on the same day. The motion was seconded by Mark Baranello. Vote: Ayes Baranello, Hollenbeck, Cushman, Taylor and Carboine Nays: None Motion Carried RESOLUTION 23-07 APPOINTMENT OF A CO-CHAIR TO THE PLANNING BOARD: Member Dale Taylor nominated Sara Hollenbeck as co-chair of the Planning Board. Member Mike Carboine seconded the motion. The co-chair will act as the chair, if the chairperson is not available and she can sign documents. Vote: Ayes Baranello, Hollenbeck, Cushman, Taylor and Carboine Nays: None Motion Carried Vote all ayes. RESOLUTION 23-08 PLANNING BOARD MINUTES FROM JANUARY 23, 2023: Member Sara Hollenbeck made a motion to approve the Planning Board minutes from 01-23--2023. Member Mark Baranello seconded the motion. Vote: Ayes Baranello, Hollenbeck, Cushman, Carboine.
