Old Business NONE Applicant: Daniel Haynes Address of the Property: 1764 Route 392 Tax Map# 127.00-04-01.000 Zone: C Amendment to the Project: This project was previous approved by the Virgil Planning Board on January 21, 2022, by Resolution 22-02. The owner and applicant seek to make an amendment to the site plan. He would like to modify the driveway making the traffic flow to be in a one-way direction with two driveways. He has reached out to the NYS DOT for their approval and Cortland County Planning stated they don’t require a review, as they consider this a minor change. Adjornment Planning Board Agenda Monday, November 28, 2022 at 7:00 pm | Agenda published on 11/18/2022 at 1:33 PM Firefox about:blank 1 of 1 11/28/2022, 10:56 AM Virgil Planning Board Meeting September 25, 2022 1 | Page TOWN OF VIRGIL PLANNING BOARD MEETING September 26, 2022, 7:00 PM BOARD MEMBERS PRESENT: Planning Board Chair Mark Baranello, Board Members Sara Hollenbeck, and Sylvia Cook OTHERS PRESENT: Alane Van Donsel Secretary APPLICANTS & PUBLIC PRESENT: Applicants Steve Kucerak and Gary Wood, Dave Denniston and Zoning Officer Adam Brown 7:00 PM THE PLANNING BOARD CHAIR MARK BARANELLO CALLED THE PUBLIC HEARING TO ORDER PUBLIC HEARING: LEGAL NOTICE: NOTICE IS HEREBY GIVEN that a meeting and public hearing will be held before the Town of Virgil Planning Board on September 26, 2022, 7 p.m. at the Virgil Town Hall 1176 Church Street, Virgil NY 13045. This meeting is being held to consider an application for a lot line adjustment for 2624 Sugarbush Lane, Dryden NY 13053 Tax Map# 115.00-01-45.000 and 2630 Sugarbush Lane Tax Map # 115.00-01-46.000. The lot line adjustment will result in increasing Tax map # 115.00-01-45.000 by +0.10 acres making it a total of 0.81 acres and decreasing Tax Map #115.00-01-46.000 by -0.10 acres totaling 3.07 acres and the road frontage decrease will be 15’, but still over the minimum for a total of 556.3’. Gary Wood spoke, and he is giving one tenth of an acre to his neighbor Steve Kucerak. Steve spoke and said that its basically y moving the lot line over a little bit, and it doesn’t change the road frontage. The adjustment will continue to keep woods lot to over the 3-acre minimum and will increase Kucerak’s lit to 1.8 acres. They plan to put a garden in. Dave Denniston neighbor from 262 West State Road is in full support of the project. Chairman Baranello asked three times if there were any further comments on this matter, as there were none, he called for a close of the public hearing at 7:05 PM and he opened the regular meeting portion of the meeting. RESOLUTION #22-026 APPROVAL OF A NEGATIVE DECLARATION of TAX MAP #115.00-01-45.000 AND TAX MAP# 115.00-01-46.000: Member Sara Hollenbeck made a motion to declare a negative declaration based on the information and supporting documentation that the proposed action will not result in any significant adverse environmental impacts. Member Sylvia Cook seconded the motion. Vote: Ayes Baranello, Hollenbeck, and Cook Nays: None Motion Carried RESOLUTION #22-27 APPROVAL OF LOT LINE ADJUSTMENT: Member Sylvia Cook made a motion to approve the lot line adjustment for Tax Map# 115.00-01-45.000 and 2630 Sugarbush Lane Tax Map # 115.00-01-46.000 increasing Tax map # 115.00-01-45.000 by +0.10 acres making it a total of 0.81 acres and decreasing Tax Map #115.00-01-46.000 by -0.10 acres totaling 3.07 acres and the road frontage decrease will be 15’, but still over the minimum for a total of 556.3’. The motion was seconded by Member Sara Hollenbeck. Vote: Ayes Baranello, Hollenbeck, and Cook Nays: None Motion Carried RESOLUTION #22-028 PLANNING BOARD MINUTES FROM AUGUST 29, 2022: Member Sylvia Cook made a motion to approve the Planning Board minutes from 08-29-2022. There is a public hearing with the Town Board on this matter on September 29th. Member Sara Hollenbeck seconded the motion Vote: Ayes Baranello, Hollenbeck, and Cook Nays: None Motion Carried FURTHER DISCUSSION: Sara Hollenbeck asked if the county approved the changes to the comprehensive plan. Adam Brown stated they just received them today. Town Clerk Van Donsel said she has attached the comments to the agenda to the upcoming town board meeting. There was further discussion regarding the proposed Chicken Law. The County stated that they wanted to know if the town was going to investigate regulation all poultry. Discussion continued regarding the proposed Chicken Law. With no further business to discuss, Chairman Baranello asked for a motion adjourn the meeting at 7:20 PM. Member Sara Hollenbeck motioned to adjourn. Member Sylvia Cook seconded the motion.
