HomeMy WebLinkAbout04-25-2022 Approved Planning Board Meeting MinutesVirgil Planning Board Meeting April 25, 2022 1 | Page TOWN OF VIRGIL PLANNING BOARD MEETING April 25, 2022, 7:00 PM BOARD MEMBERS PRESENT: Planning Board Chair Mark Baranello, Board Members Dale Taylor, Sylvia Cook and Carole Lathrop OTHERS PRESENT: Alane Van Donsel Secretary, Daniel Ellis II Town Attorney APPLICANTS & PUBLIC PRESENT: Jarid Poirier applicant, John Delvechicco Attorney for applicant, Jereme Stiles Deputy Superintendent 7:00 PM THE PLANNING BOARD CHAIR MARK BARANELLO CALLED THE PUBLIC HEARING TO ORDER LEGAL NOTICE: NOTICE IS HEREBY GIVEN that a meeting and public hearing will be held before the Town of Virgil Planning Board on April 25, 2022, 7 p.m. at the Virgil Town Hall 1176 Church Street, Virgil NY 13045. This meeting is being held to consider a site plan review for the owner Jarid Poirier of 1646 Daisy Hollow Road Tax Map # 135.00-03-14.200 to subdivide off a house with 2.5 acres, He is also seeking a variance from the Virgil ZBA at 6:00 PM because 2.5 acres is less than the required 3-acre lot according to the Virgil zoning law. Posted at the Virgil Town Hall on April 25, 2022, and Published in the Cortland Standard on April 23, 2022 Attorney John Delvechicco explained the project to the board. Chairman Baranello asked three times if there were any further comments, with no further comments Chairman Baranello closed the public hearing at 7:06 PM. RESOLUTION #22-018 APPROVAL OF A NEGATIVE DECLARAION UNDER THE NYS SEQR ACT FOR 1646 DSISY HOLLOW ROAD: Member Dale Taylor made a motion to declare a negative declaration based on the information and supporting documentation that the proposed action will not result in any significant adverse environmental impacts. Member Carole Lathrop seconded the motion. Vote: Ayes Lathrop, Baranello, Taylor & Cook. Nays: None Motion Carried RESOLUTION #22-19 APPROVAL OF THE SITE PLAN REVIEW FOR #135.00-03-14.000 WITH A CONTINGENCY: Member Dale Taylor made a motion to approve the site plan for the subdivision of tax map #135-03-14.000 with the condition that the following contingency is met: that the 1.5 +/- acre lot on the west side of Daisy Hollow Road is combined with an existing adjacent 1.7 +/- acre lot current owned by the applicant. The motion was seconded by Member Carole Lathrop. Vote: Ayes Lathrop, Baranello, Taylor & Cook. Nays: None Motion Carried RESOLUTION #22-020 PLANNING BOARD MINUTES FROM February 28, 2022: Member Dale Taylor made a motion to approve the Planning Board minutes from 03-28,2022. Member Sylvia Cook seconded the motion. Vote: Ayes Baranello, Taylor and Cook Nays: None. With no further business to discuss, Chairman Baranello asked for a motion adjourn the meeting at 7:25 PM. Member Carole Lathrop motioned to adjourn. Member Cook seconded the motion. Vote: Ayes Chairman Baranello, Members Cook, Lathrop and Taylor.
