RESOLUTION #22-01 A PUBLIC HEARING WAS CALLED: NOTICE IS HEREBY GIVEN that a meeting and public hearing will be held before the Town of Virgil Planning Board on January 24, 2022, at 7 p.m. at the Virgil Town Hall 1176 Church Street, Virgil NY 13045. This meeting and public hearings is being held to consider the following applications: 1. Vaughn and Susan Sherman owners of 125.00-03-04.000, located at 2219 Gee Hill Rd, Dryden NY 13053. Filed an application for a subdivision, subject to an area variance approval from the ZBA held on 01-24-2022 at 6PM. The owners wish to subdivide off a house with one acre 2. Sheila Morse owner of 107.00-03-05.000, located at 1724 & 1716 Tower Road, Virgil NY 13045 is looking to subdivide a 15.3-acre parcel that contains two dwellings and 2 barns. An area variance was approved by the Virgil ZBA on 06-27-2016, however the subdivision was never completed at that time. 3. Joshua Rood and Courtney Snover owner of 126.14-02-13.000 located at 1193 Church St. Virgil, NY 13045, wishes to obtain a home occupation permit to be able to continue a part-time vehicle detailing business. 5. Daniel A. Haynes Jr. is seeking a site plan review of a proposed Ice cream store with indoor seating. The parcel is located at 1764 RTE. 392 tax map#127.00-04-01.000. A Public Hearing has already taken place on this matter. SUBDIVISION FOR SHERMAN ON SIMMS HILL ROAD: Planning Board Chair Mark Baranello called the public hearing number one for a Subdivision for 276 Simms Hill Road, Owners Vaugh and Susan Sherman. to order. Vaugh and Susan Sherman stated that their variance was approved by the Virgil Zoning Board of Appeals. The Shermans made a statement about their project. There were no members of the public that spoke on this matter. Chairman Baranello asked three times if there were any further comments on this matter and there were none. Chairman Baranello closed this portion of the Public Hearing at 7:02PM. 2. SUBDIVISION FOR ROWLAND & DAVIDSON ON PAGE GREEN ROAD: Planning Board Chair Mark Baranello called the public hearing number two for a Subdivision on 2824 Page Green Road and 2714 Jenkins Road. Owner of 2714 Jenkins Road and purchaser of the subdivided off parcel Joseph Davidson spoke about this subdivision. There were no members of the public that spoke on this matter. Chairman Baranello asked three times if there were any further comments on this matter and there were none. Chairman Baranello closed this portion of the Public Hearing at 7:03PM. 3. SUBDIVISION FOR MORSE ON TOWER ROAD: Planning Board Chair Mark Baranello called the public hearing number three for a Subdivision for 1724 and 1716 Tower Road for owner Sheila Morse. Sheila Morse spoke about the subdivision request. There were no members of the public that spoke on this matter. Chairman Baranello asked three times if there were any further comments on this matter and there were none. Chairman Baranello closed this portion of the Public Hearing at 7:05PM. 4. HOME OCCUPATION PERMIT FOR 1193 CHURCH STREET: Planning Board Chair Mark Baranello called the public hearing number four for a request for a Home Occupation Permit for 1193 Church Street. Petitioner Joshua Rood spoke about his home business and about the Home Occupation Request. There were no members of the public that spoke on this matter. Chairman Baranello asked three times if there were any further comments on this matter and there were none. Chairman Baranello closed this portion of the Public Hearing at 7:07PM. 7:08 PM THE REGULAR PORTION OF THE PLANNING BOARD MEETING WAS CALLED TO ORDER BY PLANNING BOARD CHAIR MARK BARANELLO OLD BUSINESS: DANIEL A. HAYNES JR. IS SEEKING A SITE PLAN REVIEW: Site Plan review of a proposed Ice cream store with indoor seating. The parcel is located at 1764 RTE. 392 tax map#127.00-04-01.000. A Public Hearing has already taken place on this matter. There was much discussion on this matter. There is a recording of the meeting on Laserfiche if you wish to review the discussion. RESOLUTION #22-02 APPROVE THE SITE PLAN FOR #127.00-04-01.000 AN ICE CREAM STORE WITH INDOOR SEATING: Member Carole Lathrup made a motion to approve the site plan for the ice cream store with come contingencies. One being a new drawing would be submitted showing the area around the building including the parking spaces and accessible parking spaces. Also, they would like to see the parking curb bumpers. They would also like to see the roadway and path to the dumpster. Member Karen Cushman seconded the motion. Vote: Ayes Chairman Baranello, Members Lathrop & Cushman. Member Karen Cushman seconded the motion. Vote: Ayes Chairman Baranello, Lathrop & Cushman. Nays: None Motion Carried RESOLUTION #22-04 APPROVAL OF THE SITE PLAN REVIEW OF THE PROPRTY LOCATED AT 276 SIMMS HILL ROAD TAX MAP#125.00- 03-04.000: Member Carole Lathrup made a motion at approve the site plan review to Subdivide Tax Map # 125.00-03-04.000 276 Simms Hill Road, a house with one acre. Nays: None Motion Carried TABLE PLANNING BOARD MINUTES FROM JANUARY 24, 2022: Chairman Baranello stated that they are going to table the minutes from January 24, 2024, because they didn’t have a quorum of members who were present at the meeting. DISSCUSSION: There was some discussion on the Haynes Ice cream Store project. The planning Board looked at the map. Adam Brown mentioned some training opportunities coming up. With no further business to discuss, Chairman Baranello asked for a motion adjourn the meeting at 7:40 PM. Member Dale Taylor motioned to adjourn. Member Sylvia Cook seconded the motion.
