Members of the public representing themselves. 7:00 PM –THE PUBLIC HEARING WAS CALLED TO ORDER Planning Board Chair Jeffrey Breed called the public hearing to order. The legal notice was posted at the Virgil Town Hall and on the Virgil Website. The adjoining neighbors were all notified by letter from both projects. Matthew Hollenbeck explained his proposed project. Steve Terwilliger did voice concersn over the Hollenbeck project due to the fact the the business was in noncomplian ce for their sign. Terwilliger felt that they shouldn’t be approved for the new sign, unless they came into compliance. Chairman Breed asked three times if there were any other comments about the Hollenebeck project. There were none. RESOLUTION #21-39 A PUBLIC HEARING WAS CALLED: MEETING & PUBLIC HEARING OF THE PLANNING BOARD NOTICE IS HEREBY GIVEN that a meeting and public hearing will be held before the Town of Virgil Planning Board on the 23rd of August 2021, at 7 p.m. at the Virgil Town Hall 1176 Church Street, Virgil NY 13045. OLD BUSINESS: There was no old business on the agenda. NEW BUSINESS: INDEX # 21-40 THE SITE PLAN REVIEW OF 1265 STATE ROUTE 392 HOLLENBECK HOLLOW WAS TABLED: Member Mark Baranello made a motion to Table the proposed Hollenbeck Hollow Project to seek council from the town’s attorney. Sylvia cook seconded the motion. Vote: Ayes Chairman Breed, Members Hollenbeck, Cook and Baranello. Abstain: Taylor. Nays: None Motion Carried RESOLUTION #21-41 NEGATIVE DECLARATION UNDER SEQR FOR THE SITE PLAN REVIEW OF PROPRTY LOCATED ON WEST STATE ROAD: Member Mark Baranello made a motion to approve a negative declaration on the SEQR review site plan review of a proposed site plan review to consolidate four parcels located on West State Road Tax Map #’s 115.00-15-06.000; 155.00-15-14.000; 115.00-15- 03.200 and 115.00-10-05.000. Member Sylvia Cook seconded the motion. Vote: Ayes Chairman Breed, Members Hollenbeck, Baranello, Lathrop & Taylor. Member Sylvia Cook mentioned seconded the motion. Vote: Ayes Chairman Breed, Members Hollenbeck, Lathrop & Taylor. Abstain: Cook Nays: None Motion Carried With no further business to discuss, Member Breed asked for a motion adjourn the meeting at 7:53 PM PM. Member Sylvia Cok motioned to adjourn. THE PUBLIC HEARING WAS CLOSED AT 7:11 PM 21-40 Member Mark Baranello made a motion to TABLE the proposed Hollenbeck Hollow Project until the next meeting of the Virgil Planning Board to seek council from the town’s attorney. Sylvia cook seconded the motion. Vote: Ayes Chairman Breed, Members Hollenbeck, Cook and Baranello. Abstain: Taylor Nays: None Motion Carried 21-41 Member Mark Baranello made a motion to approve a NEGATIVE DECLARATION on the SEQR review for a site plan review to consolidate four parcels located on West State Road Tax Map #’s 115.00-15-06.000; 155.00-15-14.000; 115.00-15-03.200 and 115.00-10-05.000. Member Sara Hollenbeck seconded the motion. Vote: Ayes Chairman Breed, Members Hollenbeck, Cook & Baranello. Abstain: Taylor Nays: None Motion Carried 21-42 Member Sara Hollenbeck made a motion at approve the subdivision a site plan review to consolidate four parcels located on West State Road Tax Map #’s 115.00- 15-06.000; 155.00-15-14.000; 115.00-15-03.200 and 115.00-10-05.000 into two parcels. The subdivision was APPROVED provided that the normal town required subdivision rules and regulations are followed. The motion was seconded by Member Sylvia Cook. Vote: Ayes Chairman Breed, Members Hollenbeck, Cook, Baranello. Abstain: Taylor Nays: None Motion Carried 21-43 Member Sara Hollenbeck made a motion to APPROVE the planning board draft minutes from the July 26, 2021, meeting with some corrections.
