Moore, Applicant; Diana Blodgett. PUBLIC HEARING The Public Hearing was opened at 7 p.m. by Chairman Jeffrey Breed with the Board Secretary reading aloud the Legal Notice as published in the Cortland Standard on 11 September 2020. Proof of Publication has been placed on file for the record. Kerry P. Moore, Applicant/Reputed Owner – 2454 Gee Hill Road – TM #115.00-11-11.000 – Site Plan Review – Proposed Subdivision, Site Plan, Conditional Permit Chairman Breed recognized the applicant who was seeking approval to Subdivide this 21.8±-acre parcel into two 3±-acre and one 15.8±-acre parcel, build a home for his daughter on one of the three-acre parcels, and build a home for his disabled son on the other three-acre parcel. He was also requesting Site Plan/Conditional Permit approval to remove an existing mobile home, build a new home with one-chair salon on the existing mobile home pad and one-car garage on the larger 15.8±-acre parcel. Mr. Moore reported that he had already received approval for water and septic utilities. Chairman Breed asked if there were any Board questions or public comments regarding this request; there were none. With everyone having been heard who wished to be heard, Chairman Breed closed the Public Hearing at 7:06 p.m. REGULAR MEETING The Regular Meeting of the Town of Virgil Planning Board was called to order by Chairman Breed at 7:06 p.m. OLD BUSINESS - NONE NEW BUSINESS Kerry P. Moore, Applicant/Reputed Owner – 2454 Gee Hill Road – TM #115.00-11-11.000 – Site Plan Review – Proposed Subdivision, Site Plan, Conditional Permit Town Attorney Patrick Snyder informed the Board that there was no need to complete individual Environmental Assessment Forms for these applications, one form would suffice. DRAFT (T) Virgil Planning Board Minutes of Public Hearing & Regular Meeting - 28 September 2020 Page 2 of 3 Member Dale Taylor questioned sharing of driveway and the applicant explained how it was used and also that there was a second driveway. Also, Member Taylor asked if the same septic system would serve two houses, and Mr. Moore said it would, and the Health Department had already approved it. Member Mark Baranello asked about accessory structures, and Attorney Snyder stated one primary house per lot was allowed, and he assumed CEO Kevin McMahon went over this; the applicant explained that this was the reason that the other dwelling was attached by a breezeway and, yes, he has reviewed everything with the CEO. The proposed garage would be 26 ft. by 77 ft. The one-chair salon will also occupy a portion of this garage and will be well ventilated. Member Baranello asked the applicant if he was aware of the parking requirements for a home occupation, and he responded he did not know. Member Baranello read from the Code. The need for a sign was discussed, with Member Sara Sirois quoting from the Code. She also questioned what would happen if the salon was expanded, and Attorney Snyder advised the Board could specify their wishes in their final decision. He also read the definition of a Home Occupation for clarification. At the request of the Chairman, the Board Secretary read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Taylor that the action, based on the information submitted, will not cause any significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Baranello, with the vote recorded as follows: Ayes: Chair Breed Nays: None Member Baranello Member Taylor Member Sirois Absent: Member Lathrop Alternate Member Cook Motion carried. This becomes Action #29 of 2020. At the close of a brief discussion, a motion was made by Member Baranello to approve the Minor Subdivision and Site Plan as requested, and approve the Conditional Permit for a one-chair salon, subject to the Zoning Regulations of the Town of Virgil as they apply to a Home Occupation. The motion was seconded by Member Taylor, with the vote recorded as follows: Ayes: Chair Breed Nays: None Member Baranello Member Taylor Member Sirois Absent: Member Lathrop Alternate Member Cook Motion carried. This becomes Action #30 of 2020. APPROVAL OF MINUTES – 24 AUGUST 2020 A motion was made by Member Taylor to approve the (T) Virgil Planning Board Minutes of 24 August 2020, as submitted. The motion was seconded by Member Sirois, with the vote recorded as follows: Ayes: Chair Breed Nays: None Member Baranello Member Taylor Member Sirois Absent: Member Lathrop Alternate Member Cook Motion carried. This becomes Action #31 of 2020. DRAFT (T) Virgil Planning Board Minutes of Public Hearing & Regular Meeting - 28 September 2020 Page 3 of 3 OTHER MATTERS • Chairman Breed asked about the Richard Beebe property with regard to their animals getting loose, and Member Sirois commented that there has not been any problem with this previous occurrence, and that the number of animals has not increased. Chairman Breed thought the fence now seems to be providing security. • Member Taylor asked about the Middendorf application considered at the last meeting, and it was reported that the application had been withdrawn. Not sure if any deed restrictions exist. ADJOURNMENT At 8:11 p.m., a motion was made by Member Taylor, seconded by Member Baranello, to adjourn the meeting.
