PUBLIC HEARING
The Public Hearing was opened at 7 p.m. by Acting Chairman Mark Baranello with
the Board Secretary reading aloud the Legal Notice as published in the Cortland
Standard on 21 October 2020. Proof of Publication has been placed on file for the
record.

01-15.000 – Proposed Minor Subdivision
Acting Chairman Baranello asked if there was anyone present who wished to comment on the
proposed subdivision. There was no one.
With everyone having been heard who wished to be heard,
Chairman Breed closed the Public Hearing at 7:02 p.m.

It is noted for the record that the Planning Board listened to Wes Kryger regarding an upcoming
project at Greek Peak.
REGULAR MEETING
The Regular Meeting of the Town of Virgil Planning Board was called to order by Acting
Chairman Baranello at 7:25 p.m.
Carlton & Bonnie Haines, Applicant/Reputed Owner – 2681 NYS Route 215 – TM #116.00-
01-15.000 – Proposed Minor Subdivision
Acting Chairman Baranello recognized the applicant who was seeking approval to subdivide this
20±-acre parcel into one 3±-acre and one 17±-acre parcel, and consolidate the larger parcel with
their adjacent TM #116.00-01-16.200. The applicants explained that they plan to sell the 3±-acre
remaining parcel and add the 17±-acre parcel to the subject 32±-acre parcel, making that 49±
acres.
Acting Chairman Baranello advised the applicants that there were setback requirements for any
proposed buildings, and that a survey/maps were also required. Member Sara Sirois read aloud
survey map requirements. It was also noted that the requested subdivision met all of the Town’s
regulations for such.
Acting Chairman Baranello acknowledged receipt of the staff report from the Cortland County
Planning Department, dated 2 October 2020 which he read into the record, a copy of which has
been placed on file for the record.

At the request of the Acting Chairman, the Board Secretary read aloud Part II of the Short
Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A
motion was then made by Member Lathrop that the action, based on the information
submitted, will not cause any significant adverse environmental impact, resulting in a
Negative Declaration. The motion was seconded by Member Sirois, with the vote recorded
as follows:

Motion carried.
This becomes Action #32 of 2020.
With no further discussion, a motion was made by Alternate Member Cook to approve the
Minor Subdivision as requested, conditioned upon the proposed 17±-acre parcel being
consolidated with the adjacent Tax Map Parcel #116-01-16.200 if possible. Proof of
consolidation shall be provided to the Town Code Enforcement Officer. If the parcels
cannot be consolidated as one tax map parcel, then no application will be made for
residential building permits on such parcel The motion was seconded by Acting Chair
Baranello, with the vote recorded as follows:

Motion carried.
This becomes Action #33 of 2020.
APPROVAL OF MINUTES – 28 SEPTEMBER 2020
A motion was made by Member Sirois to approve the (T) Virgil Planning Board Minutes of 28
September 2020, as submitted. The motion was seconded by Acting Chairman Baranello,
with the vote recorded as follows:
Ayes: Acting Chair Baranello Nays: None
Member Lathrop
Member Sirois Absent: Chairman Breed
Alternate Member Cook Member Taylor
Motion carried.
This becomes Action #34 of 2020.
OTHER MATTERS
• Town Attorney Patrick Snyder advised the Board that the proposed building at Greek Peak
would not require a Public Hearing, but only a Site Plan Review; however this was up to
the Planning Board.
ADJOURNMENT
At 7:45 p.m., a motion was made by Member Sirois, seconded by Acting Chairman Baranello, to
adjourn the meeting. All Board members present voted in the affirmative.
