CLMN ECKSTROM SAID HE WAS SATISFIED ABOUT QUESTIONS -HE HAD ON SUBSTANCES IN
THE SEWER SYSTEM. KEN ADAMS EXPLAINED THAT HE IS WORKING WITH THE DEC AND
HAS LETTER AND DIAGRAM, AND AT ADAMS EXPENSE., 2 SAND FILTER BEDS, ONE FOR
SUMMER— SPRING, AND ONE FOR WINTER. ALL DRAINAGE GOES TO BOTTOM SIDE OF ROAD.
THAT TO ALLEVIATE ANYTHING EVER TOUCHING THE SWAMP,THERR IS NO CHANCE THAT
ANYTHING. CAN LEACH OUT THIS WAY. THE SYSTEMS CAN BE SWITCHED. THE TOMPKINS

BERTHA GRIFFIN EXPLAINED THAT SHE HAD PUMP RUNNING IN HER CELGER AND WANTED
TO KNOW WHERE SEPTIC TANK WOULD BE AND WOULD IT RUN HER WAY. ADAMS EXPLAINED
THE SYSTEM TO HER.
KEN ADAMS SAID NO RESPONSE TO LETTERS SENT CONCERNING THE PROPERTY CHANGE.

At a special meeting of the Town Board of the Town of
Danby, Tompkins County, New York, held at the Town Hall of the
said Town, 1830 Danby Road, on the 1st day of July, 1988, at GoOo
p.m.

;Resolution and moved its adoption:
offered the following
WHEREAS, ABC CLEANING SERVICES OF ITHACA, INC., of the Town
of Danby, in May of 1986, duly applied to the Town Board for a
Planned Development District at 1906 Danby Road, which property
is currently zoned as a Planned Development District for retail
tractor sales and service and automotive and small engine repair,
and has indicated that it is desirous of changing the use of the
said property according to the plans and specifications submitted
to the Planning Board of the Town of Danby, and
WHEREAS, the Planning Board of the Town of Danby has made a
study of the proposed change in use of the land and has
recommended to the 'Town Board that an amendment to the Zoning
Ordinance of the Town of Danby be passed amending the current
Planned Development District in the area hereinafter described,
and
WHEREAS, a public hearing was held on this matter on the
1st day of July, 1988, at the Town Hall in the said Town of
Danby,
NOW, THEREFORE, be it
RESOLVED: that pursuant to Section 604 of the Zoning
Ordinance of the 'Town of Danby, ABC CLEANING SERVICES OF 1THACA,
INC., is hereby granted permission for a Planned Development
District pursuant to the following regulations:
(1) The area of the Planned Development District shall be
approximately 7.75 acres at 1906 Danby Road in the Town of Danby,
which is a portion of the property known as tax map parcel number

(to be provided], and which is more particularly described as
follows as shown on a survey map entitled "[to be provided before
passage]" and which is attached hereto:
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of
Danby, Tompkins County, State of New York, ,

(2) The business to be conducted at the said property
shall be limited to a carpet and upholstery cleaning service
business and a carpet- cleaning supplies wholesale
distributorship.
(3) The current building on the said property may be
renovated, which renovations may include additions of
approximately 19 x 40 feet, 13 x 15 feet, and 30 x 44 feet, as
indicated on the attached drawing.
(4) No chemicals other than those listed on the attached
documents or approved by OSHA, DEC, or other governmental entity,
either State or either now or in the future, shall be.,
used on the premises in connection with the business to be
conducted thereon, and disposal of all chemicals shall be done in
a way that is in strict compliance with all governmental
regulations, whether State, Federal, or local.

meet DEC and Tompkins County Health Department requirements and
specifications and shall be approved in writing by the DEC and
the Tompkins County Health Department prior to the commencement
of business operations on the said property.

Councilperson Dean Eckstrom
offered the following
Resolution and moved its adoption:
WHEREAS the Town of Danby has adopted and assumed
enforcement of the New York State Uniform Fire Prevention and
Building Code.by enactment of Local Law No. 3 of the Year
1984; and '
WHEREAS the New York State Uniform Fire Prevention and
1uilding Code requires that a new certificate of occupancy be
obtained upon the resale of any property; and

WHEREAS Section 11 of Local Law No. 3 of the Year 1984
gives the.Town Board the power to set fees for duties that the
Building Officer may be called upon to perform pursuant to
those laws;
NOW, THEREFORE, be it
RESOLVED: That after July 1, 1988, a fee of $50.00 will
be charged by the Building Officer for inspection and issuance
of a new certificate of occupancy for any property that is
resold, whether or not a prior certificate of occupancy has
ever been issued with respect to that property.
