A SPECIAL MEETING WAS HELD MARCH 30t 1988t 7:30PM, AT THE DANBY TOWN HALL,
1830 DANBY ROAD, TOWN OF DANBY, COUNTY OF TOMPKINS, NEW YORK, THE PURPOSE
OF THE SPECIAL MEETING WAS TO ADOPT BOND RESOLUTION TO PURCHASE A NEW GMC
ONE —HALF TON TRUCK FOR USE BY THE HIGHWAY DEPT, THE MEETING WAS CALLED

A special meeting of the Town Board of the Town of
Danby, Tompkins County; New York, was held at the Danby Town
Hall, 1830 Danby Road, on March 30, 1988, at 7:30 p.m.
The meeting was called to order by Frederick Dietrich,
and upon roll being called, the following were
PRESENT, -DEAN ECKSTROM COUNCILMAN
DOROTHY ROBERTS COUNCILWOMAN
JULIA TAGLIAVENTO COUNCILWOMAN
FREDRIC DIETRICH SUPERVISOR
ABSENT:
MARY OLTZ COUNCILWOMAN
The following resolution was offered by CL.MN_ DEAN F.CK.STROM
who moved its adoption, and seconded by
CLMN. JULIA TAGLIAVF.NTO , to wit:
BOND RESOLUTION DATED MARCH 30, 1988
A RESOLUTION AUTHORIZING THE ISSUANCE OF $12,000.00 IN
SERIAL BOND OF THE TOWN OF DANBY, TOMPKINS COUNTY, NEW
YORK, TO FINANCE THE COST OF THE PURCHASE OF A NEW GMC
ONE -HALF TON, FOUR -WHEEL DRIVE PICK -UP TRUCK FOR THE
,.HIGHWAY DEPARTMENT.

of the Town of Danby,
Tompkins
County, New
York (the "Issuer
")
as follows:

Section 1. Based upon the review of this action by the
Issuer, the Town Board hereby determines that it
:.� Type-II action under the State Environmental
Quality Review Act (Article 8 of the Environmental
Conservation Law) and therefore no further
environmental review is required.
Section 2. For the object of purpose of paying the cost of
the said new one -half ton, four -wheel drive GMC'
highway truck, there is hereby authorized to be
issued a serial bond (the "Bond ") of the-Issuer
pursuant to the provisions of the Local Finance
Law in an amount not to exceed $12,000.00.

Section 3. It is hereby determined that the maximum estimated
cost of the aforesaid object or-purpose is
$12,000.00, and the plan for the financing thereof
is payment of five percent-of the total cost from
current funds from the appropriate fund and the
remainder by the issuance of the Bond pursuant to
this resolution. The Bond shall be sold at public
or r:.;.vate sale and all further powers in
connection with the details and the sale thereof,
including renewals of such Bond, are hereby
delegated to the Danby Town Supervisor as chief
fiscal officer in accordance with the, Local
Finance Law.
Section 4. It is hereby determined and declared (a) that the
period of probable usefulness of the object of
purpose for which the Bond hereby authorized is to
be issued is five (5).years and (b) that
subdivision 28 of paragraph a of Section 11.00 of
the Local Finance Law of the State of New York is
applicable thereto.
Section 5. The proposed maturity of the Bond will not be in
excess of five (5).years.
Section 6. An annual appropriation shall be made in each year
sufficient to pay the principal of and interest on
the Bond as the same shall become due and payable
each year. In addition, the faith and credit of
the Issuer shall be and are hereby pledged for the
punctual payment of the principal of and interest
on the Bond as the same shall become due and
payable.
Section7. The validity of the Bond may be contested only if:
a, such obligations are authorized for an
object or purpose for which the Issuer is
not authorized to expend money, or
b. the provisions of law which should be
complied with at the date of the publication
of this resolution or summary thereof, are
not substantially complied with, and an
action, suit, or proceeding contesting such
validity is commenced within twenty days
after the date of such publication; or
C. such obligations are authorized in
violation of the provisions of the
Constitution.
Section 8. This resolution shall be published in full in the

Ithaca Journal, the official newspaper of the
Issuer, together with a notice of the Clerk in
substantially the form provided in Section 81.00
of the Local Finance Law.
Section 9. This resolution shall take effect immediately

DRAINAGE,, TERMS OF DEVELOPMENT, PUBLIC WATER, FIRE,, SPEED LIMITS IN THE PROJECT,

MRS_ WRTGUZ QUESTIONED THE NAME OF THE NEW ROAD?
MR SCHLECHT SAID TOWN
SHOULD CHECK WITH COUNTY SO THAT THERE IS NO DUPLICATION
OF ROAD NAME, USUALLY LEFT UP TO•THF, DEVELOPER,
SUPERVISOR DIETRICH STATED THAT TONIGHT WAS ONLY AN INFORMATION HEARING ON THE
BLOCK PUD,
MRS, JOANNE: DF,NISON QUESTIONED ROAD TO SPECS AND WHAT COULD BE BUILT THERE?
SUPERVISOR DIETRICH EXPLAINED THE AGREEMENT WITH JAMES HOVANEC AND HIS PLANNED
UNIT DEVELOPMENT, ACCESS FOR GAS AND ELECTRIC,
MRS. DENT.ON STATED THAT THE POLE WAS GOING IN HER YARD AS THEY DON'T WANT
POLES ON THE OTHER SIDE, OF THE ROAD. UNTIL SHE READ NOTICE IN THE PAPER SHE
HAD NO IDEA ANYTHING WAS GOING IN DOWN THERE:
SUPERVISOR DIETRICH STATED THE PROPOSAL CAME-TO THE BOARD AND THEN TO THE
PLANNING BOARD AND THE PLANNING BOARD RECOMMENDED IT TO THE TOWN BOARD,
MR, DUTCHER TOLD HER THAT MANY MEETINGS WERE HELD PRIOR RECOMMENDATION OF THE
BLOCK PUD,
SUPERVISOR DIETRICH STATED THAT THE NEW ROAD WOULD BE D.O.T. APPROVED AS IT
COMES OUT ONTO 968, HOWEVER THE OLD TOWN ROAD WOULD NOT HAVE BEEN APPROVED,
DISCUSSION ON WHETHER OLD TOWN ROAD IS A ROAD OR AN ABANDONED ROAD?
QUESTIONS ON WHEN, ,THE NEW ROAD WOULD BE (OPE'NE'D?
JIM HOVANEC EXPLAINED THAT THE ROAD WOULD BE READY IN ABOUT ANOTHER WEEK OR
SO, BUT BASE HAS TO PUT ON.
SSUPERVISOR DIETRICH STATED THAT THE ROAD HAS TO BE UP TO SPECS ACCORDING TO
HIGHWAY DEPT,
MRS, DENISON QUESTIONED WHEN THE UTILITIES WERE GOING IN?
MR. HOVANEC STATED IN THE ivZXT THREE WEEKS.
SUPERVISOR DIETRICH SAID HE WOULD LOOK INTO THE POLE BEING .PUT IN MRS. DENISON'S
YARD COULD BE MOVED NORTH A FEW FEET,
MR, HOVANEC STATED THAT THEY SHOULD BE GOING DOWN OLD TOWN ROAD, BUT THEY 'AREN'T
SO OTHER PEOPLE ARE EFFECTED AND HE WANTS IT KNOWN.
DICUSSION ON TRAFFIC ENTERING HIGHWAY AND IF STATE, WOULD ADD EXTRA PASSING LANE
ON E.ITHER'SIDE,
