THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF DANBY WAS
HELD FEBRUARY 8, 1988, AT THE DANBY TOWN HALL, 1830 DANBY ROAD,
DANBY, NEW YORK, COUNTY OF TOMPKINS. THE MEETING WAS CALLED TO
ORDER BY SUPERVISOR DIETRICH AT 8:00 PM PLEDGE OF ALLEGIANCE

ON A LIST TO BE CONTACTED REGARDING MEETINGS AND ETC.

SUPERVISOR DIETRICH REPORTED THAT HE HAD BEEN IN CONTACT
WITH THE STATE, RE: NOTICE, OF INSURANCE, INSURANCE' AGENT
REVIEWED IT AND THEY SENT THAT NOTICE. AHAED AND I RECEIVED
VERIFICATION HERE AND PUT A LETTER TOGETHER AND SENT THAT
OUT ON SATURDAY FEB. 6.
SUPERVISOR DIETRICH THANKED MR. MARISA FOR ALL HIS TIME AND
EFFORT,
HIGHWAY: PETE CODDINGTON REPORTED SOMEONE; TRIED TO BREAK IN
THE; TOWN HIGHWAY BARNS THE WEEKEND OF THE 30th, HE REPORTED
THAT THEY TIPPED A TRUCK OVER THE WEEK -END OF THE, 18th. THEY
HAVE IT BACK ON THE ROAD, HE REPORTED THAT Hh' CALLED ALBANY
ABOUT ADVERTISING FOR TRUCK, AND THE LADY THERE SAID ANYTIME;

APPROVAL - SHEPARDSON PLANNED DEVELOPMENT DISTRICT

At a special meeting of the Town Board of the Town of Danby,
Tompkins County, New York, held at the Town Hall of the said Town,
1830 Danby Road, on the 8th day of February, 1988 at 8:00 p.m.
Supervisor Dietrich offered the following Resolution and moved
its adoption:
WHEREAS., Albert L. and Rheta Shepardson of the Town of Danby,
in September 1987, duly applied to the Town Board for a Planned
Development District, and
WHEREAS_ a public hearing was held on this matter on October
19, 1987, at the Town Hall in the said Town of Danby, and
WHEREAS, a Resolution approving a Planned Development District
was approved by the Town Board at their regular meeting on the 9th
clay of November, 1987, and
WHEREAS, a several modifications to that original Resolution
appear to be in order to improve upon the said original Resolution
for a Planned Development District,
NOW, THEREFORE, be it
RESOLVED: that pursuant to Section 604 of the Zoning
Ordinance of the Town of Danby, Albert L. and Rheta Shepardson are
hereby granted permission for a Planned Development District
pursuant to the following limitations and that this Resolution
shall supersede the said original Resolution:
(1) The area of the Planned Development District shall be
approximately 5 acres at 40 Muzzy Road in the Town of Danby, which
is a portion of the property known as tax map parcel number
2. -1 -43.3; this Resolution is passed pending the receipt from the
Shepardsons of a survey locating the said 5 acres of the Planned
Development District on their_ larger parcel, and if such survey map
is not received within 90 days after the date of this Resolution
then the passing hereof is automatically rescinded.
(2) This authorization is limited to one building for a
retail business, approximately 20 feet by 22 feet in size, which
building may be expanded by 50% if necessitated by expansion of the
business, and one pole barn (not larger than 30 feet by 40 feet)
to be erected in the future to be used as a western museum,
together with an off street parking area to be provided for at least
8 to 10 cars, such parking area to be located primarily and as much
as possible on the north side of'the building so that to the

greatest extent possible the parking area is not visible from the
road, with the rest of the parking area located on the west side
of the building; this offstreet parking area is to be enlarged
appropriately if the business authorized in this Planned
Development district expands so that more parking is necessary, the
intent of this provision being that there should be no necessity
for customers of the business to park along the road thus
disrupting the residential nature of the neighborhood.
