At a regular meeting of'the Town Board of the Town of
Danby, Tompkins County, New York, held at the gown Hill of the
C•���a ! own, ibJU Danby Road, on the '3th day of November, 1u8Y at
Councilwoman Dorothy Roberts offered the following
Resolution and moved its adoption:'
WHEREAS, Albert L. and Rheta Shepardson of the Town of
Danby, in September of 1.987, duly applied to the Town hoard for a
Planned Development District, and
WHEREAS, a public hearing was held on this matter on
October 19, 1987, at the Town Hall in the said Town oi= Danby,
NOW, THEREFORE, be.it
RESOLVED: that pursuant to Section 504 of the Zoning,
Ordinance of the Town of Danby, Albert L. and Rheta Shepe.rdson
are hereby grantee' permission for a Planned Development District
pursuant to the follow =ng limitations:
(1) The area of the Planned Development District shall be
approximately 5 acres at 40 Muzzy Road in the Town of Danby.
which is a portion of the property known as tax map parcel number
'1 -43.3; this Resolution is passed pending the receipt from the
Slh.epardsons of a survey locating the said 5 acres of the Planned
'U felopment Distric. Dn their larger parcel and., locating -the
kI lH.i n,g on that 5 acre parcel, and if such slarvey rla:r is not
received within 90 days after the date of this Nesolut.ion then
tie passing hereof is automatically rescinded.
2) This authorization is limited to one 5uilding,
alaproxi.m. ately 20 feet by 22 feet in size, together with an
offstreet parking area to be provided for at least 8 to 10 cars,
such parking area to be located on the north side-of the building
so that it is not visible from the road; this off street parking
.:area is to be enlarged appropriately if the business authorized
in this Planned Development District expands so that more parking
is necessary, the intent of this provision being that there

should be no necessity for customers of the business to park
along the road and thus disrupting the residential na ":r of the
neighborhood.
(3) This authorization is further limited to the retail
sale of western wear and tack, and this authorization
specifically excludes the display or sale of firearms,
ammunition, or other weaponry.
(4) This authorization includes provision for a non-
electric and non-flashing sign . stating the nar!ie of the business,
which sign is to '�� no larger than 1b square feet and, which is to
be in keeping with the rural residential nature of the
neighborhood and the nature of the business; the design of the
siren and its proposed location shall be submitted to the Town
Board for its approval prior to its actual construction ane
installation.
