RECORDING SECRETARY: JOAN BABBITT, TOWN CLERK
THE TOWN CLERK READ THE NOTICE OF THE PUBLIC HEARING AS PUBLISHED
IN THE ITHACA JOURNAL, OCTOBER 16, 19876
SU-PERVISOR BURDICK ASKED MR, SHEPAHRDSON IF THIS WAS THE DRAWING
--------------- - --
THEY HAD SUBMITTED TO THE PLANNING BOARD?
MR. SHEPARDSON: YES
SUPERVISOR BURDICK: THERE ARE A FEW QUESTIONS THE TOWN BOARD HAS
------------------
USUALLY'THERF. HAS TO BE A SURVEY DONE OF PROPERTY BOUNDERIES,
THERE IS USUALLY SOMETHING IN WRITING FROM
THE PLANNING BOARD
OR FROM YOU SAYING THEY APPROVE IT AND THE
REASON WHY THEY ARE
APPROVING IT, IF THERE IS GOING BE SEPARATE.
BUILDINGS AS IN YOUR
CASE FOR A STORE, THERE IS THE QUESTION OF
BATHROOMS, SEPTIC
SYSTEM AND OTHER THINGS. THE PLANNING BOARD
HAS NOT TOLD YOU ANY
OF THOSE THINGS?
MR. SHEPARDSON: N0, HE TOLD US WE WOULD HAVE
TO HAVE A SURVEY,
--------------- -
BUT TO HOLD OFF UNTIL WE FIND OUT WHETHER
IT HAS BEEN APPROVED
BEFORE WE NEED TO GO AHEAD AND DO A SURVEY,
SUPERVISOR_ BURDICK: THAT IS SOMETHING I'M
WE APPROVE SOMETHING THEN YOU GO AHEAD TO
QUESTIONING, WHETHER
NEXT STEP OR YOU DO ALL
THE STEPS AND THEN A FINAL THING?
MR, SHEPHHRDSON: THAT IS WHAT HE TOLD US,
FIND OUT IF IT GETS
--------------- --
APPROVAL OR NOT, NOT TO BE IN A RUSH.
,
SUPERVISOR_ BURDICK: MY SUGGESTION TO THE
HERE FROM THE PUBLIC IS THAT WE LISTEN TO
TOWN BOARD AND THE PEOPLE
THE PUBLIC AND IT LOOKS
LIKE MOST OF THEM ARE NEIGHBORS OF YOURS.
WE WILL NOT MOVE TONIGHT
TO VOTE YES OR NO ON IT, BUT TAKE THE QUESTIONS
AND CONCERNS BACK
TO THE PLANNING BOARD AND TALK TO THE PLANNING
BOARD AND GET THEIR
RECOMMENDATION, BECAUSE WE DON'T HAVE OUR
DATION.
PLANNING BOARDS RECOMMEN-
MR. SHEPARDSON:_ I THOUGHT HE TOLD YOU AT
THE LAST TOWN BOARD ME,'E'T.ING?
SUPERVISOR BURDICK: I NEED TO LAY SOME GROUND
RULES FOR TONIGHT FOR
--------------- - - - --
YOU AND FOR YOUR NEIGHBORS. WE LISTEN TO
WHAT PEOPLE HAVE TO SAY
AND
YOU CAN ANSWER THEIR QUESTIONS FOR THEM,
WOULD YOU LIKE TO MAKE
A
PRESENTATION OF THE DRAWING AS TO WHAT YOU
ARE PROPOSING, SO THE
PEOPLE IN THE AUDIENCE WILL KNOW,
MR. SHEPARDSON PRESENTED THE DRAWING AND
WE'S'TERN SHOP ON MUZZY ROAD.

(p C/ OCTOBER 26, 1987
MR_— SHEPARDSON: THERE IS ONE CHANGE WE WOULD LIKE MAKE AND THAT
IS THE PARKING AREA 710 BE PUT IN THE BACK AND NOT IN FRONT OF THE
STORE.
SUPERVISOR BURDICK: THAT IS POSSIBLE, AS WE WILL BE MAKING NO
--------------- - --
DECISION TONIGHT, AS THIS HEARING WAS TO HEAR FROM THE PUBLIC AND
THEIR CONCERNS,
ED ROBERTS HOW CLOSE IS THE NEAREST WESTERN SHOP?
MR. — SHEPARDSON: VIRGIL, 30 to 40 MILES AWAY, ONE IN LYLE
MR. MAYO: I WOULD LIKE,' THE BOARD TO CONSIDER THAT THIS MAN IS
WILLING TO INVEST HIS MONEY ONLY IMPROVE THE TOWN AND INCREASE THE
TAX BASE AND BEING ONE OF MR. SHEPARDSON'S NEIGHBORS I DON'T SEES'
ANYTHING WRONG COULD COME FROM ADDING ANOTHER BUILDING TO TAX BASF,'.
LAMAR— HERRIN: I WOULD LIKE TO READ A LETTER I HAVE PREPARED HERE.
COPY ATTACHED...........
DEAN— HOWLAND_— IF THIS PUD IS APPROVED. DOES THIS MAKE THIS SECTION
OF PROPERTY ON MUZZY ROAD COMMERCIAL?
SUPERVISOR — BURDICK_— IT WOULD ONLY MAKE THAT PROPERTY (WESTERN STORE)
COMMERCIAL, THE HOUSE WOULD NOT BE COMMERCIAL,
DEAN— HOWLAND: THE WESTERN STORE IS FINE WITH US AS LONG AS THAT IS
WHAT IT WILL ALWAYS BEIIN THE FUTURE, SAY SOMETHING CHANGES,
SUPERVISOR_ BURDICK: IF SOMEONE ELSE CAME IN AND WANTED TO PUT ANOTHER
BUSINESS IN THEN THEY WOULD HAVE TO BACK AND GO THE SAME ROUTE.
IF AND WHEN THE TOWN BOARD APPROVES THERE CAN BE STIPULATIONS AS
TO WHAT CAN AND CANNOT BE SOLD OR WHAT THE PROPERTY CAN OR CANNOT
BE USED FOR,
MR_— SHEPARDSON:_ I THOUGHT IF WE EVER SOLD THE PROPERTY IT WOULD
RE'VE'RT BACK TO WHAT IT WAS PRIOR,
SUPERVISOR — BURDICK: MR. HOWLAND IS JUST MAKING SURE THAT WE PUT THAT
IN THE RECOMMENDATION
JIM— HOVANEC_ ARE YOU GOING BY THE BUILDING CODES? CONCE'RNE'D THAT
THEY ARE UNDER THE SAME REGULATIONS AS EVERYONE ELSE, COMMERCIAL
PROPERTY DOESN'T HAVE TO BE JUNK'LIKE OTHER PLACES IN THE TOWN OF
DANBY.
MR_— SILE'O_ MY CONCERNS ARE THE SAME AS MR. HE'RRIN'S, INCREASE OF
TRAFFIC AND THE PROPERTY VALUES.
MRS_— SILEO_ QUESTIONED ADEQUATE WATER SUPPLY AND PUBLIC RE'STROOMS?
A RE'COMME'NDATION WAS MADE. -BY SUPERVISOR BURDICK, SECONDED BY CLMN.
ROBERTS TO TABLE THE WESTERN SHOP PUD AND GO BACK TO THE PLANNING
BOARD WITH THE SHE'PARDSON'S TO ANSWER THE QUESTIONS BROUGHT OUT
HERE' TONIGHT REGARDING RUNNING WATER, BATHROOMS, SURVEY AND ETC.
WE WOULD LIKE THE PLANNING BOARD TO WORK WITH YOU
RHETTA— SHE'PARDSON: WE WANTED THE BUILDING UP BEFORE THE SNOW FLIES,
SUPERVISOR BURDICK:_ WE NEED MORE INFORMATION AND WE COULD CALL A
SPECIAL ME'E'TING AF'TE'R THE PLANNING BOARD TALKS ABOUT I7', I. WANT
THESE QUESTIONS ANSWERED.
CLMN. _TAGLIAVE'NTO:_ PERHAPS HE COULD ANSWER THE QUESTIONS AND BRING
THEM TO THE BOARD MEETING NOV. 9th AND WE CAN TRACK DOWN SOMETHING
FROM THE PLANNING BOARD WE CAN MAKE A MOVE ONE WAY OR THE OTHER
THAT NIGHT,
SUPERVISOR_ BURDICK: I WILL GET TO DON GRAHAM AND ASK HIM ABOUT 17'
AND GET HIM A COPY OF THIS AND THEN AT THE NOVEMBER MEETING WE CAN
MAKE A DECIS.TON ON ? -T- MY SUGGESTIONS TO THE NEIGHBORS WOULD BE
IF ANY QUESTIONS ADDRESS THEM TO THE SHE'PARDSON'S BETWEEN NOW AND
THE NOVEMBER MEETING, NOVEMBER 9th, 19870
ANY OTHER QUESTIONS?

A -'creek and a half ugrl I ,;poke ;Ali th the Shepherdsons regarding their
building project. I told thiern f %?Vds disappointed that they had not talked
'. ^lith me perr:onally about their- plans and that within reasonable neighborly
lirnits I believed that they were entitled to do with their property as they
vVished. Then I e.;pressed the followinq concerns:
FirsJj that the establishment. of any bUSineso on Pluzzy Road might
change the character of the street, which is quiet and rural and
infrequently traveled. Second, that a business closeby ,could undoubtedly
lead to an increase in traffic, undesirable both because of the noise and
general corrirriotion it_ could cause and because of the danger it right pose
to the : :mall children living rap and down the street. Third, that we
persr-Inally had not rr hied from downtown to the country to be confronted
';rithi a business across the street and that the zoning regulations that
Dirnby sr.rbscribed to, and that Newfield, for instance, didn't, had been a
fal :trlr in Out- decision to come to D6nby. Fourth, that the real estate agent
through i,,ehoni we'd bc-lught our house and land had infortwned rrie that the

the street r_.clr.tld diminish the value of
I.Il.lr property fr_t -n ter, to t,.I';_1ntq percent. And that since, by rriy
ec;tirriation, or.rr property was considerably more valuable than any other in
the iiiirnediiate 11icinitq, we stoop the most to lose by this venture.
The Sfleflfrerd on :then made the following assrtranee:= to me:
rFirst, that they ,A ere long - standing rural people themselves and r.trlder
no circ:urrlc:tances would th-leia ,^rant to see the rural character of the street
de- ;troyed. Thiat the business they planned- -with its small gambrel- rclofed

c:hinracter. Th-lat after the grand opening it would be the source of rro
1.rrI,,0S lot ted noise. That indeed they would work to make sure the street did
riot change char after. Second; that grit' addition to thie present _tructr.rre,
for which the concrete foundation had already been poured, would be build
clf_ nirnj that -- _tructure, that. is farther away from the road- and that this
rnI_I!Jded the parking lot and the Museum that is mentioned in the variance.
r: ;id t t rnq concern th•rat th - ris bUroiness might grow into sornethiing far

relativelg irrconspicr_lor.1 ,most probably aranch -style .,iqn built. in an arch
over the driveway. Fourth, that the business they planned would under no

people in,11,olyded in hor_ ,-ebacl: riding. Fifth, that thieu_ had no intentions of
