Don r.ports'd. that he. had been contacted by Mike Loehr, who told him t at the State would not, after all, require a needs assessment for the group home which the Ithaca Childrens Trust was hoping to locate in Danby. Instead, letters of recommendation -would suffice (from the Department of Social SerVices and others), Don told him he would like that information confirmed in writing. Minutes for the September meeting were approved. Privilege,of the Floor, Walt thought it unwise to schedule hearings on the budget and on the proposed junk law back to back on the same night as the regular Town Board meeting. The rest ofthe Board agreed and we asked Dorothy Roberts to take to the Town Board our request that these two hearings he sche- duled on separate evenings. There was concern, tbo,-,that for the hearing on the proposed junk law to be useful to us and the Town, the residents needed to see copies of it. We therefore asked Carol,Benjamin to convey to Marilvn Seeley. our formal request that the full text of the law be printed. in the Danby Area News. We also agreed that as many of us as possible should attend the hearing in order to answer questions and get a feel for public opinion. Joel reported to the Board on a recent action by the Zoning Officer an4 the Town Bawd which raised a question of interpretation of the. zoning ordinance. Judd LAO hard had cited Margaret Adams for violating the ordinance for not teVring down her fire - damaged house in West Danby. After consultation with the family, the Town Board agreed to allow the house to be restored, provided work was substantially complete by May 31, 1985. Since this is a non - conforming building, this indicated to Joel that the "abandonment of use" section of the. ordinance (section 901) was being interpreted as he (Joel) and Walt SczPpans1i felt it should be, and not as some others on the Board and the Town lawyer interpreted it. He raised the point so that those who felt differently might chcosA to address the underlying.question if they wished, which has to do with the conformity of a building itself with the provisions of the ordinance as opposed to the conformity of the use to which the building is put. There was little comment. Regular Agendas Don reviewed the budget he had submitted to the Town Board, totaling $1450. t(OVER) 1 2 Ed Roberts presented the Board with his estimate of the actual cost of an appeal to the Board of Zoning Appeals of a zoning matters x'ยข15.00 secretary- $10.00 newspaper ad ' t2.80 postage 27,80 Since it was clear that a lot more work needed to be done in order to revise the schedule of fees, we adjourned to a work session held on October 30, at 730 P.M.
