HomeMy WebLinkAbout1984-07-09TOWN OF DANBY TOWN BOARD MEETING MINUTES July 9, 1984 The regular meeting of the Danby Town Board was called to order at 8:05 PM at the Danby Town Hall, 1830 Danby Road, Town of Danby, Tompkins, New York July 9, 19840 Board Members present: Councilperson Mary Oltz Councilperson Dorothy Roberts Councilman Ric Dietrich Supervisor Mildred Miller • Absent: Councilman Edward Shay Others Present. Francis & Onalee Wright, Paul Smith, Kenneth Coddington, Donald Graham, Bill Makepeace, David Mastroberti, Kurt Bogart, Debbie May - cumber, Georgia Griffith, John Grow, Judd Leonard, Joel Gagnon, Walter & Carol Sczepanski, Lorraine Bard, John Friedborn. Communications: 1. NYS Dept. of.Environmental Conservation: The memorandum of under- standing for protection of streamways has been extended for an additional period effective 6/25/84 to 12/31/84. The town should notify the department of work to be done prior to beginning the work. 2. Tompkins County Department of Planning Chairman Frank Liguori announced our application for funding assistance for the project to reduce impact of flooding was approved by the.County Board of Representatives. A resolution is needed by the Town Board establishing local shares of the funds, prior to proceeding with the work. The grant amount should be used to purchase materials, equipment, rentals or contract services not normally available to the town. There is no reimbursement for in kind labor or use of town equipment. 3. Letter from Ithaca Journal, announcing an invitation to hear Kenneth Blanchard, author of "The One Minute Manager" on July 24, beginning at 4 PM at Johnson Art Museum. 4. Tompkins County Board of Representatives. Resolution 4160. "Modification of Agriculture District No. 2 - Towns of Danby, Newfield, Enfield, Ithaca and Ulysses. A map was presented. 50 Assessment Department announced a retirement dinner for Thomas G. Payne to be held August 1, 1984 at the Ithaca Towers. Councilperson Dorothy Roberts moved to approve the June 11, 1984 Public Hearing and June 11 Regular Meeting Minutes as presented, seconded by Supervisor Miller, carried unanimously. Privilege of the Floor: Councilperson Oltz.announced replacements for District I and District II • election inspectors. Three of the inspectors appointed at June 11 meeting will not be able to serve. For District I, republican, Myrtie Hewitt will replace Peggy LaPoint, Harriet Golden will replace Rhoda Larson, as alternate and Winnie Cortright for District II, will replace Frank Haskins as alternate. Town Clerk requested a public hearing date be set for revision of Local Dog Law for 1984. John Friedborn, who is interested, along with five other families, in purchasing 150 acres on Makarainen Road. This road is now abandoned. He would like to know the procedure to extend this road back into the property. Mr. Friedborn presented a map of the anticipated plans. The Town Board suggested the plans be turned over to the Planning Board for review. Z Town Board Meeting Minutes - Page 2 July 9, 1984 Francis Wright reported for the Tompkins County Highway Commission. He is no longer chairman. The Route 13 situation is still up in the air. He reported TomTran is doing very well. Mr. Wright said he is now represent- ative on the commission for the DWI advosory board. Kurt Bogart voiced concern on a barn going up on the Maycumber property next to his property. He feels this barn is too close to the adjoining properties. David Mastroberti questioned if a building permit had been issued for this barn. Supervisor Miller said she has the building permit in her possession and is holding it pending further investigation. A decision to issue the permit will be made at the close of this meeting. Walter Sczepanski questioned the Memorandum of Understanding between the Town and NYS Department of Environmental Conservation in regards to reimbursement through in kind services.. At one point it was understood the town would be reimbursed by the County for the services. The County is now saying this is not so. After lengthy discussion, the board agreed that Donald Graham, Pete Coddington, Councilman Ed Shay should meet with Frank Liguori at the County Planning Board to clear up the misunder- standing on this issue. John Grow, attorney for American Cable Television reminded the Board an amendment to the Cable franchise agreement is still pending and inquired if a decision has been made. He also mentioned Georgia Griffith has prepared a survey for residents in West Danby on their interest in receiving cable service. Supervisor Miller said the Town would like to hold another public hearing on the franchise agreement. The only discussion that happened at the last public hearing was concern from West Danby residents.on not getting cable service. Supervisor Miller said there was no discussion on the actual issue of amending the franchise agreement for those with cable service. She felt there was not good representation of the people in Danby who have the service. The Board agreed to have a second public hearing July 24, 7:45 PM. A decision will be made following the hearing. Close to privilege of the floor. Supervisor Miller said there are several local laws pending and would like to meet with the board to review these laws, before setting a public hearing date. The board has agreed to meet at-6:30 PM prior to the cable television public hearing, July 24. The laws to be reviewed are revised dog law, junk law, flood insurance program law. Committee Reports: Youth: Councilman Dietrich reported the summer recreation program is going very well. Councilman Dietrich would like the town to send a letter to the Governor and Legislator. The County Youth has overspent their budget and there is concern the Towns may not get reimbursement thru the state. He would like the letter to state there be ample money to cover those obligations already ensued. Highway: Pete Coddington reported the department has been on vacation the week of July 2 thru 6. He reported the men have been working on Miller Road preparing it for repaving. Repair work is also being done on West Jersey Hill Road. Supervisor Miller said she received a call from a resident on Old Town Road requesting the highway department repair some large pot holes on that road. Following further discussion, Supervisor Miller asked the Board to approve her signing the memorandum of understanding with the State. Councilman Dietrich moved, seconded by Councilperson Roberts_ to authorize the Supervisor to sign the agreement for stream maintenance, carried unanimously. 1 D L_J • TownBoard.Meeting Minutes - Page 3 Committee reports, cont. July 9, 1984 23 Councilperson Roberts asked Mr. Coddington if any determination has been made on the damaged tanker recievpd by the highway department. Mr. Coddington reported someone from Richford will be coming in to do the repair work. Planning Board: Don Graham presented the May minutes.to the Supervisor along with a letter of resignation from.Dlanning board from Rolland Manley. Mr. Graham reported he has - county maps that need updating showing the new planned unit developments. ie, Locker, Wiggins. Mr. Graham also suggested the town board pass a resolution to delete the planned unit developments that never occurred and return that parcel of land to its original state. Councilman Dietrich said the public and property owner should be notified of the change. Mr. Graham said the planning board will review the sub- division request on Makarainen at their July meeting. Dog Warden: Supervisor Miller suggested the dog warden have an assistant or other dog warden sit in for her when she is unable to perform her duties. Supervisor Miller moved to accept Rolland Manley's resignation from the planning board, seconded by Councilperson Roberts. carried unanimously. Supervisor Miller said Walter Sczepanski's term on the planning board expires this year and would like to reappoint him for another term. Councilman Dietrich moved, seconded by Councilperson Roberts, to reappoint Mr. Sczepanski to the planning board. Supervisor Miller would like to appoint Rolland Manley as town constable, term to expire December 31, 1984. Moved by Councilman Dietrich, seconded by Councilperson Roberts, carried unanimously. Supervisor Miller distributed the 1985 budget forms and asked to have them returned by August 1. Supery during Gloria Miller deputy isor Miller said the the months of July Benson will not be moved. seconded by for this time, town clerk needs a deputy to work for her and August when needed; her present deputv, able to work during this time. Supervisor Councilman Dietrich to appoint Sylvia Hiney as Supervisor Miller asked board members to meet in executive session with Zoning Officer to discuss a zoning problem. Supervisor Miller reopened the meeting and asked Judd Leonard to explain the zoning situation at the Maycumber propertv on Comfort Road. Mr. Leonard said the Maycumbers have given him specifics ions for a modular home they hope to put on this property. He has also spoken with the Health Department and they have inspected the property, and all appears in order. Councilman Dietrich suggested to the Maycumbers that they should have approached their neighbors in the beginning to let them know what their plans were. This might have resolved some of the communication problems among the property owners. Warrants: General Fund Warrant #7 in the amount of $2156.17 was approved to be paid. Motion made by Supervisor Miller; seconded by Councilperson Oltz, carried unanimously. Hiahway F>>nd Warrant #7 in the amount of $4726.56 was approved to be paid. Moved by Councilperson Roberts, seconded by Councilperson Oltz, carried unanimously. Federal Revenue Sharing Warrant #7 in the amount of $58.00 was approved to be paid. Moved by Councilman Dietrich, seconded by Supervisor Miller, carried unanimously. Town Board Meeting Minutes - Page 4 July 9, 1984 Warrants, continued. Highway CHIPS Warrant #7 in the amount of $2649.27 was approved to be paid. Moved by Councilperson Roberts. seconded by Supervisor Miller, carried unanimouslv. Town Clerk reported the West Danbv Water District bills for June were lost in the mail. Roy Casterline said the amount of the bills totaled approximately $200. He would get duplicate copies of the bills to the town clerk. Councilman Dietrich moved to approve payment of the bills, seconded by Councilperson Roberts, carried unanimously.
