HomeMy WebLinkAbout1980-08-11• • TOWN OF DANBY PUBLIC HEARING August 11, 1980 The Town Board of the Town of Danby held a public hearing on August 113 1980 at 7 :30 P.M. at the Danby Town Hall, 1830 Danby Road. The purpose of this hearing is to review and consider the adoption of a local law to authorize the conduct of games of chance in the Town of Danby by all non - profit organizations in the Town pursuant to the authority of Article Nine -A of the General Municipal Law of the State of New York. Board members present: Councilperson Sylvia Hiney Councilman Ted Merritt Councilperson Dorothy Roberts Supervisor Mildred Miller Board member absent: Councilman Robert Snedden Others present: Edward Slights, Peter, Chucky Bruce, Bill Genter, and Donald Wright. Milton Todd, Pam Clermont, Moses Judy Bellivigna, Frank Haskins The meeting was called to order at 7 :30 P.M. Supervisor Mildred Miller read the proof of publication presented to her by the clerk. The clerk then read the proposed local law which is attached hereto and made a part of these minutes. All persons present were in favor of such a law. As there was no oposition Mrs. Miller stated that this local law shall take affect immediately upon filing with the Secretary of State after approval by the voters of the Town. Voting to take place at the November general election instead of a special town election. As there was no more business to be brought before the board, Councilman Ted Merritt made the motion that the hearing be adjourned. The motion was seconded by Supervisor Mildred Miller and carried by a vote of four ayes and no noes. The time was 7 :45 P.M. This Local Law is enacted pursuant to the authority of Article Nine -A of the General Municipal Law of the State of New York, and shall be knoo;n as the Games of Chance Law of the Town of Danby. Section 2: Definitions_ The Local Law shall.have the same are used in Article Nine -A of State of New York. Section 3: Games of of chance may be conducted in the Town by an authorized non- profit organization, after obtaining a' license therefor, in accordance with the provisions; requirements and limitations of Article Nine -A of the General Muncipal Law, the rules and regulations of the New York State Racing and Wagering Board and this Local, Law. words and terms used in this meaning as such words and terms the General Municipal Law.of the Chance Authorized; Restrictions. Games The conduct of games of chance on Sundays is authorized, except as otherwise restricted in Article Nine-.A of the General Muncipal Law, Section 4: Control and Supervision. The powers and duties set forth in subdivision one of Section 194 of the General Municipal Law shall be exercised by the Chief Law Enforcement officer of the County of Tomp':ins. Local Law sh Secretary of voting there to the orovi all t State on at sicns ake effect after approval a Special of the TOWN OF DANBY TOWN BOARD MEETING MINUTES August 11, 1980 The regular meeting of the Danby Town Board was called to order at 8 :05 P.M. at the Danby Town Hall, 1830 Danby Road, Town of Danby, County of Tompkins and State of New York on August 11, 19804 Board members present: Councilperson Sylvia Hiney Councilman Ted Merritt Councilperson Dorothy Roberts Supervisor Mildred L. Miller Board member absent: Councilman Robert Snedden Others present: Roy Hornbrook, Roy & Mary Casterline, Dayton Smith, Herbert Ingman, Moses Peter, Edward Slights, Milton Todd, Paul Smith, Pam Clermont, Chucky Bruce, Bill Genter, Judy Bellivigna, Frank Haskins, Donald Wright. It was noted that the General Fund Warrant #7 included an electric bill that had already been paid. The total of this Warrant was $1759.98 and was included in the July 14, 1980 minutes of the town board. The General Fund Warrant total should have been $1466.16. A motion was made by Supervisor Mildred Miller to accept the July 14, 1980 minutes of.the regular board meeting with the General Fund Warrant total corrected to read $1466.16. The motion was seconded by Councilman Ted Merritt and carried by a vote of four ayes and no noes. COMMUNICATIONS: 1. A letter from the Tompkins County Personnel Department concerning meetings to discuss health insurance. 2. A notice from the Office of the Governor of New York State informing the Town that an act to amend the general mu nicipal law in relation to increasing the fees to be paid for the services of town and village courts has been defeated. 3. A letter from Herbert A. Kline an attorney representing Empire State Speach and Hearing Clinic, Inc. asking that the Town of Danby abandon a portion of LaRue Road. 4. A letter from County Attorney, Robert Williamson, asking • about a contract between the SPCA and the Town of Danby. 5. Minutes of the meeting of the West Danby Water Commissioners held August 6, 1980. ® 6. A letter from the SPCA askin g if last ears do enumerator Y g would be willing to do the enumeration again this year. PRIVILEGE OF THE FLOOR: The town clerk asked that the board authorize her to attend the Town Clerk's School held in Syracuse the 18th & 19th of August and that Supervisor Miller also be authorized to attend. Justice Milton Todd ask the board to authorize his attendance at TC3 for Justice's school. Mr. Lee Haefele who lives on LaRue Road stated that it would be a hardship for him and the other people living on LaRue Road to have the portion of that road abandoned, which the Speech Clinic has asked the town to do. Town Board Meeting Minutes - August 11, 1980 Page 2 Privilege of the Floor continued: Dafton Smith, a reaaestate agent from Spencer, asked if LaRue Road is plowed in the winter time. He represents an individual who is purchasing property on LaRue Road. Herbert Ingman stated that the wording in the Danby Zoning Ordin- ance,in reference to unique areas in the town,needs to be stronger. He gave the board copies of maps showing the unique areas in Tompkins County. This matter was discussed. Moses Peter talked about property assessments in the Town of Danby. He feels that his property has been assessed improperly. He attended on grievance day and asked for some relief. Nothing happened. He thinks the assessment department is incompetent and the people working in that office should be replaced. This matter should be brought up with the Tompkins County Board of Representatives. Supervisor Mildred Miller appointed Sylvia Hiney to pursue the matter by approaching the County Board of Representatives or whom so ever she sees fit. OLD BUSINESS. Councilperson Dorothy Roberts made* the motion that Clifford Abbott be reappointed as a member of the Town of Danby Board of Zoning Appeals. His term to begin immediately and expire June 30, 1985. The motion was seconded by Councilperson Sylvia Hiney and carried by a vote of four ayes and no noes. Supervisor Mildred Miller stated that the census figures showing the estimates for the county have been received. It was noted that the the figures for Danby were a high estimate of 2400 people and a low.estimat of 2300 people. The high estimate of homes in Danby was 840 and the low estimate 800. This is quite an increase over the 1970 census. After discussion by the board, Councilperson Dorothy Roberts made the motion that we accept these figures as correct and ask the Town Cleri(to notify Harry Missirian of the Tompkins County Planning Department of the boards decision. The motion was seconded by Sylvia Hiney and carried by a vote of four ayes and no noes. COMMITTEE REPORTS. Highway Committee - Muzzy Road and West ready for inspection is being paved. The highway people was b Roy Hornbrook reported that he is woAing on Jersey Hill Road. These roads should be by the end of August. Steven Town Hill Road matter of disability insurance for the • rought up for discussion. Zoning - Written report submitted. Planning - Planning Board Chairman Absent - No report. Fire Co- No report. West Danby Water District - All O.K. The budget estimates for 1981 for the water district have been submitted to the supervisor. Youth - Budget estimates for 1981 have been submitted. The $1600 of state aid will be forthcoming but not until later in the year. The program has been approved and it is just a matter of time before we receive the money. Town Board Meeting Minutes NEW BUSINESS: August 11, 1980 Page 3 Councilman Ted Merritt moved a resolution to have Local Law #1 entitled "Local Law Authorizing and Regulating the Conduct of Games of Chance by Authorized Non - Profit Organizations in the Town of Danby" puton the November ballot to be voted by Danby people. The motion was seconded by Councilperson Dorothy Roberts. RESOLUTION #26 ADD LOCAL LAW #1 OF THE TOWN OF DANBY ® TO THE NOVEMBER BALLOT Roll Call Vote: Hiney - aye Merritt = aye Roberts aye Miller - aye Carried by a vote of four ayes and no noes. Consideration was given to the letter from the attorney representing Empire State Speech Clinic concerning the posibility of abandoning the portion of LaRue Road east of the bridge to Brock Road. This portion of the road is the most accissible route to properties of home owners along that road. Since tax dollars have been spent to build and repair the bridge on that portion of road, the Town Board felt that it would not be in the best interest of the Town to abandon that section. After discussion, Councilperson Dorothy Roberts made the motion that the section of LaRue Road in question not be abandoned by the Town. The motion was seconded by Council- person Sylvia Hiney and carried by a vote of four ayes and no noes. The Town Clerk was directed to inform the law firm of the boards decis,ion-: Councilperson Dorothy Roberts made the motion that Town Clerk, Mary Oltz and Supervisor, Mildred Miller be authorized to attend school in Syracuse on August 18th and 19th. The motion was seconded by Councilperson Sylvia Hiney and carried by a vote of four ayes and no noes. Supervisor Mildred Miller made the motion that Justice Milton Todd be authorized to attend the school for town justices to be held at TC3. The motion was seconded by Councilman Ted Merritt and carried by a vote of four ayes and no noes. After discussion, Supervisor Mildred Miller moved a resolution to grant the highway hourly employees disability insurance affective retroactively as of May 15, 1980. The motion was seconded by Councilman Ted Merritt. RESOLUTION #27 GRANT THE HOURLY HIGHWAY EMPLOYEES DISABILITY INSURANCE RETROACTIVELY. EFFECTIVE DATE TO BE MAY 1531 1980. Councilperson Dorothy Roberts made the motion to accept the Supervisor's reports as presented. The motion was seconded by Councilman Ted Merritt and carried by a-vote of three ayes and no noes. General Fund Warrant #8 in the amount of $731.69 was approved to be paid. The motion was made by Councilman Ted Merritt and seconded by Councilperson Dorothy Roberts and carried by a vote of four ayes and no noes. Highway Fund Warrant #8 in the amount of $4,648.19 was approved to be paid. The motion was made by Councilperson Dorothy Roberts and seconded by Councilman Ted Merritt and carried by a vote of four ayes and no noes. West Danby Water District Warrant #6 in the amount of $143.90 was approved to be paid. The motion was made by Supervisor Mildred Miller and seconded by Councilperson Sylvia Hiney and carried by a vote of four ayes and no noes. The possibility of using the Danby Elementary School, that is now closed, for town offices and other functions of the town was discussed. It would be a very expensive undertaking for the town. No action was taken. As there was no more business to be brought before the board, Councilman Ted Merritt made the motion that the meeting be adjourned.
