TOWN OF DANBY
TOWN BOARD MEETING MINUTES
May 12, 1980
The regular meeting of the Danby Town Board was called to order at
8:00 P.M. at the Danby Town Hall, 1830 Danby Road, Town of Danby,
County of Tompkins and State of New York on May 12, 19804
Board members present: Councilman Ted Merritt
Councilperson Dorothy Roberts
Councilman Robert Snedden
Supervisor Mildred L. Miller
Board member absent: Councilman Bradley Corbitt
Others present: Carol and Mike Sczepanski, Milton Todd, Bill Shippos,
Moses Peter, Gay Huddle, Rick Dobson, Ed Slights, Donald Wright, Pam
Clermont, Bill Goodwin, Judson Leonard, Frank Haskins, Roy Hornbrook,
and Donald Graham,
Councilperson Dorothy Roberts made the motion to approve the minutes
of the last regular meeting of the board held April 14, 1980. The
motion was seconded by Councilman Ted Merritt and carried by a vote
of four ayes and no noes.
PRIVILEGE OF THE FLOOR:

Gay Huddle stated that the members of the Ithaca City School Board and
Superintendent Backer are coming to Danby School May 19th at 7 :30 P.M.
She stated that good attendance from the Danby Community is needed and
invited the Town Board members to attend. She asked if the Town Attorn-
ey could give advise on the possibility of Danby breaking away from the
Ithaca City School District and forming their own school district. The
matter was discussed.

Bill.Shippos asked if anything more had been found out about T.V, fl a
Cable service for West Danby.
Sczepanski stated that there is a very narrow section of Miller
Road that could cause problems. He asked if this section could -be
made wider, o
Moses Peter asked about grievance day for property tax assessments.
He is a member of the grievance board in Danby and wants to know what .
his duties are or if this is just a formality. The Town Board will
find out.
Pam Clermont asked why the ditches had been dug out on Steam Mill Road
and why there is so much standing water. Roy Hornbrook will look into
this matter. U
COMMITTEE REPORTS :
Highway report - The backhoe and r611 jr have been received and are in

use. 35 man hours were put on the _____the first week it was used.
A date for the road check will be set.

Youth Program - The contract with the Finger Lakes Parks Association
for the use of the Danby Pond has been signed and insurance coverage v
has been taken care of. May 20th is the date of the next meeting
of the Community Council.

Zoning Office -'s report - Frank Haskins reported that 3 building permits
for new structures have been issued. A written report was submitted.

Judson Leonard from the Danby Fire District said that the Tompkins
County District Attorney has said that it is not legal fo'r non- profit
organizations, such as the fire company, to sponsor games of chance.
If the Town Board passes a resolution which states that non - profit
organizations can sponsor games of chance in the Town of Danby it is
then legal. Mr. Leonard is checking to see if the West Danby Water
District hydrant system has been certified. It could make a difference
in fire insurance rates. The West Danby Fire Company has asked the
Board of Water Commissioners to let the fire company take the
responsibility of flushing the hydrants. As they have received no
answer from the Water Commissioners, they have come to the Town
Board. Councilman Robert Snedden will pursue this matter. District
Attorney Jock will be contacted for the proper wording of the
resolution needed.

Supervisor Mildred Miller made the recommendation to the Environmental
Management Council that Herbert Engman be appointed as a member of
that board to represent Danby. He has been accepted and will serve
a two year term which will expire in December of 1981.

Planning Board Chairman - Mr. Graham had nothing to report.

Mary Oltz, Danby Town Clerk, reported that no contract has been signed
with the SPCA for handling the cases of nonlicensed dogs or picking
up dogs on complaints. She asked that she be allowed to send letters
to delinquent owners and follow through on this matter as she has
done in the past. The matter was discussed. Supervisor Mildred
Miller made the motion that the clerk be authorized to write letters
and follow through as requested. The motion was seconded by Council-
man Robert Snedden. Councilman Snedden then made the motion that_a
representative of the SPCA be invited to attend the next regular
meeting of the Town Board and a contract be negotiated. Councilman
Ted Merritt seconded the motion which was carried by a vote of four
ayes and no noes.
After discussion the board decided that Highway Superintendent Roy
Hornbrook be authorized to attend a school for highway people to
be held in June.
General Fund Warrant #5 in the amount of $30,491.21 was approved
to be paid. The motion was made by Councilperson Dorothy Roberts
and Seconded by Supervisor Mildred Miller and carried by a vote
of four ayes and no noes. e

Donald Wright was asked to take care of putting flags on veteran's
graves in West Danby and Supervisor Miller will take care of this
in Danby.
As there was no more business to be brought before the board, the
motion was made by Councilperson Dorothy Roberts to adjourn the
meeting. The motion was seconded by Councilman Ted Merritt and
carried by a vote of four ayes and no noes. The time was 9:30 P.M.
The board then retired to executive session.
A letter from Thaler & Thaler concerning the matter of Dobson vs the
® Town of Danby was read. The letter asked for two resolutions to be
passed by the Town Board. The first resolution to direct the attor�
ney to defend the Town of Danby and individual board members being
sued by Dobson. The second resolution to direct the attorney to in-
stitute a declaratory judgment action against the insurance carrier
for the Town of Danby/

Carried by a vote of four ayes and no noes.
Three people were interviewed.for membership on the Town Planning
Board. Councilperson Dorothy Roberts made the motion to appoint
Carol Benjamin to serve on the Planning Board. The motion was
seconded by Councilman Ted Merritt and carried by a vote of four
ayes and no noes.
Executive session adjourned at 10:30 P.M.
