HomeMy WebLinkAbout1980-02-11C7 • • TOWN OF DANBY TOWN BOARD MEETING MINUTES February 11, 1980 The regular meeting of the Danby Town Board was called to order at 8 :05P.M. at the Danby Town Hall, 1830 Danby Road, Town of Danby, County of Tompkins and State of New York on February 11, 1980. Board members present: Councilman Bradley Corbitt Councilman Ted Merritt Councilperson Dorothy Roberts Councilman Robert Snedden Supervisor Mildred L. Miller Others present: Edward Slights, Mr. & Mrs. William Shippos, Frank Haskins, Donald Wright, John Shepardson, Jr., John Shepardson, Sr., Ralph & Alberta Wilbur, Roy & Mary Casterline, Paul Smith, Moses Peter, Donald Graham, Pamela Clermont, Sylvia Hiney, Ithaca Journal Reporter, Carol Isenberg. in West Danby and old partly burned houses. Councilman Bradley Corbitt made the motion to the last regular meeting of January 14, 1980 of January 28, 1980 held by the Town Board. by Councilperson Dorothy Roberts and carried and no noes. COMMUNICATIONS: approve the minutes of and the public hearing The motion was seconded by a vote of five ayes 1. A letter from the Human Services Coalition concerned with the resignation of Margaret Snedden as Danby's representative on their board and the need for a replacement. 2. A letter from Pamela A. Clermont concerning the possibility that she do legal work for the Town of Danby. 3. A letter from the Office for the Aging concerning the approv- al of Danby's application for state aid in the amount of $1,000.00 4. A letter from Gwen Cukierski_ concerning the window coverings for the Town Hall and the inability to get the necessary material from Owens Corning. 5. Minutes of a meeting held by the West Danby Water commissioners and the renewal of Earl Colburn's appointment as a member of that board. 6. A letter from Edgar E. Oltz, chairman of the Danby Fire comm- issioners, asking that the town insurance and the fire district insurance be separated. %. Resolution No. 17 from the Tompkins County Board of Represent- atives entitled "Apportionment of Dog Monies ". PRIVILEGE OF THE FLOOR: Councilman Robert Snedden reported that the Town Board is still investigating the matter of disability insurance for the highway people. Bill Shippos asked what is being done about Cable T.V. for West Danby. Councilman Robert Snedden reported that the people in West Danby must now act on whether they are willing to pay the fee or not. Mr. Shippos also asked about a trailer in West Danby and old partly burned houses. blow the heat down. The trailer matter is before the Board of Zoning Appeals and the Health Department is handling the matter of the houses. Ralph Wilbur asked what is being done about the drapes in the town hall meeting room. As there was some question about a contract the minutes will be researched to see what the exact agreement was. Councilman Robert Snedden reported that he has looked into fans for the town hall meeting room to circulate the air and blow the heat down. Supervisor Mildred Miller read a resolution of approval of the Bruce planned unit development drawn up by the town attorneys. She made the motion that the resolution be adopted by the board. The motion was seconded by Councilman Ted Merritt. RESOLUTION #13 APPROVE THE BRUCE PLANNED UNIT DEVELOPMENT WITH LIMITATIONS Roll Call Vote: Corbitt - No Merritt - Yes Roberts - Yes Snedden - Yes Miller - Yes Carried by a•vote of four ayes and one no. Councilperson Dorothy Roberts made the motion that the clerk send a copy of the resolution to Mr. Bruce as he did not attend the meeting. The motion was seconded by Councilman Robert Snedden and carried by a vote of five ayes and no noes. Councilman Bradley Corbitt said that all neighbors with property abutting the Bruce property were against the Bruce planned development and the board should take this into consideration. Mr. Haskins reported that there are two applications out for permits. The zoning officer and his assistant will be available to the public, at the Town Hall, on the 2nd and 4th Wednesday's of the month from 2 :00 P.M. until 9 :00 P.M. Councilman Robert Snedden made the motion that Robert Howe be appointed assistant zoning officer for the Town of Danby. The motion was seconded by Councilperson Dorothy Roberts and carried by a vote of five ayes and no noes. Highway Superintendent, Roy Hornbrook, reported that he has a chance to get gravel from Buttermilk Falls State Park. After discussion of equipment needed, Roy Hornbrook was asked to write up specifications for a roller and a backhoe. A special meeting will be held by the board on February 25, 1980 at 8:00 P.M. to go over the specifications for this equipment. The meeting will be held at the town hall. Chairman of the Town Planning Board, Donald Graham, reported on the business before the board. The blanning board recommends that a list be drawn up showing the requirements for special permits and that this list be made available to the public. The board also recommends that the town board pass a resolution whereby a member of the planning • C, Town Board Meeting Minutess- February 11, 1980 Page 3 Committee Reports continued: board who is absent from four consecutive meetings without excuse, or six meetings in one year, be asked to resign. This would help the planning board to carry on their business more efficiently. At the present time there are three vacancies on the board. Mr. Graham presented the town board with a copy of the proposed zoning map. The town board was asked to attend a meeting of the planning board to discuss the latest revisions in the Danby Zoning Ordinance. Walter • Sczepanski was recommended to the board as someone who was interested in serving as a member of the planning board. Councilperson Dorothy Roberts made the motion that Mr. Sczepanski be appointed to serve on • that board. The motion was seconded by Councilman Ted Merritt and carried by a vote of five ayes and no noes. The proposed zoning ordinace was discussed by the town board and a time schedule for reading it and setting a hearing date was also discussed. The letter from Attorney Clermont, who lives in the Town of Danby, was looked over by the town board. It was decided that the firm of Thaler & Thaler will be retained to take care of all pending business and the partnership of Curry and Clermont will be retained to handle all new business. Councilperson Dorothy Roberts made the motion that the firm of Curry and Clermont be retained by the Town of Danby to handle all new legal matters. The motion was seconded by Councilman Bradley Corbitt and carried by a vote of five ayes and no noes. The matter of Cable T.V. in West Danby was discussed. Supervisor Mildred Miller.intr.oduced a resolution which is needed in order that funds be available for the Supervisor's new bookkeeping system of double entry required by State mandate, and also make funds available for Supervisor's schools. The amount needed is $500.00. Councilperson Dorothy Roberts made the motion that $500.00 be trans- ferred from contingency account #A1990.4 to the Supervisor's account #A1220.4. The motion was seconded by Councilman Ted Merritt. RESOLUTION #15 TRANSFER $500.00 FROM CONTINGENCY ACCOUNT A1990.4 TO THE SUPERVISOR'S ACCOUNT A1220.4 TO PAY FOR LEDGERS FOR NEW BOOKKEEPING SYSTEM AND SUPERVISOR'S SCHOOLS. Page 4 Councilman Bradley Corbitt made the motion to accept the Supervisor's reports as presented. The motion was seconded by Councilman Ted Merritt and carried by a vote of four ayes and no noes. General Fund Warrant #2 in the amount of $15,770.54 was approved to be paid. The motion was made by Councilman Robert Snedden and seconded by Councilperson Dorothy Roberts and carried by a vote of five ayes and no noes. Highway Fund Warrant #2 in the amount of $5,792.69 was approved to be paid. The motion was made by Councilperson Dorothy Roberts and seconded by Councilman Ted Merritt and carried by a vote of five ayes and no noes. West Danby Water District Warrant #1 in the amount of $670.90 was approved to be paid. The motion was made by Councilman Ted Merritt and seconded by Councilperson Dorothy Roberts and carried by a vote of five ayes and no noes. Councilman Bradley Corbitt said that Mrs. E.J. Miller called him concerning the property next door to the Town Hall that has been offered to the town for sale. She said that if the town board does not make an offer to purchase the property it will go on sale to the anyone who wishes to buy it. Councilman Robert Snedden questioned the price of the property. The price is high. The board should have a chance to bargain for it. According to the Code of Ethics adopted by the Town of Danby in 1979 the town cannot purchasetbhe property from Mr. Miller as he is a town official.
