SPECIAL BOARD MEETING MINUTES
September 11 , 1978
A special meeting of the Danby Town Board was called to order at
7 : 40 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby ,
County of Tompkins and State of New York on September 11 , 1978 .
The purpose of the meeting was to review the proposed official
town map and consider the adoption of that map as the official map
of the Town of Danby .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Dorothy Roberts
Councilman Robert Snedden
Justice Milton Todd
Others present : " Roy and Mary Casterline , Jimmie Miller , Moses Peter ,
Mary Smith , Paul Smith , Gary Evans , Joan Barber , Frank Haskins ,
Donald Wright , Edward Slights , Roy Hornbrook and Ernie Cole .
The Supervisor stated that pursuant to law the notice of the meeting
was published in the Ithaca Journal .
Copies of the proposed town map were made available for inspection by
the public . The highway committee went over the spur roads and the
names that have been given to them .
Everyone wishing to be heard having been heard , the special meeting
was adjourned at 8 : 10 P . M .

The regular meeting of the Danby Town Board was called to order at
the Danby Town Hall , 1830 Danby Road , Town of Danby , County of
Tompkins and State of New York on September 11 , 1978 at 8 : 10 P . M .

• Supervisor A . Francis Wright made the motion that Resolution #33
of August 14 , 1977 be rescinded and introduced the following
resolution in place of it . Transfer $ 500 . 00 from the bridge fund
and $ 1000 . 00 from the snow fund . The $ 1500 . 00 to be added to the
Machinery fund . $ 200 . 00 in Machinery Account DM5130 and $ 1300 . 00
in the Machinery Account under contractual expense DM5130 . 4 . With

COMMUNICATIONS :
1 . A letter from the New York State Department of Transportation
acknowledging receipt . of a request for a study of Route 34/96
in West Danby and this area be posted as a restricted speed area .
2 . Agenda of the Tompkins County Board of Representatives Monday
September 11 , 1978 meeting .
3 . A letter from the Tompkins County Personnel Department stating
the:. prgdedure ._tobe followed in naming Mary Casterline ' s
position as a town official .
4 . Notice of the quarterly meeting of the Tompkins County
Municipal Officials Association .
PRIVILEGE OF THE FLOOR :
Joan Barber reported that the Danby Directory will be out of the
printers and ready for delivery by October 1st . She then explained
what the directory is made up of . She has collected $ 800 . 00 from
the businesses in Danby and this amount will pay for the printing .
The board stated that Joan ' s efforts are appreciated .
Moses Peter discussed the assessment of his property in the Town of
Danby . He feels errors have been made in this assessment and if no
action is taken by the town board or the assessment office to correct
these errors he must soon take action in Court .

Privilege of the Floor continued :
Donald Wright said that children on skate boards are creating a
hazard by using skate boards on public highways in West Danby .
The town justices will look into this matter and report back to
the board at the next regular meeting of the board .
Frank Haskins said that he still has no house number and would like
o ne . He also stated that another street light is needed in West
Danby .
Mary Smith acting in behalf of the Danby Federated Church offered
the stone monument and marker that is now located on church property
to the town to be placed near the town hall , including it in the
landscaping when it is done .
Paul Smith reported that the mail slot in the back door of the
Town Hall has been installed .
Roy Casterline reported that he has assessment problems . He feels
that his property has not been properly assessed .
COMMITTEE REPORTS :
Highway Committee - Councilman Ralph WIlbur reported that the truck
purchased by the town is due . Lieb Road work has been completed . The
✓ adios are being installed . He stated that there is a problem with
the motor in one of the trucks that may create a budget problem . He
then moved the following resolution : The Town of Danby accepts
bridge # 131 - 2 from the county for use on the town highway system and
the town will move it from its present location on Middaugh Road to
t he Town of Danby . The motion was seconded by Justice Milton Todd .
RESOLUTION #35 THE TOWN OF DANBY ACCEPTS BRIDGE # 131 - 2
FROM THE COUNTY AND RELEASES THE COUNTY
FROM ANY FUTURE MAINTENANCE RESPONSIBILITY
OF THIS STRUCTURE AND WILL MOVE IT TO THE
TOWN OF DANBY .

The Ithaca Speech Clinic has requested a bridge possibly they will
help with the installatio#, nsaighway Superintendent Roy Hornbrook
said that the bridge can be moved for $ 300 . 00 . Councilman Ralph
Wilbur made the motion that the highway superintendent be author -
ized to use $ 300 . 00 from the bridge fund to have the bridge moved .
Councilman Dorothy Roberts seconded the motion which was carried
by a vote of five ayes and no noes .
West Danby Water District - No report
Insurance - Nothing to report .
Refuse collection and disposal - Nothing to report .

Committee Reports continued :
Youth Program - The West Danby Ball Field is being worked on .
Zoning and Planning - Nothing to report .
It was noted that the Zoning Officer , Gordon Roberts , has submitted
a letter of resignation to the supervisor . The board will need to
find someone to fill this position by January 1 , 1979 .
• Fire - Nothing to report .
Cemeteries - All taken care of .
® OLD BUSINESS :
Highway Superintendent - Nothing to add to the report already given .
Appeals Board Chairman - Absent .
Planning Board Chairman - Ernie Cole asked the town board to consider
for approval each section of the zoning ordinance as it is completed by
the planning board and when this has been completed hold a public
hearing to consider all the sections as a total for adoption as the
Danby Zoning Ordinance . He would like a summary of each section put
in the Danby Area News as it is completed and would like to hold an
educational meeting of the Planning Board and the public before the
hearing . Councilman Robert Snedden made the motion that the procedure
outlined by Ernie Cole be approved by the Town Board and be the
procedure used by the board . The motion was seconded by Justice Milton
Todd and carried by a vote of five ayes and no noes .
Zoning Officers report - Absent , written report submitted .
Supervisor A . Francis Wright stated that the $ 500 . 00 used to pay for
the sign at the town hall was taken from the general fund purchasing
account II A1345 . 4 and was budgeted and should have been used from
the revenue sharing account . To correct this Supervisor Wright moved
the following resolution : Transfer $ 500 . 00 from the revenue sharing
account to general fund purchasing account and with this resolution
authorization be given to the supervisor to make this transfer . The
motion was seconded by Councilman Dorothy Roberts .

Old Business Continued :
Supervisor A . Francis Wright made the motion to approve the proposed
town highway map with the spur roads named and adopt it as the official
map of the Town of Danby . The motion was seconded by Justice Milton
Todd .
RESOLUTION #37 APPROVE THE TOWN HIGHWAY MAP WITH THE SPUR
ROADS NAMED AND ADOPT THIS MAP AS THE OFFICIAL '
MAP OF THE TOWN OF DANBY .

The assessment of Moses Peter ' s property was discussed at length . Mr .
Peter asked that the board write to the assessment department and .
request that the property assessment be redecked within the next 30
days . Councilman Dorothy Roberts made the motion that the board write
this letter . The motion was seconded by Justice Milton Todd and
carried by a vote of five ayes and no noes .
NEW BUSINESS :
The inventory of the assets of the town was discussed . This is a
state mandate and must be done . Darwin Geuther is willing to help
with this . Councilman Robert Snedden made the recommendation that
the town go ahead with the inventory as mandated by the state using
the help of Darwin Geuther . Mr . Geuther will get assistance from the
supervisor as needed . The motion was seconded by Councilman Dorothy
Roberts and carried by a vote of five ayes and no noes .
There will be a budget meeting at the home of the Supervisor on
September 25th at 7 : 30 P . M .
The title of the position of the Deputy Town Clerk of the West Danby
Water District was discussed at length . The Tompkins County Personnel
Department questions that this is the proper title . Councilman
Robert Snedden moved a resolution to creat the position of Deputy Town
Clerk for the purpose .of collecting water bills for the town clerk .
Justice Milton Todd seconded the motion .

Councilman Ralph Wilbur made the motion that the SPCA be appointed as
the dog enumerator for the Town of Danby . The motion was seconded by
Councilman Dorothy Roberts and carried by a vote of four ayes . : . There
: was one abstaining vote .

New Business continued :
The stone with the plaque that is located in front of the church and
that has been offered to the town to be included in the landscaping
was discussed . Justice Milton Todd made the motion that the town
accept the stone and move it when the landscaping is being done . The
motion was seconded by Councilman Ralph Wilbur and carried by a vote
of five ayes and no noes .
The senior citizens are taking a trip and have asked the town for
$ 400 . 00 from the revenue sharing funds . This was not included in
the budget for this year . The matter was discussed at length .
® The appointment of a zoning officer was discussed .
There has been an increase in the premium of the hospitalization
insurance for the highway employees . Councilman Ralph Wilbur moved
a resolution to transfer $ 2 , 536 . 00 from the contingency fund account
to the highway insurance account DS 9060 . 8 to make funds available
to pay this increase in premium . The motion was seconded by Justice
Milton Todd .
RESOLUTION #39 TRANSFER $ 2 , 536 . 00 FROM THE CONTINGENCY FUND
ACCOUNT TO THE HIGHWAY INSURANCE ACCOUNT
DS 9060 . 8 TO MAKE FUNDS AVAILABLE TO PAY THE
INCREASE IN PREMIUM FOR HOSPITALIZATION INS .

General Fund Warrant #9 in the amount of $ 3 , 099 . 25 was approved to be
paid . The motion was made by Justice Milton Todd and seconded by
Councilman Dorothy Roberts and carried by a vote of five ayes and no noes .
Highway Fund Warrant # 9 in the amount of $ 2 , 623 . 00 was approved to
be paid . The motion was made by Justice Milton Todd and seconded by
Councilman Robert Snedden and carried by a vote of five ayes and no noes .
. West Danby Water District Warrant # 9 in the amount of $ 76 . 26 was
approved to be paid . Councilman Dorothy Roberts made the motion which
was seconded by Justice Milton Todd and carried by a vote of five ayes
and no noes .
The supervisor ' s reports were approved as presented . The motion was
made by Justice Milton Todd and seconded by Councilman Dorothy Roberts
and carried by a vote of four ayes and no noes .
As there was no more business to be brought before the board , the
meeting was declared adjourned at 10 : 10 P . M .

RESOLUTION NO . 3 7 ADOPTION OF OFFICIAL MAP , TOWN OF DANBY
WHEREAS , the Town of Danby is empowered. under Section 270 of Town Law
to adopt an • Official Map , and
WHEREAS , the Danby Planning Board , after extensive study , has drafted .
an Official Map and recommended that it be adopted by the Town Board , and
WHEREAS , the Town Board , on September 11 , 1978 , Nelda ; duly -advertised ------- -
public hearing on adoption of the Official Map recommended by the Planning
Board , therefore be it
RESOLVED , that the Danby Official Map is hereby adopted in accordance
with Section 270 of Town Law , and that the Official Map is conclusive as to
location , class designation , and name of all Town roads , and
RESOLVED , further , that there are three classes of Town roads on the
Official Map :. Town road , all-year maintenance
Town road , seasonal maintenance
Town right-of-way , no maintenance .
and each is indicated by appropriate symbol on the Official Map , and .
RESOLVED , further , that all town roads and rights-of-way are fifty
feet wide unless otherwise indicated on the Official Map .
Except for the following corrections and adjustments :
1 . the road running east from South Danby Road is named Peter Road rather.
than Peters Road ;
2 . the road running east from New York State Highway 34 and 96 is named
Wallding .Lane rather than Walding Lane ; and
3 . . Olsefski Road ; in addition to being designated a ,' town road , all -year
maintenance ' from Coddington Road south approximately 600 feet to a
culvert , is designated a ' town right -of -way , no maintenance ' from the
abovementioned . culvert southwesterly along its present alignment to its
intersection with and terminal at Deputron Hollow Road .
