HomeMy WebLinkAbout1978-07-10 TOWN OF DANBY TOWN BOARD MEETING MINUTES July 10 , 1978 The regular meeting of the Danby Town Board was called to order at the Danby Town Hall , 1830 Danby Toad , Town of Danby , County of Tompkins and State of New York on July 10 , 1978 at 8 : 00 P . M . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Dorothy Roberts Justice Milton Todd Board member absent : Councilman Robert Snedden Others present : Roy Hornbrook . Edward Slights , Dianna VandeBogart , Frank Haskins , Moses Peter , Mr . and Mrs . Shippos , Jimmie Miller , Joan i Barber , Donald Wright , Jr . and Donald Wright Sr . After correction of the numbers of two of the resolutions moved at the June 12 , 1978 board meeting from #22 and #23 to #23 and #24 , Justice Milton Todd made the motion to accept the minutes as corrected . The motion was seconded by Councilman Dorothy Roberts and carried by a vote of four ayes and no noes . COMMUNICATIONS : 1 . A letter from the Cayuga Lake Conservation Association , Inc . concerning nuclear waste dump sites . 2 . A thank you note to the Town Board from Ernie Cole . 3 . A letter from the Danby P . T . A . thanking the town board for its interest and support of the Danby School . 4 . Agenda of the Tompkins County Board of Representatives Monday June 26 , 1978 meeting . 5 . Agenda of the Tompkins County Board of Representatives Monday July 10 , 1978 meeting . 6 . A letter from Betty Melchin and Mrs . Vose with a check inclosed to be aplied to the cemetary fund and thanking the town for taking care of the cemetaries so well . 7 . A letter from the Association of Towns of ' the State of New York concerning bills passed by the Assembly and sent to the Senate . 8 . A letter to the Town of Danby Planning Board from Robert Snedden giving his resignation as a member of that board . 9 . A letter from the State of New York Department of Agriculture and Markets concerning revisions made to the dog law . 10 . A letter from the Assembly of the State of New York requesting election district maps . 11 . Minutes of the meeting of the Danby Board of Zoning Appeals held Wednesday June 14 , 1978 . PRIVILEGE OF THE FLOOR : The clerk stated that the drapes for the Clerk ' s Office and Justice ' s Office have been ordered and should be installed in six weeks . Moses Peter stated that no one has come to check the assessment of his property as they said they would . He has written letters and has had no replys . He is interested to know what the Danby Town Board is going to do about this matter . Discussion followed . Town Board Meeting Minutes - July 10 , 1978 Page 2 Donald Wright Jr . and Donald Wright Sr . and the Shippots from West Danby came to ask about progress on the T . V . Cable . Bill Shippos asked when the weeds will be cut along the roads in West Danby . Dianna VandeBogart asked if the ditches along VandeBogart Road could be cleaned out . COMMITTEE REPORTS : Highway - Councilman Ralph Wilbur reported that road work is being done in several areas of the town . Brush has been cut . The Charles J . Blackwell Corporation would like to have the truck the town used as a trade - in for a new truck purchased from them . The new truck has not been received yet . The board agreed that this was alright . i Paving work will be done on Miller Road on July 24 , 1978 . West Danby Water District - A meeting of the water commissioners and the fire commissioners was had . The problem of murky water and bad hydrants has been ironed out . Insurance - Nothing to report . Refuse Collection and Disposal - Nothing to report . A DEC Officer has issued a summons for litter on Bald Hill Road . Youth Program - The pond is open for swimming and the recreation program at the school will open soon . Zoning and Planning - Nothing to report . Fire - Lansing has loaned West Danby a truck to use while their ' s is being repaired . Supervisor A . Francis Wright moved a resolution of thanks to the Lansing Fire Department for their cooperation . Councilman Dorothy Roberts seconded the motion . RESOLUTION #26 THANK YOU LANSING FIRE DEPARTMENT FOR YOUR COOPERATION IN LENDING THE WEST DANBY FIRE DISTRICT A FIRE TRUCK TO USE WHILE THEIR TRUCK IS LAID UP FOR REPAIRS . Roll Call Vote : Wright - aye Wilbur - aye Roberts - aye Todd - aye Carried by a vote of four ayes and no noes . Cemetaries - All in good shape . Supervisor A Francis Wright • acknowledged receipt of the donation of $ 200 . 00 from Betty Melchen and Mrs . Voss to be put into the cemetary fund . Supervisor A . Francis Wright moved a resolution of thanks to Mrs . Melchin and Mrs . Voss for the donation . The motion was seconded by Justice Milton Todd . RESOLUTION #27 THANK YOU FOR THE DONATION OF $ 200 . 00 TO THE CEMETARY FUND . Roll Call Vote : Wright - aye Wilbur - aye Roberts - aye Todd - aye Carried by a vote of four ayes and no noes . Reports from appointed officials were requested . Iva Mae Musgrave Town Board Meeting Minutes - July 10 , 1978 Page 3 was absent but left minutes of meetings of the County Wide Youth Bureau . Dianan VandeBogart , Town Historian , would like to put a display in the town hall and said that she needs some storage space . Joan Barber , dog enumerator asked the town board to authorize the Community Council to make a town directory . Attorney Dick Thaler will be contacted for proper instructions for developing a town directory . The matter was tabled until instructions are received from Dick . OLD BUSINESS : Jimmie Miller reported on the County Board of Representatives meeting . In answer to Moses Peter ' s question on his property assessment , he stated that the assessment board of review is reviewing properties in question and will be finished early in August . • Highway Superintendant ' s report - Nothing to add to what has already been reported . Zoning Officer - Absent but a written report was submitted . A party for Floyd Dorn was discussed . Supervisor A . Francis Wright stated that the Wright ' s will have the party at their home in his honor . T . V . Cable - Supervisor A . Francis Wright reported that he has met with Kevin Roark . A working session will be held , the date to be set soon . Assessment review was discussed . Councilman Dorothy Roberts reported that Mr . Taylor has submitted specifications for draperies for the town hall meeting room for the estimated price of $ 5 , 000 . 00 . After discussion the matter was tabled until the August meeting . Funds are available . The possibility of the Danby School being closed was discussed . The feeling of the board was that the interested people of the town should band together and find a candidate from Danby to run for school board membership . NEW BUSINESS : Justice Milton Todd moved a resolution authorizing the return of $474 . 51 of tax money toethe Town clerk Tax Collector as a check of more than this amount was returned by the bang to the Town Clerk making her check to the Supervisor no good . -"his amount has been paid by the County to the Supervisor so that the town tax warrant has been satisfied . The motion was seconded by Councilman Ralph Wilbur . 4 RESOLUTION #22 AUTHORIZE SUPERVISOR TO RETURN $ 474 . 51 OF TAX MONEY TO THE TOWN CLERK TAX COLLECTOR . Roll Call Vote : Wright - aye Wilbur - aye Roberts - aye Todd - aye Carried by a vote of four ayes and no noes . The budget was reviewed as to what amount is left in each account and available for use . Funds are available to pay for the new 4-wheel drive truck . Part of the money will be used from the budget and the balance is available from the bank . Councilman Ralph Wilbur moved a resolution to transfer $ 29 , 711 . 00 - Town Board Meeting Minutes - July 10 , 1978 Page 4 from the Highway Budget : $ 17 , 093 to be taken from the Equipment Fund , $4 , 000 . 00 from the Machinery Fund and $ 8 , 618 . 00 from the Snow Fund ; toethe ' . Capital Fund Account and authorize the Supervisor to negotiate a Bond Anticipation Note For $ 37 , 000 . 00 to make funds available to pay for radios for the highway department and pay for the new 4-wheel drive dump truck purchased by the town . The motion was seconded by Justice Milton Todd . RESOLUTION #25 TRANSFER $ 29 , 711 . 00 FROM THE HIGHWAY BUDGET TO THE CAPITAL FUND ACCOUNT - H1997 . 2 AND AUTHORIZE THE SUPERVISOR TO NEGOTIATE A BOND ANTICIPATION NOTE FOR $ 37 , 000 . 00 TO PAY FOR Ali RADIOS FOR THE HIGHWAY DEPARTMENT AND THE NEW INF 4-WHEEL DRIVE DUMP TRUCK PURCHASED BY THE TOWN . • Roll Call Vote : Wright - aye Wilbur - aye Roberts - aye Todd - aye Carried by a vote of four ayes and no noes . The letter from the Association of Towns of the State of New York concerning the following two bills was discussed : Assembly 8987 ( Senate 6859 ) and Assembly 12945 ( Senate 10166 ) . Qouncilman Ralph Wilbur moved a resolution stating that the Danby Town Board objects to the passage of these two bills and dasnot approve of illegal strikes . Justice Milton Todd seconded the motion . RESOLUTION #2U DANBY TOWN BOARD OBJECTS TO THE PASSAGE OF ASSEMBLY BILL '8987 ( SENATE 6859 ) i 0 ASSEMBLY BILL 12945 ( SENATE 10166 ) . Roll Call Vote : Wright - aye Wilbur - aye Roberts - aye Todd - aye Carried by a vote of four ayes and no noes . The speed limit problem in West Danby was discussed . Justice Milton Todd moued - aresolut. ion that a feasibility study be made by the State Highway Department of Transportation of the West Danby area and that the Town. Boardrecommendr that _ a 45MFH speed ' limit be _ postedLfor?- this area . The motion was seconded by Councilman Dorothy Roberts . REOLUTION #3/ TOWN BOARD OF THE TOWN OF DANBY REQUESTS A FEASIBILITY STUDY BE MADE BY THE STATE HIGHWAY DEPARTMENT OF TRANSPORTATION OF THE WEST DANBY AREA AND RECOMMENDS THAT A 45MPH SPEED LIMIT BE POSTED IN THAT AREA . Roll Call Vote : Wright - aye Wilbur - aye Roberts - aye Todd - aye Carried by a vote of four ayes and no noes . General Fund Warrant #7 in the amount of $ 305 . 69 was approved to be paid . The motion was made by Councilman Dorothy Roberts and seconded by Justice Milton Todd and carried by a vote of four ayes and no noes . Highway Fund Warrant #7 in the amount of $ 1 , 33 . 72 was approved to be paid . The motion was made by Justice Milton sodd and seconded by Councilman Dorothy Roberts and carried by a vote of four ayes and no noes . The Supervisors reports were approved as presented . The motion was made by Councilman orothy Roberts and seconded by Justice Milton Todd and carried by a vote of three ayes and no noes . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby , County of Tompkins and State of New York on July 10 , 1978 . The purpose of the meeting was to open bids on equipment to be sold by the town that is of no further use to the town . The equipment to be sold by the town is a )6 ton , 4-wheel drive 1968 Ford pick-up truck ; a 1951 Dodge dump with 3 yard box and an Oshkosh 4-wheel drive 1957 dump with 6 yard box . B oard members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Dorothy Roberts Justice Milton Todd Board member absent : Councilman Robert Snedden Others present : Roy Hornbrook The notice of publication was presented to the Supervisor by the Clerk . The notice was read . The following bids were received : W illiam Farrell - Oshkosh 4-wheel drive 1957 dump $ 310 . 00 Paul ' s Auto Parts - Ford pick-up truck 151 . 50 Dodge Dump truck 151 . 50 Oshkosh 4-wheel drive 1957 dump 151 . 50 W illiam S . Johanson - Ford pick-up truck 161 . 50 Dodge dump truck 261 . 00 Oshkosh 4-wheel drive 1957 dump 261 . 00 After discussion of the bids received Councilman Ralph Wilbur moved a resolution that William Johanson ' s bid of $ 161 . 50 for the Ford pick- up truck and his bid of $ 261 . 00 for the Dodge dump truck be accepted . The sale of the Oshkosh to be tabled for the time being . Justice Milton Todd seconded the motion . RESOLUTION #25 SELL THE )4 TON , 4--WHEEL DRIVE 1968 FORD PICK-UP TRUCK FOR $ 161 . 50 AND THE 1951 DODGE DUMP WITH 3 YARD BOX FOR THE PRICE OF $ 261 . 00 TO WILLIAM JOHANSON .
