HomeMy WebLinkAbout1978-04-10 TOWN OF DANBY SPECIAL BOARD MEETING MINUTES April 10 , 1978 The regular meeting of the Danby Town Board was called to order at the Danby Town Hall , 1830 Danby Road , Town of Danby , County of Tompkins and State of New York on April 10 , 1978 at 8 : 10 P . M . Board members present : Supervisor A . Francus Wright Councilman Kalph Wilbur Councilman James Murinchack Councilman Dorothy Roberts Justice Milton Todd 0 Others present : Justice Paul Smith , Frank Haskins , Roy Hornbrook , Dan Hoffman , Donald Graham , Mr . Leath , Mr . and Mrs . Critzer , Donald Wright Sr . and Donald Wright , Jr . , Ed Slights , Judson Leonard , Gordon Roberts , Jimmie Miller , Helen Murinchack . A motion was made by Justice Milton Todd to approve the minutes of the regular meetings of February and March and the special March meeting of the Town Board . Councilman Dorothy Roberts seconded the motion which was carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . A letter from Walter Reimers complimenting the Highway Super- intendent for a job well done in repairing a sleuth pipe in front of his house . 2 . Agenda of the Tomplins bounty Board of Bepresentatiives Monday March 13th meeting . 3 . A letter from the Department of Transportation of the State of New York concerning the Friedman - D ' Ambrose private airport . 4 . A letter from the Ithaca Agency , Inc . suggesting that the insurance company and the Town Board get together and ' review the insurance needs of Danby . 5 . A letter from CNA stating that the medical insurance rates for the town highway employees will be increased . 6 . A letter from New York State Executive Department , Division for Youth advising of the appointment of Hoseph P . Walker as Division for Youth Field Representative for the Southern Tier East Region . 7 . A letter from the New York State Electric and Gas Corporation stating that they are no longer allowed to accept payment of bills for services at the discounted rate after the set time ) = ; • ,period's asethey . havedenpuifi the past . 8 . A letter from the New York State Racing and Wagering Board concerning games of chance . 9 . A letter from the Tomplins County Municipal Officials Asspci - ation advising of the April 19 , 1978 dinner meeting . 10 . A letter from Frank Liguori , Commissioner of Planning , of the Tompkins County Planning Department concerning participation in a county wide Transportation Commission . 11 . Minutes of the March 15 , 1978 meeting of the Town of Danby Planning Board . PRIVILEGE OF THE FLOOR : The clerk stated that Gary Evans has made copies of the section of the Zoning Ordinance that is ready for public hearing and the hearing can be advertised as soon as a date is set . The vacuum cleaner for the Town Hall has been received and works well . Town Board Meeting Minutes - April 10 , 1978 Page 2 Privilege of the Floor continued : Councilman James Murinchack announced that he is resigning from the Town Board as he is moving out of the State . His last meeting will be May 14 , 1978 . Dan Hoffman complimented Roy Hornbrook on road work that he is doing . Justice Milton Todd stated that the road work done on Station Road had been a big help . Judson Leonard as Danby Fire Chief stated that he appreciated work • done on Station Road . It is now much easier to get the fire trucks up and down the road . The two Mr . Wrights , Frank Haskins and his tenants the Smiths asked what progress is being made to get cable T . V . in West Danby . COMMITTEE REPORTS : H ighway Report - General repair work is being done on the roads . Approval of the Donovan projects is needed . The highway committee will go over this with Bill Mobbs and call a special meeting of the board to handle this - matter . The matter of radios for the highway department in conjunction with Newfieed and the Newfield School was discussed . There are still many questions that need to be cleared up . It was decided that the Danby Town Board should meet with the Newfield Town B oard and get some of these questions answered . After discussion of the Shalco bill it was secided that the town legally owes the bill and it should be paid . Councilman Ralph Wilbur made the motion that the supervisor be authorized to pay the bill . The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . The Town Board traveled to Horseheads and looked at a truck that is similar to ine needed by the Town of Danby . The Town of Redding Supervisor has facts and figures on ten wheel drive trucks and is willing to talk to the board . The matter was discussed at length . It was decided that the highway committee would set a date for the meeting with the Town of Redding Supervisor . A question of who the rep- resentative to the Tompkins -County Transportation Commission was raised . , The clerk will check the record for the answer to this question . W est Danby Water District - All fine . Insurance - A meeting will be set with Bill Scott of Ithaca Agency to go over the insurance needs of the town and also check to see if funds are available to pay the increase in the health insurnace . Refuse collection & Disposal - Nothing to report . Youth - An amendment to the youth budget in the amount of $ 218 . 00 to pay Mike Wiese ' s salary for January , February and the balance for December was submitted . The application is not for extra funds it will reduce the amount requested for materials and supplies by $ 218 . 00 and add the same amount to personal services . The total budget will be $4840 . 00 as originally set up . A copy of the revised budget was submitted for approval . Justice Milton Todd moved a resolution to adopt the revised youth budget as submitted . The motion was seconded by Councilman James Murinchack . RESOLUTION #13 ADOPT THE YOUTH BUDGET AS REVISED Roll Call Vote : Wright - aye Wilbur - aye Murinchack - aye Roberts - aye Todd aye Carried by a vote of five ayes and no noes . Town Board Meeting Minutes - April 10 , 1978 Page 3 Committee Reports continued : After some discussion Justice Milton Todd moved a resolution to amend the Youth Budget by $218 . 00 to pay Mike Wiese ' s salary . The motion was seconded by Councilman James Murinchack . II RESOLUTION #14 AMEND THE YOUTH BUDGET WITHOUT CHANGING THE TOTAL AMOUNT BUDGETED BY ADDING $ 218 . 00 TO PERSONAL SERVICES TO PAY MIKE WIESE ' S SALARY AND REDUCING THE AMOUNT BUDGETED FOR MATERIALS AND SUPPLIES BY $ 218 . 00 . Roll Call Vote : Wright - aye III Wilbur - aye Murinchack - aye Roberts - aye Todd - aye Carried by a vote of five ayes and no noes . Fire - The fire departments have been very busy . Cemetaries - Nothing to report . OLD BUSINESS : Judson Leonard reported on what has happened to date concerning cable T . V . in West Danby . The county cable commission was approached . John Marcham representative from the county cable commission looked over Danby ' s proposed franchise and suggested changing the numbering of II sections to agree with the commissions model franchise . He did not evaluate the rates . It has been recommended that the $ 7 . 00 per month rate for subscribers to the T . V . cable service be accepted . The Town Board discussed the matter . Councilman James Murinchack made the motion that a date be set for a public hearing on the proposed Cable T . V . Franchise . Justice Milton Todd seconded the motion which was carried by a vote of five ayes and no noes . Supervisor A . Francis Wright stated that he would take this matter to the town attorney and have him write up a legal notice for advertising the public hearing . James Murinchack made the motion that the public hearing be held May 1 , 1978 at the Danby Town Hall at 8 : 00 P . M . The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . Highway Superintendents report - Nothing to add to what has already been discussed . Appeals Board. Chairman - Absent Planning Board Chairman - Chairman absent . Vice -chairman Donald Graham suggested that the Town Board hold hearings on the sections as the changes are made and then when this has been completed the Zoning Ordinance should be adopted as a whole and not section by Ssection . The Town Board agreed with this suggestion . The section on administration . is ready for public hearing and the hearing will be II held May 1 , 1978 at the Town Hall at 8 : 00P . M . An informational meeting will be held at the West Danby Fire Station on this section of the Zoning Ordinance . The meeting will be chaired by Justice Milton Todd on April 24th at 8 : 00P . M . An appointment to the planning board was discussed but no action taken . Notice has been received that the State has no objections to the Gunderman Road Airport under their rules and regulations . The Town Board has not received any information that the rules and regulations as set by the Board - of Zoning Appeals have been complied with . A motion was made by Justice Milton Todd that the Zoning Officer write to the airport owners and make them aware of the rules and regulations to be complied with . The motion was seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . I { Town Board Meeting Minutes - April 10 , 19 78 Page 4 01:d-1Businessfycont nued : Councilman Dorothy Roberts reported that she has approached Margaret Snedden to serve as the representative of Danby on the Human Services Coalation and Mrs . Snedden has agreed to serve . Councilman Dorothy Roberts then made the motion to appoint Margaret Snedden to this position . The motion was seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . After a lengthy discussion of the property next to the town hall it was decided by the committee looking into this matter that they were not ready to make any recommendations at this time . NEW BUSINESS : A party for Flody Dorn who served many years as a town justice was discussed . Councilman Dorothy Roberts felt that this could set a precedent and possibly should not be done . Councilman James Murinchack felt that a party of this sort would give all the boards of the town a chance to get together . After a long discussion it was decided that a dinner at a restaurant with each person paying his own way would be a good idea . A resolution was moved by Councilman James Murinchack to authorize the supervisor to pay the electric bills as they are received as the town is no longer allowed to pay the discounted price after the alotted time period . The motion was seconded by Councilman Ralph Wilbur . RESOLUTION #15 AUTHORIZE THE SUPERVISOR TO PAY THE ELECTRIC BILLS FOR THE TOWN OF DANBY AS THEY ARE RECEIVED . Roll Call Vote : Wright - aye Wilbur - aye Murinchack - aye Roberts - aye Todd - aye Carried by a vote of five ayes and no noes . John Wilson has looked at the basement in the Town Hall to see about installing a . furnace . He feels that a furnace could be installed for approximately $4000 . 00 . This is for complete installation with all new equipment . He is willing to talk to the board about this . As the specs have not yet been written up there are no bids for drapes . Jimmie Miller in business of the Tompkins County Board of representatives stated that the Tompkins County Hospital has been transferred from a public to a private no profit situation . First claim to the Freeville to Cortland railroad line property will be given to land owners . Gordon Roberts said that he needs to know if a certain section of the LaRue Road is a town road or not before he can issue a building permit . The Town Board discussed the matter and stated that it is a ill non-maintained highway right -of-way and this should be made known to the builders . Gordon Roberts then asked where he can get the i.nvironmental assessment forms mentioned in the zoning ordinance . After discussion it was decided that Donald Graham will check into this and get them for the zoning officer . General Fund Warrant #4 in the amount of 1536 . 54 was approved to be paid . The motion was made by Justice Milton Todd and seconded by Councilman James Murinchack and carried by a vote of five ayes and no noes . Highway Fund Warrant #4 in the amount of $ 2104 . 38 was approved to be paid . The motion was made by Councilman Dorothy Roberts and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes .
