TOWN BOARD MEETING MINUTES
December 12 , 1977
The regular meeting of the Danby Town Board was called to order at
the Danby Town Hall , 1830 Danby Road , Town of Danby , County of
Tompkins and State of New York on December 12 , 1977 at 8 : 05 P . M .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
Justice Floyd Dorn
•
Justice Milton Todd
Others present : Roy and Mary Casterline , Edward and Dorothy Roberts ,
• Judson Leonard , Gordon Roberts , Bradley Corbitt , James Murinchack ,
Joe Hulbert , Roy Hornbrook , Edward Slights .
A motion was made to approve the minutes of the November 14 , 1977
meeting with the correction that the senior citizens request for
$ 400 . 00 be included in the 1978 Revenue Sharing Budget subject to
public hearing . The motion was seconded by Councilman Ralph Wilbur
and carried by a vote of five ayes and no noes .
COMMUNICATIONS :
1 . A letter from Judge Betty Friedlander to Supervisor Wright
asking that a person be appointed to represent the Town of
Danby on the newly created advisory council to the Tompkins
County Family Court .
1/ 2 . A letter from the Association of Towns of the State of New .
York asking for ideas , suggestions and recommendations so
that they can be of better service to the towns .
3 . Agenda of the Tompkins County Board of Representatives
Monday , November 28 , 1977 meeting .
4 . A letter from the New York State Department of Transport -
ation requesting a resolution be passed by the town board
concerning rail crossings in the town .
5 . A letter from Thomas Huhn Manufacturer ' s Representative ,
Automatic Voting Machines .
6 . A letter from the Tompkins County Office for the Aging
concerning availability of Title V funds for Multi - Purpose
Senior Centers .
• 7 . A letter from Bradley Corbitt concerning money available
from the Youth Budget to pay Mike Wiese and John Hollenbeck
11 for winter program at the school .
8 . A letter from Bradley Corbitt thanking the Town Board for
supporting the activities of the Community Council .

PRIVILEGE OF THE FLOOR :
Councilman Paul Smith reported that George Hovanec is working on the
sign for the Town Hall but is not sure when it will be finished .
The clerk reported that Joan Barber , the newly appointed dog enumer -
ator , has completed her job and done it well . The clerk then
presented the Town Board with a proposed resolution for the creation
of the position of typist part time in the clerk ' s office and a
proposed resolution to create the position of dog enumerator in the
Town of Danby . The proposed resolution for the creation of the
position of part time typist in the clerk ' s office was read . After
some discussion the resolution was moved by Justice Milton Todd .
and seconded by Councilman Paul Smith .

The proposed resolution for the creation of the position of dog
enumerator waIs read and discussed . The resolution was moved by
Justice Floyd Dorn and seconded by Justice Milton Todd .
RESOLUTION J34 CREATE THE POSITION OF DOG ENUMERATOR
IN THE TOWN OF DANBY .

Carried by a 'vote of five ayes and no noes .
The money to buy the stamped envelopes to mail tax notices was
discussed . The money is normally taken from the purchasing account
which at this time does not have enough money in it to pay this
bill . Justice Milton Todd moved a resolution to transfer $ 300 . 00
form General Fund account %7A1345 . 2 to the purchasing account A1345 . 4 . III
to pay this bill and any additional bills for December . The motion
was seconded by Councilman Paul Smith .

PURCHASING ACCOUNT A1345 . 4 TO MAKE FUNDS
AVAILABLE TO PAY POSTAGE FOR MAILING THE
TAX NOTICES AND ADDITIONAL EXPENSES .

Privilege of the Floor continued :
A partition os needed to help control the heat between the offices
and the meeting room . After discussion Councilman - Ralph Wilbur
made a motion to use $ 500 . 00 from the equipment fund A1345 . 2 to
I/ install folding doors between the offices and the meeting room .
The motion was seconded by Councilman Paul Smith and carried by a
vote of five ayes and no noes .
Judson Leonard reported on fire calls in the Town of Danby .
Gordon Roberts stated that if some are entitled to an increase in
salary everybody should be entitled to an increase . He did not
receive one and feels he should have .
James Murinchack stated that the community Council is still waiting
for the rules for the use of the Town Hall from the Town Board . Dan
Hoffman is interested in serving as Danby ' s representative on the
Envromental Management Council .
COMMITTEE REPORTS :
Councilman Ralph Wilbur reported that the main business of the highway
department has been snow plowing and cindering the roads . The new
cinder spreader has arrived .
West Danby Water District - All working well .
Insurance - There will be a 7 % increase in insurance costs as of
January 1 , 1978 .
Refuse Collection and Disposal - Nothing to report .
Youth - Nothing to report .
Fire - No report .
Zoning and Planning - Nothing to add to the written reports .
Cemetaries - No report .
OLD BUSINESS :
Highway Superintendents report - All is working well .
Appeals board chairman . - There were no appeals heard before the
board this month .
Zoning Officer - Written report submitted .
Planning Board Chairman - absent .
The appointment to the Environmental Management Council was discussed .
two people are being considered . They are Mark Haag and Dan Hoffman .
Other people are interested and should be listened to .
Appointments to the Board of Zoning Appeals were discussed . Ralph
Wilbur recommended that Mr . Clifford Abbott and Robert Heldesen be
appointed to fill the vacancies on this board . Sylvia Hiney should

be considered when there is an opening on the planning board .
Also Frank Darrow is interested in serving on the board of
zoning appeals . The motion was made by Justice Milton Todd to
appoint Mr .. Clifford Abbott and Robert Helgesen to serve as
members of the Town of Danby Board of Zoning Appeals . The
motion was seconded by Justice Floyd Dorn and carried by a
vote of five ayes and no noes .
Councilman1Ralph Wilbur reported that Frank Muzzy has agreed to
serve as chairman of the Board of Zoning Appeals if appointed .
He then made the motion that Mr . Muzzy be appointed to fill
this position . The motion was seconded by Councilman Paul
Smith and carried by a vote of five ayes and no noes .
Councilman Paul Smith introduced Kevin Roarke who is General ' I
Manager of Cerracche Telivision Corp . which is a subsidiary of
American Telivision Corporation to report on the proposed
franchise between the Town of Danby and the American Television
Corporation . He stated that he hoped that a formal agreement
could be signed by spring and. TV service installed this summer .
The matter was discussed at length .
Councilman Paul Smith reported that someone is coming to look into '
the matter of accustics in the Town Hall meeting room .
NEW BUSINESS :
Reservations should be made for the people who wish to attend
the Associations of Towns meeting to be held in New York City
in February . The clerk was asked to make the reservations .
A proposediresolution presented by the New York State Transport -
ation Department was read by Supervisor A . Francis Wright . This
is an agreement to be made between the Town of Danby and the New
York State Department of Transportation to construct a Federal
Aid Rail - Highway Crossing Program project in the Town of Danby .
This would involve Station Road , Brown Road and Walding Lane .
Supervisor A . Francis Wright moved the resolution which was
seconded by Councilman Ralph Wilbur .
RESOLUTION #36 AN AGREEMENT BETWEEN THE NEW YORK STATE
HIGHWAY DEPARTMENT AND THE TOWN OF DANBY
TO CONSTRUCT A FEDERAL AID RAIL- HIGHWAY
CROSSING PROGRAM PROJECT IN THE TOWN OF
DANBY .
Roll Call Vote : Wright - aye
Wilbur - aye
Smith - aye
Dorn - aye
Todd - aye
Carried by a vote of five ayes and no noes .
Town Clerk , Mary Oltz and Justice Milton Todd were appointed to
serve as a committee to look over the voting machines and make
recommendations to the town board .
The youth fund budget was discussed . Justice Milton Todd moved
a resolution to transfer $ 555 . 00 from account A7310 . 4 and add
this amount to account A7310 . 1 to make funds available to pay
salaries for the winter program at the school . The motion was
seconded by Councilman Paul Smith .

Rules and regulations for the use of the Town Hall were discussed .
A meeting will be held December 13 , 1977 at 8 : OO , P . M . at the Town
Hall with the union man to discuss the proposed ' BSEA . contract
between the . Town of Danby Highway employees and the Town of Danby .
Justice Milton Todd moved a resolution to transfer $ 50 . 00 from
the contingency account to general fund account A1450 . 4 to make
funds available to -Pay the balance of the election inspectors
salaries . The motion was seconded by Councilman Ralph Wilbur .

A meeting will be held by the Town Board on December 22 , 1977 at
8 : 00 P . M . at the Town Hall to pay the year end bills .
General Fund Warrant #12 in the amount of $ 1 , 076 . 81 was approved
to be paid . The motion was made by Councilman Ralph Wilbur and
seconded by by Justice Milton Todd and carried by a vote of five
ayes and no noes .
Highway Fund Warrant #12 in the amount of $ 12 , 283 . 63 was approved
to be paid . The motion was made by Councilman Ralph Wilbur and
seconded by Justice Milton Todd and carried by a vote of five ayes
and no noes .
Councilman Ralph Wilbur made the motion to approve the Supervisor ' s
reports as presented . Justice Milton Todd seconded the motion which
was carried by a vote of four ayes and no noes .
. The motion to adjourn the meeting was made by Councilman Paul Smith
at 10 : 30 P . M . and seconded by Justice Milton Todd and carried by a
vote of five ayes and no noes .
