TOWN OF DANBY
TOWN BOARD MEETING MINUTES
September 12 , 1977
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby ,
County of Tompkins and State of New York on September 12 , 1977 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
Justice Floyd Dorn
Justice Milton Todd
Others present : Roy Hornbrook , Mary Scott , Dan Hoffman , Mr . and
• Mrs . Liberman , Paul Grover , Roy Casterline , Ernest Cole , Gordon
Roberts , Sandy Roberts , Edward Slights , Eda Hulbert , Joe Hulbert ,

Councilman Paul Smith made the motion to approve the minutes of the
August 8 , 1977 - meeting -ast. presented . : . The , tmot&Lon: :was seconded by
Justice Floyd Dorn and carried by a vote of five ayes and no noes .
The minutes of the special meeting held August 30 , 1977 were
approved as presented . The motion was made by Justice Milton
Todd and seconded by Councilman Ralph Wilbur and carried by a vote
of five ayes and no noes .
COMMUNICATIONS :
1 . A letter from Ronald Donlick concerning the sale of
his property adjacent to town property to the town .
2 . A letter from the New York State Department of Audit and
Control concerning the use of Federal Revenue Sharing
Funds .
3 . A letter , from the New York State Department of Audit and
Control concerning the 1978 payment of Highway Aid to
towns .
4 . Agenda of the Tompkins County Board of Representatives
meeting of Monday September 12 , 1977 .
S . A letter from the Tompkins County Department of Assessment
• concerning the final equalization rates for the towns
to be recommended for adoption by the Board of Represent -

14 . Minutes of the meeting of the Town of Danby Board of
Zoning Appeals held August 10 , 1977 .
15 . A letter from the State of New York _ Executive Department
Division of Housing and Community Renewal concerning a
copy of the code manual for the State Building Construct -
on Code which is being sent to the =town .
16 . A letter from the Tompkins County Municipal Officials
Association advising of the Wednesday , September 21 , 1977
dinner meeting .
17 . A letter from the New York State Cable TV Commission
answering Councilman Paul Smith ' s letter of August , 1977 .
PRIVILEGE OF THE FLOOR :
Mary Oltz stated that she was asked by the EOC outreach worker to
ask the Town , Board if she could use the Town Hall two mornings a
week to take care of telephone business . Also election inspectors
need a clock in the Town Hall . When the board is considering budgets
the inspectors would like an increase to $ 3 . 00 per hour for their
services and they need maps of the district boundaries .
Gordon Roberts asked what is to happen to Jersey Hill Road next , it
has been tarred and stoned . He was referred to Bill Mobbs .
Dan Hoffman stated that he has a present presentation but not
speach . He 'passed out what he called genuine West Danby apples .
COMMITTEE REPORTS :
Highway report - Councilman Ralph Wilbur reported that the section
of Michigan Hollow Road that was rebuilt last year has been tarred
and stoned again this year . The gas tank has been installed and the
usual patch work is being done .
West Danby Water District - The budget for 1978 has been submitted
to the board for consideration .
Insurance - 'Supervisor A . Francis Wright reported that he has been
notified by the Carey McKinney Group that the hospitalization
insurance premium has been increased by 5 % as of October 1 , 1977 .
Refuse Collection and Disposal - Nothing to report .

Committee reports continued :
Youth - Nothing to report .
Zoning and Planning , - Nothing to report other than the reports that
have been submitted by the two boards .
Fire - Councilman Ralph Wilbur commented on the Danby Rescue Squad
and the hunt for the lost child in Danby .
Cemetaries - All in good order .
OLD BUSINESS ;
The DeputronlHollow Road problem that was tabled in August was
discussed . Supervisor A . Francis Wright pointed out that the Danby
Town Board does not want to involve itself in a civil dispute .
The problem between the Olsefski ' s and the Liberman ' s should be
settled first . Mr . Liberman wants an extension of 300 feet where
road work is to be done by the town beyond what is being done at
the present time . Mary Scott who lives on the other end of the road
would like the road declared abandoned . It was decided that the
advise of the town attorney was needed before the board can vote
on this matter . The thought was that the 300 foot section should
be abandoned or maintained . Councilman Paul Smith made the motion
to table the matter until the board has consulted with the town
attorney . Councilman Ralph Wilbur seconded the motion which was
carried by a vote of five ayes and no noes .
Jimmie Miller reported on the highlights of the Board of Represent =
atives morning meeting . The senior citizens exemption of tax
purposes has been raised form $ 6 , 500 to $ 7 , 200 . There will be a
meeting at TC3 on the new Resourse Conservation and Development
Project of Tompkins County . This is a federal program . The
meeting will be held September 20th . One of the group homes in
Tompkins County was closed by the State . He mentioned that the
Town of Danby has not appointed a representative to the County
Wide Youth Bureau . This was discussed at length .
Appeals Board Chairman - A new member is needed as one member has
resigned .
Zoning Officer - A written report was submitted .
• Planning Board Chairman - Ernest Cole reported that the matter of the
airstrip was considered by the Planning Board and has been returned to
the Board of Zoning Appeals for their decision . The Planning Board
is recommending to the Town Board that revisions to the Zoning
Ordinance be considered in groups of amendments . One such amendment
was presented to the Town Board . A meeting of the Town Board and
the Planning Board will be held September 22 , 1977 at the Danby
Town Hall to consider this amendment . This will be a public
meeting and an appointment to the Board of Zoning Appeals will be
made .
The bridge located on Fisher Settlement Road leading to the Speach
Clinc has been checked as weld as the dam . The dam and bridge are
both in bad shape . After a lengthy discussion the matter was
tabled .

Ou' deBusiness : continued :
Nana were submitted for consideration for appointment - to the Board
of Zoning Appeals and also the Planning Board . Also names for
Consideration for the position of representative ' to- the County
Wide Youth Bureau . A committee was choosen to interview these
people . The committee members are ; Councilman Ralph Wilbur ,
Councilman Paul Smith , Supervisor A . Francis Wright and James
Murinchack . 1People will be interviewed for ' the above positions '
on September19 , 1977 at 8 : 00 P . M . at the Town Hall .
The airstrip ' appeal to be heard before the Board of Zoning Appeals
at their next meeting was discussed at length . The zoning officer
has information that may make it impossible to hear this case .
Councilman Ralph Wilbur made the motion to have the attorney attend
the hearing . The motion was seconded by Justice Milton Todd and
carried by a vote of five ayes and no noes . The clerk was asked
to call the attorney andtask him to attend the hearing . '

The lease agreement between Leon Drake and the Town of Danby to
be used for a family recreation area in West Danby was read by
the clerk . ` A discussion followed '. The ' lease ' agreement is for a
twenty year period at a cost ' of $ 100 . 00 per year . Supervisor
Wright proposed a ' resolution to transfer funds to make them
available to pay. for the lease . This resolution was - moved by
Justice Milton Todd and seconded by Councilman Paul Smith .

Councilman Paul Smith moved a resolution authorizing the Supervisor
to sign the lease agreement between Loen Drake and the Town of Danby .
The motion w;as seconded by Councilman Ralph Wilbur .

NEW BUSINESS :
Supervisor A . Francis Wright reported on a meeting with Chairman
Town Board Meeting Minutes - September 12 , 1977 Page 5
New Business continued :
MacNeil of the Tompkins County Board of Representatives . The purpose
of the meeting was to inform the supervisors of the county of a
referendum to be voted on by the people in the November election .
This referendum is for $ 250 , 000 , 000 . 00 to improve the economy of
New York State . The State wants recommendations from the County
by the 16th of September on programs to beitinitiated in the
County . Some suggested ideas were to improve the swimming area
at Buttermilk Falls , put a new bridge at Enfield Falls and several
other things to be done at the State parks . The idea is to attract
tourists . The octopus was a problem that was discussed .
A budget meeting date was set . It will be Septemberl26 , 1977 at
7 : 30 P . M . at the Supervisor ' s home .
The revenue sharing budget was read . Justice Milton Todd moved a
resolution that the Revenue Sharing Funds be spent as budgeted .
Repairs to town garage $ 5 , 000 . 00 ; Town Hall repairs and landscaping
and Town Hall parking lot $ 10 , 000 . 00 ; reduce the mortgage on the
Town Hall $ 5 , 000 . 00 ; Highway storage building $ 11 , 896 . 10 ; pave
2 mile of road $ 4 , 500 . 00 ; and West Danby Recreation area $ 1 , 000 . 00
for a total budget of $ 37 , 396 . 10 . The resolution was seconded by
Councilman Paul Smith .
RESOLUTION # 24 ADOPT REVENUE SHARING BUDGET

Carried by a vote of five ayes and no noes .
Stationary for the town was discussed . Justice Milton Todd made
the motion that the town clerk check into prices for having
stationary printed for the town . Councilman Paul Smith seconded
the motion which was carried by a vote of five ayes and no noes .
A Gas and Electric Company representative will be invited to the next
town board meeting .
The town clerk will get maps for the election inspectors designating
the election districts in the Town of Danby . Also the board will
consider a raise in pay for the election inspectors from $ 2 . 50 to
$ 3 . 00 per hour . James Murinchack will ask the Community Council
if they would like to donate a clock to be used in the Town Hall .
The matter of who should make up the committee for the West Danby
Recreation area was discussed at length . The Town Board does not
want to get involved in who should make up the committee but would
want to make sure West Danby is represented . Justice Milton Todd
made the motion that Joe Hulbert do the bulldozing work at the
future West Danby Recreation Area using town equipment . This is
to be done after regular working hours and no one else is to use
town equipment . The motion was seconded by Councilman Paul Smith
and carried by a vote of five ayes and no noes .

New Business continued :
General Fund Warrant #9 in the amount of $ 1 , 5241. 50 was approved tb
be paid . The motion was made by Justice Milton Todd and seconded
by Councilman Ralph Wilbur and carried by a vote of five ayes and
no noes .
Highway Fundi Warrant #9 in the amount of $ 9 , 118 . 21 was approved to
be paid . The motion was made by Councilman Ralph Wilbur and seconded
by Justice Milton Todd and carried by a vote of five ayes and no noes . ",
West Danby Water District Warrant #8 in the amount of $ 316 . 88 was
approved to be paid . The motion was made by Justice Milton Todd and
seconded by Justice Floyd Dorn and carried by a vote of: five ayes
and no noes .
The Supervisor ' s reports were accepted as presented . The motion
was made by Councilman Ralph Wilbur and seconded by Justice Milton
Todd and carried by a vote of four ayes and no noes .
The meeting was declared adjourned at midnight . :
