TOWN BOARD MEETING MINUTES
July 11 , 1977
The regular meeting of the Danby Town Board was called to order at
8 : 05 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby ,
County of Tompkins and State of New York on July 11 , 1977 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
Justice Milton Todd
Justice Floyd Dorn
• Others present : Rick Dobson , Mary & Roy Casterline , Ernest Cole ,
Gordon Roberts , Edward Roberts , Clifford DeMayo , James Murinchack ,
• Sandy Roberts , Helen Murinchack , Jimmie Miller , Joe Short , Dan Hoffman ,
Mrs . Hulbert , Mr . & Mrs . Liberman .
Councilman Pau]Smjth made the motion to approve the minutes of the
June 13 , 1977/a ti ±" 5the addition of the appointments of election
inspectors from a list submitted by the town clerk . The motion tas
seconded by Justice Floyd Dorn and carried by a vote of five ayes and
no noes .
COMMUNICATIONS :
1 . Town of Danby Planning Board resolution entitled "Bruce ' s
request for a planned development`.
2 . Memorandum from Tompkins County Board of Representatives
requesting the appointment of a youth board representative
from the Town of Danby .
3 . Resolution No 267 of 1976 - Tompkins County Board of
Representatives - Establishment of the Tompkins County
Youth Bureau as amended .
4 . Agenda of the Tompkins County Board of Representatives
Monday , May 9 , 1977 meeting .
5 . Agenda of the Tompkins County Board of Representatives
Monday , June 27 , 1977 meeting .
6 . Notification of the final State Equalization rate for the
1976 assessment roll .
7 . A letter from the Tompkins County Senior Citizen ' s Council
noting the raise from $ 6 , 500 to $ 7 , 200 of the income limit
for 50,E real property tax exemption for persons over 65 years .
PRIVILEGE OF THE FLOOR :
Rick Dobson would like work done on a ditch so that water will be
divertedfrom his property . He stated that the town highway department
• caused this proplem when working on the ditches . The Town Board
stated that if the town caused this problem they would correct it .
Mr . Dobson asked what decision has been made concerning his trailer
park .
Gordon Roberts stated that he is suprised by the county ' s yes vote on
the County Wide Youth Bureau . The supervisor stated that a letter
of opposition was sent to . the county . The resolution passed by the
county was read .
Mr . Libcrm n asked the town for minimal maintenance of the DePutron
Hollow/etas property . He has done this maintenance work himself
for many years and would like the town to do this now , at least on
a small section . The matter was turned over to the highway
committee for study . Possibly there will be an answer at the
August Town Board Meeting .

Privilege ofithe Floor continued :
Mr . Dan Hoffman stated that he supports the West Danby ball field
Mary Casterline said that people are dumping garbage along Bald
Hill Road and this is becoming a problem .
COMMITTEE REPORTS :
Highway Superintendent - Joseph Hulbert reported that the highway
department has the new tank and tractor . Work is being done to
finish King Road and the next major project is Hornbrook Road .
West Danby Water District - Nothing
Insurance - Nothing
Youth - The Pond problem was discussed at length .
Zoning and Planning - Nothing
Cemetaries - , All in good shape .
OLD BUSINESS :
The highway superintendent has an estimate on a roof for the highway
barn .
Zoning Officer - A written report was submitted . He stated that there
are four appeals to be heard at the next meeting of the Appeals Board .
Appeals Board Chairman - No report .
Planning Board Chairman - Ernest Cole stated that a replacement is
needed for Mr . Best who is presently a member of the Planning Board .
He also said that the Planning Board voted against a County wide
youth board .
A proposed local law was read . The title of this law was "Written
Notificationof Defects and Obstructions of Town Highways and sidewalks " .
After discussion , Councilman Ralph Wilbur moved a resolution to make this
Town Law #1 of the year 1977 . The motion was seconded by Justice'
Milton Todd .

OF TOWN HIGHWAYS AND SIDEWALKS "

Carried by a vote of five ayes and no noes .
Proposed local law entitled " Publication of Notice and Description of
Ordinances of the Town of Danby " was read and discussed . Justice
Floyd Dorn moved a resolution to make this Local Town Law #2 of the
year 1977 othe Town of Danby . The motion was seconded by
Councilman Paul Smith .

Old Business continued :
A proposed local law entitled " Town of Danby Publication Notice Law "
was read and discussed . Justice Milton Todd moved a resolution to
make this Local Law #3 for the year 1977 for the Town of Danby . The
motion was seconded by Councilman Ralph Wilbur .
RESOLUTION #19 LOCAL LAW #3 OF 1977 ENTITLED " TOWN
OF DANBY PUBLICATION NOTICE LAW "

Carried by a vote of five ayes and no noes .
The estimates for a new roof for the town barn were submitted to the
highway committee for study and recommendations will be made to the
town board .
Draperies for the town hall were discussed . It would help the problem
of acoustics but would not solve it completely . It was recommended that
Councilman Paul Smith get in touch with the restoration committee to
get ideas for solving this problem .
West Danby ball field - James Murinchack stated that estimates for
leveling the field were received from three contractors . The lowest
estimate was for $2 , 000 . 00 . There is a lot of work to be done to
make this field usable . This matter was discussed at length . This
will be turned over to the planning board and they will see if funds
are available to do something of this nature .
The motion was made by Councilman Ralph Wilbur that James Murinchack
be appointed chairman of the Appeals Board . The motion was seconded
by G`ounoilman Paul Smith and carried by a vote of five ayes and no noes .
Councilman Ralph Wilbur made the motion to appoint Edgar Oltz to
serve as a member of the Appeals Board . The motion was seconded by
Justice Milton Todd and carried by a vote of five ayes and no noes .
A letter will be written to Mr . Best asking his intentions to serve or
not serve on the planning board . Councilman Ralph Wilbur made the
motion to appoint Robert bnedden to serve as a member of the Planning
Board . The motion was seconded by Councilman Paul Smith and carried
by a vote of five ayes and no noes .
The committee studying the recommendations made by the planning board
concerning unnamed roads in the Town of Danby recommended that the
Town Board adopt these recommendations and changes in the preparation
of a highway map . After a lengthy discussion , Justice Milton Todd
made the motion that the board act accordingly . The motion was
• seconded by Councilman Paul Smith and carried by a vote of five ayes
and no noes .
A sign for the town hall was discussed . A question was raised as to
where the sign should be located , what would be posted on it and
whether it would be double faced .
Jimmie Miller, Tompkins County Board of Representatives member from
the Town of Danby discussed the business before the board of
representatives . He said that he had voted yes on the County Wide
Youth Program and explained why .
NEW BUSINESS :
Insulation for the Town Hall was discussed and tabled for the time
being .

New Business continued :
A representative from Damby to serve on the County Wide Youth
Bureau Board is needed . It was recommended that this matter be
taken to the Community Council and ask them to suggest names .
The new state income limit for 50,E real property tax exemption has
been increased from $ 6500 . 00 to $ 7200 . 00 . After discussion by the
Town Board Justice Milton Todd moved a resolution to increasethe
income limit from $ 6500 . 00 to $ 7200 . 00 for 50% real property
tax exemption for people over 65 in the Town of Danby . Whe motion
was seconded by Councilman Paul Smith .
RESOLUTION #20 INCREASE THE INCOME LIMIT FROM $6500 . 00
TO $ 7200 . 00 FOR PEOPLE OVER 65 TO RECEIVE
A 50% REAL PROPERTY TAX EXEMPTION .

Carried by a vote of five ayes and no noes .
The purchase ; of property abutting the town property where the highway
barns are located was discussed . This property is owned by Ronald
Donlick at the present time . Justice Floyd - Dorn made the motion
to offer $ 1 , 000 . 00 for this property . This offer to be contingent
upon findings of a public hearing on the intended use of the property .
This motion was seconded by Councilman Paul Smith and carried by a
vote of five ayes and no noes .
General Fund Warrant #7 in the amount of $ 393 . 89 was approved to be
paid . The motion was made by Justice Milton Todd and seconded by
Councilman Paul Smith and carried by a vote of five ayes and no noes .
Highway Fund Warrant #7 in the amount of $ 10 , 447 . 48 was approved to
be paid . The motion was made by Councilman Ralph Wilbur and seconded •
by Justice Floyd Dorn and carried by a vote of five ayes and no noes .
West Danby Water District Warrant #6 in the amount of X255 . 66 was
approved to be paid . The motion was made by ouncilman Ralph Wilbur
and secondedlby Councilman Paul Smith and carried by a vote of five
ayes and no noes .
The Supervisor ' s reports were accepted as presented . The motion was
made by Councilman Palph Wilbur and seconded by Justice;:-Milton Todd
and carried by a vote of four ayes and no noes .
The meeting was declared adjourned at 10 : 55 P . M .
