TOWN OF DANBY
TOWN BOARD MEETING MINUTES
February 14 , 1977
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby ,
County of Tompkins and State of New York on February 14 , 1977 .
Board members present : Supervisor A . Francis Wright
Councilman Paul Smith
• Councilman Ralph Wilbur
Justice Floyd Dorn
Justice Milton Todd
• Others present : James Murinchack , Gordon Roberts , Mr . Race , Moses
Peter , Christopher and Virginia Gartlein , Edward Slights , Ernest
Cole , Ralph Sager , Jimmie Miller , Roy & Mary Casterline , Joseph
Short , William Farrell and Ithaca Journal Reporter .
The minutes of the January 11 , 1977 and January 20 , 1977 meetings
were approved as presented . The motion was made by Justice Floyd
Dorn and seconded by Councilman Paul Smith and carried by a vote of
five ayes and no noes .
COMMUNICATIONS :
1 . A letter from Gary Lee concerning the Town Highway Improvement
or Donovan Plan .
2 . A letter from Thaler & Thaler with information about funding
available for recreation .
3 . Agendas of the Tompkins County Board of Representatives
meetings of January 10 , 1977 , January 24 , 1977 and
February 14 , 1977 .
4 . A letter from Krueger with information on folding chairs
available under New York State contract .
5 . Resolution # 12 — APPORTIONMENT OF DOG MONIES adopted by the
Tompkins County Board of Representatives .
6 . A letter from the Tompkins County Intergovernmental Relations

Communications continued :
13 . Minutes of the hearing of the Town of Danby Board of Zoning
Appeals held January 12 , 1977 .
PRIVILEGE OF THE FLOOR :
Councilman Paul Smith reported that the town Board will have to make II
up rules and regulations for the use of the Town Hall . He has been
approached by the people publishing the Danby Area News who would
like to store their equipment in the Town Hall . He also stated •
that there are some people that would like to see lights in front
of the Town Hall to show it off at night much the same as is done
at the church . He then asked what has been done with the Cable •
T . V . Contract .
Mary Oltz , Town Clerk , reported that the Secretary of State has
advised her office that the dog law has been received and filed .
Ralph Sager stated that he would like the local dog law put in the
paper on some other page than under legal notices so people would
be more likely to see it . He stated that he is constantly bothered
by dogs scattering garbage . The Dog Law was discussed at length .
J oe Short asked about the problem of acoustics in the Town Hall .
J immie Miller , Danby ' s representative to the Tompkins County Board
o f Representatives said the mornings meeting was very interesting .
The board voted that the County Courts stay as they are now with
two judges serving three courts . Business Tax Abatment Law was
discussed . -
Mr . Race of Race Office Equipment has a replacement for the check
w riter used in the supervisor ' s office . He told the board what he
had . Councilman Paul Smith made the motion which was seconded by
Councilman Ralph Wilbur to authorize the supervisor to purchase a
$ 75 . 00 check writer for his office . The motion was carried by a
✓ ote of five ayes and no noes . Mr . Race then discussed the
furniture available under state contract . If the town uses the
state contract they do not have to go to bid as that is the lowest
price available ; He recommended Steelcase because they: have a
complete line of furniture . He discussed the discounts on different
pieces of furniture and the different kinds of files available .
If the town decides to order through Race Office Equipment it will
take six to eight weeks for the furniture to be delivered from the III
date it is ordered . A meeting was set for Monday March 7th at
8 : 00 P . M . at the Town Hall for the Board and Mr . Race to get
together and decide what is needed . III
COMMITTEE REPORTS :
Highway Committee - Councilman Ralph Wilbur reported that the
biggest concern is that the Donovan Plan is being phased out .
A furnace for the town garage was discussed . It will cost money for
o il and the furnace but as it is now the men have to go out and cut
wood for their present furance and their time is paid for by the
town . Possibly the old furnace from the town hall can be put in
t he town garage .

Committee Reports continued :
West Danby Water District - Justice Milton Todd reported that things
are running a little more smoothly now as the power situation seems
to have improved .
Insurance - The town highway employees have accepted the health insurance
program available from the Carey McKinney Group and it will become
• affective March 1 , 1977 .
Refuse Collection and Disposal - No report .
• Youth - It was mentioned again that the Community Council would like
to store the equipment for printing the Danby Area News at the Town
Hall . A meeting was set for the 9th day of March to set up rules and
regulations for the use of the town hall . The meeting time to be 7 : 00P . M .
Justice Floyd Dorn reported that the minutes of the last meetings of
the Planning Board and Zoning Board of Appeals have been read . The
propsed Zoning Ordinance was discussed . Moses Peter said that the
ordinace should be rejected by the Town Board . After further
discussion Councilman Ralph Wilbur made the motion that the Town Board
go on record by vote that the Revised Zoning Ordinance will not be
passed without modifications and public information meetings . The
motion was seconded by Justice Floyd Dorn and carried by a vote of
five ayes and no noes .
Fire - It was noted that in the last week the fire department was out
on call every night . Supervisor A . Francis Wright proposed a resolution
acknowledging the fact that the Danby Volunteer Fire Department was
under undue stress during a recent week when they were called out
every night . The Town Board appreciates the services of the Danby
volunteers . This service is done' for the good of the community
with no thought of personal reimbursement . The resolution was
seconded by Councilman Paul Smith .

OLD BUSINESS :
Highway Superintendent - Absent no report .
Zoning Officer - A written report was submitted . The zoning officer
read his report of business during 1976 .
Appeals Board Chairman - Absent . The minutes of the January hearing
were read .

Old Business continued :
Planning Board Chairman - Ernest Cole stated that there has been no
action since the January 19th meeting . Supervisor A . Francis
Wright made the motion to commend the Planning Board Chairman for
his long hours of work under pressure . The motion was seconded by
Councilman Paul Smith and carried by a vote of five ayes and no noes .
After some discussion the motion was made to table the matter of the
Business Exemption Tax Law . The motion was seconded by Councilman •
Paul Smith and carried by a vote of five ayes and no noes .
Councilman Paul Smith made the motion that the town of Danby join the
T . V . Task Force for a fee of $ 130 . 00 . The motion was seconded by
Councilman Ralph Wilbur and carried by a vote of five ayes and no
noes .
Supervisor A . Francis Wright moved a resolution to authorize the
supervisor to sign the necessary agreement and appropriate the
$ 130 . 00 necessary to join the T . V . Task Force . The resolution
was seconded by Councilman Paul Smith .

SUPERVISOR TO SIGN THE AGREEMENT .

Carried by a vote of five ayes and no noes .
Outside lights for the town hall were discussed . Councilman Paul
Smith made the motion to table the matter because of the energy
crunch . The motion was seconded by Justice Floyd Dorn and carried
by a vote of five ayes and no noes .
NEW BUSINESS :
Justice Milton Todd made the motion to appoint Supervisor A . Francis
Wright as delegate to the Association of Towns meeting with
Councilman Paul Smith as alternate . The motion was seconded by
Councilman Ralph Wilbur and carried by a vote of five ayes and no
noes .
Councilman Ralph Wilbur made the motion to authorize Councilman
Paul Smith , Onalee Wright and Supervisor A . Francis Wright to
attend the Association of Towns meeting in New York City . Justice
Floyd Dorn seconded the motion which was carried by a vote of five
ayes and no noes .
Justice Milton Todd moved a resolution to reaffirm Resolution ## 14 of
March 1976 to transfer $ 2 , 300 . 00 from the General Fund to the Highway
Fund for employees benefits as this was not done at that time . The
motion was seconded by Councilman Ralph Wilbur .

RESOLUTION #4 REAFFIRM RESOLUTION OF MARCH 1976
TO TRANSFER $ 2 , 300 . 00 FROM THE
GENERAL FUND TO THE HIGHWAY FUND
TO BE USED FOR EMPLOYEE BENEFITS .

• Carried by a vote of five ayes and no noes .
Councilman Ralph Wilbur made the motion that the SPCA be sent a copy
of the Dog Law and a letter from the Supervisor authorizing them to
inforce the law . The motion was seconded by Justice Milton Todd and
carried by a vote of five ayes and no noes .
The removal of Town Justices as members of the Town Board was discussed .
General Fund Warrant # 2 in the amount of $ 2 , 538 . 38 was approved to
be paid . The motion was made by Councilman Paul Smith and seconded
by Justice Milton Todd and carried by a vote of five ayes and no noes .
Highway Fund Warrant # 2 in the amount of $ 2 , 512 . 21 was approved to
be paid . The motion was mode by Councilman Ralph Wilbur and
seconded by Justice Milton Todd and carried by a vote of five ayes
and no noes .
West Danby Water District Warrant # 1 in the amount of $ 598 , 16 was
approved to be paid . Justice Milton Todd made the motion which was
seconded by Councilman Paul Smith and carried by a vote of five ayes
and no noes .
The Supervisor ' s reports were approved as presented . Councilman
Ralph Wilbur made the motion which was seconded by Justice Milton
Todd and carried by a vote of four ayes and no noes .
Councilman Paul Smith made the motion to adjourn the meeting at
11 : 00 P . M . The motion was seconded by Justice Milton Todd and
carried by a vote of five ayes. and no noes .
