HomeMy WebLinkAbout1976-11-08 TOWN OF DANBY TOWN BOARD MEETING MINUTES November 8 , 1976 The regular meeting of the Danby Town Board was called to order at 8 : 30 P . M . at the Danby Town Hall , Town of Danby , County of Tompkins , and State of New York on November 8 , 1976 . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Paul Smith Justice Floyd Dorn Justice Milton Todd Others present : Ed Slights , Moses Peter , Ernest Cole , Joseph Hulbert , Gordon Roberts , Roy Casterline , James Murinchack , Albert Sebesta , Erie J . Miller , Dan Hoffman . The minutes of the October 11 , 1976 , meeting of the board were approved as presented . The motion was made by Justice Floyd Dorn and seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . A letter from the Human Services Coalition asking the Town of Danby to support the coalition by contributing $ 107 . 99 for their 1977 budget . 2 . A letter from Diana VandeBogart , Town Historian , notifying the board and the public of a meeting to be held December 11 , 1976 . 3 . Agenda of the Tompkins County Board of Representatives meeting of Monday October 25 , 1976 . 4 . Agenda of the Tompkins County Board of Representatives meeting of Monday November 8 , 1976 . 5 . A letter from Edward J . Conley , Mayor of the City of Ithaca asking the town to contribute to the Human Services . . Coalition budget for 1977 . 6 . Copies of letters to the Newfield School concerning the Station Road Railroad crossing, 7 . A letter from Ruth Davis Hughes who says that she has some historical documents that may be of interest to the Town ® of Danby . 8 . Notice of meeting to be held November 12 , 1976 by the Susquehanna River Basin Commission . 9 . Notice of Public hearing held in the Town of Ithaca to be held November 4 , 1976 . 10 . A letter from the Tompkins County Board of Representatives acknowledging reseipt of a resolution passed by the Danby Town Board . 11 . A meeting of the West Danby Water District Commissioners held November 3 , 1976 . c 13 . Minutes of the Town of Danby Board of Zoning Appeals meeting held October 7 , 1976 . 14 . Minutes of the October 20 , 1976 meeting of the Town of Danby Planning Board meeting . and a copy of a resolution that was passed . PRIVILEGE OF THE FLOOR : Mary Oltz , Town Clerk , reported that she had a request from the Newfield News to publish the zoning ordinance as they are equiped to publish legal notices and do not charge as much as the Ithaca Journal . Moses Peter expressed a concern that the proposed Zoning Ordinance is not available to the public other than looking at it at the clerk ' s office or the other locations . It cannot be taken away from these locations for futher study . Ernest Cole stated that it would be much too expensive to give everyone a copy . . The matter was discussed at length . Jimmie Miller discussed the county budget hearing . The county wide youth program was discussed again . He felt that there might be a duplication of services between the town program and the county program . Costs of such a program may go up radidly in years to come . He asked if the Town of Danby still was in favor of the county wide program . This was discussed to some extent . Mortgage taxes received by the town were discussed . COMMITTEE REPORTS : Highway Report - Councilman Ralph Wilbur said that he has not received specs for a radio system for the highway department . King Road , which is a Donovan project , is ready for inspection . Hornbrook Road which is also on the Donovan Plan will not be ready this year . West Danby Water District - Roy Casterline read a letter from the New York State Electric and Gas Corporation concerning the surcharge for a three phase system . He told the board . of the problem with the water pump caused by low voltage . This matter was discussed at length and it was decided that a meeting will 411 be set for the near future . Insurance - No problems . Refuse Collection and Disposal - No report . Youth - The Community Council is in favor of a joint city and county youth bureau . Zoning and Planning - No report Fire - No report Cemetaries - All work done for the winter . Town Board Meeting Minutes - November 8 , 1976 Page 3 OLD BUSINESS : Highway Superintendents Report - Camp McCormick people have policed the picnic area at the Danby Pond . Other work will be lined up for them to do . After some discussion it was decided that the Town Highway Department would keep the parking area clear of snow in the winter time . Zoning Officer - Written report submitted . Appeals Board Chairman - Absent , no report . It ,wasnot,ed that the draft of rules and regulations has not been adopted by the board . The motion was made by Councilman Ralph Wilbur that no more appeals be heard before the board before a set of rules and regulations has been adopted . Justice Milton Todd seconded the motion which was carried by a vote of five ayes and no noes . The Town Clerk was asked to send a letter to the Appeals Board Chairman to this affect . Planning Board Chairman - Ernest Cole passed out a corrected page for the draft of the ordinance . He stated that if more copies are needed of the draft they can be made available . The town ' s position on the county wide youth program was discussed at length . The motion was made by Councilman Paul Smith that the town take the position in favor of the county wide youth program . As there was no second to the motion it was defeated . Justice Milton . Todd made the motion to stay with our own town youth program . Councilman Ralph Wilbur seconded the motion which was carried by a vote of five ayes and no noes . . NEW BUSINESS : Supervisor A . Francis Wright stated that the title of Roy Casterlines jobi ,in the West Danby Water District must be changed to Water Treatment Plant Operator so that it will come under Civil Service as an exempt position so that the town can legally continue to pay his salary . The resolution was moved by Justice Milton Todd that change in title , be made . Justice Floyd Dorn seconded the motion . RESOLUTION #35 CHANGE ROY CASTERLINE ' S TITLE TO WATER TREATMENT PLANT OPERATOR Roll Call -Vote : Wright aye , Wilbur - aye , Smith - aye , Dorn - aye , Todd - aye . Carried by a vote of five ayes and no noes . Mr . Freedman and Mr . D ' Ambrose , through their attorney , sent a leXtter requesting the town board to exercise its authority and request that the Commissioner of Transportation of the State of New York determine whether the proposed airport facility meets its standards . These people want to construct an airport on property owned • by them in the Town of Danby . It was noted that the town attorney advised the town board that they can make this request but before the airport can be . constructed it must be approved by the Town Board , Justice Milton Todd made the motion that the Town Board make this request of the Commissioner of Transportation . The motion was seconded by Councilman Paul Smith and carried by a vote of four ayes and one no . Supervisor A . Francis Wright will make a draft of the letter to be sent . The Human Services Coalition request for $ 107 . 99 be tabled until further information is available . Town Board Meeting Minutes - November 8 , 1976 Page 4 New Business continued : Justice Milton Todd made the motion to accept = ithef1977 youth projects of which there are two , Youth Service Project - and Recreational Cultural Project '. - If the state approves these programs , the state aid will be $ 3 , 000 . 00 . Councilman Paul Smith seconded the motion which was carried by a vote of five ayes and no noes . This motion to be contingent upon state approval of either one or both programs . Justice Milton Todd made the motion to adopt the preliminary budget for 1977 as the Town • Budget for 1977 . The motion was seconded by , Justice Floyd Dorn and carried by a vote of five ayes and no noes . This budget has a town tax of $ 11 . 695 , fire tax of $ 3 . 572 and West Danby Water District tax of $ 9 . 15 . _ RESOLUTION # 36 ADOPT PRELIMINARY BUDGET FOR 1977 AS PRESENTED • Roll Call Vote : Wright - aye , Wilbur - aye , Smith - aye , Dorn - aye , Todd - aye . Carried by a vote of five ayes and no noes . Supervisor A . Francis Wright stated that the Association of Towns dues have increased and therefore an additional $ 7 . 00 is needed to pay these dues . • Councilman Ralph Wilbur moved the following resolution to transfer $ 7 . 00 from account A1110 . 4 to A1920 . 4 , Municipal Association dues account . The resolution was seconded by Justice Milton Todd . RESOLUTION #37 . TRANSFER $ 7 . 00 FROM A1110 . 4 TO A1920 . 4 TO COVER ADDITIONAL COST OF ASSOCIATION OF TOWNS DUES . Roll Call Vote : Wright - aye , . Wilbur - aye ; Smith - aye , Dorn - aye , . Todd - aye . Carried by a vote of five ayes and no noes . The West Danby Water District Clerk presented the Town Board with a list of the unpaid water bills covering the year beginning October 1975 and ending October 31 , 1976 in the amount of $ 1 , 432 . 05 . Councilman Ralph Wilbur moved a resolution that the unpaid water bills be added to the tax roll . The resolution was seconded by Justice Milton Todd . RESOLUTION #38 UNPAID WATER BILLS IN THE AMOUNT OF $ 1 , 432 . 05 BE ADDED TO THE TAX ROLL . . . ' 4. Roll Call Vote : Wright - aye , Wilbur - aye , Smith - aye , Dorn - aye , Todd - aye . Carried by a vote of five ayes and no noes . Supervisor A . Francis Wright moved a resolution to transfer $ 320 . 75 from account A1010 . 4 to account A1950 . 1 to make the necessary funds available to pay the election inspectors . RESOLUTION #39 TRANSFER $ 320 . 75 FROM A1010 . 4 TO A1950 . 1 TO PAY ELECTION INSPECTORS SALARIES . . • Roll Call Vote : Wright - aye , Wilbur - aye , Smith - aye , Dorn - aye , Todd - aye . Carried by a vote of five ayes and no noes . Town Board Meeting Minutes - November 8 , 1976 Page 5 New Business Continued : Justice Milton Todd made the motion to appoint Marshall Martin to serve as a member of the West Danby Water District Commissioners . The motion was seconded by Councilman Paul Smith and carried by a ✓ ote of five ayes and no noes . Justice Milton Todd made the motion to appoint Donna Smith to serve as alternate election inspector to replace Mildred Weitzel , w ho has resigned . The motion was seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . Supervisor A . Francis Wright made the motion to authorize the two Town Justices to attend the justice training school to be held at TC3 . The motion was seconded by Justice Milton Todd and carried by a vote of three ayes and two abstentions . Albert Sebesta reported that Mr . Cerracche would like the investi - gating complaints clause taken out of the proposed T . V . franchise . This was discussed by the town board . The town attorney advised them to include this clause and before making a decision they will consult with him again . Possibly it will be necessary to go to the County T . V . Commission to negotiate . General Fund Warrant # 11 in the amount of # 2 , 073 . 79 was approved to be paid . Councilman Ralph Wilbur made the motion which was seconded by Councilman Paul Smith and carried by a vote of five ayes and no n oes . Highway Fund Warrant # 11 in the amount of $ 3 , 567 . 48 was approved to be paid . Justice Milton Todd made the motion which was seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . West Danby Water District Warrant # 11 in the amount of $ 565 . 09 was approved to be paid . Councilman Ralph Wilbur made the motion which w as seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . The supervisor ' s reports were approved as presented . Justice Floyd Dorn made the motion which was seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . The meeting was declared adjourned at 11 : 30 P .
