TOWN BOARD MiEETING MINUTES
September 13 , 1976
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Town Hall , Town of Danby , Tompkins County ,
New York on September 13 , 1976 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
Justice Floyd Dorn
Justice Milton Todd
IOthers present : E . J . Miller , Ernest Cole , Gordon Roberts , Mrs . Miller
Mike Wiese , Dave Walters , Moses Peter , Bill Shippos , Mrs . Shippos ,
Bob Snedden , James Murinchack , Roy and Mary Casterline , Gould Colman ,
John Myers , Joseph Hulbert , John Novaar , Alfred Sebesta , Max Potter ,
and Edward Slights .
The minutes of the August 9 , 1976 meeting of the Danby Town Board
were approved as presented . The motion was made by Justice Milton
Todd and seconded by Justice Floyd Dorn and carried by a vote of five
ayes and no noes .
COMMUNICATIONS :
1 . • A letter from the New York State Retirement System concerning
contributions made to the plan .
2 . A letter from Gordon Roberts concerning his inspection of the
Bell property which was cleaned up by Roy Casterline per
contract with the town .
3 . Agenda of the Tompkins County Board of Representatives meeting
of Monday , September 13 , 1976 .
4 . A letter from the Tompkins County Office for the Aging
concerning swine flu immunization_ clinics .
5 . A petition with over 50 names on it concerning the plans to
alter the bed or banks of Six-Mile Creek .
PRIVILEGE OF THE FLOOR :
Floyd Dorn commented on the large number of cases heard in the courts .
Paul Smith asked about the dog menace in the town and how it is being
handled . This is still a problem that has not been taken care of . The
matter was discussed at length .
Moses Peter thanked the town board for having Tom Payne , from the
county assessment office , speak at the last town board meeting . He
was impressed , but not favorably .
• Bill Shippos asked what is being done about the TV cable service for
West Danby . He was told that this matter is on the agenda of the
meeting .
Mr . Mike Wiese discussed the the proposed plan for a county wide youth
program and discussed the affect it would have on the Town of Danby .
Jim Murinchack stated that action is needed on the dog problem in Danby .
Max Potter and Dave Walters asked the town board if they needed any of
the cemetaries cleaned as they do this type work professionally . The
cemetery committee was asked to look into this matter .
Gould Colman commented on the town hall renovation . Acoustics is a
problem but the looks of the hall have been tremendously improved .

Privilege of the Flo r Continued :
John Novaar discussed the unfinished work of renovating the town hall .
Also he brought to the attention of the board a zoning problem next
door to his property . The Bruce ' s are doing body work on cars and
also there is a house trailer on the property and it is being lived
in . The matter was discussed at length .
Gordon Roberts brought to the attention of the town board that there
had not been a meeting of the board in West Danby this year .
COMMITTEE REPORTS :

Tompkins County Representative Jimmie Miller asked that problems
with dogs be turned over to him as the county is working on a
contract with the SPCA at the present time . Bonds have gone on sale
f or the County Hospital . The dedication of the old court house was
h eld at noon September 13 , 1976 . The problem of alcoholism in
Tompkins County was discussed at length . Mr . Miller presented the
idea for purchasing the property between the town hall and the gas
station for consideration by the town board . A group is working on
this and the property owners are willing to sell .
W est Danby Water District - They are working on their budget for 1977
and will turn it over to the town board when it has been completed .
Highway report - Councilman Ralph Wilbur stated that King Road is
being worked on and Michigan Hollow Road is almost completed for this
year . The town has the opportunity to purchase a tank type truck for
hauling salt brine .
Insurance - The insurance voucher that was paid twice will be checked
out with the insurance agency .
Refuse collection and disposal - No report .
Youth - The board will wait to take action on the plan proposed by
Jimmie Miller until they hear the Community Council ' s reaction to
the plan .
Fire - No report .
Cemeteries - Mowing is done but brush needs to be cleared out .
OLD BUSINESS :
Highway Superintendents report - Damage due to recent flooding was
discussed but no solution was reached .
Zoning Officer - A written report was submitted . Gordon Roberts
stated that the problem with the trailer in West Danby is still in
question .
Planning Board Chairman - Ernest Cole stated that a special meeting
of the planning board will be held September 14 , 19 76 . After this 411
meeting , the ordinance will probably be ready for hearings to be
scheduled . Possibly the new proposed ordinance will be made
available for study .
P eople interested in serving as a member of the Danby Board of Zoning
Appeals have been interviewed . Justice Floyd Dorn made the motion
that Frank Muzzy be appointed to serve as a member of the Zoning Board
of Appeals for a five year term . A special meeting of the Danby Town
B oard was set up for September 20 , 1976 at 8 : 00 P . M . at the Danby
Town Hall for the purpose of discussing furnishing the Town Hall and
appointing another member to serve on the Danby Board of Zoning Appeals
to make a full board .
RESOLUTION # 28 AUTHORIZE PAYMENT OF $ 1 , 475 . 00 TO
ROY CASTERLINE FOR CLEANING UP THE
BELL PROPERTY .
At the regular meeting of the Danby Town Board , Held at the Danby
Town Hall , 1830 Danby Road in the Town of Danby , County of
Tompkins and State of New York , on September 13th , 1976 at 8 : 00
P . M . , the following resolution was put before the board .
WHEREAS , it was noted that all the requirements stipulated in Resolu -
tion # 21 of 1976 , entitled " Clean Up Of Bell Property " (Tax Parcel
# 17 - 1 - 18 ) have been met , and ,
WHEREAS , Roy Casterline submitted a bid to do this work in the
amount of $ 1 , 475 . 00 , and ,
WHEREAS , This bid was the low bid , a contract was signed by Roy
Casterline as contractor and A . Francis Wright as Supervisor of
the Town of Danby to have this clean up work done , it was ,
RESOLVED , that the supervisor be authorized to make payment to Roy
Casterline in the amount of $ 1 , 475 . 00 as agreed in the contract .

Old Business Continued :
General Fund Warrant #8 was discussed . Michael Wiese ' s salary of 5600 . 00
should not have been included . Also an Ithaca Agency bill for $ 20 . 00
was questioned and removed . A bill for 580 . 00 to the Ad People for the
ox roast was added . Because of these changes the following resolution
was moved by Justice Milton Todd . The resolution was seconded by
Councilman Ralph Wilbur .
RESOLUTION #27 CHANGE THE TOTAL OF THE GENERAL FUND WARRANT
#8 FROM $ 14 , 514 . 24 TO $ 13 , 894 . 24 .

Carried by a vote of five ayes and no noes .
Roderic Randall ' s request for a permit to build a barn on property he
is purchasing on route 96B for the purpose of selling farm produce was
discussed . He has presented his proposed plan to the planning board
and has the approval of that board . The motion was made by Councilman
Ralph Wilbur that the Town Board hold a public hearing on the matter of
Roderic Randall ' s request for a permit on September 27 , 1976 at 8 : 00P . M .
at the Danby Town Hall . The motion was seconded by Councilman Paul
Smith and carried by a vote of five ayes and no noes .
The matter of salary for Roy Casterline for cleaning up the Bell property
was discussed . Councilman Ralph Wilbur moved the following resolution
which was seconded by Justice Milton Todd .
RESOLUTION #28 AUTHORIZE PAYMENT OF ROY CASTERLINE FOR
CLEANING UP THE BELL PROPERTY AND TRANSFER
$ 1475 . 00 FROM THE CONTINGENCY ACCOUNT
A1990 . 4 TO THE BEAUTIFICATION ACCOUNT A8510 . 4
FOR THIS PURPOSE

Carried by a vote of five ayes and no noes .
The signing of the certificate of substantial completion of the
renovation of the Town Hall by Novaar-Mackesey in order that they
can be released of there bonding was discussed at length . Justice
Milton Todd made the motion to authorize the supervisor to sign the
certificate . The motion was seconded by Councilman Ralph Wilbur and
carried by a vote of five ayes and no noes .
• NEW BUSINESS :
Danby ' s representative to the Enviromental Management Counsel , Robert
Snedden , discussed the unique areas in the Town of Danby and a copy
of these areas was given to the Town Board .
Francis Carrier was recommended by the town board to sy yt as dog
enumerator for the town . Supervisor A . Francis Wright /check with him
to see if he will be available to do the job .
As chairman of the committee to purchase furniture for the town hall ,
Mary Oltz said that the furniture stores in Ithaca and one outside
Ithaca have been contacted and the only one that shows interest and
can also give the town a discount under state contract was Race ' s
Office Equipment . A date will be set to have Mr . Race come and talk
to the board .

New Business Continued :
Cable TV franchise for West Danby was discussed . The town attorney is
waiting for Mr . Cerracche to present a franchise which is acceptable .
Albert Sebesta reported on the progress with Cerracche TV . The motion
was made by Justice Milton Todd to authorize Mr . Sebesta and Mr .
Cerracche to rewrite the franchise and present it to the Town Board
for approval . The motion was seconded by Councilman Ralph Wilbur and
carried by a vote of five ayes and no noes .
An assistant to the zoning officer was discussed . Gordon Roberts
gave some reasons that it might be a good idea and also told how it
would create certain problems . A great deal more thought needs to
be given this matter before any decision is made .
The problem of tax assessment was discussed . Jimmie Miller will be
asked to check into this matter . Mr . Peter asked for a resolution to
revise the County Charter and regain ' town assessors as in the past .
This matter was discussed Et length . A motion was made by Councilman
Paul Smith that the Danby Town Board protest the practice of the
assessment of property for tax purposes without attempting to
contact the owners . The motion was seconded by Councilman Ralph
Wilbur and carried by a vote of five ayes and no noes . The board
asked that a letter voicing this motion be sent to the chairman of the
Board of Representatives with copies going to Jimmie Miller and Tom
Payne .
After some discussion of the resolution Lefore the board of represent -
atives regarding a place for treatment of alcoholism , Justice Milton
• Toddmoved the following resolution which was seconded by Justice
Floyd Dorn .

THERE IS A PROPER PLACE OF TREATMENT OF
ALCOHOLISM IN THE COUNTY .

General Fund Warrant #9 in the amount of $ 1 , 993 . 87 was approved to be
paid . The motion was made by Councilman Ralph Wilbur and seconded by
Justice Milton Todd and carried by a vote of five ayes and no noes .
Highway Fund Warrant ; 9 in the amount of $ 2 , 795 . 73 was approved to be
paid . The motion was made by Councilman Ralph Wilbur and seconded by

:14 West Danby Water District Warrant #9 in the amount of $ 321 . 34 was
approved to be paid . The motion was made by Justice Milton Todd and

Justice Milton Todd made the motion to accept the supervisor ' s
reports as submitted . The motion was seconded by Justice Floyd Dorn
and carried by a vote of four ayes and no noes .
