TOWN OF DANBY
TOWN BOARD MEETING MINUTES
August 9 , 1976
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Town Hall , Town of Danby , Tompkins County ,
New York on August 9 , 1976 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
Justice Floyd Dorn
• Board member absent : Justice Milton Todd
Others present : Ernest Cole , Joseph Hulbert , James Murinchack ,
Jimmie Miller , Lon Gallop , Mrs . DePloy , Edward Slights , Roy
Casterline , Tom Payne , John Wilkinson , Moses Peter , Gordon Roberts ,
Albert Sebesta , Bradley Corbitt , Rick Churchill , Mr . & Mrs . Randall ,
Joe Short , Onalee Wright , Bob Boehlecke .
The minutes of the July 12 , 1976 meeting of the Danby Town Board
were approved as presented . The motion was made by Justice Floyd
Dorn and seconded by Councilman Paul Smith and carried by a vote
of four ayes and no noes .
COMMUNICATIONS :
1 . A letter from the Congress of the United States concerning
• eligible programs offered by the federal government to aid
communities with flood and heavy rain damage .
2 . A letter from the New York State Department of Enviromental
Conservation concerned with the Freshwater Wetlands Act .
3 . Agenda of the Tompkins County Board of Representatives
meeting of August 9 , 1976 .
4 . Minutes of the meeting of the West Danby Water District
. Commissioners held August 9 , 1976 .
5 . Notice of the quarterly meeting of the Tompkins County
Municipal Officials Association meeting to be held September
15 , 1976 at 7 : 00 P . M .
6 . A memorandum from the Tompkins County Board of Represent -
atives concerning dog problems .
7 . Minutes of the meeting of the Town of Danby Planning Board
held July 14 , 1976 .
8 . Minutes of the combined meeting of the Planning Board ,
Town Board and Board of Zoning Appeals held July 19th and
20 , 1976 .
• PRIVILEGE OF THE FLOOR :
Justice Floyd Dorn stated that after July 1 , 1977 no town justice
will sit on the town board . Many speeding tickets were issued
last week which has kept the court busy .
Rod Randall stated that he is applying for a permit to construct a
barn on the Lon Galup property to be used to retail farm products
in the summer and for storing these products in the winter as well
as farm equipment . Albert Sebesta commented that he owns property
directly across from Rod Randall ' s proposed development and he is
concerned about parking space for cars stoping to buy and the
development of a commercial establishment in the area . The Town
Board turned this matter over to the Town Planning Board for their
recommendations .

Jimmie Miller , Danby ' s representative to the Tompkins County Board
of Representatives stated that he would answer questions but had
nothing special to report on county business . The process of
collecting sales tax and how it is turned over to the towns was
discussed .
Tom Payne from The Tompkins County Assessment Office attended the
meeting to discuss the duties of his office , how property is
assessed and to answer questions, on assessment . One of the
responsibilities of the assessment office is to estimate damage
done by dogs to domestic animals . He distributed a brochure
called the Tompkins County Story . He stated that the assessment
office is open to the public and the records can be looked at
and people are available to answer questions .
COMMITTEE REPORTS :
H ighway Report - Councilman Ralph Wilbur stated that the rough base
has been put on the Michigan Hollow Road . Work is being done on
the King Road and also on Hornbrook Road .
W est Danby Water District - All is in order .
Insurance - There is a problem with a duplicate billing but this
is being taken care of .
Refuse Collection and Disposal - Nothing to report .
Youth - A letter was received from Bradley Corbitt which included
the Danby Community Council ' s preliminary budget . The County
Youth program was discussed . Councilman Paul Smith was asked to
head a committee working with Bradley Corbitt and Mike Wiese on
the matter of a county youth program versus the program that the
town currently has .
Zoning and Planning - Justice Floyd Dorn reported that he has
been busy in court .
Fire - Councilman Ralph Wilbur reported that the barbecue was
very successful . The two old fire trucks have been sold .
Cemetaries - The grass has been too wet to mow .
OLD BUSINESS :
J immie Miller gave a .; financial report of the Bicentenial Committee .
The week of activities was a success . After paying some bills
incurred there is a cash balance on hand of $ 644 . 17 .
Bradley Corbitt as representative of the Danby Community Council
asked the Town Board if the profits from the bicentenial activities
could be turned over to the Community Council to support the
drama committee . As the bills have not all been paid the Town Board
will make their decision on the use of the funds at their September 0
meeting . Jimmie Miller and Floyd Dorn expressed their feelings in
favor of turning over funds after the bills have been paid to the
Community Council .
Highway Superintendents Report - Joe Hulbert stated that he has
been contacted by the Newfield School about children that want to
attend the Blueberry Hill School which would mean busing over
Bruce Hill Road which is usually closed in the winter time . Some
thing is needed from the town attorney in writing . The town can ' t
maintain the road and will inform the attorney . The board asked
that Joe Hulbert ask the school district for a letter of request
so the board would have an official document to take to the
attorney . Joe said that a map of the town roads has been obtained .
The board discussed the map and the closing of some roads and
state aid available . Radio equipment for the highway people was
discussed .

Old Business continued :
Zoning Officer ' s report - A written report was submitted . The
problem of building on Durfee Hill will be answered in writ
This matter was discussed at length .
Appeils Board Chairman - John Wilkinson reminded the board that two
board members are needed to fill vacancies on the board of zoning
appeals . The board cannot act with these vacancies and there are
now two appeals pending .
SPlanning Board Chairman - Ernest Cole reported that the zoning
ordinance is almost completed . Wednesday ' s meeting may wrap it
up and a public hearing can be held .
Town Hall Renovation report - Councilman Paul Smith said that the
renovation is substantially completed . There are several small jobs
to be done to complete the work and the town board will discuss this
in executive session before signing the completion certificate . The
pump does not work so there is no water but this is something the
town board will have to take care of . The date set for the executive
session was August 16 , 1976 at the town hall at 7 : 00 P . M .
NEW BUSINESS :
After studying the revised map of the Churchill sub -division the
following resolution was moved by Councilman Ralph Wilbur . The
resolution was seconded by Justice Floyd Dorn .
RESOLUTION #25 APPROVE THE CHURCHILL SUB -DIVISION
WITH THE REVISED MAP
Roll Call Vote : Wright - aye
Wilbur - aye
Smith - aye
Dorn - aye
Carried by a vote of four ayes and no noes .
The matter of an assistant to the Zoning Officer was discussed as
the new zoning ordinance will make more work . Councilman Ralph
Wilbur made the motion to table the matter for 30 days . Councilman
Paul Smith seconded the motion which was carried by a vote of four
ayes and no noes . Space in the renovated town hall for storing
records currently being used by the zoning officer , planning board
and board of zoning appeals was discussed . All old records will
be stored in the vault with the other town records . A committee
was chosen by the supervisor to work on furnishing the town hall .
The people chosen were Ralph Wilbur , Paul Smith and Mary Oltz with
Mary Oltz as chairman . The purchase of furniture will have to be
provided for in the 1977 budget .
411 Councilman Ralph Wilbur discussed CSEA . A new man from Industrial
relations will be the representative dealing with the town in
connection with CSEA instead of Mr . Miller .
Councilman Ralph Wilbur will check the pump at the town hall .
General Fund Warrant #8 in the amount of $ 14 , 434 . 24 was not approved
for payment as the costs for the bicentennial celebration were
unclear and this matter will be taken up at a special meeting of the
board . Councilman Ralph Wilbur made the motion which was seconded
by Justice Floyd Dorn and carried by a vote of four ayes and no noes .
Highway Fund Warrant #8 in the amount of $ 2 , 185 . 97 was approved to
be paid . The motion was made by Councilman Ralph Wilbur and
seconded by Justice Floyd Dorn and carried by a vote of four ayes
and no noes .

West Danby Water District Warrant #8 in the amount of $ 113 . 50 was
approved to be paid . Councilman Paul Smith made the motion which
was seconded by Justice Floyd Dorn and carried by a vote of four
ayes and no noes .
Councilman Ralph Wilbur made the motion to accept the Supervisor ' s
reports as submitted . The motion was seconded by Councilman Paul
Smith and carried by a vote of three ayes and no noes .
Councilman Ralph Wilbur made the motion to adjourn the meeting at
11 : 30 P . M . The motion was seconded by Councilman Paul Smith and
carried by a vote of four ayes and no noes .
