TOWN BOARD MINUTES
April 12 , 1976
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Elementary School , Gunderman Road , Town of
Danby , Tompkins County , New York , on April 12 , 1976 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
• Justice Milton Todd
Justice Floyd Dorn
Others present : Joseph Hulbert , Deborah Linker , Dan Hoffman , Roy
Casterline , Mary Casterline , Alfred Sebesta , Gordon Roberts , Jimmie
Miller , Ernest Cole , Robert Boehlecke , James Murinchack , Joseph
Short and Rick Jenson Ithaca Journal reporter .
As all members of the board had not read the minutes of the previous
meeting of the board they will be submitted for approval next month .
COMMUNICATIONS :
1 . A letter and resolution concerning sales tax relief
for Chessapeak & Ohio Railroad system .
2 . Agendas of the Tompkins County Board of Representatives
meetings of February 23 , 1976 , March 22 , 1976 and April
12 , 1976 .
3 . Memorandum from Richard A . Desrochers concerned with new
applications and amendments as they apply to youth
programs .
4 . A letter from the Tompkins County Personnel Department
concerned with the title of West Danby Water District
Deputy clerk .
5 . A letter from the Tompkins County Personnel Department
concerning position titles .
6 . A letter from the Tompkins County Department of Health
concerned with assistance if needed in regard to public
health or enviromental protection .
7 . A letter from Moses Peter asking our representative Jimmie
Miller to clarify the County Budget to the taxpayers .
• 8 . A note from the Tompkins County Department of Budget and
Administration advising the town that they have been
11 charged for flags for the cemetaries in the town .
9 . A letter from the Danby Community Council concerned with
purchase of a bus for the community .
10 . A bid proposal from Paul T . Seeley for the removal of the
house and garage located next to the town hall .
11 . Minutes of the Danby Town Planning Board Meetings of
March 17 , 1976 and March 31 , 1976 .
12 . Minutes of the meeting of the Danby Town Board of Zoning
Appeals held March 10 , 1976 .

Communications continued :
13 . Minutes of the April 7 , 1976 meeting of the West Danby
Water Commissioners meeting .
PRIVILEGE OF THE FLOOR :
Councilman Ralph Wilbur commented on the Zoning Officer ' s policy
of issuing building permits and sending a copy of the permit to
the Tompkins County Assessment Department and the proceedure
followed in assessing new buildings . •
Justice Floyd Dorn commented on dog ordinances .
Town Clerk , Mary Oltz , commented that there are several summons to
be served on people who have not purchased a dog license for
1976 . The Town Constable has been contacted but could not say
when he would get these taken care of . This is very late . Some
people have been served and paid considerable fines .
Several people commented on trees being cleared away along the roads
in Danby .
Deborah Linker handed out ballots to be used to vote for a director
from Danby to be a part of the EOC Board of Directors . Only low
income people can vote .
Jimmie Miller stated that April 26 , 1976 has been set as the date for
the final public hearing on the Ag . District . If there are no
objections then the Board of Representatives will vote on this .
He also discussed the dog problem .
COMMITTEE REPORTS :
Highway report - Councilman Ralph Wilbursaid that people that live
on Michigan Hollow Road should be aware that the road will be graded
and gravelled but the money allotted is not sufficient to pave the
✓ oad as some seem to think . .
West Danby Water District - Roy Casterline reported that there is a
problem with some wiring and the Gas and Electric Co . will be
contacted to see if this can be corrected .
Insurance - No report .
Refuse Collection and Disposal - No report .
Youth - Bradley Corbitt introduced a revised agreement between
the parks people and the Town of Danby . The town attorney says
t here will be problems with this agreement . This matter was
discussed at length . TheuRedmen " are in favor of moving the stone ,
w ith their inscription on it , from the area by the Danby I . G . A .
t o the fire district property by the Danby Community Sign .
Zoning and Planning - The question of whether the town has adequate
legal services or not was discussed . If pending cases are not
cleared up the anticipated hearing of the Planning Board will be
held up . After a lengthy discussion it was decided that the town
w ill continue with the legal counsel they have until regular
appointment time . This matter will be reconsidered at that time .

Committee Reports continued :
Cemetaries - Grass is ready for cutting .
Bicentenial Committee Report - Jimmie Miller stated that the agenda
for the bicentenial week in the Town of Danby has been set up .
Several requests will be made of the Town Board . A budget will
be submitted to the board for their consideration by the next
meeting . The committee would like the board to purchase three
flags . People are reading for parts in the play that will be
• presented .
Cable T . V . Committee Report - Al Sebesta reported that the application
for the extension of Cable T . V . in Danby has been mailed .
OLD BUSINESS :
Highway Superintendenes Rport - Radio equipment for the highway
department was discussed at length . The repairs that need to be
done on the pipe line were discussed . The board authorized the
approval of repairs to pipe lines by the Consolidated Gas Co .
purstat to an agreement reached with the town attorney and that
all/ be taken care of by Consolidated Gas Co . and that the town be
free of any and all liabilities . Justice Milton Todd made the
motion which was seconded by Councilman Ralph Wilbur and carried by
a vote of five ayes and no noes .
Zoning Officers report - All matters have been covered .
Appeals Board Chairman - Absent , no report .
Planning Board Chairman - Everything has been covered . The next
meetings will be held April 13th and the 28th .
NEW BUSINESS :
Justice Milton Todd moved the resolution submitted by state officials
asking for exemption of " Chessie " from the applicability of Section V
of the NorteastRegionali_ Rail Organization Act and an extension of the
deadline within which " Chessie " and the unions can negotiate freely and
independently . The motion was seconded by Councilman Paul Smith .

Robert Boehlecke reported that the Town Hall Renovation is going well
and should be completed by June 15 , 1976 . He then introduced three
change orders for approval by the board . These change orders are
numbered 2 , 3 and 4 . They are as follows :
2 . Instead of keeping the existing ceiling it will be ripped off
and the old wood ceiling will be restored at a cost not to
exceed $ 1 , 200 . 00

New . Business continued :
3 . Sill on the south side of the building needs to be
repaired and will cost an additional $ 800 . 00 .
- 4 . The steel stairs will be reinstated rather than -having the
wooden stairs, at an additional cost of $ 1 , 340 . 00 .
Justice Milton Todd made the motion to accept change orders # 2 , #3 ,
and #4 . The motion was seconded by Councilman Paul Smith and
carried by a vote of five ayes and no noes . Supervisor A . Francis •
Wright stated that the floor in the Town Hall was not level when the
work was started and that sheet rock was stacked in the middle of
the floor aggrivating the problem . . After a discussion by the board
it was decided that the contractors should correct the matter of the
sagging floor at their own expense .
Supervisor A . Francis Wright prepared a budget of the Town Hall
renovation which he presented to the board for their information .
To carry out the renovation project it will be necessary to
borrow $ 35 , 000 . 00 . It will also be necessary to transfer $ 10 , 377 . 02
from the Revenue Sharing Fund , and $ 6 , 024 . 98 from the General Fund
to the Capital Fund account to complete the renovation project .
The Danby Highway Department will demolish the house on the
Van de Bogart property for $ 480 . 00 . The money for the demolishion
of the house has been included in the budget . Justice Milton Todd
made the motion to authorize the Town Highway Department to demolish
the house and render a voucher to the town board for the expense of
doing so . The motion was secoi d by Councilman Paul Smith and
carried by a vote of five ayes and no noes .
Justice Milton Todd moved a resolution to transfer $ 10 , 377 . 02
from the Revenue Sharing Fund Account to the Capital Fund Account
H1997 . 3 . The motion was seconded by Justice Floyd Dorn .

Councilman Paul Smith moved a resolution to transfer $ 6 , 024 . 98 •

The motion was seconded by Councilman Ralph Wilbur .

Councilman Ralph Wilbur moved a resolution authorizing the issuance
of special obligations bonds for the purchase of land and renovation
of the Danby Town Hall . (This resolution having been inadvertantly
omitted from the business before the board at their October meeting
at which time it was their intent to handle this matter ) The motion
was seconded by Justice Milton Todd .

Carried by a vote of five ayes and no noes .
Justice Milton Todd moved a resolution to approve a bond anticipation
note in the amount of $ 35 , 000 . 00 for the purpose of providing funds
to purchase property and renovate the town hall . Councilman Paul
Smith seconded the motion .

Carried by a vote of five ayes and no noes .
Problems with the Civil Service job classifications was discussed .
It was decided that the town clerk would talk to Carl Mount on this
matter .
In regards to the community bus for the Town of Danby , the board
could forsee many problems and would need to study this matter
before making any decision . After discussing this at length it
was decided that Councilman Paul Smith would meet with Bradley
Corbitt to discuss this further .
General Fund Warrant #4 in the amount of $ 15 , 527 . 34 was approved to
be paid . The motion was made by Justice Milton Todd and seconded by
Justice Floyd Dorn and carried by a vote of five ayes and no noes .
Highway Fund Warrant #4 in the amount of $ 4 , 076 . 05 was approved to
• be paid . Councilman Ralph Wilbur made the motion which was seconded
by Justice Milton Todd and carried by a vote of five ayes and no noes .
West Danby Water District Warrant #4 in the amount of $ 72 . 27 was
approved to be paid . The motion was made by Justice Milton Todd and
seconded by Justice Floyd Dorn and carried by a vote of five ayes and
no noes .
Justice Milton Todd made the motion to accept the Supervisor ' s
reports as presented . The motion was seconded by Councilman Ralph
Wilbur and carried by a vote of four ayes and no noes .
The meeting was declared adjourned by Supervisor A . Francis Wright at
11 : 25 P . M .
