TOWN OF DANBY
TOWN BOARD MINUTES
January 13 , 1975
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Elementary School , Town of Danby , Tompkins
County , New York , on January 13 , 1975 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Clyde Carrier
Justice Milton Todd
• Board member absent : Justice Floyd Dorn
Others present : Mr . Westmiler , Gordon Roberts , Joseph Hulbert , Roy
and Mary Casterline , Mr . Campbell , Ernest Cole , Rick Jenson- Journal
reporter , Erie J . Miller , Alex Soule , Les Palmer , Mr . & Mrs . Eveilyn ,
Tim Chaffee and Ken Coddington .
The minutes of the December 9 , 1974 meeting and the minutes of the
December 19 . 1974 special meeting were approved as presented . The .k
motion was made by Justice Milton Todd and seconded by Councilman
Clyde Carrier and carried by a vote of four ayes and no noes .
COMMUNICATIONS :
1 . The minutes of the meeting of the West Danby Water
Commissioners meeting of January 8 , 1974 .
2 . A letter from Louis R. Thompson conceraathg the freedom of
information law .
3 . A letter from the Association of Towns of the State of
New York concerning a Voting Delegate from the Town of Danby
at the February meeting of the Association of Towns .
4 . A letter from the Ithaca Journal stating; that an increase
in advertising rates will become effective February 1 , 1975 .
5 . Minutes of the meeting of the Town Board of Zoning Appeals
held December 11 , 1974 .
PRIVILEGE OF THE FLOOR :
Ken Coddington representing the Town of Danby Highway employees
expressed dissatisfaction with the raise in pay designated to them
by the town board for 1975 . They feel that they are entitled to more
than a 4% increase as the cost of living has increased by over 10% .
He stated that he hopes the board will reconsider this matter . A
meeting was set for Thursday , January 23 , 1975 at 8 : 15 P . M . at the
Danby Fire House with the Town Board and the Highway Employees to
discuss this matter .
Ernest Cole stated that it had been brought to his attention that
a meeting will be held to discuss the development of a county wide
youth program and the Town of Danby should be represented at this
meeting . Supervisor Wright stated that he would attend or ask Mike
Wiese to attend .
Mr . Evelyn asked why Mr . Maycumber is allowed to expand his junk yard
as he is doing . Supervisor Wright. stated that the town attorney has
started action and this matter will be taken care of .
Representative Jimmie Miller stated that the meeting with the County ,
Board of Representatives was an organizational one . Committees were
appointed . He said that he was appointed chairman of the Social
Services Committee . He said he would be glad to answer questions
that people may have .

COMMITTEE REPORTS :
A . Highway report - Councilman Ralph Wilbur stated that the Highway
Superintendent would like to stockpile some stone in West Danby to
save trucking over the hill . Joe Hulbert would like to know the
procedure to follow to do this . Supervisor A . Francis Wright made
the motion that if this was agreeable with the Water Commissioners
he had the town boards authorization to go ahead . Councilman Clyde
Carrier seconded the motion which was carried by a vote of four ayes
and no noes . Councilman Ralph Wilbur said that a gradall is needed
and that one is available at the suggested price of $ 14 , 000 . 00 with
® no trade in . He asked that the board give Joseph Hulbert authorization
to draw up specs for a used gradall contingent on the necessary funds .
Justice Milton Todd made the motion that Joseph Hulbert be authorized
to draw up specs and let bids for a used gradall contingent on funds .
Councilman Clyde Carrier seconded the motion .
RESOLUTION # 1 AUTHORIZE HIGHWAY SUPERINTENDENT
TO LET BIDS ON A USED GRADALL
CONTINGENT ON FUNDS .

Carried by a vote of three ayes and one abstention .
Joe Hulbert has ordered signs for the town roads that state that a
certain road will be plowed or cindered or not as the case may be .
Distraction of mailboxs by snowplows when the mailbox is in the
highway right of way was discussed at length . A form letter will be
made up to give people who have mailboxs on the highway right of way .
This letter will also cover cars that are left in the right of way .
Councilman Clyde Carrier will make up the letter and the clerk will
type it .
B . West Danby Water District - There is an electrical problem at the
pump house that is being worked on .
C . Insurance - The motion was made by Justice Milton Todd and
seconded by Councilman Ralph Wilbur to instruct Ithaca Agency to
remove the road scraper (# 78300 ) from the town ' s general accident
equipment floater policy . The motion was carried by a vote of
four ayes and no noes .
D . Refuse Collection and Disposal - No report .
E . Youth - No report .
F . Fire - No report .
G . Zoning - The zoning officer read a summary report of business for
• 1974 . He stated that he would not be as lenient as he has been
in the past towards violators of the zoning ordinance .
H. Cemetaries - No report .
OLD BUSINESS :
Report of Highway Superintendent - The highway Superintendent had
nothing to add to the report already given on highway business .
The Zoning Officers Report - A written report was submitted .
Report of the Appeals Board Chairman - Minutes of the last appeal
heard before the board were read .

Old Business Continued :
Planning Board Chairman ' s Report - The board is progressing slowly
on the revision of the zoning ordinance . There was a long discussion
on land use and the future possibility of water and sewer districts
in the town and if the ordinate should be changed with this in mind .
NEW BUSINESS :
Due to an error in the list of land owners with delinquent water bills
Mrs . Evelyn Cole has been charged with a delinquent water bill on her
• town and county tax bill for 1975 . In order to correct this a check
should be drawn from the Water District account and given to the clerk
to give to Mrs . Cole when she pays her taxes . The assessment office
said that this is the most legal way to handle this matter . The motion
to write the check from the water district account to correct the
error on` Mrs , Cole ' s tax bill was made : 'by ; JdAt:ice` Mi1ltor Tddd and
seconded by Councilman. Clyde Carrier .
RESOLUTION # 2 CORRECT ERRONEOUS TAX BILL

Carried by a vote of four ayes and no noes .
It was noted that Mary Casterline will be responsible for collecting
the delinquent water bill which is owed by Mr . Westmiller . The clerk
will ask the assessment office for verification that Tax Lot # 17 - 1 - 13
is owned by Evelyn Cole .
Councilman Ralph Wilbur stated that the owner of the property known
as the 'Old. Country Inn " approached him saying that the property is
available if the town could use it for office space . There is a large
parking area and plenty of room to be used for meetings and office
space . The planning board was asked to look into and make
recommendations to the town board .
The following appointments for 1975 were recommended by the supervisor .
Deputy Town Clerk , Edgar E . Oltz ; Deputy Town Clerk West Danby Water
District , Mary Casterline ; Town Custodian , Edward Slights ; Town
Constable , Harold Barnhardt ; Zoning Officer , Gordon Roberts ; West
Danby Water District Superintendent , Roy Casterline . ; Justice Milton
Todd made the motion that the recommendations made by the supervisor
be accepted by the board . The motion was seconded by Councilman Clyde
Carrier and carried by a vote of four ayes and no noes .
Councilman Clyde Carrier made the motion to appoint Onalee Wright as
Deputy Supervisor . Justice Milton Todd seconded the motion which was
carried by a vote of four ayes and no noes .
40 It was recommended that Thaler and Thaler remain town attorneys ; The
Tompkins County Trust Company the Official Bank ; and the Ithaca
Journal the official newspaper of the town . Justice Milton Todd
made the motion to accept these recommendations . Councilman Ralph
Wilbur seconded the motion which was carried by a vote of four ayes
and no noes .
A poll was taken of people attending the Association of Towns meeting
in February . Mr . and Mrs . Todd , Mr . and Mrs . Wright , Mr . and Mrs .
Carrier , and Mr . and Mrs . Dorn all plan to attend . The motion was
made to appoint Supervisor A . Francis Wright as voting delegate at
the Association of Towns meeting and Councilman Clyde Carrier as
alternate . The motion was made by Councilman Ralph Wilbur and seconded
by Justice Milton Todd and carried by a vote of four ayes and no noes .

New Business Continued :
As many of the December bills for 1974 have not been paid a motion
was made to pass a blanket resolution authorizing the Supervisor to
incumber funds in the necessay accounts to pay the 1974 bills . The
motion was made by Justice Milton Todd and seconded by Councilman
Clyde Carrier .
RESOLUTION # 3 BLANKET RESOLUTION AUTHORIZING THE
SUPERVISOR TO INCUMBER THE NECESSARY
FUNDS NEEDED TO PAY 1974 BILLS .

Carrier - aye

Carried by a vote of four ayes and no noes .
General Fund Warrant #1 in the amount of $ 920 . 33 was approved to be
paid . The motion was made by Councilman Clyde Carrier and seconded
by Justice Milton Todd and carried by a vote of four ayes and no noes .
Highway Fund Warrant #1 in the amount of $ 2 , 125 . 20 was approved to
be paid . The motion was made by Councilman Ralph Wilbur and seconded
by Councilman Clyde Carrier and carried by a vote of four ayes and
no noes .
West Danby Water District Warrant # 1 in the amount of $ 638 . 59 was
approved to be paid . The motion was made by Justice Milton Todd and
seconded by Councilman Ralph Wilbur and carried by a vote of four ayes
and no noes .
The motion was made by Councilman Ralph Wilbur to authorize the
Supervisor to invest idle funds for 1975 . The motion was seconded
by Justice Milton Todd .
RESOLUTION #4 AUTHORIZE THE SUPERVISOR TO INVEST
IDLE FUNDS FOR 1975 .

Carried by a vote of four ayes and no noes .
Councilman Ralph Wilbur made the motion to accept the Supervisor ' s
reports . Councilman Clyde Carrier seconded the motion which was
carried by a vote of three ayes and no noes .
At 10 : 00 P . M . Councilman Ralph Wilbur made the motion to adjourn the
meeting and conduct the annual audit of the town books . The motion
was seconded by Justice Milton Todd and carried by a vote of four ayes
and no noes .
