TOWN OF DANBY
TOWN BOARD MINUTES
July 9 , 1973
The regular meeting of the Danby Town Board was held in the Danby
Elementary School , July 9 , 1973 , at 8 : 00 P . M .
Board members present : Supervisor A . Francis Wright
Councilman Gerald Crance
Justice Floyd Dorn
Justice Milton Todd
Board members absent : Councilman Ralph Wilbur
Others present : Edward Slights , Gordon Roberts , Mr . Ceracche ,
• Moses Peter , Joseph Hulbert , Erie J . Miller , Dr . Dennis and Mr . Cohnon .
COMMUNICATIONS :
1 . A letter from the Divis &nn000f Assessments regarding the
railroad ceilings .
2 . A letter from the Association of Towns concerning the
increase in the cost of the State Retirement Systems
in New York State .
3 . Agenda Tompkins County Board of Representatives meeting
o f Monday July 9 , 1973 .
4 . A letter from Ceracche Television Corp . converning TV
cable franchise in the town of Danby .
5 . Department of Transportation New York State with a
check in the amount of $ 2 , 600 . 00 representing advance
funds for disaster work .
6 . A letter from Thaler and Thaler concerning the naming
o f a law firm to represent a town and abolishing the
office of town attorney .
PRIVILEGE OF THE FLOOR :
Moses Peter express the opinion that the town should make an
application for flood insurance for their own ptotection . He also
mentioned that the grass has not been cut in many locations on the
right - of -ways by the State Department of Transportation . He feels
that the board should request a schedule of mowings in writing .
COMMITTEE REPORTS :
A . Highway Report - Superintendent of Highways , Joseph Hulbert ,
reported that he is doing a lot of patching and oiling and that
it is a long slow process . The pick - up truck will not be ready
for delivery for another month . Another piece of snow equipment
will be needed this winter and already it is being looked into .
B . West Danby Water District - No bids have been received on
• painting the water tank . The commissioners have not had a
meeting . This matter will be tabled for another 30 days .
C . Insurance - No report .
D . Refuse Collection and Disposal - No report .
E . Youth - Supervisor A . Francis Wright reported that the Danby
Community Council has a big program lined up for the summer
both at the school and at the Danby Pond .
F . Zoning and Planning - No meetings were held .
G . Fire - No report .
H . Cemeteries - The stones that needed to be reset have been taken
care of . This was done by Edward Slights and Joseph Hulbert .

OLD BUSINESS :
Report of the Zoning Officer - Gordon Roberts reported that
certified letters have been sent to many offenders and if the
time passes and he gets no reply he will swear out complaints :
Some complaints are in order at the present time and some people
are cleaning up .
Report of Appeals Board Chairman - No report .
Report of Planning Board Chairman - No report .
Moses Peter asked that Gary Vincent be reappointed to the Appeals
Board . The last meeting had to be canceled as there was not a
• quorum . Floyd Dorn made the motion that Gary Vincent be reappointed
to the Appeals Board for a term of five years ending June 30 , 1978 .
Milton Todd seconded the motion which was carried by a vote of four
ayes and no noes .
NEW BUSINESS :
Mr . Ceracche has made Applications for Certificate of Confirmation
from the State . A franchise is needed to extend cable service in
the Town of Danby . Application has been filed with the state .
The Town Board must sign an affidavit so that the service may be
extended . Justice Milton Todd made the motion that the Town Board
authorize the Town Supervisor to sign the affidavit . The motion
was seconded by Justice Floyd Dorn and carried by a vote of four
ayes and no noes .
An Option has been obtained to purchase the Van de Bogart property
next to the town hall for the sum of $ 7 , 000 . 00 . The clerk read the
option to the board . The supervisor was given authorization to
contract with architects on an hourly basis to do preliminary
studies concerning the feasibility of renovating the town hall or
raising it and the house on the Van de Bogart property and the
construction of a new Town Hall . The motion was made by Justice
Milton Todd that the board accept the option and authorize the
supervisor to negotiate with the architects to do preliminary
studies . The motion was seconded by Justice Floyd Dorn .
RESOLUTION # 14 ACCEPT OPTION TO PURCHASE
VAN DE BOGART PROPERTY AND
AUTHORIZE THE SUPERVISOR TO
NEGOTIATE FOR PRELIMINARY STUDIES

Carried four ayes and no noes .
Justice Milton Todd made the motion that the board pass retro -
actively a resolution for the five year highway improvement program
required by section 220 , Article 8 -A of the Highway Law . The
• motion was seconded by Justice Floyd Dorn .
RESOLUTION # 15 FIVE YEAR HIGHWAY IMPROVEMENT
-PROGRAM PLAN
Roll Call Vote : Wright - aye
Crance - aye
Todd - aye
Dorn - aye
Carried four ayes and no noes .
After some discussion it was decided any further action concerning
the pension plan would be tabled for the time being because the
increase in costs are prohibitive .

New Business continued :
Justice Milton Todd made the motion that the board do away with the
position of Town Attorney and retain the law firm of Thaler &
Thaler as legal counsel as needed . The motion was seconded by
Councilman Gerald Crance .
RESOLUTION # 16 ABOLISH THE OFFICE OF TOWN
ATTORNEY AND RETAIN THE THALER
& THALER LAW FIRM AS LEGAL
COUNSEL FOR THE TOWN
Roll call vote : Wright - aye
Crance - aye
Todd - aye
Dorn - aye
Carried four ayes and no noes .
Supervisor A . Francis Wright will investigate the possibility of
flood insurance for the town .
General Fund Warrant # 7 in the amount of $ 201 . 85 was approved to
be paid . The motion was made by Councilman Gerald Crance and
seconded by Justice Milton Todd and carried by a vote of four
ayes and no noes .
Highway Warrant # 7 in the amount of $ 254 . 89 was approved to be
paid . The motion was made by Justice Floyd Dorn and seconded by
Justice Milton Todd and carried by a vote of four ayes and no noes .
West Danby Water District Warrant # 6 in the amount of $ 48 . 58 was
approved to be paid . The motion was made by Councilman Gerald
Crance and seconded by Justice Floyd Dorn and carried by a vote
of four ayes and no noes .
The motion to accept the supervisors reports was made by Justice
Milton Todd and seconded by Justice Floyd Dorn and carried by a
vote of three ayes and no noes .
An agreement was signed by the board for the expenditure of
Highway monies .
Justice Milton Todd made the motion that the meeting by adjourned .
Justice Floyd Dorn seconded the motion which was carried by a vote
of four ayes and no noes .
