TOWN BOARD MINUTES
February 12 , 1973
The regular meeting of the Danby Town Board was held in the Danby
Elementary School , February 12 , 1973 at 8 : 00 P . M .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Gerald Crance
Justice Milton Todd
Justice Floyd Dorn
• Others present : Edward Slights , Roy Casterline , Mary Casterline ,
Joseph Hulbert , Gordon Roberts , Erie J . Miller and Gary Vincent .
The minutes of the regular meeting of January 8 , 1973 were mailed
to board members for reading :. and correction .
A correction was made under new business . The size of the building
should have been 30X60 instead of 24X90 . The minutes were
approved as corrected .
COMMUNICATIONS :
1 . A letter from Daniel E . Stompka , Architest , express -
ing an interest in planning and designing a new town
hall or renovating the existing one .
2 . A letter from the Tompkins County Trust Company
to the Chase Manhattan Bank in New York City
explaining how the payment of a Town of Danby
bond was made .
3 . A letter from Daniel E . Stompka again expressing his
interest in possible renovation of the town hall or
a new structure with an - experience resume attached .
4 . A letter from the Tompkins County Department of
Planning concerning Town Planning . Boards power over
preliminary plat subdivisions review by authorization
of town boards .
5 . A letter from the Automatic Voting Machine Division
concerning voting machine rental contract .
6 . A letter from Garrett J . Guertze , architect , concern -
ing the proposed new town hall .
7 . The report of the Town Historian , Tresa Cortright ,
was read also a letter accepting the appointment
of Town Historian for the coming year .
8 . A resolution from the Tompkins County . Board of
• Representatives correcting the assessment roll for
the Town of Danby .
9 . A letter from the Tompkins County Board of
Representatives concerning a study report to be
presented January 29 , 1973 .
10 . A letter from The State of New York Department of
Transportation concerning the suspension of Grey -
hound fare hike pending investigation .
11 . A letter from RobertLA . . Boehleke Jr . , architect ,
expressing interest inp. being considered for the
job of renovating the existing town hall or
building a new one .

Communications continued :
12 . A letter from the Tompkins County Department of
Planning giving fact sheets and planning guides that
may be useful to the planning and zoning boards .
13 . A letter from the Mobile Pipe Line Company listing
numbers where they can be contacted in case of an
emergency in New York State .
PRIVILEGE OF THE FLOOR :
Supervisor A . Francis Wright , Justice Floyd Dorn and Town Clerk ,
Mary Oltz were able to attend the meeting of the Association of
Towns held in New York City . Supervisor Wright reported the
workshops and programs were both worthwhile and helpful . He
thanked the to for the opportunity to attend this meeting .
Tompkins County Representative , Erie J . Miller reported that
there are many problems to be settled by the board at the
present time . More dog wardens are being considered to help
with the ever growing dog problem . A new hospital for the County
is a matter still to be settled . Also there are problems in
the Social Services Department . In answer to a request by
P aul Smith , Mr . Miller has contacted Dr . Broad who said that
the Health Department will check the pollution in the creeks
in Danby in either May or June . Mr . Miller also talked about
bail funds being made available to help young people with no
money get out of jail .
Gary Vincent read a letter to the board from the Danby Community
Council . The council would likecthe town to provide = trucks for
Danby Clean -Up Day and also asked if the town could . clear more
of the area fronting on the Danby Pond . These items , of business
were added to the agenda .
COMMITTEE REPORTS :
A . Highway Report - Work is being done on the pipe on Michigan
Hollow Road . Some dead elms have been cut . As the old
pick -up truck is all worn out , Joe Hulbert will investigate
state contract for purchasing a new one and report back
next month .
B . West Danby Water District - No report .
C . Insurance - No report .
D . Refuse Collection & Disposal - Councilman Gerald Crance ,
on behalf of the Town Board , will call the garbage
collectors and ask that they attend the next town board
meeting .
E . Youth - No report .
F . Zoning and Planning - No report .
G . Fire - Ralph Wilbur reported that the Fire Commissioners are
ready to set public hearings to contract the Coddington Road
fire coverage with Brooktondaie . This will be donee at a
cost of $ 650 . 00 per year including insurance .
H . ' Cemeteries - No report .
OLD BUSINESS :
Report of the Highway Superintendent - Joe Hulbert reported that
more trees will be cut and also that he has been attending
classes at TC3 .

Old business continued :
Report of Zoning Officer - Gordon Roberts reported that he has
been working with the Health Department and the town attorney
on subdividing . There is a problem of a building being constructed
on Gunderman Road without a . permit . . Theowner is - not the builder .
• Mr . Roberts . will file a stop work order tomorrow . The Student
from the Cornell Law School who has been working with the town ,
has been studying the junk car problem and will come up with
recommendations which will be taken to the town attorney for
final approval .
Report of Planning Board Chairman - No report .
• Report of Appeals Board Chairman - No report .
NEW BUSINESS :
The motion was made by Justice Milton Todd that the Historians
report be accepted . The motion was seconded by Councilman
Ralph Wilbur and carried by a vote of five ayes and no noes .
A . resolution by the Town Board is needed to submit a bid on a
voting machine .

A resolution is needed to reaffirm a resolution passed in 1972
to transfer funds from general fund to highway fund .

Mr . & Mrs . Allen Cropf of Jennings Pond Road have a problem of
tree stumps in the ditch in front of their house . They wrote
to the Town Board concerning this matter . The Town Board referred
them to the State Engineer . The clerk wrote to the State
Engineer explaining their problem and asking for assistance .
Councilman Ralph Wilbur reported that a resolution is needed to
have a preliminary valuation of a pension plan for town employees
done by the state .

A lengthy discussion of the pension plan versus raises for the
town highway employees followed .
• Supervisor A . Francis Wright said that as we are unsure of how
we want to spend the moneys received as the towns share of the
Federal Revenue Sharing plan , we should wait to set up the
budget . The town has twelve months from December 1 , 1972 to
set up a budget for these moneys . Mr . Wright also gave a
summary of the town accounts .
Supervisor A . Francis Wright stated that a resolution was needed
authorizing publication of a summary report of the Supervisors
annual report to the State Comptroller . This summary report is
to be published in the newspaper by the clerk .

Supervisor A . Francis Wrighttstated that the Town would help
in the Danby clean up by the - Community Council and that there
are funds in the budget that :_ could be used for cleaning up the
Danby Pond area .
Because of an amendment to the town law it is now necessary for
town planning boards to have authorization giving them power
over preliminary plat subdivision review . Supervisor . A . Francis
Wright gave the sample resolution to Floyd Dorn to take to the
next planning board meeting .
Councilman Gerald Crance showed the Town Board plans that had
. been drawn up for a town hall in another area . He will report
further on this next month .
General Fund Warrant # 2 in the amount of $ 753 . 79 was approved
to be paid . The motion was made by Councilman . Gerald .. Crance
seconded by Justice Milton Todd and carried by a vote of five
ayes and no noes .
The Highway Warrant # 2 in the amount of $ 4 , 338 . 16 was approved
to be paid . The motion was made by Justice Floyd Dorn and
seconded by Councilman Ralph Wilbur and carried by a vote of
five ayes and no noes .
The motion to accept the Supervisors report was made by
Councilman Ralph Wilbur and seconded by Justice Floyd Dorn
and carried by a vote of four ayes and no noes .

The motion to adjourn the meeting was made by Justice Floyd Dorn
at 11 : 10 P . M . and seconded by Supervisor A . Francis Wright and
carried by vote of five ayes and no noes .
