TOWN OF DANBY
TOWN BOARD MINUTES
December 11 , 1972
The regular meeting of the Danby Town Board was held in the
West Danby Fire House , December 11 , 1972 at 8100 P . M .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Gerald Crance
Justice Floyd Dorn
Justice Milton . Todd
Others present : Onalie Wright , Highway Superintendent , Joe
Hulbert , Moses Peter , Mary Casterline , Roy Casterline , Ed Oltz
and Gordon Roberts .
The minutes of the regular meeting of November 13 , 1972 , were
mailed to board members for reading and correction .
The minutes were approved as corrected .
COMMUNICATIONS :
1 . Minutes of the Planning Board meeting of November
15 , 1972 .
2 . A letter to Gordon Roberts , Zoning Officer ,
concerning signs that are in violation of the
zoning ordinance .
3 . Agenda of the Tompkins County Board of Representatives
meeting of November 27 , 1972 .
4 . A letter from the Area Beautification Council of
Tompkins County requesting Supervisor A . Francis
Wright to appoint a representative from the town
to serve on this council .
5 . A letter from the United States Department of
Agriculture enclosing two notices of payment due
by January 1 , 1973 , in the amount of $11 , 170 .
6 . Agenda of the Tompkins County Board of Representatives
meeting of Monday , December 11 , 1972 .
7 . A letter from the New York State Executive Department
Office for the Aging , suggesting that the Federal
Revenue Sharing monies might be used to benefit the
aged .

Communications continued :
8 . A letter from the Department of Audit and Control
concerning accounting instructions for the Federal
Revenue Sharing monies .
9 . Training announcement from Mr . Hill , Director ,
Office of Environmental Manpower concerning
training courses on combined wastewater systems .
10 . A memorandum from the Tompkins County Board of
Representatives concerning changes of the boundaries
of election districts in the Townsof Tompkins County .
11 . A letter from the Town Clerk concerning the adding
machine for her office , also the Association of Towns
meeting and a question of raising fees for the towns
for conservation licenses and dog licenses .
12 . A letter from Thomas H . Huhn concerning the towns
voting machine rental contract . He advised the
board that the purchase option will expire 2/1/73 .
13 . A letter from Gordon Roberts concerning a dangerous
intersection at mit Jersey Hill Road and King Road
West .
14 . The minutes of the November 1 , 1972 and the November
15 , 1972 meetings of the Board of Zoning Appeals .
PRIVILEGE OF THE FLOOR :
Moses Peter was upset with the Town Board for not taking
immediate action on two items he thought were very important .
They were disposal of the Old Town Hall and the garbage
pick up in the Town of Danby . Both subjects were discussed at
the November town board meeting . A new item of business he
brought to the attention of the board was the damage done to
Hunsinger Hill Road and Jack Hill Road by heavy equipment
traveling over them . He also expressed the opinion that it is
time for a reevaluation of priorty in maintaining the town roads .
Supervisor A . Francis Wright stated that routes traveled by the
school buses have first priority and this should remain the same
if there is a reevaluation Survey .
COMMITTEE REPORTS :
A Highway Report e Councilman Ralph Wilbur said that the pipe
has been received and the repair work done on Michigan
Hollow Road . Work is being done to improve a section of
Comfort Road to make it possible for the snow plows to get "
through .

Committee Reports Continued :
B . West Danby Water District - Roy Casterline reported that a
fire proof file has been purchased for the water district .
The file was purchased at a surplus auction at a price that
he felt was very reasonable . The total bill was $100 . 00 .
The file itself was $ 55 . 00 and the balance covered the
trucking fee . Supervisor A . Francis Wright asked that
Attorney Richard Thaler be contacted to see that everything
was handled in a legal manner . The bill should then be
submitted to the board for payment .
C . Insurance - No report .
D . Refuse Collection and Disposal - Councilman Gerald Crance
reported that a meeting is planned with the refuse
collectors in Danby but no date has been set yet . He would
like this matter tabled ' until January .
E . Youth - Supervisor A . Francis Wright said that the board
must approve next years budget for the youth program . The
tenative budget was passed around to the board members .
The total youth budget is $4 , 390 . 00 . Councilman Ralph
Wilbur made the comment that last year $1 , 000 . 00 was
appropriated for a bus for the summer program but this was
never used . Possibly the youth program is over funded .
Mary Oltz stated that the reason these funds were not
used was the state cut back on funds for the program and
then when the program for the summer session was started
the state came through with the monies that had been cut
from the budget . However this was to late to reinstate the
bus . The Supervisor stated that the funds appropriated for
the bus and not used were lost to the program . These funds
can only be used for the purpose they have been appropriated
for .

Committee Reports Continued :
F . Zoning and Planning - Justice Floyd Dorn looked up the
Town of Danby Junk Car Law . At the time the law was
passed notices were sent to violators and results were
received in at least half of the cases . Justice Dorn
feels now is the time for action . Justice Milton Todd
told the board of the bad situation that exists in the
fire house while court is in session . The bunkers eat
their meals during this time and leave the counters
covered with bottles and dishes . Both justices feel that
this makes a very poor appearance during court sessions .
Councilman Ralph Wilbur has talked to Clyde Carrier about
this situation and says that the bunkers will be
approached and see if it can be arranged so that their
supper hour will be another time on court nights and also
see if the area can be cleaned up . Again it was mentioned
that if we had our own office building this problem would
be eliminated .
G . Fire - Councilman Ralph Wilbur reported that the fire
Commissioners are meeting and Clyde Carrier will ask for
approval to move the town safe from the old fire house to
the new one . The title for the old fire house will be
transferred this week . Mr . Wilbur would like the
permission of the town board to have Joe Hulbert move this
safe when the commissioners give their approval .
OLD BUSINESS :
Report of the Highway Superintendent - Joe Hulbert reported that
the gravel roads in the town are in bad shape . He also reported
that there was a meeting in the county and the Donovan Projects
discussed . The Donovan Projects were not turned in by Julyl ,
1972 as they should have been therefore the town loses its
funds for 1973 . The county was at fault here in not giving
proper information to the towns about the deadline . The towns
were given a deadline of September 1 . The Town of Danby uses
Donovan funds more than the other towns in the county , therefore
they lose more .
Report of the Zoning Officer - A violation notice was sent to
Francis Shepard concerning the Auto Salvage sign on his
property . Mr . Shepard contacted Mr . Bartoff who in turn
contacted Gordon Roberts for the proper forms to be filled out
so that this matter can be appealed . Also after some discussion
with Mr . Shannon it was found that signs can be cut down if
they are on State Land and the Town informs the proper
authorities that they are in violation .

Old Business Continued :
Report of Planning Board Chairman - The minutes of the last
meeting were mailed and read .
Report of the Appeals Board Chairman - There are two appeals
coming up but other than that things are pretty quiet .
NEW BUSINESS :
Moses Peter reported that he has contacted Mr . Awad ' s attorney
in connection with property the town might be interested in
buying . The property is owned by Mr . Awad and is located on
the Danby Road . Mr . Awad ' s attorney said the property is still
for sale and he will be in touch with Mr . Awad and get back
to Mr . Peter concerning this matter .
Supervisor A . Francis Wright advised the board of a meeting
on the Federal Revenue Sharing in Binghamton on December 18 , 1972 .
He asked the board for authorization for the Deputy Supervisor ,
the Town Clerk and himself to attend this meeting . Justice Milton
Todd made the motion that these people be authorized to attend
the meeting . The motion was seconded by Justice Floyd Dorn and
carried by a vote of five ayes and no noes .
Supervisor A . Francis Wright brought to the attention of the
board the need to modify the general fund budget by 4637 . 06
to cover year end expenses of the Town Clerk ' s Office . This
amount would cover the cost of an adding machine ; aminutes book ;
Town Clerk ' s monthly record book ; tax collector ' s record book ;
the amount paid the deputy clerk ; and also any other small items
incurred by the clerk ' s office . This amount would be transferred
from the contingency fund to item A1410 . 4 .

New Business Continued :
Supervisor A . Francis Wright stated that 0000 , 00 was needed in
the Highway Fund to cover wages from the present time until
January 1 , 1973 .
RESOLUTION #16 TRANSFER FUNDS FROM THE
CONTINGENCY . FUND IN THE AMOUNT
OF $3 , 000 . 00 to ITEM 4
OF THE HIGHWAY FUND TO
COVER SNOW REMOVAL
Moved by Councilman Ralph Wilbur and seconded by Justice
Floyd Dorn .

Carried five ayes and no noes .
Supervisor A . Francis Wright said that the year end meeting of
the board should be held the last week in December . r It was
decided that the meeting would be held December 27 , 1972 at the
Danby Elementary School at 8 : 00 .
Gerald Crance said it was the recommendation_ of the planning
board to leave the West Danby Grange Hall in the hands of the
people involved and let them dispose of it the way they want
to . Councilman Crance made the motion that the recommendation
of the planning board be accepted . Justice Floyd Dorn seconded
the motion which was carried by a vote of five ayes and no noes .
The board made the recommendation that Marvel Hatfield be
contacted to see if she would like to be appointed as a
representative from the Town of Danby to serve on the Area
Beautification Council .
The Town Board made the recommendation that the Town Clerk reply
to John Marcham and tell him that the election districts in the
town will remain the same as they have been .

The meeting of the Association of Towns to be held in New York
City in February was discussed . Justice Floyd Dorn , Mary Oltz ,
Town Clerk , and Supervisor A . Francis Wright may be able to
attend at that time . Joe Hulbert , Highway Superintendent , will
advise later if he can be free to go . Justice Milton Todd made
the motion that the above named people be authorized to attend
the meeting of the Association of Towns . Councilman Gerald
Crance seconded the motion which was carried by a vote of five
ayes and no noes . There is a possibility that a bus will be
chartered to make the trip .
It was the feeling of the town board that the town clerks
should present , at the association of towns meeting , a desire
to have the 250t.. fee given the towns on the Sale of conservation
licenses and dog licenses raised . The opinion was expressed
that if this fee paid the towns is raised the total license fee
will also be increased .
A . Frnncis Wright asked that the town board authorize the town
clerk to purchase a NCR adding machine for the price of $280 . 00 .
Councilman Ralph Wilbur made the motion that the town clerk
purchase the adding machine . Justice Milton Todd seconded the
motion which was carried by a vote of five ayes and no noes .
Councilman Ralph Wilbur made the motion that we pick up our
purchase option on the voting machine that we have been renting .
Justice Floyd Dorn seconded the motion that was carried by a
vote of five ayes and no noes .
The board asked Joe Hulbert , Highway Superintendent , to ask the
county to clarify the meaning of the sign at the intersection of
Jersey Hill Road and King Road . This is a sign with a double
arrow which does not make it clear who has the right of way .
Councilman Gerald Crance reported that anyone interested may
attend a meeting , Saturday , December 16 , at 1 : 00 P . M . at the
Town Hall . A man from McPhearson Builders is coming up to go
over the building . It was mentioned that back in January of
1967 , Frank Saturne estimated the cost of renovating the town
hall at $18 , 000 . 00 . Plans were drawn at that time . Ed Oltz will
inform Paul Smith of this meeting and will also attend the
meeting ..
Joe Hulbert , Highway Superintendent , will contact the company
responsible for the heavy equipment that has damaged John Hill A'
Road and Hunsinger Hill Road .
° The town board will help Joe Hulbert set up a schedule of
priorities for snow plowing the town roads . Joe Hulbert will
set a date and time and contact the board .

Justice Floyd Dorn read a resolution to the board having to do
4 with obolishing the present justice court system . The
If Association of Magistrates sent him a resolution which if
adopted by the towns would protect the justice court system .
Justice Floyd Dorn made the motion that the board accept the
tenative resolution to protect the justice courts . Councilman
Gerald Crance seconded the motion which was carried by a vote
of five ayes and no noes .
Councilman Ralph Wilbur said the board should send a letter of
protest because the town did not get its Donovan Funds . A
special meeting was held by the town board to get these figures
in on time . Supervisor , A . Francis Wright said he would write
a letter to Bill Smith , Connie Cook and Mr . Mobbs .
Councilman Ralph Wilbur thought it would be a good idea for the
town to give some thought to building or buying an existing
house and lot for town offices . This property would be resalable
if another proposal came up . He feels that the cost estimates
of town offices will be prohibitive . Also highway buildings
are needed .
General Fund Warrant #12 in the amount of $996 . 23 was approved
to be paid . The motion was made by Justice Floyd Dorn and
seconded by Justice Milton Todd and carried by a vote of five
ayes and no noes .
The Highway Warrant #12 in the amount of $01 , 776 . 43 was approved
to be paid . The motion was made by Councilman Ralph Wilbur and
seconded by Justice Milton Tod and carried by a vote of five ayes
and no noes .
West Danby Water District Warrant #11 in the amount of $ 88 . 50 '
was approved to be paid . The motion was made by Councilman
Gerald Crance and seconded by Justice Milton Todd and carried
by a vote of five ayes and no noes .
The motion to accept the Supervisors Report was made by
Councilman Gerald Crance and seconded by Justice Floyd Dorn and
carried by a vote of four ayes and no noes .
The motion to adjourn the meeting was made at 11 : 15 P . M . by
Justice Floyd Dorn and seconded by Justice Milton Todd and
carried by a vote of five ayes and no noes .
