TOWN BOARD MINUTES
September 11 , 1972
The regular meeting of the Danby Town Board was held in the
Danby Elementary School , September 11 , 1972 , at 8 : 00 P . M .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Gerald Crance
Justice Floyd Dorn
Justice Milton Todd
Also present : Percy Button , Edward Slights , Joe Hulbert ,
Gordon Roberts , Mary Casterline , Roy Casterline , E . J . miller ,
Manley Thaler , Howard Snyder , Walt Chapman , and Mr . & Mrs .
Westmiller .
The minutes of the regular meeting of August 14 , 1972 , were
mailed to board members for reading and correction .
The minutes were approved as presented .
COMMUNICATIONS :
1 . A letter to the Zoning Officer from Jason Seley
asking to have a deviation granted fron the normal
residential zoning .
2 . A letter to Gordon Roberts from the Division of
Assessment in respect to the valuation of the
Valley View Investors Inc .
3 . A letter from the New York State Executive Depart -
ment Office of Planning Services explaining the
New York State Legislation Governing Town subdivi -
sion Plat control procedures to become effective
January 1 , 1973 .
4 . A letter from the State of New York Public Service
Commission discussing joint trenching of electric
and telephone utilities .
5 . A letter from the State of New York Department of
Audit and Control about the 1973 payment of Highway
Aid to Towns .
PRIVILEGE OF THE FLOOR :
Mr . Westmiller asked why the town has not replaced the bridge (
that has been washed out on the Brown Road . Councilman Ralph

Privilege of the Floor : Continued :
Wilbur explained that it was a County Bridge and it was up to
the County to replace it . Also it was mentioned that the road
. repair work in some areas has not held up . Mr . Button also
expressed concern over the poor condition of some of the town
roads . This will be brought to the attention of the Highway
Superintendent . Councilman Ralph Wilbur stated that the Town
will work on Maple Avenue tomorrow and that will finish the
flood work .
Walt Chapman spoke to the board as a representative of the
West Darby Grange . He said that the few grange members that
are still active are not able to keep the grange hall in
good repair . At the last meeting of the grange it was decided
that the town should be asked if they would like to take over
the grang hall rather than find a purchaser . Mr . Chapman told
the board1 ! ze and potential of the building . The Board had no
answer for Mr . Chapman . At the present they are trying to
decide what to do with the Town Hall that they already own .
Attorney Thaler felt the Town Board should hold a public hear -
ing and get the opinion of the people as to what they think
should be done with the Town Hall . From the information that
they get from the public the board should then decide what
should be done .
County Representative Jimmie Miller said that District Attorney
William Sullivan requested another assistant and more secretarial
help . The board granted both requests . This will be a big
help to the town justices . The County Board will be reapportioned .
there will be 15 members on the board instead of 16 as there
has been in the past . The S . P . C . A . is still a controversial
subject .
COMMITTEE REPORTS :
A . Highway Report - Councilman Ralph Wilbur reported that the
Highway Superintendent is no longer using the extra help
provided from the flood area . This program has been
exhausted . Clyde Carrierms problem has been resolved at
least for the present . A resident of the town has built a
home on an unimproved town road and is asking that the road
be repaired and plowed in the winter time . If the town does
not do this he will take this matter up with his attorney .
" Attorney Thaler advised the Town Board that if and when
action is taken the town should abandon the road as it is
too costly to repair .

Committee Reports Continued :
B . West Danby Water District - Councilman Gerald Crance reported
that there are two new houses to be added to the Water
District . All the easements have not been given to the
°- ./attorney yet . There have been some problems getting
t ; _��_, them . When preparing next years budget for the Water
District it was suggested that attorneys fees should be
included .
C . Insurance - No report
D . Refuse Collection and Disposal - Councilman Gerald Crance
reported that everything is going well .
E . Youth - No report .
F . Fire - Councilman Ralph Wilbur reported that there has been
a bid of X10 , $ 00 . 00 subject to approval of a referendum and
a zoning variance . The man purchasing the building will
use it for a manufacturing business . It will not be a full
time business . Mr . Seley , the purchaser , will have to follow
the normal procedure in getting a zoning variance to inable
him to carry on his business if the referendum is passed by
the public ,
G . Zoning and Planning - Justice Floyd Dorn said the board had
a good meeting . Among other things old junk cars were
discussed . This has been a long standing problem .
H . Cemetaries - Ed Slights reported that he would have to
mow once more this year .
OLD BUSINESS :
A . Highway Superintendent - No report .
B . Zoning Officers Report - There is the possibility that the
zoning officer will need a larger budget next year . A .

if by September 20 , 1972 .

Old Business Continued :

E . 'eSupervisor A . Francis Wright noted that a position of
Highway Foreman should be created and his salary set until
the Highway Superintendent retires or resigns .
RESOLUTION #8 CREATE THE POSITION OF
H IGHWAY FOREMAN AT A
S ALARY OF $4 . 10 PER HOUR
Moved by Councilman Ralph Wilbur and seconded by Councilman
Gerald Crance .
Roll Call Vote : Wilbur - aye
Dorn - aye
Wright - aye
Crance - aye
Todd - aye
Carried five ayes and no noes' .
F . A . Francis Wright noted that there is a meeting of the
Appeals Board , Planning Board and the Town Board . The date
is September 20 , 1972 at the Danby Elementary School at
8 : 00 in the evening . Mr . Frank Liguori will be the guest
speaker .
G . West Danby Park - Tabled until October .
NEW BUSINESS :

g hearing the 25th of Septmeber a Monday .
Supervisor A . Francis Wright will call the Board Members as to
time and place .
The clerk informed the board that an additional $30 . 00 more or
less would be needed to complete the work on the clerk ' s sign
board' . Councilman Gerald Crance made the motion that this
money should be taken to finish this worked and coded as
advertising . Councilman Ralph Wilbur seconded the motion which
r_ was carried by a vote of five ayes and no noes .
General Fund Warrant #9 in the amount of $438 . 62 was approved
to be paid . The motion was made by Justice Milton Todd and
seconded by Justice Floyd Dorn and carried by a vote of five
ayes and no noes .

New Business Continued :
The Highway Warrant #9 in the amount of $4 , 263 . 12 was approved
to be paid . The motion was made by Justice Floyd Dorn and
seconded by Justice Milton Todd and carried by a vote of five
ayes and no noes .
The motion to accept the Supervisors Report was made by Justice
Floyd Dorn and seconded by Justice Milton Todd and carried by
a vote of four ayes and no noes .
The motion to adjourn the meeting was made at 10 : 00 by
Councilman Ralph Wilbur and seconded by Justice Milton Todd
and carried by a vote of five ayes and no noes .
