TOWN OF DANBY
TOWN BOARD MINUTES
May 8 , 1972
The regular meeting of the Danby Town Board was held in the
West Danby Fire House , May 8 , 1972 , at 8 : 00 P . M .
Board Members present : Councilman Gerald Crance
Councilman Ralph Wilbur
Justice Floyd Dorn
Justice A . Francis Wright
Absent : Supervisor Donald Makie
Also present : Lloyd French and wife , Paul Smith , Mr . Percy
Button , Zoning Officer Gordon Roberts , Dean Westmiller , Mr .
& Mrs . Seamon , Ashley Westmiller , Mary Casterline , Roy
Casterline , Andrew Reed , Gladys Hulbert , Joseph Hulbert and
Mrs . Westmiller .
In the absence of the Supervisor , due to illness , and also the
Deputy Supervisor the meeting was called to order by the clerk
who announced that the board would elect a chairman for the
meeting .. Councilman Ralph Wilbur made the motion that Justice
A . Frnacis Wright be elected chairman for the evening . The
motion was seconded by Justice F1o, l Dorn and carried by a vote
of three ayes and no noes .
Note : Persuant to town law in the abEnoe of the supervisor the
deputy supervisor will chair the meeting . In the absence of
both , the clerk will call the meeting to order and the board
will elect a chairman from their number .
The minutes of the regular meeting of April 10 , 1972 , . were
mailed to board members for reading and correction .
The minutes were approved as presented .
COMMUNICATIONS :
1 . The minutes of the Town Planning Board meeting of
April 9 , 1972 .
2 . A . letter to George Phann from Thaler & Thaler ,
confirming approval by the State of the Extension
of the West Danby Water District .
3 . A , letter from John Marcham to the supervisors and
mayors of Tompkins County concerning the reapportionment
of County Board Districts . .

Communications Continued :
4 . A letter from the Tompkins County Department of
Health , concerning water supplies .
5 . The agenda of the Tompkins County Board of
Representatives meeting of Monday April 24 , 1972
meeting .
6 . A letter from the Tompkins County Department of
Health concerning the desposal of septic tank
pumpings .
7 . A letter from the Tompkins County Division of
Assessment in reference to the Assessment review .
8 . The agenda of the Tompkins County Board of
Representatives meeting of May 8 , 1972 .
9 . A notice of 1972 Regional meetings for local
Officials from the " State resources for Local Action . "
10 . A letter from Daniel E . Stompka , Architect , giving
the town board an experience resume .
PRIVELEGE OF THE FLOOR :
Gerry Crance would like to see certain hours of the day
designated for open burning . Also he wondered if a fine could
be lieved on violators . Councelman Ralph Wilbur will get
more information on this .
Percy Button wants to know what a farmer can do when he needs
to clean hedge rows and finds he has a large pile of brush
that needs to be burned . Ralph Wilber said that the only
legal open burning was fire training practice burning .
Brush is not wanted at the Sanitary Land Fill .
Lloyd French says he has the planning boards approval of his
plan for a proposed trailer park . He also said many of
his neighbors had come to the meeting and if they had anything
to say or object to they could . Mrs . Westmiller would like
trees planted between the park and her property . One
suggestion was that no more trailer park plans be approved
until the two now being built were completed and filled .

After some disscusion there didn ' t seem to be any serious
objections . The Town Board tabled the matter until the June
meeting when Mr . French will have the plans and all other
necessary papers for the board to review .
Gordon Roberts wanted to know how to get a burning permit for
burning brush on your own property . Ralph Wilber says we
are in region sevehwhich is the Syracuse district . You have
to get a permit to burn from the Syracuse office . Applications
are available at the Health Department . It will take about ?"
four months to get an answer from an application .
COMMITTEE REPORTS
A . Highway Department - Councilman Ralph Wilber stated that
we cannot have an unexpended balance on the Highway
improvement program . The clerk read a letter from the
Department of Transportation explaning this in some
detail . To do the necessary road work this summer we
will have to get a tax anticipation note .
B . West Danby Water District - The people in West Danby were
not aware that the extension of the water district had
been approved . Councilman Crance is going to get to-
gether with the de eager and Mr . Thaler and see if they
can improve relations and get the program under way .
It was also brought up that Mary Casterline needs a file
for her correspondence and records of water bills paid
and pending . It was suggested that the board should get
a recommendation from the water board . Kenneth Coler
Chairman of the Water Board will come up with this
recommendation .

D . Refuse Collection and Desposal - No Report
E . Youth - No Report
F . Zoning and Planning - Justice Floyd Dorn mentioned that
Paul Smith has accepted the appointment as chairman of
the Planning Board ,

Committee Reports Continued :
H . Cemetaries - Justice Floyd Dorn reported that Ed Slights
is ready to start the years work as soon as the weather
permits . Some monuments have been tipped over in one
of the cemetaries . At one time Dick Chaffee said that
sometime when he was going by with a bucket and chain
he would set them back up .
OLD BUSINESS
A . Highway Superintendant - No Report
B . Zoning Officer - Report mailed and read by the Board .
Also a copy of the Certificate was mailed to the clerk
for filing .
C . Planing Board Chairman - Submitted a report which was
read to the Board .
D . Appeals Board Chairman - In the absence of the chairman
Councilman Ralph Wilbur reported that the Appeals Board
is in dire need of another member on the appeals Board .
There was an appeals board meeting May 2 , 1972 and there
was difficulty getting a quorm . Two People came and three
are needed to make a quorm . One person came after much
phoning . Chairman Justice A . Francis Wright asked that
at the next meeting the Appeals Board chairman be ready
to recommend a new member . The clerk was asked to write
a letter to a present member of the board who has missed
five meetings and ask for his resignation .
NEW BUSINESS
Ralph Wilbur looked into Clyde Carriers situation with the
run off . He has talked to ]Dick Chaffee and this will be put
in there highway tour . The only time there seems to be a
problem is when the snow melts and water runs down the road .
Councilman Crance reported that the radio towers were not
issued a permit for the King Road location by the Town of
Ithaca because the people in the area said that it would
block the view of the lake and valley . The board disapproved
for this reason and no appeal was made .

New Business Continued :
Chairman Justice A . Francis Wright said that Erie J . Miller
had called him and could not make the meeting because of a
special committee meeting called on the question of the sales
tax . As far as the dog question is concerned , there seems to
be a stalemate . The County has been putting pressure on the
S . P . C . A . to put on more help . The S . P . C . A . answers that they
will if they get more money from the County .
Councilman Ralph Wilbur received information from the Cortland
Conservation Office that the stream in West Danby that is
flooding and damaging property is not a trout stream . For this
reason no application is needed to clean this stream . The
board agreed that more information was needed and legal advise
should be sought before it is decided to clean a stream on
private property .
Councilman Ralph Wilbur says that we will have someone at
one of our meetings from Cerracche T . V . Cable service . The
purpose will be to ask for a raise in the montly rate of
T . V . Cable service by $ . 50 . Unless he gets a franchise the board
can ' t see getting him a raise .
General Fund Warrant #5 in the amount of $ 89 . 90 was approved
to be paid . The motion was made by Justice Floyd Dorn and
seconded by Councilman Gerald Crance and carried by a vote of
four ayes and no noes .
The Highway Warrant #5 in the amount of $741 . 05 was approved
to be paid . The motion was made by Councilman Ralph Wilbur and
seconded by Justice Floyd Dorn and carried by a vote of four
ayes and no noes .
West Danby Water District Warrant #5 in the amount of $146 . 30
was approved to be paid . The motion was made by Councilman
Gerald Crance and seconded by Justice F1q . Dorn and carried
by a vote of four ayes and no noes .
At 9 : 55 P . M . the motion to adjourn the meeting was made by
Justice Floyd Dorn and seconded by Councilman Ralph Wilbur and
carried by a vote of four ayes and no noes .
