There were no additions or deletions to the agenda. (2) PRIVILEGE OF THE FLOOR No one spoke. (3) APPROVAL OF MINUTES MOTION: Approve July minutes with requested edit Moved by Cowan, seconded by Bergman The motion passed. In favor: Bergman, Cowan, Davis, Scriber, Maher Abstain: Colbert (4) TOWN BOARD LIAISON REPORT Town board member Connors was unavailable, so Supervisor Gagnon provided the report: - The Board passed “Safe Streets for All.” This initiative identifies the largest road-related hazards in Danby, and brings in experts to advice on risk reduction in those areas. It can also be utilized to seek grant funding. - The town board is moving towards enforcing derelict buildings provisions in general, and specifically in regards the house next to Town Hall. The town is also looking into acquiring that parcel, with or without the house on it. - The town is once again considering the previously proposed noise law. The draft is on the town website and is available for folks to review. - The town is continuing to engage with South Hill Cidery and its neighbors with the hope of coming to an agreement regarding concerns about noise and the scope of the operations. (5) DEVELOPMENT REVIEW SUB 2025-02 365 Troy Road Parcel: 3.-1-9.3 Applicant: Hasham Qaisar Anticipated Board Action(s) this Month: Public Hearing, Consider Approval Zone: Low Density Residential SEQR: Unlisted Proposal: Minor Subdivision (one lot subdivided into two lots) Maher reviewed previous steps and decisions, including the recent Area Variance granted by the BZA. Now that that approval has been received, the applicant has returned to have the subdivision reviewed by the Planning Board. Environmental review has already been completed. PUBLIC COMMENT Public Hearing was opened at 7:10 pm. No one spoke. Public hearing was closed at 7:11 pm. The Planning Board briefly reviewed the final plat and noted that the requested additions had been made. MOTION: Approve Planning Board Resolution No. 15 of 2025 - Preliminary and Final Approval, Minor Subdivision, 365 troy Road, Tax Parcel #3.-1-9.3 Whereas an application has been submitted for review and approval by the Town of Danby Planning Board for a Minor Subdivision of Town of Danby Tax Parcel No. 3.-1-9.3, by Hasham Qaisar, Owner; and Whereas the Owner proposes to subdivide the existing property into two parcels: one measuring approximately 2.0 acres and the other measuring approximately 1.81 acres; and Whereas the property is in the Low Density Residential Zoning District, requiring a lot area minimum of 2 acres and lot frontage of 200 feet; and Whereas an Area Variance for lot area reduction was approved by the Board of Zoning Appeals on July 22, 2025; Whereas a Minor Subdivision is an Unlisted Action under the State Environmental Quality Review Act and is subject to environmental review; and Whereas the Board of Zoning Appeals and the Planning Board were involved agencies in the SEQRA process; and Whereas the Planning Board issued a Notice of Intent on June 17, 2025 to serve as Lead Agency in a coordinated environmental review; and Whereas the Board of Zoning Appeals passed a motion on June 24, 2025 stating that they have no concerns with the Planning Board serving as Lead Agency for SEQRA; and Whereas the Planning Board, acting as Lead Agency, did on July 15, 2025 make a Negative Declaration of Environmental Significance for the project; and Whereas this is considered a Minor Subdivision in accordance with the Town of Danby Subdivision and Land Division Regulations, Article II, § 201 B.2. Minor Subdivision, Option #2; and Whereas the Town of Danby Planning Board has sole authority for approving Minor Subdivisions; and Whereas the application was referred to Tompkins County for review per GML 239-l, m, and n, and the County determined the proposed action will have no significant county-wide or inter-community impact; and Whereas legal notice was published and adjacent property owners within 500 feet notified in accordance with the Town of Danby Subdivision and Land Division Regulations, Article VI, § 601 II.H. Hearing and Notices; and Whereas the Planning Board held the required Public Hearing on August 19, 2025; Now Therefore, be it Resolved that the Town of Danby Planning Board on August 19, 2025 does hereby grant Preliminary and Final Subdivision Approval for the Minor Subdivision application submitted by Hasham Qaisar, Owner, of Town of Danby Tax Parcel No. 3.-1-9.3, as shown on the “Subdivision Map No. 365 Troy Road, Town of Danby, Tompkins County, New York” as prepared by T.G. Miller P.C. on July 28, 2025, subject to filing with the Tompkins County Clerk within 62 days; and Resolved that the Owner is required to submit a copy of the recorded Minor Subdivision to the Town of Danby within 30 days after recording with the Tompkins County Clerk. Moved by Bergman, seconded by Davis The motion passed In favor: Bergman, Colbert, Cowan, Davis, Scriber, Maher Maher signed the plat copies and suggested the applicant work with the planner to file with the county. (6) PLANNER REPORT - Maher stated that the Rhize Up project on Hornbrook submitted paperwork but they will wait until Greg Hutnik, Town Planner, returns after Labor Day to move forward.
