HomeMy WebLinkAbout2007_09_27 PB Meeting MinutesTOWN OF DANBY PLANNING BOARD MINUTES SEPTEMBER 27, 2007 PRESENT: Chairperson Robert Roe Planning Board Members: Dave Mastroberti, Ted Melchen, Naomi Strichartz, Ray Van de Bogart, Olivia Vent ABSENT: Linda Hansen (excused) Others Present: Carol Sczepanski - Secretary Susan Beeners - Code Enforcement Officer George Blanchard - Alternate Planning Board Member Members of the Public: Sarah Hogben, Jacob Colbert, Joel Gagnon Chairperson Roe opened the Planning Board Meeting at 7:06 p.m. Consideration of the Wendt Reauest The Planning Board reviewed the information of the application for a Special Permit from Scott and Kelly Wendt and the public hearing and the following resolution was approved. RESOLUTION NO.21 OF 2007 APPROVAL OF SPECIAL PERMIT FOR A SECOND DWELLING ON A LOT By Ray Van de Bogart: Seconded by Naomi Strichartz WHEREAS, this action is to Consider Granting a Request for a Special Permit for the proposed installation of a second dwelling on a lot, at 2411 West Danby Road, Tax Parcel 18.4-25.1. Scott and Kelly Wendt owners, and WHEREAS, this is a SEQRA Type II action which needs no further environmental review; and WHEREAS, the Planning Board on September 27, 2007 has held a public hearing related to this request, NOW, THEREFORE, IT IS RESOLVED, that the Town of Danby Planning Board grants a Special Permit to Scott and Kelly Wendt for the proposed installation of a second dwelling on a lot at 2411 West Danby Road, Tax Parcel 18.4 -25.1. A roll call vote on the resolution resulted as follows: (Linda Hansen - excused) Mastroberti Aye Melchen Aye 3 Planning Board Minutes September 27, 2007 will enter into a formal agreement with the Danby Community Park Association for two(2) test wells. One will be near the ball field area and monitored for at least one year and will be turned over to the park for their water use. Information Update Debbie Teeter has asked to address the Planning Board at their October meeting should there be changes made to the County Map. Susan Beeners reported that Russ Nitchman is concerned about selling his lots and asked if he . should ask he Planning Board if he could rescind his approval. The regulation is affecting sale of lots. The Danby Fire Department is hosting a benefit on October 14, 2007. The benefit is for Eric Gaden, a former volunteer fireman and the Fire -Chief s father. The benefit is from Noon to 5:00 p.m. and includes a spaghetti dinner and many raffels. NIMS The members of DEMPC are attending many meetings and training sessions forlearning how to speak the same language and what operations are. The training is mandated by the Federal Government and necessary for us to get funding for disasters. This requirement should be incorporated into our planning. The Town Board knows that disaster preparedness is a critical part our critical infrastructure. Chairperson Roe said that the State also had a mandate under the DEC for this type of work to be done. Flag Lots Susan reported that we have recessitated Flag Lots by Special Permit since December 6, 2006 that were recommended to the Town Board. Naomi Strichartz said that we should put flag lots as part of a compromise measure in return for the fact that the Task Force had come up with a different picture of how they were going to do land planning. That proposal was voted down by the majority of the Town Board. Her support on the flag lots was contingent upon the compromise. She would like this put on the back burners. Ray Van de Bogart said that the Task Force made a recommendation for the bigger lot size and extended periods of time. We had a meeting with the Town Board in November of 2005 regarding what the Task Force was to work on in 2006. The things they asked of the Task Force was to work on was the Right to Farm Law, bonus lots for agriculture land and flag lots. They asked for recommendations for those things. He said he would like us to take time to discuss it and not put it on the back burner.
