HomeMy WebLinkAbout2007_06_21 PB WH Public Hearing and Meeting MinutesTOWN OF DANBY PLANNING BOARD PUBLIC HEARING WHITE HAWK ECOVILLAGE JUNE 21, 2007 PRESENT: Chairperson Robert Roe Planning Board Members: Linda Hansen, Dave Mastroberti, Ted Melchen, Naomi Strichartz, Ray Van De Bogart, Olivia Vent Others Present: Carol Sczepanski - Secretary Applicant - Henry Peterson Members of the Public Joel Gagnon, Russ Nitchman, Dave Auble, Magic Barrett Public Hearing Declared Oven Chairperson Roe declared the Public Hearing for the White Hawk Ecovillage open at 7:04 p.m. and read the following "Notice of Publication": PLEASE TAKE NOTICE, that the Planning Board of the Town of Danby will hold a public hearing on Thursday, June 21, 2007 at 7:00 p.m .at the Town of Danby Town Hall, 1830 Danby Road, Ithaca, NY to Consider Granting Final Site Plan Approval for the proposed "White Hawk Ecovillage", proposed to be located in Planned Development Zone 19, on the west side of Danby Road on Tax Parcels T-1-68 and T-1-69.1; with the project proposed to consist of 30 dwelling units, a common house, and accessory structures. Henry Peterson, property owner/applicant. The Application maybe viewed at the Town Clerk's office during regular office hours. All persons will be heard either in person or in writing. Comments of Planning Boar Ray Van De Bogart said he is happy with the solutions that the Board came up with. An additional 2 Planning Board Public Hearing June 21, 2007 requirement was that a bus stop would be put up when there was ten units. PRESENT: Chairperson Robert Roe Planning Board Members: Linda Hansen, Dave Mastroberti, Ted Melchen, Naomi Strichartz, Ray Van De Bogart, Olivia Vent Others Present: Carol Sczepanski - Secretary Members of the Public Joel Gagnon, Russ Nitchman, Dave Auble, Henry Peterson, Magic Barrett Chairperson Roe opened the Planning Board Meeting at 7:10 p.m. Consideration of Granting Final Site Plan Abnroval for the Proposed White Hawk Ecovillage RESOLUTIONNO.14 OF2007— WHITE HAWKECOVILLAGE—SEORADETERMIlVATION RELATED TO CONSIDERATION OF FINAL SITE PLAN APPROVAL By Naomi Strichartz: Seconded by Olivia Vent WHEREAS, this action is to Consider Granting Final Site Plan Approval for the proposed "While Hawk Ecovillage", proposed to be located in Planned Development Zone 19, on the west side of Danby Road on Tax Parcels 7.-1-68 and T-1-69.1; with the project proposed to consist of 30 dwelling units, a common house, and accessory structures; Henry Peterson, property owner/applicant; and WHEREAS, this is a Type I action for which the Town of Danby Planning Board is Lead Agency in environmental review, and with other involved or potentially involved agencies having been notified of this action, including the Tompkins County Department ofPlanning, the New York State Department of Environmental Conservation, the New York State Department of Transportation, and the United States Army Corps of Engineers; and WHEREAS, the Planning Board has reviewed the SEQRA Long Environmental Assessment Form and the recommendation of the Code Enforcement Officer that a negative determination of environmental significance be made for this action; NOW, THEREFORE, IT IS RESOLVED, that the Town of Danby Planning Board recommends to the Town Board that a negative determination of environmental significance be made for this Type I action and that this development is for up to thirty(30) dwellings. A roll call vote on the resolution resulted as follows: 2 Planning Board Minutes June 21, 2007 Hansen Aye Mastroberti Aye Melchen Aye Strichartz Aye Van de Bogart Aye Vent Aye Roe Aye Carried Unanimously RESOLUTION NO. 15 OF 2007— WHITE HAWK ECOVILLAGE — CONSIDERATION OF FINAL SITE PLAN APPROVAL By: Dave Mastroberti: Seconded by Ted Melchen WHEREAS, this action is to Consider Granting Final Site Plan Approval for the proposed "White Hawk Ecovillage", proposed to be located in Planned Development Zone 19, on the west side of Danby Road on Tax Parcels 7.-1-68 and T-1-69.1; with the project proposed to consist of 30 dwelling units, a common house, and accessory structures; Henry Peterson, property owner/applicant; and WHEREAS, this is a Type I action for which the Planning Board on June 21, 2007, acting as Lead Agency in environmental review, has made a negative determination of environmental significance; and WHEREAS, the Tompkins County Commissioner of Planning, pursuant to General Municipal Law 239-1 and m, has on June 12, 2007 determined that the proposal, as submitted, has no negative intercommunity or county -wide impacts; and WHEREAS, the Planning Board has on June 21, 2007 held a public hearing on this action; NOW, THEREFORE, IT IS RESOLVED, that the Town of Danby Planning Board grants Final Site Plan Approval to the project as proposed, based on the application materials submitted as of May 16, 2007, and supplemented by additional materials received and reviewed prior to June 21, 2007, with the following conditions and provisions: 1. The applicant shall comply with all provisions of Local Law No. 3 of 2007. 2. The applicant shall obtain approvals and permits from the following agencies: a. N.Y. S. Dept of Transportation. b. Tompkins County Health Dept. C. US. Army Corps of Engineers. The Stormwater Pollution Prevention Plan and plans for erosion and sedimentation control shall be subject to further review and approval by the Town's consulting engineer. 4. The applicant shall file the Stormwater Pollution Prevention Plan with the N.Y.S Dept. of Environmental Conservation. 3 Planning Board Minutes June 21, 2007 5. The installation of pumpindhydrants at the upper retention pond and the farm pond shall be subject to review and approval by the Danby Fire District. 6. Prior to the issuance of any building permits, and pursuant to Section 806 — Financial Guarantees for Improvements of the Town of Danby Zoning Ordinance, the applicant shall provide a letter of credit in an amount to be approved by the Town Board to insure satisfactory construction and completion of infrastructure; and shall execute an Agreement related to same. 7. Prior to the issuance of any building permits for areas proposed for lease or transfer, the applicant shall submit (pursuant to Section M, Paragraph 1 of Local Law No. 3 of 2007) adequate legal and survey description, showing the dimensions and location of such areas. 8. A Bus Shelter shall be installed in a location near Rte. 96B subject to approval by the Planning Board, prior to the issuance of more than 10 building permits or certificates of occupancy for dwelling units. Motion to Set Public Hearin-z Date and Time A motion was made by Ray Van De Bogart and seconded by Linda Hansen that the Planning Board set a public hearing date of Thursday, July 19, 2007 at 7:00 p.m. for the William Landstrom proposal for Subdivision of Danby Tax Parcel No. 26.-1-14 into three lots. A roll call vote on the motion resulted as follows: Hansen Aye Mastroberti Aye Melchen Aye Strichartz Aye Van de Bogart Aye Vent Aye Roe Aye Sousa Subdivision Application Carried Unanimously 4 Planning Board Minutes June 21, 2007 The Planning Board reviewed an application submitted by DeForest Sousa for a proposed Subdivision of Town of Danby Tax Parcel 30.-1-27.22 located on LaRue Road near South Danby Road, 16.38 acres total, into two lots of 2.239 +/- and 14.14 +/- acres each. The proposal is to create a mortgage parcel. Motion to Set Public Hearing Date and Time A motion was made by Linda Hansen and seconded by Ray Van De Bogart that the Planning Board set the public hearing date of Thursday, July 19, 2007 for the Sousa Subdivision proposal, following the Landstrom public hearing. A roll call vote on the motion resulted as follows: Hansen Aye Mastroberti Aye Melchen Aye " Strichartz Aye Van de Bogart Aye Vent Aye Roe Aye Carried Unanimously Nitchman Subdivision Proposal for Subdivision. The Board reviewed an application submitted by Russell and Kim Nitchman for a proposed subdivision of Town of Danby Tax Parcel No. 14.-1-27.22, located on Danby Road ner Van De Bogart Road, 23.82 acres total into three lots of 6.8.878, 5.515, and 11.427 acres each. Motion to Set Public Hearing Date and Time A motion was made by Dave Mastroberti and seconded by Olivia Vent that the Planning Board set the public hearing date of Thursday, July 19, 2007 for the Nitchman Proposed Subdivision and is to follow the Sousa public hearing. A roll call vote on the motion resulted as follows: Hansen Aye Mastroberti Aye Melchen Aye Strichartz Aye Van de Bogart Abstained Vent Aye Roe Aye Carried Town Board Reauest - Recommendation on Thresholds and Flat Lots On June 11, 2007 The Town Board passed a motion directing the Planning Board to make recommendations on the thresholds for land division by permit (in the Draft Subdivision Regulations and Land Division Regulations); and on flag lots. Planning Board Minutes June 21, 2007 Ray VanDeBogart said that the Task Force reviewed and discussed flag lots at their December 6, 2006 meeting. They discussed what could be done and how it could be accomplished. Items For July 21. 2007 Meeting The Planning Board was asked to come back next month with a list of areas where we think are historical areas.
