HomeMy WebLinkAbout2007_10_15 TB Special Meeting MinutesTOWN OF DANBY TOWN BOARD MINUTES SPECIAL MEETING OCTOBER 15, 2007 PRESENT: Supervisor Dietrich Councilpersons: Eugene Beavers, Norbert Nolte, Joseph Salino ABSENT: Councilperson Varona-Lacey(excused) Others Present: Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Ted Jones - Bookkeeper Laura Shawley - Bookkeeper Supervisor Dietrich called the meeting to order at 6:35 p.m. and announced that the meeting was to consider awarding a bid and contract for the Aquifer Study - Test Drilling in Upper Buttermilk/Danby Creek Valley The Board reviewed the information submitted in the bids and a proposed resolution that was submitted by the Code Enforcement Officer. The Code Enforcement Officer asked that the Board a memo attached to the proposed resolution. She said that her memo basically summarizes where we are. The split -spoon option is defiantly something that we would recommend be done. We are recommending the six inch casing. RESOLUTION NO. 76 OF 2007 AQUIFER STUDY -TEST DRILLING IN UPPER BUTTERMILK/DANBY CREEK VALLEY - AWARD OF CONTRACT By Councilperson Beavers: Seconded by Salino WHEREAS, the U.S. Geological Survey (USGS), in cooperation with the Town of Danby, Tompkins County and the New York State Department of Health, is conducting a ground -water investigation in the Upper Buttermilk/Danby Creek Valley, "Town of Danby, NY, and to complete this project the Town requires the services of a professional well driller to complete the drilling of a minimum of two test wells, and WHEREAS, a Notice to Bidders was published in the Ithaca Journal on September 22, 2007 on September 22, 2007, which Notice contained instructions for obtaining the necessary bid documents from the Town Clerk, and stated that bids would be received until 4:30 p.m. on the 5tn day of October, 2007 in the Town Clerk's Office at the Danby Town Hall and further that such bids would be publicly opened and read by the Town Board pm October 9, 2007 at 6:30 p.m. in the Danby Town Hall, and 2 Town Board Minutes Special Meeting October 15, 2007 WHEREAS, Addendum Number One to the Project Manual, dated October 3, 2007, was issued and amended the Notice to Bidders to indicate that the bids would be publicly opened and read by the Town Board on October 8, 2007 at 6:00 p.m. at the Danby Town Hall, and said Addendum also revised the location of the test well on Community Park Association Property, and WHEREAS, all bids were submitted in sealed envelopes to the Town Clerk, and WHEREAS, all bids were publicly opened and read aloud by the Town Board on October 8, 2007 at 6:00 p.m. in the Danby Town Hall, and NOW, THEREFORE IT IS, RESOLVED, that the Town Board of the Town of Danby hereby awards a contract to the lowest responsible bidder furnishing the required security whose bid complies with the specifications set forth by the Town, for the project entitled "Test Drilling in Upper Buttermilk/Danby Creek Valley, which bidder is Barber & DeLine, L.L.C. with the contract price to be Thirty Thousand Five Hundred Twenty -Eight and 00/100 Dollars (30,528.00), as described in the Base Bid dated October 4, 2007 submitted by Barber & DeLine, L.L.C. subject to the completion of all requirements set forth in the bid documents provided by the Town, including execution of Agreement and provision of all related Contract Documents for the project (as set forth in Article 8 of said Agreement); AND IT IS FURTHER RESOLVED, that the Town Board authorizes the Town Supervisor to execute said Agreement; AND IT IS FURTHER RESOLVED, that the Town Clerk is directed to put the following Notice of Award on Town letterhead and deliver the same to Barber & DeLine, L.L.C. "NOTICE OF AWARD Dated: October 15, 2007 TO: Barber & DeLine, L.L.C. ADDRESS: 995 Rt. 11A Tully,. New York 13159 3 Town Board Minutes Special Meeting October 15, 2007 PROJECT NO. E07-30 PROJECT: Test Drilling in Upper Buttermilk/Danby Creek Valley CONTRACT FOR: General Construction You are notified that your Bid dated October 4, 2007 for the above Contract has been considered. You are the apparent successful bidder and have been awarded a contract for the Base Bid. The Town of Danby has elected to include Item No. 4, In -situ Sediment Samples, as you have included in your base bid. The Contract Price of your contract as described in your Base Bid is Thirty Thousand Five Hundred Twenty -Eight and 00/100 Dollars ($30,528.00). Three copies of the Agreement and Project Manual are being delivered to you with this Notice. You must comply with the following conditions precedent within fifteen days of the date of this Notice of Award, that is by October 30th, 2007. 1. You must deliver to the OWNER three fully executed counterparts of the Agreement including all components of the Project Manual. Each of the Project Manuals must bear your signature on the cover. 2. You must deliver with the executed Agreement the Contract Security (Bonds) and Certificates of Insurance as specified in the Instructions to Bidders (paragraph 18). Failure to comply with these conditions within the time specified will entitle OWNER to consider your bid abandoned, to annul this Notice of Award and to declare your Bid Security forfeited. Within ten days after your comply with those conditions, OWNER will return to you one fully signed counterpart of the Agreement with the Contract Documents attached. AND IT IS FURTHER RESOLVED, that upon receipt by Town Clerk of all items required under the terms of the bid documents and set forth in the Notice of Award, said Town Clerk is directed to put the following Notice to Proceed on Town letterhead and deliver the same to Barber & DeLine, L.L.C. "NOTICE TO PROCEED Barber & DeLine, L.L.C. 995 Rt. 11 A Tully, New York 13159 Dated: October X, 2007 Project: Test Drilling in Upper Buttermilk/Danby Creek Valley Project No. E07-30 Contract For: General Construction You are notified that the Contract Time under the above contract will commence to run on October XX, 2007. Within 10 days of this date, you are to start performing your obligations under the Contract Documents. In accordance with Article 3 of the Agreement the date of Final Completion is November 30, 2007. cc: T.G. Miller, P.C."
