TOWN BOARD MINUTES
OCTOBER 8, 2007

Supervisor Dietrich called the meeting to order at 6:10 p.m. and led all present to the Pledge of
Allegiance to the American flag.
Supervisor Dietrich reported that the SPCA may double the fee we pay for dog control service
and that representatives from the SPCA are here tonight to give us an update on their services
and expenses to provide that service. He also said that there is the fact that towns are required to
provide shelters based on FEMA mandates in case of an emergency. It is mandated that each
town in an emergency can provide a service to individuals who need it.
Abigail Smith, the director of the SPCA, addressed the board and public with power point
presentation describing the background of the SPCA, their services and a comparison to some
surrounding areas for animal shelters. The contracts for providing services is drastically
underfunded. She explained the reason behind the decision of the SPCA's to draw up new
agreements/contracts that will double the fees for Tompkins County municipalities as the fact
that they had been depleting their resources for the past three years. They have used up their
reserves to provide services to the County and cannot continue to operate without added fees for
service. In order to continue to provide services to maintain the SPCA shelter it is necessary to
raise the fees to municipalities.

The Board and the SPCA entertained comments and questions from the public.
ADDITIONS TO THE AGENDA
Stripping and waxing of the Town Hall floors proposal - consideration of approval.
Privileize of the Floor
The Town Clerk reported that the Tompkins County Town Clerks Association are meeting on
Tuesday. On their agenda is an update by Tompkins County Town Clerk, Aurora Valenti on
information regarding a central archival records storage facility. They also may discuss the
services are provided by the SPCA in their towns and what their respective towns are doing
about the increased costs.
Members of the Public:
Ronda Roaring - asked Representative Proto if the Legislators of Tompkins County have been
approached by Tioga County, or does he have any knowledge the intent to dissolve and annex
with surrounding in townships.
Representative Proto said that New York State has to be involved to dissolve a county.
County Representative Renort
County Representative Frank Proto reported on the following:
1. Budget process has begun and there has been a public information meeting. The over-all
goal is to stay at the 2% Levy.
2. Pre-school special education programs increases are State mandates.
3. Water Resources Council - Cornell University must resubmit a permit application for
continuing to provide resource cooling.
4. County Roads in Danby - the public works superintendent has not heard from anybody in
Danby about a meeting regarding the roads.
Supervisor Dietrich reported that the County is not mowing the Town of Danby roads. They are
mowing the County roads.
5. County Administrator - County searching for a County Administrator.
6. Health Department Building - a final decision has not been made.
7. City Historian - has now completed brochures for the towns.
Hizhwav Report:
A written report was submitted on the activities of the highway department for the month of
August, He also reported that East Miller Road has not been completed and still needs a top
coat, the new highway truck cab and chassis is now in Watertown to have the box and plow
equipment installed. He said that he and his deputy highway superintendent, Carl Seamon, are
going to inspect the cab and chassis this week to make sure it meets specifications.

West Danbv Water District
Carl Seamon reported that he will check on the generator for the West Danby Water Department.
There is some routine maintenance and a a few repairs to the water plant that are necessary.
Planning Board Report
Naomi Strichartz said that the Planning Board at their August meeting did not make a decision or
recommendation on the proposed flag lot legislation. She suggested that the Planning Board
might be more productive to stop work on land issues and to work on helping the Town become
compliant with the NIMS mandates.
Beautification Committee
Naomi Strichartz reported that there is not grant money available this year. The County
alternates funding to different towns each year.
Recreation Partnership
Supervisor Dietrich reported that the Recreation Partnership Committee has approved the
agreement with the towns. It now goes to Tompkins County Legislature.
Community Council
Dan Klein reported that Community Council that they had initiated their film series. There is
another film night scheduled for November.
Senior Citizens
The Danby Senior Citizens met on October 4, 2007 for a dish -to -pass luncheon. There was no
entertainment provided. There is a bus trip to Farmington for an Andrew Sisters program on
November 7, 2007.
DEMPC
Councilperson Beavers reported that he and John Smith met with Tompkins County Sub group
last month and presented the emergency package that our DEMPC has put together and the final
survey. The discussed the responses we have received from the Danby residents, future goals
and asked them to help further assist us with the needs people. He said that DEMPC was not
actually designed to be the NIMS control group.
Communications:
A memo from the Jennings Pond Coordinator addressing the budget.. No budget request for
2008 has been submitted for the board to review. She has submitted the memo to the
bookkeeper and her budget was received tonight.
OLD BUSINESS:
Motion to Approve the Revised Addendum to Aereement to Spend Hiahwav Funds
A motion was made by Supervisor Dietrich and seconded by Councilperson Salino that the Town

Board of the Town of Danby move to approve the Revised Addendum to the Agreement and the
expenditure of funds as it is reallocated and as outlined on page one of the Revised Addendum to
the Agreement to Spend Highway Funds dated October 8, 2007.
Discussion:
Supervisor Dietrich reported that the original agreement from April 2007 showed an incorrect
figure and did not include a $40,000 grant received and the CHIPS amount was incorrect.
Councilperson Beavers said that it also changed the amount being spent on roads for individual
projects and understands that the money has already been spent on Hill Road and Curtis Road
and that this an after effect request.

Draft of Flaz Lot Legislation
Supervisor Dietrich said that we have a Draft of Flag Lot Legislation to consider a referral and or
directions to the Planning Board.
Councilperson Beavers said that the Planning Board will review the Flag Lot Legislation on
October 18, 2007. He personally liked what was drafted by the Task Force. If the Planning
Board has concerns with some of the acreage he is in favor of the acreage being increased from
five to seven acres. He does not want to see this being bounced back and forth.
Tompkins County Agriculture & Farmland Protection Board Reauest to Chance Date for
Application of Land Owners
A motion was made by Councilperson Beavers and seconded by Supervisor Dietrich that the
Town Board of the Town of Danby endorses the proposal of the Tompkins County Agriculture &
Farmland Protection Board that the start of the annual 30 day period for landowners to request
the addition of their land to one of the two existing NYS Certified Agricultural Districts in the
County be changed from November 1" to February 1st of each year.

STAFF SUPPORT FOR DEMPC
RESOLUTION NO. 74 OF 2007
APPROVAL OF EMERGENCY MANAGEMENT PLANNING CONSULTANT
By Councilperson Beavers: Seconded by Supervisor Dietrich
RESOLVED, that the Town Board of the Town of Danby hereby approves the retention of an
Emergency Management Planning Consultant; and it is
FURTHER RESOLVED, that the consultancy is approved for 320 hours, at a total cost of
$4,800, for an approximate period of October 24, 2007 through February 15,2008, with extension
subject to further Town Board approval; and it is
FURTHER RESOLVED, that the source of Town of Danby finds for this consultancy, in the
amount of $4,800 shall be Comprehensive Plan Account 8020.401; and it is
FURTHER RESOLVED, that the Town Board delegates to the Danby Emergency Management
Committee the authority to appoint the Consultant; and it is
FURTHER RESOLVED, that the Town Board authorizes the Town Supervisor to execute an
Agreement with the Consultant related to terms and to scope of services.
FURTHER RESOLVED, that the Town board requests that the Danby Fire district provide
additional funds to extend the period of the consultancy.

RESOLUTION NO. 75 OF 2007
NIMS IMPLEMENTATION COORDINATOR
By Councilperson Beavers: Seconded by Supervisor Dietrich
RESOLVED, that the Town Board of the Town of Danby ratifies the appointment of Town
Supervisor Ric Dietrich, to serve as the principal coordinator for overall NIMS implementation,
with the date of appointment September 13, 2007.

Special Meeting of the Board Scheduled
A motion was made by Councilperson Beavers and seconded by Councilperson Varona-Lacey
that the Town Board of the Town of Danby schedules a special meeting of the Board for
Monday, October 15, 2007 at 6:30 p.m. The purpose of the meeting is to consider award of bids
for the Aquifer Study Well Drilling Project.
Councilperson Beavers asked that before we award a bid that we get a a clarification on the bids
submitted so that we can ensure that the bids are for only two wells.

Town Hall Tile Floors
Supervisor Dietrich has received a quote from Tony Catlin for the stripping and waxing of the
Town Hall tile floors for $80.00.
Motion to Approve Strinning and Waxing of Town Hall Floors
A motion was made by Supervisor Dietrich and seconded by Councilperson Salino that the Town
Board of the Town of Danby authorizes the supervisor to contract with Tony Catlin to strip and
wax the tile floors in the town hall.

A motion was made by Supervisor Dietrich and seconded by Councilperson Salino that the Town
Board of the Town of Danby approves the General Fund Warrant No. 10 of 2007 in the amount
of $16,266.50 voucher numbers 388-413
