ADJOURNMENT:
Resolution # Authorizing the Town Highway Superintendent to
Purchase a New Town Dump Truck.
Whereas, the Town Superintendent of Highways did, on the day on June
11, 2007, duly recommend the purchase on certain equipment pursuant to
the provision of Section 142 of the Highway Law.
Now, Therefore Be It Resolved, that the Town Superintendent of Highways
is authorized to purchase/bid out, in accordance with the provision of Article
5-A of the General Municipal Law, the following:
I st BID
2007/2008- Chassis, frame, and equipment as written in the specifications
provided by the Town Highway Superintendent.
2nd BID
2007/2008- Stainless steel dump body and snow equipment to include
spreader, plow and wing, as written in the specifications provided by the
Town Highway Superintendent.

Supervisor Fredric Dietrich called the meeting to order at 6:35 p.m. and led all present to the Pledge
of Allegiance to the American flag.
ADDITIONS OR DELETIONS TO THE AGENDA
Add item #4 under Communications - Final Report from Attorney on Highway
Add item #2 - under Old Business - Water District
Add item #8 - under New Business - Possible resolution for Highway Bid authorization.
PRIVILEGE OF THE FLOOR
Councilperson Beavers asked that Shane Spencer be allowed to address the Board regarding his
request to the West Danby Water District for an extension on his water line.
Councilperson Nolte asked for an update on Highway.
Privilege of the Floor:
Ames Brown - letter from Cooperative Extension - local zoning restrictions cannot over -ride NYS
Agriculture and Market Laws.
Ann Klingensmith - was involved with Task Force and reported how hard they worked on
compromise for land divisions for one lot and special permits.
George Blanchard - regarding proposed subdivision regulations - would be difficult to make it perfect

as it needs work. He appreciates the efforts of the Task Force and staff. George submitted a letter
of interest to serve as one of the Alternate Planning Board positions.
Joel Gagnon - the process is important. He was happy with the compromise that the Task Force came
up with and feels it is something we can live with.. Back and forth is not in the Town's best interest.
Joel submitted a letter of interest in serving as an Alternate Planning Board member.
REPORTS:
Recreation Partnership Agreement
Supervisor Dietrich reported that he has received the Proposed Recreation Partnership Agreement but
there will be no action on the agreement tonight. The Partnership has been working on the proposed
agreement since January 2007. Copies have been distributed to the Board for their review and is to
be discussed at the July 9, 2007 Agenda meeting. He asked the Board to make suggestions for
modifications and/or changes returned to him by and that the Partnership would like to have that
information by August.
Zoning - Written report for May 2007 has been received by the Board.
Planning Board - The Planning Board at the May 17'h meeting made the following recommendation
to the Town Board. A certified copy was distributed to the Board.
Planning Board Motion to the Town Board
A motion was made by Dave Mastroberd and seconded by Ted Melchen that the Danby Planning
Board recommends to the Town Board of the Town of Danby that the Planning Board be designated
as Lead Agency in the "Danby Hamlet" planning process and that they will use a process similar to
those that the Planning Board used in the development of the Comprehensive Plan which may also
involve the creation of special committees to maximize public participation.
The Planning Board will hold a public hearing on June 21, 2007 to consider Final Site Plan Approval
for the Proposed White Hawk Ecovillage project.
Highway Report - No written report was received.
Councilperson Nolte asked about the road sweeping.
Susan Beeners reported on the cost estimates for the pumping and disposal of waste at the highway
barns.
Reauest from Shane Spencer of May 2007
Shane Spencer addressed the Board and reported that he has all the paperwork that was requested by
the Board in May. He presented an updated survey map, a site plan showing the approximate location
of the proposed dwelling, proposed water line where it would cross Mr. Banta's property. He has a
letter from Mr. Banta giving him permanent easement for the water line and a copy of his 2007 tax
bill. He said that he pays water tax on the entire property even though there is six (6) acres is in the

water district. He submitted some case law from his lawyer relating to similar cases for reference.
Zoning Report - Written report received for May 2007.
Susan Beeners - The Code Enforcement Office has been addressing some complaints and doing some
GIS work. The Beech Hill Pond situation was settled out of court.
Beautification Committee Report
The Committee has purchased and planted an assortment of plants that have been planted around the
Town.
Supervisor Dietrich reported that some plants were purchased and planted in the planters around the
entrance Town Hall.
Tompkins County Department of Emergencv Response
Supervisor Dietrich reported that Tompkins County Legislature has designated Tompkins County
Department of Emergency Response as the official "NIN4S Point -of -contact for the County. Several
informational sessions have been scheduled for June for town participants in the NIMS programs.
DEPMC - Report
Councilperson Beavers reported that the DEMPC group has met and made a few changes on the
survey to be distributed at the Danby Fun Day. Packets and information are now being put together
for our tent. The Fun Day is to be held on July 14th at the Danby Fire Station. Our theme for the
event is "Emergency Preparedness Starts With You".
Highway Department Reauest to Send out Bids for the Purchase of a New Town Dump Truck,
With Stainless Steel Dump Box
The Board has received copies of bid proposals for the purchase of anew Town Dump Truck but have
not had adequate time to review the bid specifications. The Highway Superintendent has requested
that the board authorize him to bid out for the purchase.

County Legislators Retort
Representative Proto reported on the Following:
Assessments - information for internet access.
Is meeting with Spitzer in Albany- he requested ideas and to take to the State level.
County established goals - 100% assessments will take effect in 2009.
Planning Committee - Affordable housing legislation passed in committee.
Support of Special Review Committee to investigate charges of President and Vice President by
members.
Consideration of Pronosed Local Law - Amending the Subdivision Re?i lations.
SusanBeeners gave an update on the recommendation of Tompkins County Planning Department and
explained the changes and the process for land divisions issued proposed to be issued directly out of
the Code Enforcement Office.

A motion was made by Councilperson Nolte and seconded by Supervisor Dietrich that the Town
Board of the Town of Danby directs the Planning Board to make recommendations on the thresholds
for land divisions by permit (in the Draft Subdivision Regulations and Land Division Regulations);
and on Flag Lots

West Danbv Water Hook-up Request
Councilperson Beavers reported that Sean Spencer is looking for a water hookup on property he
purchased that is partially in the water district. The question is whether he can get municipal water
where he plans to build a new dwelling. That section of property is outside of the district. He is
currently paying the water tax on the entire property.
Motion to Direct the Supervisor and Code Enforcement Officer to Check on Lezal
Rea uirements To Extend Water
A motion was made by Councilperson Beavers and seconded by Councilperson that the Town Board
of the Town of Danby directs the Town Supervisor and the Code Enforcement Officer to check on
the legal status for extending water on the Spencer property.

Consideration of the Propsosed Local Law Amending the Subdivision Reoulations of the Town
of Danbv
The Code Enforcement Officer described the recent revisions to the Proposed Local Law Amending
the Subdivision regulations of the Town of Danby.

Councilpersons Beavers said that the board has not reviewed together and discussed the items in the
proposed subdivision regulations and the long term effects. He said he would like the board to review
the revisions together before considering adoption.
Councilperson Nolte would like the board to direct the Planning Board to deal with flag lots.
Motion Directing the Planning Board to Make Recommendations for the Proposed
Amendments to the Subdivision Regulations
A motion was made by Councilperson Nolte and seconded by Supervisor Dietrich that the Town
Board of the Town of Danby directs the Planning Board of the Town of Danby to make

RESOLUTION NO. 52 OF 2007
CONSIDERATION OF ENACTMENT OF A LOCAL LAW AMENDING THE
SUBDIVISION REGULATIONS OF THE TOWN OF DANBY. NEW YORK BY
RECLASSIFYING CERTAIN LAND DIVISIONS AND SUBDIVISIONS. MODIFYING
PROCEDURES RELATED TO SUCH LAND DIVISIONS AND SUBDIVISIONS AND
INCORPORATING STANDARDS AND GUIDELINES SET FORTH IN THE STATE
ENVIRONMENTAL CONSERVATION REVIEW ACT
By Councilperson Nolte: Seconded by Supervisor Dietrich
WHEREAS, this action is to Consider Enactment of a Local Law Amending the Subdivision
Regulations of the Town of Danby, New York by Reclassifying Certain Land Divisions and
Subdivisions, Modifying Procedures Related to Such Land Divisions and Subdivisions and
Incorporating Standards and Guidelines Set Forth in the State Environmental Conservation Review
Act; and
WHEREAS, this is a Type I action for which the Town Board of the Town of Danby is acting as
Lead Agency in environmental review, with the Planning Board of the Town of Danby an involved
agency; and
WHEREAS, the proposed local law was referred to the Tompkins County Department of Planning
for review pursuant to General Municipal Law Sections 239-1 and —m; and that Department responded

on May 14, 2007 that it had determined that the proposal as submitted has no negative inter -
community or county -wide impacts; and
WHEREAS, the proposed local law was referred to the Planning Board of the Town of Danby for
a report thereon, and said Board on March 15, 2007 recommended to the Town Board that the
proposed amendments be approved; and
WHEREAS, the Town Board of the Town of Danby on May 14, 2007 has held a public hearing
to hear all interested parties in the matter, which hearing was duly advertised in the Ithaca Journal;
NOW, THEREFORE IT IS
RESOLVED, that the Town Board of the Town of Danby, acting as Lead Agency in
environmental review of this Type I action, hereby makes a negative determination of
environmental significance; and it is
FURTHER RESOLVED, that the Town Board of the Town of Danby adopts Local Law Number
4 of 2007, entitled "A Local Law Amending the Subdivision Regulations of the Town of Danby,
New York by Reclassifying Certain Land Divisions and Subdivisions, Modifying Procedures
Related to Such Land Divisions and Subdivisions and Incorporating Standards and Guidelines Set
Forth in the State Environmental Conservation Review Act ", a copy of which is attached hereto
and made a part of this Resolution; and it is
FURTHER RESOLVED, that the Town Clerk be and she hereby is directed to enter said local
law into the minutes of this meeting and in the local law book of the Town of Danby, to publish a
copy of said local law as required by law, and to give due notice of adoption of said local law to
the Secretary of State of the State of New York.

Office of Court Administration for funding from the 2007 Justice Court Assistance Program for
the purchase of court related items, and
WHEREAS, Town of Danby Town Justice Theresa Klinger and Justice James Herson are
requesting authorization from the Town Board for permission for the Danby Town Court to
submit a grant application to the New York State Office of Court Administration for funding from
the 2007 Justice Court Assistance Program in an amount not to exceed $20,000, now be it

a.m. until 11:55 a.m., from the intersection of East Miller and West Miller Roads to the

FURTHER RESOLVED, that the Town Board approves the extension of this time period, from
10:15 a.m. to 12:15p.m. if the Danby Fire Department deems such extension necessary to
facilitate the safe movement of the Parade participants; and it is
FURTHER RESOLVED, that there will be a detour route from the West Miller Road
intersection with Route 96-B to Comfort Road to Lieb road, to the Bald Hill intersection with
Route 96-B.

Van Woert Road, which road enters the Town of Danby for a distance of approximately 62 feet, is

PROPOSED HIGHWAY DEPARTMENT REOUEST TO AUTHORIZE THE TOWN OF
DANBY HIGHWAY SUPERINTENDENT TO BID OUT FOR PURCHASE A NEW
TOWN DUMP TRUCK

WHEREAS, the Town of Danby Superintendent of Highways did, on the 11' day of June 11,
2007, duly recommend the purchase of certain equipment pursuant to the provision of Section
142 of the Highway Law, now therefore be it
RESOLVED, that the Town of Danby Superintendent of Highways is authorized to bid for
purchase in accordance with the provision of Article 5-A of the General Municipal Law, the
following:
1S' BID
2007/2008 Chassis, frame, and equipment as written in the specifications provided by the Town
Highway Superintendent
2°d BID
2007/2008 Stainless steel dump body and snow equipment to include spreader, plow and wing,
as written in the specifications provided by the Town Highway Superintendent.
AND IT IS FURTHER RESOLVED, that bids will be returned by 12:00 Noon on Friday, July
6, 2007.
