Supervisor Fredric Dietrich called the meeting to order at 6:55 p.m. and led all present to the
Pledge of Allegiance to the American flag.
ADDITIONS TO AGENDA
1. Request from Highway Superintendent to send out bids for a truck.
2. Tabled Resolution No. 36 to rescind discontinuance of the Comprehensive Plan
Implementation Task Force.
Privilege of the Floor:
Ames Brown- small business not flourishing in Danby.
REPORTS:
Hi-ahwav_ Report:
A written report for April was received. Highway Superintendent reported to the Board that he
is researching prices for the purchase of a new dump truck. He asked the Town Board for
permission to send out bids and to set a date for bid opening for June 4 or June 11.
Zonin
The Code Enforcement Office has submitted their monthly report for April. Susan reported that
her intern will be here for two(2) more weeks and is working with her on the GIS system.
Highway Remediation project tanks are in and have been pumped. Dave Herrick will be
working on the project.
Violations charge on Beech Hill have been dropped in the child custody case.
White Hawk would like to start work on the straight piece of road in the development.

Planning Board Report:
Susan Beeners reported that there will be a training session the Planning Board and the Board of
Zoning Appeals on Thursday May 19, 2007 at 6:00 p.m. with Chelsey for the GIS mapping
system. A public hearing will be held on May 19, 2007 at 7:00 p.m. for the Fire District
Expansion Proposal.
Recreation Partnership
Supervisor Dietrich reported that the Recreation Partnership has been meeting on a weekly basis
to discuss programs and funding.
Community Council
Community Council sponsored a concert here at the Town Hall last Sunday.
There will be a plant exchange on Sunday at the Danby Fire Station from 12:00 to 3:00 p.m.
They have asked for space for a file cabinet here at the Town Hall.
DEMPC (Danby Emergency Management Planning Committee)
Councilperson Beavers reported that the DEMPC will review surveys and information packets to
be distributed at the Danby Fun Day.

4. Letter from Shane Spencer -regarding West Danby Water District hook-up request.
Discussion- Letter from S. Spencer
The Town Board reviewed the letter from Shane Spencer requesting an extension to the water
hook-up on his 27 acre property. The water hook-up is only to his residence and he is requesting
that it be extended so that he can erect an additional dwelling.
West Danby Water District Superintendent said that the water district boundary is only on a
portion of Mr. Spencer's property not the whole property. There has not been a recent survey of
the property. Mr. Spencer does not want to pay the water tax on the whole property if it is not in
the water district.
The Town Board requested the Town Clerk to write a follow up letter to Mr. Spencer requesting
that he provide a recent survey map and a Site Plan showing the proposed location of the new
dwelling and the water service line including any areas where the service line would
cross other property. This may require a change in the Water District
boundary.

Motion to rescind Resolution No. 23 "Creation of a Hamlet Planning Advisory Committee"
was raised from the table.

A motion was wade by Councilperson Seavers and seconded by Supervisor
Dietrich to withdraw the motion and put the issue on hold until the board
has heard back from the Planning Board.

NEW BUSINESS
Consideration of Proposed Local Law -Amending the Subdivision Regulations
The board would like to review suggestions made by the persons who addressed the
Amendments to the Subdivision Regulations at the public hearing. Concerns and suggestions
were submitted by two residents at the hearing. Consideration of possible changes will be
addressed at the June 4tn Agenda Meeting.
RESOLUTION NO. 49 OF 2007
APPROVAL OF MOWING AGREEMENT
WHEREAS, the Town of Danby has received a proposed agreement from Forest City
Landscaping to provide mowing of the Town Hall properties and Town of Danby Cemeteries for
the 2007 season, now therefore it is

RESOLVED, that the Town Board of the Town of Danby authorizes the Town of Danby
Supervisor to sign the agreement with Forest City Landscaping for the mowing of Town of
Danby properties for the 2007 season as submitted.

RESOLUTION NO. 50 OF 2007PERMISSION FOR HIGHWAY SUPERINTENDENT
TO PUT OUT A BID FOR A NEW HIGHWAY TRUCK
By Councilperson Nolte: Seconded by Supervisor Dietrich
RESOLVED, that the Town Board of the Town of Danby gives permission for the Highway
Superintendent to advertise bids for the proposed purchase of one(1) highway dump truck with
the bid opening date to be on June 4ch at 6:15 p.m.
Resolution No. 50 of 2007 Withdrawn
After discussion the Town Board requested that they be provided with a copy of the bid
specifications for the truck and Councilperson Nolte withdrew the resolution.
County Legislature Representative Report
County Representative Frank Proto reported on the following:
Grievance Day (Local Assessment Board of Review) Danby had only on applicant.
Radios for Emergency vehicles, Youth Award, Sites for the County Health Department Building,
Recreation Partnership Contract, and that Youth Employment monies are available.
Motion to Extend Meeting
A motion was made by Councilperson Nolte and seconded by Councilperson Beavers at 8:40
p.m. to extend the board meeting to 9:00 p.m.

submitted.

Trust and AF-ency Account
A motion was made by Councilperson Beavers and seconded by Councilperson Nolte that the
Town Board of the Town of Danby authorizes the payment of $1,411.20 from the Trust and
Agency Fund Account for legal expenses paid for Legal Subdivision Agreement.
